Water plant agreement

Based on our discussion yesterday, I think this is the simplificatlon amendment we agreed torecommenci to our boards:

t. Ownership interests in individual components of the 2 plants and 3 wells will not change, andeach MUD wili be responsibie for capital repairs or replacements based on their o*r-,*r*hip.

2. Variable and fixed operating costs will be treated the same*determined solely orr rrr*g* ofwater by each entity.

3. Costs in excess of $25,000 will be keated as major expenses, and borne by the owners ofwhatever component needs the expendifure, based on percentage of that component.

No commilment is rnade rega:ding the approval of this recommendation by an board. Please correctmy notes if you think we need to expand or revise" I probably left someone off this email, so pleaseforward tei any other folks who may need it.

Where Do We Get Our Water?

Montgomery County MUD No. 89 provides ground water from the Evangeline Aquifer. The Texas Commission onEnvironmental Quality (TCEO) completed an assessment of your source water and results indicate that our sourceshave a low susceptibility to contaminants. The sampling requirements for your water system are based on thissusceptibility and previous sample data. Any detections of these contaminants will be found in this ConsumerConfidence Report.

For more information on this report, as well as source water assessments and protection efforts at our system, please

contact John Montgomery of our Regulatory Compliance Department at (281) 367-5511.

About the TablesEPA requires water systems to test for more than 90 contaminants in drinking water. The data tables in this report containall of the regulated contaminants detected in your water, which are below state and federal allowed levels. The state ofTexas allows us to monitor for some contaminants less than once per year because the concentrations do not changefrequently. Definitions and abbreviations are provided below and sources of detected contaminants in this report follow thetables.

This table contains scientific terms and measures, some of which may require explanation.

The level of a contaminant in drinking water below which there is no known or expected riskto health. ALGs allow for a margin of safety.

The concentration of a contaminant which, if exceeded, triggers treatment or otherrequirements which a water system must follow.

Regulatory compliance with some MCLs are based on running annual average of monthlysamples.

A Level 1 assessment is a study of the water system to identify potential problems anddetermine (if possible) why total coliform bacteria have been found in our water system.

A Level 2 assessment is a very detailed study of the water system to identify potentialproblems and determine (if possible) why an E. coli MCL violation has occurred and/or whytotal coliform bacteria have been found in our water system on multiple occasions.

The level of a contaminant in drinking water below which there is no known or expected riskto health. MCLGs allow for a margin of safety.

The highest level of a contaminant that is allowed in drinking water. MCLs are set as close tothe MCLGs as feasible using the best available treatment technology.

The level of a drinking water disinfectant below which there is no known or expected risk tohealth. MRDLGs do not reflect the benefits of the use of disinfectants to control microbialcontaminants.

The highest level of a disinfectant allowed in drinking water. There is convincing evidencethat addition of a disinfectant is necessary for control of microbial contaminants.

nephelometric turbidity units (a measure of turbidity)

picocuries per liter (a measure of radioactivity)

micrograms per liter or parts per billion - or one ounce in 7,350,000 gallons of water

milligrams per liter or parts per million - or one ounce in 7,350 gallons of water.

A required process intended to reduce the level of a contaminant in drinking water.

Secondary ConstituentsMany constituents (such as calcium, sodium or iron) which are often found in drinking water, can cause taste, colorand odor problems. The taste and odor constituents are called secondary constituents and are regulated by the Stateof Texas, not the EPA. These constituents are not causes for health concern. Therefore, secondary constituents arenot required to be reported in this document, but they may greatly affect the appearance and taste of your water.

Outdoor Water Conservation Tips:

o To keep your lawn healthy during the summermonths - it only takes 1" of water a week.

o During the hot summer months, try to waterin the early morning or late evening.

o ln hot summer months, set your lawn mowerto a higher setting, because taller grasshelps hold in moisture. Cutting your grasstoo short can cause you to water more andcan cause the grass to burn easier.

o Set your sprinkler system to a timer andadjust during the different seasons.

Indoor Water Conservation Tips:

o To save on water and energy, always runyour dishwasher with a full load.

o Take a shower instead of a bath.o Check for leaks in your toilets and faucets.

(A helpful hint is to schedule this for everysix months when you are checking yoursmoke detectors.)

o When brushing your teeth, shaving, orwashing your hands, only run the waterwhen it is time to rinse.
