1.Citation

TheseRegulationsmaybecitedastheDeedsRegistryRegulations.

2.Identityofpersons

(1)Theidentityofpersonsshallbeestablishedbymeansoftheirnamesanddatesofbirth,orinlieuofthedateofbirthbyamethodapprovedbytheRegistrar,whichshallbeenteredinthepersonalandotherregistersinwhichtransactionsrelatingtoanyonepersonarerecorded.

(2)ThedateofbirthshallbeestablishedbymeansofthebirthorbaptismalcertificateoranaffidavitproducedtoandfiledbytheRegistrar.

(3)Whereproofofthedateofbirthofanypersonhasalreadybeenfiledintheregistryitwillbesufficient to refer to such proof provided the conveyancer concerned certifies to or produces proof of theidentityoftheparty.

(4)InrecordingthedateofbirthofanypersonintheappropriateregistertheRegistrarshallcause

anotetobemadethereinindicatingthedocumentwithwhichsuchproofisfiled.

(5)TheRegistrarshallrectifyanyerrormadeinconnectionwithanentryornoteofthedateofbirthofanypersonappearinginhisRegistryuponprooftohissatisfactionthatanerrorhasbeenmade.

(6)TheRegistrarshallhaveauthority inconnectionwithanydeedordocumenttenderedforexecution, registration or record to call for evidence to establish the identity or nonidentity of any partytheretowithanypersonwhosenameappearsinanyregisterkeptintheRegistry.

3.Deeds,etc.,tobewritten,etc.,onpaperapprovedbytheRegistrar

Deeds,powers,andotherdocumentslodgedforexecution,registration,orrecordmustbewritten,printed,ortypedonpaperapprovedbytheRegistrar.

4.Deeds,etc.,tobeneat

(1)Alldeeds,powers,andotherdocumentslodgedforexecution,registration,orrecordmustbeneatlyandplainlywrittenortyped,orprintedwithblackinkofgoodqualityandamarginofatleast37,5mmallowedforbindingpurposes.

(2)Copyinginkmustnotbeused,andnocarboncopyofanydeed,power,orotherdocumentshallbeacceptedforthepurposeofbeingfiledinthedeedsregistry.

(3)Alterationsandinterlineationswillrenderadeed,power,orotherdocumentliabletorejection,but,ifmade,theymustbeinitialledbythepersonorpersonsexecutingthedeed,power,orotherdocument,asthecasemaybe,andalsobythepersonsattestingthesame.

(4)If,however,thealterationsorinterlineationsareattestedbypersonsotherthantheoriginalattestors,suchpersonsshallattachtheirsignatures.

(5)Ifanysignaturetoadocumentiswrittenacrossastamp,orwithotherthanblackinkofgoodquality, or encroaches on themargin, the Registrar may decline to allow it to be used for the purposesintended.

(6)Allalterationsandinterlineationsmust,inthecaseofadeedattestedbyanotary,beinitialledalsobysuchnotary.

(7)Theupperhalfofthefirstpageofdeedsmustnotbeusedforwriting,typing,printing,oranyotherpurpose,butmustbereservedforthepurposeofdeedsregistryendorsements.

(8)AnyoftheprovisionsofthisregulationmayberelaxedbytheRegistrarathisdiscretion.

5.Spaces

Anyspaces inadeedwhichhavenotbeenusedshall be ruled through,andwhereadeedcomprisesmorethanonepagethenecessarycatchwordshallbewrittenatthefootofeachpage.

6.Registrarmaydeclinetoattest,etc.

If,intheopinionoftheRegistrar,thewriting,typing,orprintinginanydeed,power,orotherdocumentlodgedforattestation,executionorregistration,orforanyotherpurpose,is,owingtothefaintnessthereof,notcalculatedtosecuredurability,hemaydeclinetoattest,execute,register,oraccept it,asthecasemaybe.

7.Names,etc.,ofpersonsnamedindeeds

(1)Deeds,powers,andotherdocumentsmustcontainthefullnamesanddatesofbirthofthepersonsnamedtherein,exceptingsuchpersonswhoareactinginorareappointedtoactinarepresentativecapacity.

(2)Theprovisionsofsubregulation(1)mayberelaxedbytheRegistrarinspecialcircumstancesin

hisdiscretion.

(3)Anadditionofan"alias"tothedescriptionofanypersonbyortowhomadeedlodgedforexecutionorattestationinadeedsregistryistobepassedshallnotbepermitted,and,ifanysuchadditionhasbeenmadeinanyotherdeedorpower,orotherdocumentlodgedforregistration,thecorrectnameonlyshallberecognizedforthepurposeofsuchregistration.

(4)Deeds,powers,andotherdocumentsifexpressedinaforeignlanguagemay,atthediscretionoftheRegistrar,beacceptedforregistrationorrecordifatranslationdulycertifiedbyapersonapprovedbytheRegistrarislodgedtherewith.

8.Placeanddateofexecution

Everydeedanddocumentexecutedinorlodgedforregistrationorrecordinthedeedsregistryshalldisclosetheplaceanddateofexecutionthereof.

9.Dateandnumbergranted,transfer,etc.

Everydeedconferringtitletolandmustquotethedateandnumberofthegrant,transferorothertitlebywhichthelandisheld,andalsothedateandnumberofthegrant,transferorothertitletowhichthediagramof the land is annexed or relates, aswell as the nameof the person inwhose favour such lastmentionedgrant,transfer,orothertitlewasmade.

10.Propertiestobespecifiedinseparateparagraphs

(1)Whereadeedconferringtitletolandincludesmorethanoneproperty,eachpieceoflandshallbedescribed in a separateparagraph,which shall benumbered, andeachparagraph shall conform to theprovisionsofregulation9.

(2)Aseparateregistrationclausemust,ifrequiredbytheRegistrar,beinsertedattheendofthedeedinrespectofeachpieceofland,whichclauseshallbearanumbercorrespondingtothenumberoftheparagraphinwhichthelandisdescribed.

(3)Whentwoormorepiecesoflandareshownasseparatefiguresonasinglediagrameachpieceshall be described in the relevant deed in a separate paragraph, and may thereafter be transferredindependentlyonlyupontheproductionofafurtherdiagramthereof.

(4)Itshallnotbenecessary,whereseparatediagramsoftwoormorepiecesoflandareannexedto one and the same deed of transfer and transfer is sought of any of such pieces, to procure from theDirectorofSurveysandLandsacopyofthediagramthereofforthepurposeofannexuretothenewtransfer.

11.Districtortownshiptobenamed

(1)Indescribinglandinadeedthenameofthedistrictinwhichitissituatedshallbequotedand,inthecaseoflandsituateinatownship,thedistrictandthenameofthetownship.

(2)Theregisterednumber,ifany,ofthelandshallbegiven,andindeedsconferringtitletolandtheusualextendingcauseshallbeinserted.

(3)Indescribinglandnoreferenceshallbemadeinadeedconferringtitletolandorinamortgagebondtoanybuildingorotherproperty,movableorimmovable,whichmaybeonorattachedtotheland.

(4)Whenthedescriptionofthesituationoflandinanexistingdeedisdefectiveorinsufficient,anditisdesiredinconnectionwithafurthertransferofsuchlandtoamendthesame,theRegistrarmay,subject,ifhethinksnecessary,totheproductionofacertificatefromtheDirectorofSurveysandLands,permitsuchamendmenttobemade.

(5)Itshallnotbenecessarytorepeatthedescription(ifany)oftheboundariesmentionedinadiagram,providedthatasuitablereferencetosuchdiagramismadeintherelevantdeed.

12.Extentoflandtobeexpressedinwordsandfigures

Inthedescriptionoflandconveyedorhypothecatedinadeedorbondtheextentthereofshallbeexpressedinwordsandfigures.
