Many people planning to leave an inheritance are concerned about the recentdramatic falls in the value of their shares and houses, but at Attwaters Solicitorswe believe the recession could actually save them money in the long termthrough paying less Inheritance Tax.

HM Revenue and Customs has issued statistics showing that a large number ofpeople who die each year leave shares or property other than the house theylive in.

In the 05/06 tax year, 47% of estates where Inheritance Tax had to be paidcontained such assets, which were valued at nearly £9bn. After deduction ofmortgages and debts, this amounted to an Inheritance Tax bill of approximately£2.8bn being paid by these estates.

Here at Attwaters Solicitors we believe people could reduce the amount ofInheritance Tax payable when they die by taking advantage of falling asset pricesnow before values start to increase again in the years to come. Inheritance Taxis currently payable on estates worth more than £325,000, but the amount ofInheritance Tax payable can be mitigated by making lifetime gifts of assets.

Generally, any gifts over £3,000 are liable for Inheritance Tax if the personmaking the gift dies within seven years. The current low values of secondhomes, buy-to-let properties and shares provide a good opportunity to saveInheritance Tax on death.

Lifetime gifts are valued at the date of the transfer, so if you can afford to giveaway assets now currently worth say £200,000 and die within seven years whenthe value has increased to say £300,000, it will be the £200,000 figure that issubject to Inheritance Tax - a potential £40,000 saving to your estate.

If you die after seven years, the taxsaving is a massive £120,000!As long as you're not giving away a house you need to live in, or assets thatprovide an income to live on, this is the ideal moment to consider lifetime gifts.The only downside is that on making a gift of an investment property or sharesit might give rise to a Capital Gains Tax liability. Even so that expense will almostcertainly be far outweighed by the potential Inheritance Tax saving.

It is becoming commonplace for couples to enter into CohabitationAgreements to set out their financial intentions. Whilst CohabitationAgreements are currently not legally binding in English law, the Law Courtswill give them some weight and validity if the following principals havebeen adhered to when the document is drawn up:

• Both Parties have received independent legal advice on the

terms of the agreement and provided full financial disclosure

• The Agreement is in writing and is clear and open in its intention

• The Agreement is in the form of a Deed

• The Agreement has been entered into once the couple

begin living together

Correctly drawn up Agreements which do not restrict any right to apply toa court for a financial order if necessary can, therefore, allow couples todetermine important financial issues which can effect the time they livetogether and also on the breakdown of their relationship. Recent cases ofSutton v Mishcon De Reya and Gawor & Co (2003) EWHC 3166demonstrate courts recognising the validity of Cohabitation Agreements.Agreements can cover a wide range of issues such as ownership ofproperty, child maintenance and children’s surnames (Any Agreementmade in connection to children will be limited by the Children Act 1989).Agreements can also cover practical issues such as how to divide householdbills and determine ownership of joint accounts.

Unmarried couples do not have the same rights under the MatrimonialCauses Act 1973 and couples can only seek legal recourse with regards toproperty and children matters on the breakdown of a relationship undergeneral property law or under the Children’s Act 1989. The relaxedattitudes of the courts is also demonstrated by the recent decision inRadmacher v Granatinio 2009 EWCA Civ 649 whereby the terms of a pre-nuptial agreement were up-held and it was stated that the “rights ofautonomous adults to govern their future financial relations” by suchagreements should be given great weight. So, whilst it may not seem themost romantic topic of discussions when you are moving in with yourpartner you do not want it to be one of the more important discussions youshould have had!
