Chrystal was issued her Licence Controller Qualification (LCQ) in October 2014 under the new Act. In December 2016 Chrystal sold alcohol to a minor during a Controlled Purchase Operation. She explained that at the time the premises was busy and she had little assistance so made an error of judgement which she accepts. Following the sale she has appeared before a Community Justice Panel as a consequence of the sale. The applicant has completed all the requirements the panel requested from her. DECISION (ON THE PAPERS) This is an application by DJCJ Trading Limited for an on-licence in respect of premises situated at 11 Old Main North Road, Leithfield, known as “The Old Leithfield Hotel“. The general nature of the business to be undertaken is that of a Hotel with the hours authorised for the sale of alcohol between Monday to Sunday from 10.00am to 02.00am the following day and until 01.00am for all outdoor areas. These hours are the same as those held by the previous licensee. In 2015 the outdoor trading hours were reduced from 2.00am to 1.00am following discussions with the previous licensee. The rationale for the 1.00am closing time for the outdoor areas was based on the use of the area on warm summer evenings (mainly only Friday and Saturday nights) and for New Year’s Eve celebrations. The Old Leithfield Hotel has been operating under a temporary authority since March 6 2017. The hotel has previously operated with both on and off-licences. The applicant has decided at this time not to seek an off-licence however may reconsider this in the future. The application was duly advertised and no objection or notice of desire to be heard has been received. In their reports, the Police, Medical Officer of Health, and District Licensing Inspector have raised no matters in opposition to this application. We are satisfied as to the matters to which we must have regard as set out in s. 105 of the Act and we grant the applicant an on-licence authorising the sale and supply of alcohol, to any person for consumption on the premises and to let people consume alcohol there. The licence may issue immediately. Requirements on holders of on-licences The applicant’s attention is drawn to ss. 51 to 54 of the Act where it is a requirement for all holders of an on-licence to ensure that:

(2) at all times when the premises are open for the sale and supply of alcohol, a reasonable range of food is available for sale and consumption on the premises, in portions suitable for a single customer, at reasonable prices and within a reasonable time of being ordered.

(3) ensure that, at any time customers are lawfully on the premises there is readily

available free, comprehensive, and accurate information about the forms of transport from the premises that are available at that time.

The applicant’s attention is drawn to ss. 56 and 57 of the Act obliging the holder of an on-licence to display:-

(1) A sign attached to the exterior of the premises, so as to be easily read by persons outside each principal entrance, stating the ordinary hours of business during which the premises will be open for the sale of alcohol ; AND

(2) A copy of the licence, together with a statement of all conditions subject to which it is issued, attached to the inside of the premises so as to be easily read by people entering each principal entrance.

This is an application by Leithfield School Fund Raising Committee for an on-site special licence in respect of premises situated at 220 Terrace Road, Leithfield and known as The Woolshed The nature of the particular event for which the licence is sought is the Leithfield School Kiwiana Car Rally with the days and hours authorised for the sale of alcohol being Sunday 4 June 2017 from 4.00pm to 10.30pm. The licensed area is undesignated and includes the interior of the woolshed. The applicant has advised that they plan to close the bar 30 minutes prior to the end of the event to allow 30 minutes ‘drink up’ time. Victoria Thompson is the proposed manager for the event and although she does not hold a manager’s certificate the Committee is satisfied that she will manage the conduct of the sale of alcohol in accordance with the licence. The licensee is exempt from the requirements of appointing a manager under subpart 7 of the Act. DECISION (ON THE PAPERS) This is an application by Koyama Wines Limited for a Temporary Authority Order in respect of premises situated at 434 Omihi Road, Omihi, known as “Mountford Estate“. The general nature of the business to be undertaken is that of a Winery with the hours authorised for the sale of alcohol between Monday to Sunday from 8.00am to 10.00pm. The tasting room, rose garden and courtyard areas of the premises are designated as Supervised. The application is due to Koyama Wines Limited’s recent purchase of the property and winery. The current off-licence is held by Mountford Vin Waipara Limited and it expires on 19 February 2018. The annual fee for the licence has been paid. Takahiro Koyama is the sole director and shareholder of Koyama Wines Limited. In their reports, the Police and District Licensing Inspector have raised no matters in opposition to this application. We are satisfied as to the matters to which we must have regard as set out in s. 136 of the Act and we grant the applicant a temporary authority for the duration of 3 months, commencing on 12 June 2017, subject to the current licence 57/OFF/391/2015 continuing in force for the duration of the Order. Section 136, Sale and Supply of Alcohol Act 2012

Pursuant to the Sale and Supply of Alcohol Act 2012, an Order is hereby made whereby Koyama Wines Limited is authorised to sell alcohol for a period of three months from the 12 June 2017 on or from the premises for consumption off the premises and to supply alcohol free, as a sample, for consumption on the premises known as Mountford Estate, 434 Omihi Road, Omihi, subject to the duties, liabilities and obligations under the current licence no. 57/OFF/391/2015 continuing in force for the duration of the Order.
