EOI & Bid for Loan Licensing of Pharmaceutical Products

BENGAL CHEMICALS & PHARMACEUTICALS LIMITED (BCPL) is a pioneer in Pharmaceuticals, Home products and

Chemicals under the Department of Pharmaceuticals, Ministry of Chemicals and Fertilizers, Govt. of India. BCPL is

involved in the production and marketing of Pharmaceuticals, Home products and Chemicals at affordable price to

the Nation. BCPL is in the process of consolidating its Pharma business and is in the final stage of commissioning

new productions blocks for antibiotics and other oral solid dosages. For reasons of capacity and non-availability of

production plants (especially liquid dosages) BCPL desires to have manufacturing under loan license arrangement

with Pharma companies who is ready to offer the facility for Loan License Manufacturing.

The product category list is attached and bidders are required to select the product list for which they are offering

their facility.

BCPL BACKGROUND NOTE:

Bengal Chemicals & Pharmaceuticals Ltd (BCPL) is the oldest Pharmaceutical Company in the country .It was

established by Acharya P C Ray in 1901. From humble beginningwith one factory in Manicktala (Kolkata) in 1905.

Three more factories were Established – One at Panihaty (North 24 Parganas, West Bengal) in 1920, one at

Mumbai in 1938 and one at Kanpur in 1949 with its registered office at 6 Ganesh Chunder Avenue, Kolkata. The

company expanded and diversified into a multi product conglomerate, having three divisions viz Division –I

(Chemicals ) , Division –II (Drugs &Pharmaceuticals) and Division-III (Cosmetics and Home products). Stringent

Standards of quality control, infallible commitment to the consumers have enabled BCPL to receive Schedule M-

GMP certificate, DGQA & ISO 9001 certificate.

Terms & Conditions:

1. Bid submission Criteria: Bidders to be submitted their Bids under two separate sealed covers, one cover containing Part:1 (Un-priced Bid / Technical Bid) & the other cover containing Part 2 (Priced Bid / Commercial Bid). Indicating Tender Name, No, Date with Tender Due Date. These two bids should be submitted in a single sealed cover with the respective Tender No & Item. Mentioned thereon, complete in all respect. All documents to put in technical bid (Part: 1 Un-priced bid) only. The Price Bid (Part: 2 should contain only price offer) Bids not received in two bid system (as mentioned above) will not be considered. EMD to submit in a separate Envelop superscripted as EMD with tender no and tender date. 2. Selection Criteria: Only bidders qualified in all parameters identified and mentioned as Eligibility criteria (Page No: 05) will be considered for “bidder’s factory / production facility inspection” by BCPL’s designated team. Only successful bidders in terms of Eligibility Criteria and Production Facility Inspection will be considered for their price bid evaluation, all other bidders price bid will not be evaluated. However BCPL’s existing Loan License manufacturer’s again site inspection will not be required as their facility is already approved and accepted by BCPL. Facility inspection will be carried out in case of only new applicants / bidders. 3. Price: Bidders quoted discounted price to be F.O.R to BCPL, either at Kanpur (Utter Pradesh) or Kolkata

(West Bengal).

4. EMD: Rs. 1Lakh (Rs. 1,00,000/-) per item maximum 5Lakh (Rs. 5,00,000/-) in the form of DD or Banker’s Cheque in favor of ‘Bengal Chemicals & Pharmaceuticals Limited’ payable at Kolkata. Un-successful bidder’s EMD will be returned within 15days of awarding the contract. Successful bidders submitted total EMD will be converted to security deposit, regardless to number of items awarded. The said security deposit will be returned on successful completion of contract without any interest, the contract period will be 1year from the date of this tender finalization.

5. Micro and Small Scale industries can avail tender fees and EMD exemption against submission of Micro / small scale industries registration certificate from appropriate authority.

6. Payment Terms: 90 days from the date of receipt of goods. However, payments to MSME Units will be

released in 30 to 45 days after deducting 3% of the awarded/agreed rates mentioned in the Purchase Order.

7. Prices to be quoted as per the format given as “Annuxure-III Price bid format with product details” only (Page No: 09 to 16)

8. L-1 identification: L-1 evaluation will be on the quoted basic price.

9. L-1 Matching: BCPL may ask L-2 to match L-1 price to have more supplier in hand, in-case there is any timely

supply problem with L-1.

10. Agreement: Successful bidder will be entered for an agreement with BCPL for 1year and can be extended on mutual consent.

11. The qualified parties should be ready with the facilities along with the terms and condition within one month.

Selected parties have to obtain Loan License permission from respective Drug Control authorities on behalf of

BCPL.

12. Awarded bidders to complete all deliveries to BCPL, Kolkata within 30days including the transportation time from the date of order, beyond 30days will be treated as delayed days which will attract ‘Late Delivery Penalty’ @1% per week or part thereof on the value of undelivered quantity maximum up to 10%, for example delayed days 1 to 7 days = 1%, 8 to 14 days = 2%, 15 to 21days = 3%....maximum up to 10%.

13. STATUTORY LICENSING FEES TO BE PAID BY THE PARTY ON BEHALF OF BCPL. 14. RIGHTS OF BCPL

(i) BCPL reserves the right to accept / reject the offers received without assigning any reasons whatsoever, or may call for any additional information / clarification if so required.

(ii) BCPL reserves the right to limit or delete any item mentioned in this document and extend the last date of submission of the EOI and bid.

(iii) Decision of BCPL will be final. 12. COURT JURISDICTION: This shall be subject to the exclusive jurisdiction of courts at Kolkata, India.
