1. SUBJECT OF THE TENDER

ATER ROMA, Territorial Housing company of the Municipality of Rome, announces an international design competition (under Chapter IV, Section III, art. 99 and following of Legislative Decree 163/2006 and art. 260 of Presidential Decree 207/2010) “RIGENERARE CORVIALE”. The competition is promoted and funded by Regione Lazio under Regional Council Decree No. 607 of 23.09.2014, published in the Official Bulletin of Regione Lazio No. 78 dated 30.09.2014. The competition is based on the “GUIDELINES” drawn up by ATER in the month of July 2014 and shared with the “Tavolo di Concertazione Istituzionale per la progettazione integrata di riqualificazione e rigenerazione del Quadrante Corviale” (“Institutional Round Table for integrated planning of the Corviale Sector requalification and regeneration”) set up by the Ministry for Cultural Assets, Activities and Tourism - General Office for Landscape, Fine arts, Architecture and Modern art.

1.2 THEMES AND AIMS OF THE COMPETITION

The themes and aims of the competition, indicated in the Preliminary Design Document, develop the questions put forward in the “GUIDELINES” and fall within a general reference framework that deals with a series of integrated operations that have involved the complex in recent years: Contratto di Quartiere II Corviale (CdQII) and Programma di Recupero Urbano (P.R.U.). The indications for these integrated plans, attached with the tender material, must be taken into account in the design proposals put forward by competitors.The themes of the competition are divided into MAIN THEMES and CORRELATED THEMES and the design proposals must be suitable for implementation in operational phases. Each operational phase must involve a complete operation, to be carried out in full at different times.

The MAIN THEMES subject of the Competition are as follows:

A. REGENERATION OF CORPO I: ACCESS AND INTERNAL CIRCULATION, PERMEABILITY OF GROUND FLOOR, NEW DISTRIBUTION SYSTEM AND NEW FUNCTIONS;B. PLAN FOR PARTICIPATION OF INHABITANTS DURING THE SUBSEQUENT DESIGN PHASES;C. NEW EXTERNAL ROUTES AND CONNECTIONS TO EXISTING AND PLANNED PUBLIC SERVICES.

The CORRELATED THEMES subject of the Competition are as follows:

D. GENERAL MASTERPLAN;E. CORVIALE SMART BUILDING;F. ORIENTATION SYSTEM;G. INTEGRATION WITH ARTISTIC INTERVENTIONS.

The MAIN THEMES A and B will be the subject of the first operational phase, the independence, feasibility and completeness of which will be specifically assessed. Completion of the MAIN THEMES (including the residual part of MAIN THEME A, should it not be carried out during the first operational phase, and MAIN THEME C) and the CORRELATED THEMES, will make up the plan for total regeneration of the entire complex, within a plan that ATER, with the agreement of Regione Lazio, may approve. The project guidelines for definition of the competition’s declared aims are specified more fully in the Preliminary Planning Document (PPD) and attachments, described in art. 4.

1.3 OPERATION AREA

The operation area, described in full in the PPD and attachments, comprises:

• Zoning Map No. 61; • the earth connection (garage level and ground floor), the roof, the horizontal and vertical connections,

the communal areas, the 5 condominium meeting rooms, the airshafts in Corpo I;• the areas and rooms owned by ATER included in Zoning Map No. 61.•

1.4 FINANCIAL PLAN AND COST ESTIMATE

The overall design proposal, divided into MAIN THEMES and CORRELATED THEMES, must be suitable for implementation in operational phases that can be carried out at different times. Each operational phase must involve a complete operation carried out on the entire building.

THE MAIN THEMES

A. REGENERATION OF CORPO I: ACCESS AND INTERNAL CIRCULATION, PERMEABILITY OF GROUND FLOOR, NEW DISTRIBUTION SYSTEM AND NEW FUNCTIONS B. PLAN FOR PARTICIPATION OF INHABITANTS DURING THE SUBSEQUENT DESIGN PHASESC. NEW EXTERNAL ROUTES AND CONNECTIONS TO EXISTING AND PLANNED PUBLIC SERVICES

The design group must estimate the parametric cost for all the MAIN THEMES (A+B+C).The first operational phase must involve an intervention on the entire building and must respond to MAIN THEME A (“Regeneration of Corpo I: access and internal circulation, permeability of ground floor, new distribution system and new functions“) and to MAIN THEME B (“Plan for participation of inhabitants during the subsequent design phases”). The estimated value for the realization of the first operational phase (A + B) must have a maximum cost of Euro 7,200,000 net of VAT. If the resulting amount (A+B) exceeds Euro 7,200,000.00, the parts that could be moved to a second intervention, with their relative value, must be highlighted. It must be stressed that the first operational phase must foresee work on the whole of Corpo I. The economy of the proposal submitted, its management and simplicity of maintenance will also be evaluated.

The design group must estimate the maximum cost for implementing the operational phases for the realization of CORRELATED THEMES (D+E+F+G). The economy of the proposal presented will also be assessed with the aim of satisfying all the CORRELATED THEMES.

1.5 CLASS AND CATEGORY OF WORKThe operation to which the competition refers is defined as: “building renovation work”, as per art. 4 par. 1 letter d) of Presidential Decree 380/01. The contents of art. 9 par. 5 of the Municipality of Rome’s New General Building Plan regarding Application of New Technology, categories Re1 or Re2, also applies. Under Ministerial Decree 143/2013, the operation falls under the category Building work, Functional Use - Existing buildings and artefacts, Works Id - E.20, I/c.

2. COMPETITION PROCEDURE

Single stage, International Design Competition, according to Chapter IV, Section III, art. 99 and following of Legislative Decree 163/2006 by means of an anonymously opened procedure, with the aim of acquiring a design with a preliminary level of preparation, in line with the project concepts described in the Invitation to Tender (Art. 1), and with the indications provided in the “Preliminary planning document” (PPD). The Commissioning body reserves the right to decide whether or not to assign the subsequent planning phases to the winner of the competition, as specified in full in art. 11.

2.3 SOLE PROJECT MANAGER

The Sole Project Manager (SPM) is the architect Oscar Piricò, member of the Servizio Nuovi Interventi.

2.4 CONSULTANCY AND ASSISTANCE WITH THE TENDER PROCEDURE

To plan and assist in completion of the competition procedure, ATER makes use, until the term set for the same, of the consultancy of the Competitions Department of Ordine degli Architetti Pianificatori Paesaggisti e Conservatori di Roma e Provincia (OAPPCR).

2.7 REFERENCE LEGISLATION

The reference regulations for the competition procedure are those contained and mentioned in this Invitation to Tender and its attachments, together with Leg. Dec. 163/2006 and subsequent modifications and additions and the relevant references, and Pres. Dec. 207/2010 and subsequent modifications and additions.

2.8 OFFICIAL LANGUAGE AND METRIC SYSTEM

The sole official language for the entire procedure is Italian and the material required to take part in the competition under art. 6 must be drawn up in the Italian language. For the purposes of preparation of the design proposal, only the decimal measuring system may be used.

3. CONDITIONS FOR PARTICIPATION

3.1 ADMISSION REQUIREMENTS

The competition is open to architects and civil and environmental engineers from the European Union, duly registered with professional orders or registers in their country of origin, and in any case authorised to provide services of the type indicated in the Invitation to Tender, according to Directive 85/384/CEE, and who, at the time of registration in the competition, are not in any way prohibited from practising their profession, in accordance with art. 38 of Leg. Dec. 163/2006 and relevant references. Also allowed to take part in the design competition in reference, in the forms indicated below, are professionals from non-E.U. countries that, in agreement with the European Union, have adopted a system of equivalence and comparability of professional qualifications. In this case, the request to participate must contain indications of the legal equivalence references in force.Professionals with the required qualifications are allowed to take part in the manners foreseen by art. 90, paragraph 1, letters d), e), f), fbis), g), h) and art.101, paragraph 2, of Leg. Dec. 163/06 and listed below:

• individual competitors also in association in the manners foreseen by current legislation;• professional companies;• engineering companies;• providers of engineering and architectural services under category 12 of attachment II A (Leg.

Dec. 163/2006) set up in Member States, established in accordance with the laws in force in their respective Countries;

• temporary joint ventures between the persons indicated above, even if not yet formally established, to which the provisions of art. 92, Pres. Dec. 207/2010 and art. 37 of Leg. Dec. 163/2006 apply;

• in fixed consortiums of professional companies and engineering companies, including those of mixed form.Also allowed to take part are Public Administration employees holding the authorisation described in art. 53 of Leg. Dec. 165/2001, with the exception of employees of the Commissioning Body and those working

part time on behalf of administrations that operate within the same territory, under art. 90 paragraph 4 of Leg. Dec. 163/2006 and subsequent modifications and additions. Each competitor, whether individually or in association, may only present one design proposal.The companies must indicate the legal representative and issue a statement to the effect that they fulfil the requirements envisaged, respectively, by art. 90 of Leg. Dec. 163/2006 and arts. 254 and 255 of Pres. Dec. 207/2010.In the case of a temporary joint venture, even if it has not yet been set up, each member must fulfil the general requirements for participation envisaged by the Invitation to Tender, penalty exclusion of the entire design group from participation in the competition.Temporary joint ventures must include a professional figure who has been licensed to operate for less than five years, according to the rules of the European Union Member State of residence, as set down in art. 253 of Pres. Dec. 207/2010. Competitors taking part in joint ventures are required to indicate the name of the individual who will take on the role of group leader with powers. This will be the only person with whom the Commissioning Body will have official relations.For all purposes of this consultation, every group of competitors will, collectively, have the same rights as an individual competitor. All members of the design group are acknowledged to have equal rights to and ownership of the competing proposal.Each competitor may make use of consultants and/or associates. The professional qualification of each consultant and the nature of the consultancy must be stated. They must not be incompatible under art. 3.3 of this Invitation to Tender; their tasks and assignments will be defined within the competing group, without the relationship of the group itself with the Commissioning Body being affected thereby.Each individual competitor may not compete in more than one form, that is to say by taking part simultaneously as an individual and in a group (either as group leader, or as member of the group, or as consultant and/or associate, or as administrator/employee of an engineering company).Violation of this prohibition will result in all competitors with whom the individual in question is connected being excluded from the competition.It is also prohibited for stable consortiums and the individual consortium members (for whom the consortium is competing) to take part in the same competition, and likewise it is prohibited for the same individual to form part of more than one stable consortium. Failure to comply with this requirement will result in exclusion from the competition of both the consortium and the consortium member.Competitors who are in one of the conditions foreseen by art. 2359 of the Italian Civil Code may likewise not take part in the competition.For any points not mentioned in this Invitation to Tender regarding requirements for participants, please refer to Leg. Dec. 163/2006 and subsequent modifications and additions and the relevant references, and Pres. Dec. 207/2010 and subsequent modifications and additions.

3.2 COMPOSITION OF THE DESIGN GROUP

Considering the multi-disciplinary nature of the subject of the Competition, each designer or group of designers must, compulsorily, combine skills with those of professionals, researchers, experts in specific fields. The design group must be made up of at least the following:

• one architect;• one structural specialist (architect or engineer);• one expert in energy saving and sustainable architecture;• one sociologist expert in participatory processes;• one artist.

Their professional qualifications must be proven, by means of curriculum or registration with a professional Order. Each member of the design group must not form part of more than one group or take part in the Competition as an individual or associate. Violation of this prohibition will result in all the groups with whom the professional figure in question is connected being excluded from the competition.

3.3 INCOMPATIBILITY AND CAUSES FOR EXCLUSION

The following may not take part in the competition, penalty exclusion:

A. • the full and acting members of the competition Jury, their spouses, relatives and family to the third degree;• the members of the unit identified by the OAPPCR Competitions Department, as specified more fully

in point 2.4, their spouses, relatives and family to the third degree;• the members of the technical Secretariat, as specified more fully in point 2.5, their spouses, relatives

and family to the third degree;• the members of the technical and administrative Secretariat supporting the Jury, as specified more

fully in point 8.2, their spouses, relatives and family to the third degree;

B. the business partners, direct superiors and employees, and all those who, for whatever reason, have business, collaboration or ongoing and known relations with the members of the categories listed under point a) above;

C. the administrators, board members and employees of the Commissioning Body, including those with a fixed term and/or consultancy/internship/apprentice/job experience contract or the like, consultants with permanent contracts with the Administration and employees of public bodies working within the same territory as that in which the competition is held, as well as Companies controlled by the Commissioning Body itself;

D. persons under the employment of Public Bodies, Associations, Institutions or Administrations, including University lecturers, without prejudice to the participation foreseen by current legislation and subject to presentation of the documentation required to prove the legitimacy of participation in the competition under laws, regulations or trade union agreements;

E. persons for whom there are conditions prohibiting them from working with the Public Administration.

Violation of the provisions on the requirements and method of participation (articles 3.1 and 3.2) and/or the presence of sources of incompatibility (art. 3.3) and/or conditions preventing participation, will result in exclusion from the competition of the individual, person or group, that caused the violation. This Invitation to Tender is governed by the causes for exclusion indicated in articles 38 and 46 of Leg. Dec. 163/2006 and subsequent modifications and additions, and art. 253 of Pres. Dec. 207/2010 and subsequent modifications and additions.

The Commissioning Body also provides on the competition site a version in English of the texts relating to the Invitation to Tender and the PPD, without prejudice to the indications provided in art. 2.8.

5. SITE INSPECTION

It is not compulsory to attend the site inspection in order to take part in the Competition, but it is strongly recommended. The site inspection will take place on 07.09.2015 at 15:00 o’clock, meeting in front of the monumental staircase in Lot 1 - Largo Reduzzi 5. The site inspection will take place during the morning of the date in question.The schedule with details of the site inspection will be published on the competition web site.

6. TECHNICAL DRAWINGS REQUIRED

In order to take part in this competition, the following technical project drawings are required for the overall operation, drawn up to a level of detail equivalent to that of a preliminary project, as defined by articles 93 and 99 of Leg. Dec. No. 163/2006, based on the Preliminary Planning Document (PPD), illustrating the design proposal in a full and thorough manner.The competition takes place anonymously, so the technical drawings must bear no names or indications liable to reveal or suggest the identity of the competitor.Competitors must present, penalty exclusion, all and only the documentation foreseen in this article, in a single, anonymous sealed package as indicated in art. 7.3. The individual competition drawings and the outside of the packages must only bear the alphanumeric code, made up of a maximum of 5 characters (freely chosen from numbers and letters).Inside the package there must be three separate, distinct packs, which must not be transparent, must be sealed and anonymous and as indicated below.

PACK A - DESIGN PROPOSAL

Single, separate, distinct, non-transparent, sealed and anonymous package, bearing on its outside the words:

RIGENERARE CORVIALE – CONCORSO INTERNAZIONALE DI PROGETTAZIONEALPHANUMERIC CODEPACK A - DESIGN PROPOSAL

containing the following documentation:

1. 4 drawings A0 (base 1188 mm x height 840 mm), numbered from 1 to 4 with their long side as base, mounted on rigid, light-weight panels such as forex, to allow for easy display. The technical drawings must provide a full illustration of the project by means of at least the following drawings:

1a. plan of the area of operation, as shown in the General Masterplan in scale 1:1.000 (CORRELATED THEME D);1b. description of the project in scale 1:500 and scale 1:200 (MAIN THEMES A and C) by means of plans, prospect views and cross-sections with specific indications of the operational phases;1c. organisation charts, profiles, prospect views, cross-sections, construction details, any quantity tables, simulations and three-dimensional representations (in a suitable scale and free hand) required for an accurate description of the design, for understanding of the special characteristics of the design proposal and for its sub-division into complete, independent operational phases;1d. indications of the technological, construction and installation options made in relation to the design and architectural choices proposed (using suitable methods and scales of illustration) by means of simulations and representations in a suitable scale and free hand technique (CORRELATED THEME E);1e. indications of the artistic installations and the orientation layout integrated with the design proposal (CORRELATED THEMES F and G).

The composition of the drawings may be freely formulated by the competitors.

2. No. 2 copies of the drawings, reduced to A3 format, of which one bound.

3. No. 1 design report in A4 format (in two copies) comprising a maximum of 10 pages including the cover, with a maximum of 12 thousand characters using a size 12 font. The report may include tables, graphs, drawings, photographs considered of use to illustrate the choices proposed, provided they are within the limits set of 10 pages and in A4 format.

The report must contain:

3a. an illustrated description of the design criteria verifying compliance with the indications in the Preliminary Planning Document (PPD) and with any questions that cannot be seen from the technical drawings and might have an influence on the choices and success of the design;3b. a description of the operations in the first operational phase of the project relating to MAIN THEME A (“Regeneration of Corpo I: access and internal circulation, permeability of ground floor, new distribution system and new functions”) and to MAIN THEME B (“Plan for participation of inhabitants during the subsequent design phases”) with indications of the areas and opportunities left open in the design for subsequent definition during the participation phase;3c. a summary estimate of the approximate costs of the operation, determined by operational phase and category of work as specified more fully in art. 1.4. The summary calculation of expenditure must be carried out, according to art. 22 of Pres. Dec. No. 207/2010, by applying the corresponding standard costs to the quantities characteristic of the work, or by applying parameters taken from similar operations carried out or by drawing up an approximate metric estimate calculation with unit prices obtained from official price lists or rates in force in the Regione Lazio.

Single, separate, non-transparent, sealed and anonymous envelope, bearing on its outside the words:

1. Application to participate ontaining the personal details of the design group with the names of all the members and any associates and consultants, signed by the persons in question (as shown in FORM A1);

2. Nomination of the individual with the role of group leader, with power of representation signed by all the members of the group. In the case of a company, the name of the legal representative and/or the technical manager must be indicated (as shown in FORM A2);

3. Declaration in lieu of certification formulated like a personal sworn declaration under arts. 46 and 47 of Pres. Dec. No. 445 dated 28 December 2000, (as shown in FORM A3):

• attesting that all the members of the design group are registered with a professional Order or Board, or declaring that they are in possession of an equivalent qualification,

• attesting compliance with the conditions for participation under points 3.1 and 3.2 and non-existence of the conditions of incompatibility under point 3.3,

• authorising public display and publication of the design and mention of the designers.

4. In the case of professionals who are employed by Public Bodies, Associations, Institutions or Administrations, including university lecturers, documentation proving the legitimacy of their participation in the competition (e.g. laws, regulations or trade union agreements, specific authorisations).

5. Copy of a valid identity document for members of the group and any consultants/associates.

The statements made under point 2) and 3) must be signed:

• in the case of individual professionals: by the professional in person and by any associates/consultants;• in the case of a professional association: by the group leader and by all the associated professionals

and by any associates and/or consultants;• in the case of professional companies or engineering companies or stable consortiums by the legal

representative of the company/consortium or by the person delegated to represent it or by the chief executive officer or by an attorney (in which case the relevant power of attorney must be attached) and by any associates and/or consultants;

• in the case of existing temporary joint ventures: by the person acting as group leader and by any associates and/or consultants;

• in the case of temporary joint ventures that have not yet been set up: by the group leader and by all the individuals who are to set up said temporary joint venture, and by any associates and/or consultants;

In particular, penalty exclusion, in the case of:

• an existing temporary joint venture, it is necessary to indicate the name of the agent (group leader) and attach the collective mandate or articles of association, as results from a certified private agreement, and the relevant special power of attorney granted to the legal representative of the group leader, as results from a public deed, in compliance with the indications of art. 37 of Legislative Decree No. 163/06;

• a temporary joint venture still to be set up, it is necessary to provide a specific declaration signed jointly by all the legal representatives of the individuals making up the joint venture to be formed, containing their commitment, in the event of victory and consequent assignment of the engagement, to grant a special collective mandate as representative to the member of the group indicated as group leader, as well as to comply with the regulations foreseen by art. 37 of Leg. Dec. No. 163/2006;

• an engineering company, professional company, group of associates, it is necessary to indicate the name of the legal representative and attach a certified copy of the articles of association of the company, in the form required by law.

7. MANNER OF PARTICIPATION

7.1 QUESTIONS

Any requests for clarification on the competition concepts must be received by 21.09.2015.• via e-mail to the address [email protected] addressed to the Competition Technical

Secretariat.The answers to any queries will be published over time in the FAQ section of the web site www.rigenerarecorviale.aterroma.it until 09.10.2015.After the period ending 09.10.2015 the secretariat will continue to be available to respond to questions of an administrative nature on questions relating to delivery of the proposals.

7.2 DELIVERY OF TECHNICAL DRAWINGS

All the documentation required must reach the protocol department of the Competition Commissioning Body, penalty exclusion, not later than 12.00 noon on 18.11.2015 at the following address:

The offices of the Commissioning Body are open to the public for delivery of packages by hand or by courier during weekdays (from Monday to Friday) from 9 a.m. until 1 p.m.The expiry date refers unfailingly to the date of delivery, and not to the date of dispatch, whatever the means of delivery used. Delivery of the packages is at the competitors’ risk and expense, and after expiry of the above due date no further packages will be accepted and no additional materials will be accepted for those delivered within the term.The package must bear the following indication:

and indications of the recipient:

The package must be completely anonymous. Should the chosen carrier require the address of the sender, that of the competition Commissioning Body must be indicated.Under no circumstances may the competitors violate the anonymous nature of the competition phase by affixing identification codes, names or symbols, signs or other identification elements, liable to reveal the identity of the competitor, penalty exclusion from the competition.

7.3 TRANSPORT AND INSURANCE

Participants may deliver the technical documents directly to the Commissioning Body’s protocol department within the terms set in the preceding point.For documents sent via post or express courier, the date and time of actual receipt by the Commissioning Body’s Protocol Department will be considered, not the date of dispatch. In the event of loss of the parcel the Commissioning Body will accept not claims for recovery from the competitors. The packages containing the technical documents must not be sent with payment and/or insurance costs charged to the recipient.

8. EVALUATION OF THE DESIGN PROPOSALS

8.1 JURY

The Jury is nominated by the Commissioning Body under articles 84 and 106 of Leg. Dec. No. 163/06 and is made up of 7 full members and 2 acting members:

• the Director General of ATER ROMA or No. 1 member delegated by him, as chairman of the Jury,• No. 1 manager or professional expert on the tender concepts, on the indications of Regione Lazio;• No. 1 member expert on the tender concepts, on the indications of MIBACT (Ministry for Cultural

Assets, Activities and Tourism);• No. 1 manager or professional expert on the tender concepts, on the indications of Roma Capitale;• No. 3 professionals and/or professors of international repute and expert on the tender concepts,

nominated by ATER;• No. 2 acting members, professionals expert in design, nominated by ATER.

The acting members will be present while the Jury is at work, but will not be entitled to vote.

The names of the Jury members will be made public after expiry of the term for delivery of the technical documents under art. 84 of Leg. Dec. 163/2006, and will be published on the competition web site www.rigenerarecorviale.aterroma.it. The members of the Jury must declare the absence of any of the states of incompatibility envisaged by current legislation and by this Invitation to Tender, including those foreseen by art. 84, paragraph 7 of Leg. Dec. No. 163/06. In the event of any incompatibility, the competitor (or the consultant or associate) will be excluded, along with any group of which he is a member. The competition PM will be present while the Jury is at work, but will not be entitled to vote.The Jury is assisted in its job by the activities of the Technical and Administrative Secretariat, details of which are given in art. 8.2 below. A member of the Technical and Administrative Secretariat will draw up minutes for the meetings of the Jury, and these will be kept by the Commissioning Body. In the event of a full member not being able to attend, that member will be replaced in full by an acting member. In this case, the acting member will replace the full member for the entire remaining duration of the Jury’s work.

8.2 TECHNICAL AND ADMINISTRATIVE SECRETARIAT

The Commissioning Body will nominate a Technical and Administrative Secretariat made up of technical and administrative officers from the Commissioning Body and professionals from the Competitions Department of the Rome Order of Architects, among those taking part in organisation of the procedure and preparation of the Tender documents, with the task of supporting the proposal assessment phases and the Jury, participating in its work without right of vote, as described in point 8.4.The names of the Technical and Administrative Secretariat members will be made public after expiry of the term for delivery of the technical documents under art. 84 of Leg. Dec. 163/2006, and will be published on the competition web site www.rigenerarecorviale.aterroma.it.

8.3 EVALUATION CRITERIA AND SCORING METHOD

The Jury will assess valid proposals and will assign a score to each design proposal, using the assessment methods indicated below.Evaluation of the design proposals received is determined by calculating the arithmetical average of scores assigned at the discretion of the individual Jury members in the following assessment areas:

• Architectural quality of the design solution (MAIN THEMES A and C) with particular reference to integration of the design within the reference context: maximum 35 points

• Program for participation of residents in the subsequent design phases (MAIN THEME B): maximum 15 points

• Town planning quality of the solutions proposed in the masterplan, in relation to the current and planned context (CORRELATED THEME D): maximum 10 points

• Quality of the technological solutions implemented in relation to the overall architectural quality of the work, to the running and maintenance of the artefact, to the specific solutions with respect to questions of energy saving and system innovation (CORRELATED THEME E): maximum 10 points

• Orientation system and integration with artistic works (CORRELATED THEMES F and G): maximum 10 points

• Technical and economic assessment of the costs of execution, economics and congruence in relation to the type of work: maximum 20 points

Total maximum score: 100 points

8.4 ASSESSMENT METHODS

Within 30 days following expiry of the term for participation in the competition, the Sole Project Manager, with the support of the Technical and Administrative Secretariat, will proceed, during a public meeting notified via the competition web site at least 7 days prior to the date on which it is held:• to verify the completeness and correctness of the anonymous packages received,• to open said packages and verify the presence inside them of the three packs indicated in art. 6 and

their correctness for administrative purposes.

After this the Sole Project Manager, with the support of the Technical and Administrative Secretariat, will proceed, during a non-public meeting, to open the packs containing the technical drawings (PACK A), and will prepare them for evaluation by the Jury.A report will be drawn up during these preliminary phases, and will be presented to the Jury by the PM during the start of approval work, and this report will form an integral part of the proposal evaluation procedure. The Jury, during a private session, will then carry out the assessment using the criteria indicated in art. 8.3 above. After assigning the scores and drawing up the resulting provisional anonymous classification based on the anonymous design drawings, the competition Jury, assisted by the Technical and Administrative Secretariat, will then open PACK C - IDENTIFICATION CODE to determine the provisional classification. This will be followed by opening of PACK B - ADMINISTRATIVE DOCUMENTATION, in order to verify that the competitors classified fulfil the admission requirements. Should the administrative documentation fail to comply with the requirements of the Tender the competitor will be excluded and the classification adjusted accordingly.Finally, the Jury will draw up the report and the final classification of all the designs examined, associated with the name of the individuals who prepared the individual proposals, indicating the winning design, the second and third placed in the classification and any mentions.The minutes of the work carried out by the Jury will be filed with and kept by the Commissioning Body, and will be available for access by the interested parties. A summary of the contents of the minutes will also be published on the competition web site www.rigenerarecorviale.aterroma.itThe work of the Jury will be completed within 30 days of the term for preparation of the design technical drawings presented, by the SPM. The Jury’s decision is binding for the Commissioning Body.

9. COMMUNICATION OF THE COMPETITION RESULTS

Proclamation of the winner will be made by the Commissioning Body within 30 (thirty) days of the end of the Jury’s assessment, with the full results being published on the competition web site. The results will be notified to all the participants in writing or via certified mail. Further evidence will be provided in the forms envisaged by the regulations, and by Italian and foreign cultural institutes in the sector, the specialist press, specialist web sites.

10. PRIZES AND REIMBURSEMENTS

The Commissioning Body offers the following gross amounts for prizes and reimbursements, divided as follows:

1st prize Euro 100,000.00, inclusive of VAT and social security charges, if due, 2nd prize Euro 35,000.00, inclusive of VAT and social security charges, if due, 3rd prize Euro 23,000.00, inclusive of VAT and social security charges, if due.

The Jury may also award up to 3 mentions as a reimbursement of expenses, to a maximum overall value of Euro 12,000.00 in total, inclusive of VAT and social security charges, if due, to designs that are considered worthy of merit. Finally, the Jury may formulate a judgement of suitability for designs worthy of merit, ascertaining the full technical and professional compliance of the design presented with the requirements of the Invitation to Tender. This judgement of suitability may be shown as an element for assessment in the professional curriculum of the individual designers authors of the proposal. No further prizes are envisaged.In the event of a group the prize will be paid to the individual indicated as the group leader.There will be no joint winners.The Adjudicating Committee may decide not to assign all the prizes at its disposal, should there not be a corresponding number of proposals considered suitable.For the winner, the prize is to be considered as the fee for the preliminary project drawn up.

11. ASSIGNMENT OF WORK

The Commissioning Body reserves the right to decide whether or not to start the subsequent planning phases relating to the winning preliminary design. In this case, the winner of the competition will be assigned the task of drawing up the final project, including initial indications on the safety and co-ordination plan, only as regards the part relating to the first operational phase (MAIN THEMES A and B) as envisaged by art. 99 of Leg. Dec. 163/06.The task will be assigned by means of a negotiation procedure, as regulated by art. 57 of Leg. Dec. 163/06. In compliance with the requirements of current legislation, in order to be assigned the work, prior to start of the negotiation procedure the winner must satisfy the requirements indicated in art. 263 of Pres. Dec. 207/2010, to the minimum extent indicated below. It is possible to resort to pooling to attest the requirements, as foreseen by art. 49 of Leg. Dec 163/06.The minimum economic/financial and technical/organisational requirements indicated in art. 263 of Pres. Dec. 207/2010 (Participation requirements) must be declared, also as foreseen by art. 49 of Leg. Dec. 163/06 (Pooling) to the minimum extent indicated below:

A. having completed during the last ten years services under article 252, relating to work in the category and class “Building, Functional use - Existing buildings and artefacts, Works Id - E.20, l/c”, to which the services to be assigned refer, identified on the basis of the lists contained in current professional price lists, amounting to a total value equal to the estimated value of the work, Euro 7,200,000.00, to which the service refers;

B. having carried out during the last ten years two services under article 252, relating to work in the category and class “Building, Functional use - Existing buildings and artefacts, Works Id - E.20, l/c”, to which the services to be assigned refer, identified on the basis of the lists contained in current professional price lists, amounting to a total value not less than Euro 2,880,000.00, equal to 0.40 the estimated value of the work to which the service refers, with reference to types of work that are similar in size and technical characteristics to those to which the engagement refers;

C. average annual number, with reference to the last three years preceding publication of this Tender, of technical staff used, not less than 6 persons, corresponding to double the estimated number required to carry out the assignment.

The final project must be drawn up based on the winning preliminary project and according to the indications and requests of the Commissioning Body, who may request the introduction of modifications and improvements, provided these are not substantial, without this entailing any further compensation beyond that set for preparation of the project.

11.1 FEE

The presumed amount of the fee for the final project relating to the main concepts is currently calculated as euro 7,200,000.00 net of VAT. The assignment is currently estimated based on this value, which may be increased by the Body following the addition of concepts and amounts, net of social security payments and tax, if due, to euro 298,990.15 for assignment of the final plan inclusive of initial safety indications and prescriptions.The amount has been calculated at preliminary level, with reference to the Decree from the Ministry of Justice No. 143 dated 31 October 2013 (Regulation on determination of the fees to be used as a basis for tenders in the procedures for assignment of public and service contracts relating to engineering and architecture), and in any event a negotiation procedure will be used to assign the service, as foreseen by art. 99 paragraph 5 of Leg. Dec. 163/06.

12. OWNERSHIP OF THE TECHNICAL DRAWINGS AND COPYRIGHT

The Commissioning Body will retain access to the technical drawings provided by all participants in the competition phase, without prejudice to legal guarantees and respecting copyright.Full ownership of the winning design and of the prize-winning designs, without prejudice to the intellectual property of the work, will only be acquired by the Commissioning Body after the prizes have been paid. In any event, all competitors will retain copyright for their designs, as provided for in current legislation, and will be free to publish said designs without restriction only after the results of the Competition have been announced.

13. RIGHT OF PUBLICATION

Following proclamation of the results, the Body reserves the right to exhibit, publish and divulge, through the organisation of initiatives of the type it considers most advisable, for example exhibitions and publications, the designs presented during the competition, either fully or in part, which, in the sole opinion of the Body, are considered of interest, indicating the authors and any associates, without said authors and associates being entitled to any right or compensation as a result.To this end, the competitors taking part in the competition authorise handling of their personal information for the purposes of disclosure, without prejudice to the guarantee of Copyright, under Leg. Dec. 196/2003 and subsequent modifications and amendments, relating to the protection of personal information.All competitors are strictly prohibited, penalty exclusion from the Competition, from publishing their designs or having them published and/or making them known to third parties while the Competition is taking place, and before the results of the Jury’s decision are made known. Any non fulfilment, as well as resulting in exclusion from the Competition, will be notified to the relevant professional bodies.

14. RETURN OF TECHNICAL DRAWINGS

The technical drawings presented, with the exception of the winning project and prize-winning projects which will remain the property of the Commissioning Body, will be made fully available to the competitors, who will be able to collect them, at their own expense, within 120 days of the end of the disclosure operations. After said time, the Commissioning Body will no longer be responsible for keeping them.

15. ACCEPTANCE OF THE TENDER CLAUSES

Participation in the tender competition implies unconditional acceptance by every competitor of all the regulations contained in the Invitation to Tender. Failure to comply with the articles in this Invitation to Tender will result in exclusion from the competition.

16. HANDLING OF PERSONAL INFORMATION

Under and according to Legislative Decree No. 196/03 the personal and sensitive information supplied by competitors will be acquired by the Commissioning Body and handled, also by means of an automated database, solely for the purposes relating to the competition procedure or in order to carry out obligations required by current legislation. The rights envisaged by art. 7 of Legislative Decree No. 196/03 may be exercised in the manners indicated by Law No. 241/90 and reference legislation regarding access to documents. For all questions not dealt with in this Invitation to Tender, reference is made to the legal and contractual legislation and regulations currently in force.

17. CONTROVERSIES

In the event of any controversies relating to this procedure, the sole court of competent jurisdiction is the Court of Rome. No arbitration will be allowed.
