May 01, 2020 I am pleased to present the 2019 Annual Disciplinary Report produced by the Department of Financial and Professional Regulation (the “Department”) pursuant to Public Act 100-286. The report contains a wealth of information about the number of applicants for the Department’s licensed professions who have past criminal convictions, and the outcomes of those applications. While I encourage you to read the whole report, there are some observations I’d like to make that relate to this data and how the Department is working to improve the outcomes for this group of applicants. First, the Department has taken significant steps to make the application process clearer and more user friendly for applicants with a prior conviction. While there are several steps in any license application process, there are often additional steps for those with past convictions. With the help of feedback from some of our community partners who serve this population, we have improved our website www.idfpr.com to provide more and clearer information about the process for license applicants with a prior conviction. The Department will continue to look for ways to improve both the process and the way we communicate with applicants with prior convictions, to remove unnecessary barriers while still taking the necessary steps to determine if granting a license is appropriate. Second, like last year, the data strongly demonstrates that just having a past criminal conviction is rarely a bar to obtaining a license. There are some crimes that are so serious and some professions so sensitive that a license cannot be granted as a matter of law. But for the vast majority of applicants with previous convictions, that is not the case. For that group, the 2019 data shows that of the more than 1,100 applicants with past criminal records, less than two percent were denied a license in whole or in part because of the conviction. Simply put, if you have a past criminal conviction and that conviction doesn’t create a legal bar, it is highly unlikely that the conviction itself will prevent you from becoming licensed. Finally, the Department continues to encourage otherwise qualified people with previous convictions to apply and seek their license. Similar to last year’s Report, while a non-excluded conviction rarely prevents a license from being granted, the number and percentage of applications we receive from those with previous convictions remains low compared to the overall applicant pool. Of the over 95,000 applications the Department received in 2019, more than 1100 applicants had previous criminal convictions. Studies have repeatedly found that employment helps formerly incarcerated people gain economic stability after release and reduces recidivism. The Department recognizes that becoming a licensed professional can be a gateway

to economic opportunity, and we encourage all qualified applicants to apply, including those with past criminal records. Thank you for your interest in this Report, and I hope you find it useful and encouraging. There is more we can do, but as the data shows, in most cases the mere existence of a past criminal conviction is not a barrier to licensure or the economic opportunity that comes with being a licensed professional.
