INTRODUCTION

The Illinois Register is the official state document for publishing public notice of rulemaking activity initiated by State governmental agencies. The table of contents is arranged categorically by rulemaking activity and alphabetically by agency within each category.

Rulemaking activity consists of proposed or adopted new rules; amendments to or repealers of existing rules; and rules promulgated by emergency or peremptory action. Executive Orders and Proclamations issued by the Governor; notices of public information required by State Statute; and activities (meeting agendas; Statements of Objection or Recommendation, etc.) of the Joint Committee on Administrative Rules (JCAR), a legislative oversight committee which monitors the rulemaking activities of State Agencies; is also published in the Register.

The Register is a weekly update of the Illinois Administrative Code (a compilation of the rules adopted by State agencies). The most recent edition of the Code, along with the Register, comprise the most current accounting of State agencies’ rulemakings.

NOTICE OF PROPOSED AMENDMENTS

1) Heading of the Part: Medical Payment 2) Code Citation: 89 Ill. Adm. Code 140 3) Section Numbers: Proposed Action: 140.24 Amendment 140.28 Amendment 4) Statutory Authority: Section 12-13 of the Illinois Public Aid Code [305 ILCS 5/12-13] 5) Complete Description of the Subjects and Issues Involved: This rulemaking clarifies

payment procedures for alternate payees; addresses the reasonable concerns of applicable providers and alternate payees; and implements the enhanced screening and verification mandates of the SMART Act. It also, adds language that provides that certain classified employers, who are eligible to participate in the State's Medical Assistance Program, may be designated as an alternate payee by an individual practitioner who is employed by the payee. Further, it tracks currently proposed changes to 89 Ill. Adm. Code 140.1001, which address registration requirements for alternate payees.

In addition, this rulemaking amends 89 Ill. Adm. Code 140.28, Record Requirements for

Medical Providers, which currently requires providers of medical services that are enrolled in the Medical Assistance Program to retain business and professional records for a period of three years and requires these providers to retain business and professional records for a period of six years. Accordingly, this rulemaking will change the retention period to six years.

Department's Medical Assistance Program. 1) Providers enrolled as business entities are limited to one payee. A

business entity is defined as any firm, corporation, partnership, agency, institution or other legal organization organized for the purpose of providing medically related professional services. A provider enrolled as a business entity may designate the corporate or partnership name as the payee. The mailing address for the payee must be the provider's service address, the designated address of the provider's corporate or partnership office, or a designated address that will accept and forward the remittance advice to the business entity.

2) Providers enrolled as individual practitioners are allowed to have more

than one payee. An individual practitioner is defined as an individual person licensed by an authorized State agency to provide medical services. Payment may be mailed to an individual practitioner at one of the following addresses that will accept and forward the remittance advice to the individual practitioner: A) The provider's service address; or B) The provider's residence; or C) The provider's designated address; or D) The address of the provider's designated alternate payee pursuant

to subsection (d) of this Section; or E) The address of the entity specified according to an arrangement

under Section 140.27(c) or (d).

3c) A long term care facility and its corporate or partnership owner may request the facility's warrant be sent directly to the business office address of the corporate or partnership owner. After approval is given, the warrant will be issued in the name of the facility or corporate name doing business under the facility name, but sent to the business office address of the corporate or partnership owner rather than the facility.

cd) Individual practitioners may request the Department to designate an alternate

Additionally, the individual practitioner must meet the following conditionsSubpart J and: 1) The individual practitioner must havehas a contractual/salary arrangement

with a hospital or a hospital affiliate, as defined by the Hospital Licensing Act [210 ILCS 85], that requires fees to be turned over to the hospital or hospital affiliate, as a condition of employment with a hospital or professional school. A professional school is defined as a college or university offering a degree to qualify individuals for licensure to perform medical services; or

2) The individual practitioner must have a contractual/salary arrangement

with a professional school that requires fees to be turned over to the professional school. A professional school is defined as a college or university offering a degree to qualify individuals for licensure to perform medical services; or

32) The individual practitioner must havehas a contractual/salary arrangement

with or beis employed by a practitioner owned group practice that requires fees to be turned over to the practitioner owned group practice. The practitioner owned group practice must be owned by three or more full-time licensed individual practitioners who are eligible to participate in the Medical Assistance Program; or

43) The individual practitioner must have a contractual/salary arrangement

with a partnershipis a partner in a partnership and has a partnership arrangement that requires fees to be turned over to the partnership. The partnership must be solely-owned by two or more practitioners who are eligible to participate in the Medical Assistance Program; or

a condition of employment with an individual practitioner "employer" that requires fees to be turned over to the employeran employee, as a condition of employment, to turn over his or her fees to the employer. The employer must be eligible to participate in the Medical Assistance Program. An individual practitioner may designate an employer who is a physician licensed under the Medical Practice Act of 1987 [225 ILCS 60] if the practitioner is an advanced practice nurse licensed under the Nurse Practice Act [225 ILCS 65]. and, except as provided below, must be licensed in the same profession as the practitioners in his or her employ who have designated the employer as the alternate payee. The employer may only qualify as a payee for a total of four individual practitioners, including the employer. Section 140.28 Record Requirements for Medical Providers

a) Providers shall maintain in the regular course of business the following: 1) Any and all business records, that may indicate financial arrangements

between the provider and other providers in the program or other entities, or that are necessary to determine compliance with federal and State requirements, including but not limited to: A) business ledgers of all transactions, B) records of all payments received, including cash, C) records of all payments made, including cash, D) corporate papers, including stock record books and minute books, E) records of all arrangements and payments related in any way to the

leasing of real estate or personal property, including any equipment,

F) records of all accounts receivable and payable; and

2) Any and all professional records that relate to the quality of care given by

This rule does not require a provider to keep or make available medical records for persons who are not applicants or recipients and for whom no claim to the Department for payment is made.

B) other professional records required to be maintained by applicable

federal or State law or regulations. b) The business and professional records required to be maintained shall be kept in

accordance with accepted business and accounting practice and shall be legible. Such records must be retained for a period of not less than 63 years from the date of service or as provided by applicable State law, whichever period is longer, except that if an audit is initiated within the required retention period the records must be retained until the audit is completed and every exception resolved. This provision is not to be construed as a statute of limitations. However, the Department will not deny, suspend or terminate a provider pursuant to Sections 140.14 through 140.19 solely because the provider has failed to keep records for more than 3 years.

c) All records required to be maintained shall be available for inspection, audit and

copying (including photocopying) by authorized Department personnel during normal business hours. Department personnel shall make all attempts to examine such records without interfering with the professional activities of the provider.

d) The provider's business and professional records for at least 12 previous calendar

months shall be maintained and available for inspection by authorized Department personnel on the premises of the provider. Department personnel shall make requests in writing to inspect records more than 12 months old at least 2 days in advance of the date they must be produced.

e) The provider is responsible to furnish records to the Department. If records are

maintained by a designated alternate payee or another entity, the provider remains responsible for obtaining those records and furnishing them to the Department.

"Agency" – includes all State agencies and units of local government and their political subdivisions, agencies, boards, committees and commissions which are under the jurisdiction of State or local governments. "Agency Action Report" – a report submitted to the Department by agencies proposing actionsan action(s) requiring consultation. The information required to be submitted shall be sufficient to determine the presence or absence of a threatened or endangered species or natural areaNatural Area in the vicinity of the proposed action. "Applicant" – the agency or third party consulting with the Department. A third-party applicant is a non-governmental party consulting with the Department on behalf of an agency because the third-party is seeking financial support, funding, authorization or other approval from the agency. "Authorized" or "Authorization" – any permitting, licensing, zoning or other administrative approval provided by an agency. "Biological Opinion" – the component of the Detailed Action Report prepared by the Department, when a valid record of an occurrence for a threatened or endangered species or natural areaNatural Area exists within the vicinity of a proposed action. This opinion will conclude whether the action will jeopardize the listed species present, destroy or adversely modify their essential habitat, or adversely modify a natural areaNatural Area. "Carried Out" – conducted by, or on behalf of, an agency or its agents through contract, agreement or other legal arrangement. "Cumulative Effects" – direct and indirect effects of a proposed action,action(s) together with the identifiable effects of actions that are interrelated or interdependent with the action. Indirect effects are those that are caused by the action but are later in time or farther in distance. Interrelated actions are those that are a part of a larger action. Interdependent actions are those that have independent utility apart from the action. "Department" – means the Department of Natural Resources. "Detailed Action Report" – a written report that is prepared by an agency when a threatened or endangered species or natural areaNatural Area has been identified within the vicinity of a proposed action. This report shall contain sufficient information to make a judgement regarding the potential adverse impacts to a listed species or its essential habitat or a natural areaNatural Area. "EcoCAT" – the Department's on-line consultation application process. "Essential Habitat" – is the physical and biological environment that is required to maintain viable populations of a listed species in order to ensure the survival and recovery of that species. "Funded" – receipt of any grant, loan, loan guarantee, bond or other public financing provided by an agency. "Jeopardize" – to engage in an action thatwhich would reduce the likelihood of the survival or recovery of a listed species or would result in the destruction or adverse modification of the essential habitat of such a species or which would result in the destruction or adverse modification of a natural areaNatural Area. "Listed Species" – is any species of plant or animal thatwhich has been listed as endangered or threatened by the Illinois Endangered Species Protection Board or the U.S. Fish and Wildlife Service.

Section 1075.90 Consultation Fee The purpose of this Section is to establish procedures for collecting fees from applicants for consultation services in accordance with Section 805-555 of the Department of Natural Resources (Conservation) Law [20 ILCS 805/805-555].

a) Applicability. This Section applies to each application for consultation services submitted to the Department pursuant to Section 11(b) of the Act and Section 17 of the Natural Areas Act, except for those applications for consultation services submitted by, or on behalf of, an agency of State or federal government.

b) Amount of Fee. Each application for consultation services must include a fee in

the amount of $500. c) Manner of Payment

1) Applicants must pay the consultation fee when initiating the consultation request.

2) For consultation requests submitted through the Department's EcoCAT

system, the fee must be paid using credit card or e-check through the EcoCAT system in the manner identified by the EcoCAT system.

3) Applicants unable to use a credit card or e-check to pay the fee using the

EcoCAT system must submit a certified or cashier's check to the Department before the consultation request will be completed.

1) An area at North Point Marina, located off the northern breakwater,

running the length of the beach parallel to the shoreline and 100 yards out into the lake.

2) An area at Illinois Beach State Park, located between the park office and

the #3 bathhouse, running parallel to the shoreline and 70 yards out into the lake.

e) It shall be unlawful to operate any watercraft with a motor larger than 10

horsepower on the waters of Griswold Lake in McHenry County. f) The following portions of the Kankakee River shall be designated as Slow, No

Wake areas: 1) An area 100 yards upstream and 100 yards downstream from the River

Isle hairpin curve that is approximately midway between Momence, Illinois and the Indiana border.

2) An area 100 yards upstream and 100 yards downstream of the hairpin

curve created by the east side of Rudecki Island, which is approximately one mile west of River Isle.

a) Within 10 days after a decision is made on an application, the Department shall inform the applicant in writing of the decision. This notice shall contain a decision on each of the following programs for which the recipient may be eligible based on information contained on the application: TANF, Medical Assistance, AABD, GA (City of Chicago), and SNAP benefits. No decision shall be required for any assistance program for which the applicant has expressly declined in writing to apply.

b) The Department shall send a notification of its determination within the following

time periods, calculated from the date of application: 1) Aid to the Aged, Blind or Disabled (Aged)/((AABD)(A)) and related

Medical Assistance-No Grant (MANG) – 45 calendar days 2) Aid to the Aged, Blind or Disabled (Blind)/((AABD)(B)) and related

MANG – 45 calendar days 3) Aid to the Aged, Blind or Disabled (Disabled)/((AABD)(D)) and related

MANG – 60 calendar days 4) Temporary Assistance for Needy Families (TANF) and related MANG –

4530 calendar days 5) General Assistance (GA) – 45 calendar days

c) The time limitation for determining eligibility for TANF may be extended 45 calendar days when a decision cannot be reached because information necessary for a determination is available only from third parties and those parties fail to respond or delay their response to a request for the information.

d) The time limitation for determining eligibility for General Assistance may be

exceeded only when a decision cannot be reached because of failure or delay on the applicant's part.

de) The Department shall make a decision on an application for social services within

30 days after the date of application and shall inform the applicant in writing of its decision within l5 days after the decision.

Section 10.430 Approval of an Application and Initial Authorization of Financial Assistance

a) Financial assistance (for Aid to the Aged, Blind or Disabled and Temporary Assistance for Needy Families General Assistance) shall be authorized effective 30 days after the date of application, provided the case is eligible on that date.

Exception: Financial assistance for an AABD or General Assistance client residing in a sheltered care facility shall be authorized effective the date of application, or the date of entry into the sheltered care facility, whichever is later.

b) Financial assistance for the Temporary Assistance for Needy Families program

shall be authorized effective the date of application, provided the case is eligible on that date.

c) Financial assistance for General Assistance shall be authorized effective:

1) Thirty days following the date of application. 2) If General Assistance (GA) is approved as a result of termination of

Temporary Assistance for Needy Families (TANF) or Aid to the Aged, Blind or Disabled (AABD) assistance or deletion (TANF only) for certain non-financial reasons (see Section 10.270(f)), assistance shall be authorized with no gap if an application is filed within 30 days after the notice of termination of TANF or AABD or deletion (TANF only) (see also Section 10.270).

bd) If the applicant is determined eligible for financial assistance, the notice (see

Section 10.420) shall state the amount of financial assistance to be provided, and a statement of the reasons for any partial grant amounts. Partial grant amount is defined as the maximum grant that a family unit for whom application for public assistance was filed is eligible to receive, less any reductions resulting from the consideration.

The MOU assigns the RC-014-14 pay grade to the Photographer title effective December 1, 2012. Effective December 1, 2012, the Civil Service Commission approved the establishment of the new Photographer title (title code 32080). The Photographer title has two incumbents appointed from the Photographer II title, which was abolished effective December 1, 2012. 37 Ill. Reg. 282 At its meeting on February 6, 2013, the Joint Committee on Administrative Rules objected to the Department of Healthcare and Family Services establishing an effective date for its emergency rule titled Hospital Reimbursement Changes (89 Ill. Adm. Code 152; 37 Ill. Reg. 282 - 1/4/13) that was outside the 9 day window allowed by Section 5-45 of the Illinois Administrative Procedure Act [5 ILCS 100], which states that an emergency rule can become effective immediately upon filing or on a stated date less than 10 days thereafter. HFS filed this emergency rule with the Secretary of State more than 9 days prior to its effective date. Failure of the agency to respond within 90 days after receipt of the Statement of Objection shall be deemed a refusal. The agency's response will be placed on the JCAR agenda for further consideration.

Statute requiring agency to publish information concerning proposed changes in methods and standards for establishing medical assistance payment rates for hospital services in the Illinois Register: 5 ILCS 100/5-70(c) 2. Summary of information: Effective January 1, 2013, states are required to provide

qualified primary care physicians payments at rates not less than the Medicare rates in calendar years (CYs) 2013 and 2014. States will receive 100% FMAP for increased expenditures equal to the difference between the Medicare rate and the State plan rate as of July 1, 2009 for these services. The provision applies to certain evaluation and management (E & M) services and vaccine administration services delivered by physicians with a specialty designation of family medicine, general internal medicine or pediatric medicine. This change could cost as much as $600 million per year. However, this estimate is likely to be significantly less, depending how regulators interpret this new federal mandate. These costs will be partially offset through federal matching dollars.

EXECUTIVE ORDER

2013-4 Executive Order Eliminating and Consolidating Boards and Commissions

WHEREAS, Article V, Section 11 of the Illinois Constitution authorizes the Governor, by an Executive Order, to reassign functions or reorganize executive agencies that are directly responsible to him to simplify the structure of the Executive Branch, to ensure efficiency, and to further achieve effectiveness; and WHEREAS, under Article V, Section 11 of the Illinois Constitution, such an Executive Order may become effective immediately, either in part or in whole, to the extent it does not contravene a statute; and WHEREAS, under Article V, Section 11 of the Illinois Constitution, the applicable portions of such an Executive Order that contravene a statute must be delivered to the General Assembly to be considered for up to 60 calendar days; and WHEREAS, Section 3.2 of the Executive Reorganization Implementation Act, 15 ILCS 15/3.2, provides that "Reorganization" includes (i) "the abolition of the whole or any part of any agency which does not have, or upon the taking effect of reorganization will not have, any functions" or (ii) "the consolidation or coordination of the whole or any part of any agency, or of the whole or any part of the functions thereof, with the whole or any part of any other agency or the functions thereof;" and WHEREAS, this Executive Order abolishes or consolidates those entities directly responsible to the Governor whose functions are now obsolete or duplicative, whose abolition increases agency efficiency, streamlines the executive branch and dissolves inactive entities; THEREFORE, BE IT ORDERED, pursuant to the power vested in me by Article V, Section 11 of the Illinois Constitution, that the following agency reorganization shall be executed:

III. CONSOLIDATION OF BOARDS AND COMMISSIONS THAT CONTRAVENES STATUTES The River Councils listed in subpart (a), below, are consolidated into a single "State of Illinois Rivers Council." The rights, powers, duties, and functions vested by law in these entities, or any office, division, council, committee, bureau, board, commission, officer, employee, or associated individual, person, or entity, and all rights, powers, and duties incidental to these provisions including funding mechanisms, are also consolidated. The consolidation detailed in this Part shall be effective 60 calendar days from delivery of this Executive Order to both houses of the General Assembly, provided neither house disapproves of this Part of the Executive Order, either in whole or in part, by the record vote of a majority of the members elected:

a. Illinois River Coordinating Council, 20 ILCS 3967/15

Mississippi River Coordinating Council, 20 ILCS 4003/10 b. Wabash and Ohio River Coordinating Council, 20 ILCS 4060/10

The State of Illinois Rivers Council shall consist of the 21 voting members appointed by the Governor to the former councils, including 3 representing soil and water conservation districts and 18 representing local communities, not-for-profit organizations working to protect the rivers, business, agriculture, recreation, conservation, and the environment. One member shall be the Lieutenant Governor who shall serve as a voting member and as chairperson of the Council. The ex-officio agency members of the Council shall include the Director, or his or her designee, of each of the following agencies: the Department of Agriculture, the Department of Commerce and Economic Opportunity, the Illinois Environmental Protection Agency, the Department of Natural Resources, the Department of Transportation, and the Historic Preservation Agency. In addition, the Council shall include: 1) the Director, or his or her designee, of the Army Corp of Engineers, the National Great River

Research and Education Center (NGRREC), and the Association of Illinois Soil and Water Conservation Districts (AISWCD). Members of the Council shall meet at least quarterly, and meetings may be held in-person, by videoconference, and telephone conference at the discretion of the Chair. The Office of the Lieutenant Governor shall be responsible for the operations of the Council, including, without limitation, funding and oversight of the Council's activities. The Office may reimburse members of the Council for travel expenses.

c. Duties of the Council. The Council shall:

i. Periodically review activities and programs administered by State

and federal agencies that directly impact the Illinois River Watershed, the Mississippi River, the Wabash and Ohio Rivers, and other Illinois rivers.

ii. Work with local communities and organizations to encourage

partnerships that enhance awareness and capabilities to address watershed and water resource concerns and to encourage strategies that protect, restore, and expand critical habitats and soil conservation and water quality practices;

iii. Work with State and federal agencies to optimize the expenditure

of funds affecting the rivers and the Illinois River Watershed; iv. Advise and make recommendations to the Governor and State

agencies on ways to better coordinate the expenditure of appropriated funds affecting the Illinois River Watershed and rivers;

v. Advise and make recommendations to the Governor on funds and

the priority of projects; vi. Encourage local communities to develop watershed management

plans to address stormwater, erosion, flooding, sedimentation, and pollution problems and shall encourage projects for the natural conveyance and storage of floodwaters, the enhancement of wildlife habitat and outdoor recreation opportunities, the recovery, management, and conservation of the rivers, the preservation of farmland, prairies, and forests, and the use of measurable economic

vii. Help identify possible sources of additional funding for rivers and

watershed management projects. d. To the extent practical, the Council shall perform its duties in accordance

with the Office of the Lieutenant Governor's Integrated Management Plan for the Illinois River Watershed Technical Report (1997).

e. State agencies represented on the Council shall provide to the Council, on

request, information concerning agency programs and activities that impact the Illinois River Watershed and the rivers.

IV. CLARIFICATION AND CONFIRMATION OF ABOLISHED BOARDS

As a matter of both clarification and confirmation, the following boards and commissions have been abolished, either through statutory action or through the expiration of the General Assembly that created the board or commission by resolution for the term of that particular General Assembly.

V. SAVINGS CLAUSE:

a. The rights, powers, duties, and functions of the entities abolished by this Executive Order shall be vested in and shall continue to be exercised by the Department of Central Management Services or any other appropriate agency to the extent necessary to effectuate the termination or winding down of affected administrative affairs. Each act done in the exercise of these rights, powers and duties shall have the same legal effect as if done by the former entities, and by the officers, members and employees of those entities.

b. Every person or corporation shall be subject to the same obligations and

duties and to the associated penalties, if any, and shall have the same rights arising from the exercise of these obligations and duties as if exercised subject to the former entities or the officers, members and employees of those entities.

c. Every person shall be subject to the same penalty for offenses as

prescribed by existing law for the same offense by any person whose powers or duties were abolished or consolidated under this Executive Order.

d. Whenever reports or notices are now required to be made or given or

papers or documents furnished or served by any person or entity, then those requirements shall be waived or, if completed, then those reports and notices shall be delivered, immediately after the effective date of this Executive Order.

e. This Executive Order shall not affect any act done, ratified, or cancelled or

any right occurring or established or any action or proceeding had or commenced in an administrative, civil, or criminal cause, before this Executive Order takes effect, but these actions or proceedings may be prosecuted and continued by the Department of Central Management Services in cooperation with any other agency, if necessary.

f. This Executive Order shall not affect the legality of any rules in the Illinois Administrative Code that are in force on the effective date of this Executive Order, which rules have been duly adopted by the pertinent agencies. If necessary, however, the affected agencies shall propose, adopt, or repeal rules, rule amendments, and rule recodifications as appropriate to effectuate this Executive Order. These rule modifications shall coincide with, if applicable, the termination and winding down of the abolished entities' affairs.

g. Whenever any provision of any previous Executive Order, any Act, or any

Act's Section transferred by this Executive Order provides for membership of an individual from an abolished entity or their respective designee, on any board, commission, authority, or other entity, the Director of the Department of Central Management Services or his or her designee shall serve in that place, if necessary. If more than one such individual is required by law to serve on any board, commission, authority, or other entity, then an equivalent number of representatives of the Department of Central Management Services or the Director of the Department of Central Management Services' designees shall so serve, if necessary.

h. All employees, if any, of the abolished entities are transferred to the

Department of Central Management Services. The rights of the employees, the State, and the transferring agencies under the Personnel Code or any collective bargaining agreement, or under any pension, retirement, or annuity plan, shall not be affected by this Executive Order.

i. All personnel records, documents, books, correspondence, papers, real and

personal property, and other associated items in any way pertaining to the rights, powers, duties, and functions of the abolished entities shall be delivered and transferred to the Department of Central Management Services or the State Archives, as appropriate.

j. All pending business and affairs in any way pertaining to the rights,

powers, duties, and functions of the abolished entities shall be transferred to the Department of Central Management Services for continuation, modification, winding down, or termination, as appropriate.

k. The unexpended balances of any appropriations or funds, grants,

donations, or other moneys available for use by the abolished entities shall be transferred to the Department of Central Management Services and shall be expended for similar purposes for which the appropriations, funds,

VI. SEVERABILITY:

If any provision of this Executive Order or its application to any person or circumstance is held invalid or disapproved by either house of the General Assembly by the record vote of a majority vote of the members elected, then the invalidity or disapproval of that provision or application does not affect other provisions or applications of this Executive Order that can be given effect without the invalid or disapproved provision or application.

VII. FILING:

This Executive Order shall be filed with Clerk of the House of Representatives and the Secretary of the Senate. In addition, this Executive Order shall be filed with (i) the Secretary of State for publishing in the Illinois Register and (ii) the Legislative Reference Bureau for preparation of a revisory bill effectuating these provisions.

VIII. EFFECTIVE DATE:

This Executive Order shall become effective immediately for those boards and commissions listed in Parts I and IV, above. For those boards and commissions listed in Parts II and III, above, this Executive Order shall become effective 60 calendar days from delivery of this Executive Order to both houses of the General Assembly, provided neither house disapproves of these Parts of the Executive Order, either in whole or in part, by the record vote of a majority of the members elected.
