1. Islamabad today is one of the most inviting spots for real estate developers in

Pakistan and abroad. There are numerous prospects for safe and secure

investments in Commercial plots located in the busy 'Marakiz' of different

sectors of Islamabad.

2. CDA assures provision of infrastructure to our valued clientele at their door

step. The in-house Engineering and Planning facilities are capable of meeting

development / infrastructure related needs of the clients instantly. A fast-track

one-window facility is available to assist the depositing of dues, taking over

possession, getting building plans approved and addressing any other queries

that the clients may have.

3. Commercial plots located in various sectors of Islamabad are being offered for

allotment on leasehold basis, for a term of 33 years extendable for another

two terms of 33 years each, on standard terms and conditions applicable at the

time of each renewal of lease.

4. The auction will take place at Pak-China Friendship Center, Islamabad on

15th and 16th June, 2015. The proceedings shall commence at 10:00 A.M. and

shall continue till the end.

ELIGIBILITY

1. The auction is open to all Pakistani nationals, whether residing in

Pakistan or abroad. Companies/firms and societies registered in

Pakistan under the relevant laws can also participate in the auction.

Foreign nationals and companies can participate in the auction with the

prior permission from the Ministry of Interior, Government of Pakistan.

2. Token money for plots will be as under:-

i. Rs. 20 million for commercial plots Blue Area.

ii. Rs. 20 million for commercial plots above 3000 sq.yds.

iii. Rs. 10 million for commercial plots upto 3000 sq.yds

iii. Rs. 10 million for Orchard plots

3. The person(s) participating in the auction are required to obtain tokens

by providing Pay Order of Rs. 20 million / 10 million for commercial

plots from the Accounts Officer (Estate Management-II), CDA Main

Office, Khayaban-e-Suhrawardy, G-7/4, Islamabad upon fulfilling the

prescribed requirements as per Annex-A and submitting the

application at Annex-B & Annex-D of this Brochure. Tokens will also be

available at the auction venue and can be purchased before the start of

auction.

4. Token used in successful bids shall be adjusted in the first installment

and therefore cannot be used in subsequent bid. All unsuccessful

tokens can be used for subsequent bidding or refunded at the instance

of token holder.

5. The successful bidders shall be required to obtain additional token to

participate in the bid of any other plot. The token shall be submitted on

the original Application Form annexed in this Brochure at Annex-B.

6. If any person intends to participate in the auction on behalf of another

person, company, firm or society, he / she will have to submit, at the

time of purchase of token, a special power of attorney as per specimen

at Annex-C or a sealed (embossed) resolution or authorization from

the company, firm or society authorizing him / her to participate in the

auction on its behalf along with a copy of certificate of incorporation or

registration.

1. The plots shall be auctioned on the basis of complete infrastructure

facilities (water, gas, electricity, roads & sewerage) and site / location of

the plot shall not be changed on any ground whatsoever at any stage.

The bidder shall be bound to satisfy himself about the location, ground

positions and surroundings of the plots and no claim at a subsequent

stage shall be entertained in this regard as the plots are auctioned on

“as is, where is” basis.

2. The Premium will be charged according to actual size of the plot as

determined at the time of handing over its possession. In case of

substantial variation in the size of plot, the successful bidder will,

however, have the option to retain or surrender the plot and claim

refund of the amount without any deduction / markup or

compensation under special circumstances within 30 days. After 30

days, usual deduction @ 10% of total premium will be applicable.

3. The Auction Committee reserves the right to withdraw any plot from

the auction without assigning any reason thereof.

4. The Auction Committee also reserves the right to reject any bid without

assigning any reason thereof.

5. The Auction Committee/CDA management reserves the right to

disqualify any bidder and to amend / delete any of the provisions

contained therein to any extent or to add new terms and conditions at

the time of auction without assigning any reason.

6. Auction results shall not be final unless approved by the Board of

Capital Development Authority and a highest bid at auction shall not

per se accrue any right in favour of the bidder. The approval of the bid

would be further subject to payment of applicable taxes, duties or

surcharge that may be levied on such auction under the prevalent law

and non-payment of such taxes, etc, within the period specified in this

behalf will result in automatic cancellation of acceptance of the bid.

7. The CDA Board shall decide acceptance or rejection of the bid within

10 days of auction and in case of rejection shall refund the amount

within 15 days (excluding holidays) after the decision of the Board. If

the amount deposited by the bidder is not refunded by the CDA within

45 days, in case of rejection of the bid, the amount of profit received by

the Authority on such deposit will be paid to the bidder alongwith the

amount deposited by him provided that the period of delay on account

of any default on the part of unsuccessful bidder will be excluded in

computing this period.

1. The Auction shall be conducted through open bidding. The bid will be

offered in terms of rupees per square yard, which will form basis to

calculate total premium of the plot /site. Each bid will be raised by the

bidders by multiples of Rs. 1000/- per sq. yard. The bid start price will

be informed for each plot at the time of auction.

2. The bid will be expressed loudly with show of token number.

3. Provisional Acceptance of bid will be issued in the name of person(s) in

whose name token was issued. The bidder may add name(s) on the Bid

Sheet (within 72 hours of bid acceptance), subject to the payment of

"inclusion fee" which shall be equivalent to 25% of transfer fee for each

additional name. The inclusion of name(s) on the bid sheet prior to its

signing by the Auction Committee will be free of charge.

1. Subject to payment of full premium and other dues, the leasehold rights in

the plots are transferable on payment of “Transfer Fee” as fixed by the

Authority from time to time.

2. Non-conforming use of the site or building shall render the defaulter liable to

pay such penalties as are prescribed in the prevalent laws, Rules and

Regulations, and may result in cancellation of the allotment as well.

3. CDA shall not be responsible for any loss / damages to the allottees in case

any unauthorized service line is laid by any agency other than CDA.

4. In the event of cancellation or surrender of plot for whatever reason, the

deposited amount of premium shall be refunded after forfeiture of 10% of

the total auction price of the plot.

5. Any decision of Authority regarding auction, acceptance or rejection of bid,

forfeiture of token money, 10% of total premium deduction or any other

matter in relation to auction / allotment of plots shall be final.

6. The correspondence shall be at the address indicated by the bidder /

attorney and it will be his responsibility to communicate any change in

address to the Authority. If the successful bidder does not receive any

intimation from the Authority within 15 days, he himself shall contact the

Authority to inquire about the status of his bid.

7. The bidder will be deemed to have read and accepted the terms and

conditions enumerated in this booklet and the Annexures and would be

bound by these.

area (or as may be revised from time to time) which presently works out to Rs._________________ for____________sq feet of the

covered area of the entire building. The area has been calculated on the basis of total permissible covered area of the building.

8. Within one month from the date of possession or assumed date of possession, CDA will, if so desired by you, execute an agreement to lease

out the plot in question in your favour and get the same registered at your cost and expense.

9. Charges on delayed payments will be levied at the rate as fixed by the Authority from time to time on all types of delayed payments.

10. No additional charges, mark up or compensation shall be payable by CDA on any amount that would have remained with it.

11. All payments shall be made through Bank Drafts / Pay Orders in favour of Capital Development Authority, Islamabad.

12. If for any reason you decide to surrender the plot, the Authority shall accept such surrender by forfeiting 10% of the total premium of the

plot.

13. Within six months from the date of possession or assumed date of possession you shall start construction in accordance with the plans /

drawings of the proposed building, duly approved by the Authority and complete it in all respects within a period of 03 years from the date of

this letter fit for occupation and use in substantial workman- like manner with good and sound material of the respective kinds strictly in

accordance with the relevant provisions of Islamabad Building and Zoning Regulations, standards and instructions as may be in force during

the course of construction. Failure to complete the building within the stipulated time may render allotment liable to be cancelled, in which

event 10% of the total premium of the plot shall be forfeited in favour of the Authority. No compensation etc shall be paid for the structure

thereon. Provided the CDA Board may for good and sufficient cause (to be shown in writing) allow you extension in the construction period

by imposing extension surcharge at the rate as may be fixed by the Authority from time to time. No application for extension of construction

period shall be entertained unless the same is submitted at least nine months before the expiry of the period.

14. If for any reason CDA fails to hand over possession of the plot to you within three months after full payment of the price, you will have the

option to apply for surrendering the plot and claim refund of the paid amount without any deduction. The decision of the Authority shall be

final in this regard.

15. You shall permit and afford reasonable facility, at all times, to any officer of the Authority authorised in this behalf to inspect the plot and any

building thereon at all stages.

16. You shall submit Form "D" to the CDA for checking at the plinth level (damp proof course) and shall submit Form A-I, A-II approval of

Building plans and shall submit form B-l and B-2, in duplicate, alongwith Seven completion drawings / plans to the CDA, for the issuance of

Completion Certificate within three months from the date of completion of the building, failing which penalty, as prescribed by the Authority,

shall be imposed and recovered for every week of delay in submission of these forms.

17. Upon completion of the said building and fulfilling the terms and conditions herein contained to the satisfaction of the Authority, whose decision in this behalf shall be final, the Authority will, at your cost and expense, execute a lease deed in your favour in respect of the plot reserving to itself or the Government the rights in all mines, minerals, etc and the right to remove / enjoy the same in accordance with law. In no case the building shall be occupied without the issuance of Permission to Occupy the building by the Authority.

18. If it is found at any time that the lease has been secured by you by giving false information the plot will be withdrawn and the premium paid and structure raised thereon will be forfeited by the Authority and you will be liable to make good any loss that may be sustained by the Authority on resale of the plot.

19. You shall, before using or renting out the building for any business / trade or purpose other than one for which the plot / site has been allotted to you, be required to obtain approval from the authority. Normally no restriction will be imposed about any trade but in case the Authority considers some trade to be harmful to the interest of the surrounding area, it may refuse the use for that purpose. The decision of the Authority in this regard will be final and binding upon you. The change may be subject to payment of fee of trade change as may be fixed by the Authority from time to time. The Basement will not be used for any other purpose under any circumstances, other than purpose provided under para 2 above.

20. In case of default due to non-conforming use, the allotment of lease will be withdrawn and structure if any on the plot, will be confiscated and no compensation will be paid.

21. In case of cancellation of lease allotment, you may appeal to the CDA Board within a period of three months. In case of restoration of cancelled plot for non-payment of Authority's dues, or for any other reason you will have to pay not only the outstanding dues, if any, but also the delayed payment charges thereon and the restoration fee within 30 days.

22. Transfer of plot will be subject to the policy of CDA, prevailing at the time of making request for transfer.

23. You shall not without the prior permission in writing of the Authority divide the plot or building or change it's dimensions in any manner whatsoever, nor shall you part with the possession of or let out the plot or any part thereof.

24. You shall intimate to the Authority any change in your address failing which any communication meant for you will be sent at the last address available with the Authority. Under normal circumstances, a letter posted shall be deemed to have been delivered at the address outside Islamabad in one-week time and in Islamabad within four days of the date of posting.

25. If in the opinion of the Authority whose decision in this behalf shall be final topography of the plot so requires the Authority shall, at the time thereafter, have the right of passage and running of water and soil from the adjoining and neighboring land and building now or thereafter created thereon through sewerage, drainage pipes and channels or any of them for the purpose of exercising the said right of running of water and soil but without any allowance or paying any compensation to you for the exercise of such rights.

26. You shall comply with and abide by the rules, regulations, bye-laws, orders and directions that may be issued or given by the Authority from time to time.

27. You shall not tap or use underground water except to the extent and in the manner as may, in writing, be permitted by the Authority.

28. From the date you take over or are deemed to have taken over possession of the plot, you shall pay all taxes, rates, and royalties, if any, land revenue, assessment, duties, charges (including betterment and maintenance charges) and impositions whatsoever, which are now chargeable or may hereafter be charged or imposed upon or be payable in respect of the plot or site, any structure thereon or anything fastened thereto under any law, or order for the time being in force.

29. The municipal services, such as water connection, will be disconnected by the CDA in case you fail to pay property tax and other dues of the CDA within the prescribed period.

30. In case of breach of any one or more of the above-cited conditions and non-observance of the above-mentioned obligations, the allotment will be liable to be withdrawn / cancelled after deducting 10% of the total premium of the plot.

31. Time will be the essence of contract in these terms & conditions.

32. These conditions are in addition to the provisions of law, rules and regulations, etc, of the Authority that may be applicable to the allotment of the subject plot and its use.
