    GENER L INSTRUCTIONS

    You have been placed on the Adams County Intermediate Punishment Program. You have been placed on one of three programPartial Confinement Work Release), House Arrest, and/or Intensive Supervision.Ifyou have been placed on House Arrest you are not permitted to leave your place ofresidence except for reasons approved by thProbation OfficeIfyou have been placed on General Intensive Supervision, you will be subject to acurfew established by your Probation Officer wicertain restrictionsIfyou have been sentenced to Partial Confinement Work Release), you will subject yourself to all rules and regulations ofthe AdamCounty Prisonor designatedDetentionCenter.All Intermediate Punishment Programs are subject to random urinalysis testing and curfew checks in which you must comply witYour future conduct will be governed by the rules and conditions which follow these general instructions. It is very important that younderstand these rules and conditions. Any prison violations may constitute aviolation ofIntermediate Punishment. Itwill be yourresponsibility to understand and follow them. Ignorance will not excuse any violations. Ifthere is anything that you do not understand ask fan explanation.There are certain requirements for reporting. All reports must be made immediately. Ifyou fail toreport, for example, an arrest orbeingfired firom a job youwill faceincarceration.Any condition that may be waived or changed by the Probation Office will require written permission. All other changes will requipermission bya Probation Officer or Prison Official.Ifweapons are prohibited, you are notified that iffound to be in possession ofany type offirearm, as defined in 18 Pa.C.S.A. Sectio6105 i)., the weapon will be confiscated for an Order ofDestruction. You have 15 days fi-om today s date to provide proofofdisposal ofanweapon currentlyheld in yourpossession.Court-Ordered conditions relating to the possession and ownership offirearms are in addition toany State orFederal Law nowcurrently enforced anddoes notrelieve your obligation tocomply with those laws.Keep in mind that the purposes of Intermediate Punishment Program, relate not only to your rehabilitation, but to the communiawareness of intervention of the criminal justice system.You must comply with all conditions identified as standard by an asterisk * ) and all special conditions which have been checkeYou have; have not been classified asa sexual offender and are; are not required tocomply with SO conditions.

    ALCOHOL CONTROLLED SUBSTANCES ANP COUNSELING

    1. Y OU M U ST N OT :a. Use non-prescribed controlled substances.b. Becomedrunk or publicly intoxicated or have a BACof .05or greater.c. Be ina building vehicle orother property where alcohol and/or non prescribed controlled substances are present orwhere itisplainly visible.d. Enter or remain inany bar tavern orother drinking establishment or any establishment selling alcoholic ormalt beveragesincludingStateLiquorStoreswithoutconsent fromthe ProbationOffice.

    e. Possess orconsume alcoholic beverages orhave itpresent inyour residence until this condition has been waived inwntingby the Probation Office. YO U MUST:a. Agree tohave your person blood breath orurine tested as directed by the Probation Office orPrison Officials todetermine ifyou are alcohol and/or drug free.b. Attend counseling ortherapy sessions related to drug and alcohol abuse as directed by the Probation Office and comply with

    conditions of any treatment program recommended.c. Successfiilly complete thealcohol safedriving program orotherprogram required bylaw.d. Attend and comply with mental health counseling and therapy programs as directed by the Probation Office and comply withconditions of that program.e. Attend and comply with any counseling ortreatment program related to domestic violence as directed by the Probation Office.

    3 Y OU M US T:Not commit any violation of the law.b. Report any contactwith law enforcement officialoragency to the Probation Office within the next business day. This includesany arrest receiptof criminalcomplaint citationor summons.c.Not associate withpersons having serious criminal records andreputations forcriminal conduct.Reportto theProbationOffice when directed.Obeyall directions givenby any Probation/Parole Officer.f. Not commit any action which might cause fear annoyance or alarm to the victim ofany case where charges have been filedagainst you.g. Be inside your home andobey anycurfew established bytheProbation Office.h. Obey all Prison and house arrest rules including those imposed while participating in the work release program.

    i. Abide by the terms and conditions ofall active Orders ofProtection issued by any court and provide acopy ofany existing Ordeo f Protection to the Probation Office

    4 Y O U M U S T:Obtain employment as soon as possible as directed by your Probation/ParoleOfficer and maintain steady employment.b. Not cause the loss ofany job you get.c. Notify the Probation Office ofany change inyour employment status within the next court busmess day.FINANC IAL OBLIGATIONS

Masks and disguises. Photographs, videos, DVD s, or films depicting or showing nudity.vi. Photographs of the victim.vii. Pornography.viii. Computer on internet access. This includes access tothe mtemet atanylocation outside your residence.

    11 Y OU M U ST N O T W I TH O U T Y OU R PROBATION OFFICER S APPROVAL:i. Use fictitious names, other than those registered for legitimate business purposes.ii. Have any contact withchildren, otherthanthose specifically authorized byyourProbation Officer, and subject to conditionsimposed by your Probation Officer.iii. Enteror remainupon school property, playgrounds, or placeswherechildren congregate.iv. Linger, loiter, or prowl in thevicinity of schools, playgrounds, or places where children congregate. Use a public street or sidewalk that passes such a location, except for legitimate purposes of travel or movement. Insuch a case,your useshall be limited in time and purpose to expeditiously traveling from one legitimate location to another.vi. Rentor maintain a postofficebox,or receive mail atany location thatdoesnot identify youractual residence, withoutauthorization from your Probation Officer.

    You are hereby notified that upon being granted Intermediate Punishment Probation or Parole you are subject to the provisions ofAct 35 of 995 Act 35 of 995 gives county probation and parole officers the authority to search the property of county offendersaccordance with the provisions of section 27 2 of Act 35of 1995

    The following paragraphs outline when and how a search may be conducted1 A personal search ofan offender may be conducted by any Intensive Supervision Parole or Probation Officer;

    a If there is reasonable suspicion to believe the offender possessescontraband or other evidence of violations of the conditions ofsupervision

    b When an offender is transported or taken into custodyc Upon entering or leaving the securing enclosure ofa correctional institution jail or detention facility

    Notice and Agreement

    1 Youarebeingconsidered for O Probation, O Parole, O ARD, O IPP.2 A condition of yourparticipation in theprogram orpunishment phase willbethatyouwillnotuseor consume alcoholic beverageand or controlled substances3 Violation of this conditionwill result inyour removal fromthe program or phase For IPP or probation participants removal willresultin re-sentencing. Removal from parole will result inyourbeing committed totheAdams County Prison to serveflie balanceof yourunexpired sentence. Revocation of yourentryintoARD willresultinyourcasebeing placed backon thetrial list4 Youmustsubmitto periodic testsof yourblood, breath, or urineonequipment approved bytheAdams County Board of Judges.5 As a condition of youradmission or participation inARD, Probation, IPP oryourreleasefrom imprisonment or parole, youmusagree thatthe results of tests will be admissable in revocation proceedings wiAout supporting evidence establishing thereliabilityoftheequipment and/or results. Inother words, rules ofevidence will notapply and theresults will justify your removal from theprogram or punishment phase6 A sample ofany blood orurine that you provide will be retained for 10 days bytheProbation Office. You will have the right tohave an independent analysis ofthesample bya laboratoiy ofyour choice ifyou request this within theten 10 day period. TheProbation Office will asa courtesy provide youwiththenameand address of a laboratory thatdoesthistypeof work, butyouwillnotbe confined to that laboratory. Ifno request foran independent analysis is made within thetendayperiod, the specimensample shall be destroyed andyourrighttoan independent analysis willbe lost.

    I have read andunderstand the foregoing information. I understand and agree that thetestresults shall beadmissable in revocation proceedingwithout supporting evidence showing reliability and that the results shall besufficient cause for revocation and removal from the ARD, IPP,Probation or ParoleIfyou believe your rights have been violated or about tobeviolated byadministrative actions a written complaint must beprovided to theChief Adult Probation Officer
