We, the signatories to this letter, members of the University of Edinburgh community, believe that:

International staff are crucial to the University of Edinburgh’s standing as a leading

international university

International staff should be treated as an asset and supported to continue working for

the University

International staff should not be left in debt in order to obtain Indefinite Leave to

Remain so that they can continue working for the University

We therefore urge the University of Edinburgh to commit to reimbursing all costs of applying for

Indefinite Leave to Remain for international staff and their dependents, as it already does for visa

fees.

Context

The spiralling costs of visas and Indefinite Leave to Remain (ILR) applications are a serious and

immediate hurdle that international staff in British academia have to contend with. At the University

of Edinburgh, provisions were put in place for reimbursement of Tier 2 (General) visa fees — the

most common type of working visa for academics — after a sustained campaign by rank-and-file

staff and UCU.

International staff must, however, also obtain Indefinite Leave to Remain in order to stay in the UK

for more than six years and continue working for the University. A non-EEA national who has not

applied for ILR after six years on a Tier 2 visa must leave the country and cannot resume

employment in the UK for a year. International colleagues on time-limited contracts face the

necessity of securing a new visa for each new contract.

The costs of all kinds of visas, including ILR, have risen dramatically in recent years. ILR costs

currently stand at a minimum of £2,398 per applicant. These costs are multiplied for staff whose

family members (including children) also require a visa. For a family of four, an ILR application would

cost £9592. The University offers an interest-free loan to assist with ILR costs, but they are still borne

in the end by staff.

In essence, international staff have to take a pay cut simply so that they can continue working for

the University. The costs of ILR leave them worse off than their British and EU colleagues, and

counteract the effects of progression and promotion.

This is not fair.

The University of Edinburgh should seek to be a leader in this area, matching best practice in the

sector such as the current policy at St Andrews. As other universities, such as Sheffield, improve

their policies, Edinburgh risks falling behind.

ILR costs are borne in a context in which the effects of the Home Office’s ‘hostile environment’

policy are acutely felt across many sectors of the British public sphere, including in higher education.

Recent revelations about the surveillance, marginalisation, and lack of transparency facing migrant

workers in the UK have galvanised public opinion and garnered media attention. This is especially

relevant today as around 12% of British university staff are from outside the EEA, with the

proportion of overseas academics amongst research-only staff reaching 47%. In British universities,

international staff and students are subject to strict, often indiscriminate immigration controls and

ever-increasing costs in relation to their immigration status. Successful campaigning by UCU has led

to the Home Office announcing that it will change its immigration rules to allow migrant workers to

participate fully in strike action, however it remains unclear how such action affects international

students. In a sector that boasts of its international allure and its diverse community, compliance

with the hostile environment brings into question these claims and highlights deep ramifications for

equality and diversity on British campuses. Reimbursing the costs of ILR for international staff and

their dependents would be a positive step towards demonstrating the University of Edinburgh’s

commitment to international staff.
