Proposal:

The Owner is requesting permission to construct a cabana with the following variances:

Official Plan:

The subject lands are designated “Serviced Residential” by in-effect OPA #601 (Kleinburg – Nashville Community Plan). The subject lands are also designated “Low Rise Residential” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

The Development Planning Department does not have any concerns with the proposed variances. Any impact from the proposed rear yard setback is completely mitigated, as the subject lands abut an Open Space block to the rear. As well, the proposed cabana is comprised of an enclosed area totaling 19.77m2 and an unenclosed area totaling 10.51m2, for a total area of 30.28m2. The enclosed portion is consistent with previous approvals in this area. Finally, since the proposed location of the cabana is 12.15m away from the nearest adjacent residential property, any impact associated with the height of the cabana is mitigated as well. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Recommendation:

The Development Planning Department supports Minor Variance Application A210/12.
