Island Greenway Bike Path Alternatives• Alt. A – Bike Path on east side of retention pond
– License with no “consideration clause”– Condition of license requires construction of FE-6 fence (min) & 50-ft
clear zone; and maintenance for life of license (i.e. assuming multiple renewals)
• Alt. B – Bike Path on west side of retention pond– License contains “consideration clause” for fair market value (FMV) – Construction of FE-6 fence (min) & 50-ft clear zone ; and maintenance
as “consideration” in first term of license – FMV payment as “consideration” in the subsequent renewals
• Alt. C – No Bike Path– Amend easement to include as-builts for retention pond and require
construction of FE-6 fence (min) & 50-ft clear zone for public safety– No consideration requiredAssumption: Either license (Alt. A or Alt. B) conveys everything from west side
of “Greenway” to the MOTSU boundary to the east
License Considerations• License include sufficient condition and
liability for the proposed use (bike path)• Any “new” use requires approval at Assistance
Chief of Staff for Installation Management (ACSIM) 60-90 day process
• Anything up to 20-yrs possible, longer terms risk non-approval.
Independent Action Items
• Amend Easement #DACA21-2-03-3218 to reflect as-built conditions
• Address perceived encroachments• Determine appropriate fence that meets Army
needs
Potential Alternative Fence
• We can approve the use of a higher-rated security fence that may be more aesthetically pleasing.
• Examples include ornamental fences referenced (with specifications) in Unified Facilities Criteria 4-022-03, dated 1 October 2013 (e.g./ drawings UFC 720 & 721).
