TERMINOLOGIES
1. Act” means the ‗Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act, 2013 (Central Act 30 of 2013);
2. “Appropriate Government” means the State Government and includes the Deputy
Commissioner of the District.
3. ‗Deputy Commissioner‟ means the Deputy Commissioner of a revenue district and includes
Special or Additional Deputy Commissioner or Assistant Commissioner, and any other officer
authorized by State Government to perform the duties of a Deputy Commissioner under the Act.
4. “Form” means form appended to these rules; e) ―Social Impact Assessment‖ means a social
impact assessment study made under sub section (1) of section 4;
5. “Social Impact Management Plan” means a plan prepared by the authority conducting the
social impact assessment study under sub (6) of section 4;
6. „GramaSabha‟ – means the Grama Sabha as defined in clause (16) of section 2 of the Karnataka
Panchayat Raj Act, 1993 (Karnataka Act 14 of 1993).
7. Ward Committee means Ward Committee as defined in Karnataka Municipal Corporations Act,
1976 (Karnataka Act 14 of 1977).
8. The Preliminary Notification issued under sub-section (1) of section 11
9. “Project affected family: Includes a person, his or her spouse, minor sons, unmarried
daughters, minor brothers, unmarried sisters, father, mother and other relatives residing with
him or her and dependent on him or her for their livelihood; also includes "nuclear family"
consisting of a person, his or her spouse and minor children
10. Project affected person (PAP): Any tenure holder, tenant, Government lessee or owner of
other property, or non-titleholder who on account of the project has been affected from such
land including plot in abadi or other property in the affected area.
11. Project displaced person (PDP): Any tenure holder, tenant, Government lessee or owner of
other property, or non-titleholder who on account of the project involuntarily displaced from such
land including plot in abadi or other property. A displaced will always be a PAP but all PAPs
may not be PDPs
12. Replacement cost: A replacement cost/value of any land or other asset is the cost/value
equivalent to or sufficient to replace/purchase the same land or other asset.
13. Small farmer: Refers to a cultivator with an un-irrigated land holding up to two (2) hectares or
with an irrigated land holding up to one (1) hectare.
14. Squatter: A person who has settled on public/government land, land belonging to institutions,
trust, etc. and or someone else‘s land illegally for residential, business and or other purposes
and/or has been occupying land and building/asset without authority.
15. Tenant: A person who holds/occupies land/structure of another person and (but for a special
contract) would be liable to pay rent for that land/structure. This arrangement includes the
predecessor and successor-in-interest of the tenant but does not include mortgage of the rights
of a landowner or a person to whom holding has been transferred; or an estate/holding has
been let in for the recovery of an arrear of land revenue; or of a sum recoverable as such an
arrear or a person who takes from Government a lease of unoccupied land for the purpose of
subletting it.
16. Titleholder: A PAP/PAF/PAH who has legal title to land, structures and other assets in the
affected zone.
17. Vulnerable group :Includes SC, ST family/household headed by women/female, disabled,
handicapped, orphans, destitute, BPL, abandoned woman; unmarried girls; widows; and
persons above the age of 65 years irrespective of their status of title (ownership). Vulnerable
groups would also include those farmers who (after acquisition of land) become small and

marginal farmers and qualify for inclusion in BPL. For such cases, total land holding of the
landowner in that particular revenue village will be considered in which land has been acquired.
18. Wage earner: Wage earners are those whose livelihood is affected due to the displacement of
the employer. The person must be in continuous employment for at least six months prior to the
cut-off date with the said employer and must have reliable documentary evidence to prove
his/her employment.
19. Compensation: Refers to the amount paid under the Land Acquisition Act for private property,
structures and other assets acquired for the project. In this context, compensation refers to
payments made by the government when Eminent Domain is exercised and title of a property is
transferred from a private entity to government.
20. Assistance: Refers to the support provided to PAPs in the form of ex-gratia payments, loans,
asset services, etc. in order to improve the standard of living and reduce the negative impacts of
the project.
21. Entitlement: Compensation or assistance or allowance or facilitation and other forms of
support that can be claimed by the affected/displaced person/family as per the appropriate law
or policy.
22. Entitlement Matrix: List or table containing different types of project impacts or losses (land,
structures, assets); entitled persons/families; and types of entitlements to be delivered.
23. Agricultural land: means lands being used for the purpose of i) Agriculture of horticulture ii)
dairy farming, poultry farming, pisciculture, sericulture, seed farming breeding of livestock or
nursery growing medicinal herbs raising of crops, grass or garden produce: and iii) raising of
crops, trees grass or garden produce: land used by an agriculturist for the grazing of cattle, but
does not include land used for cutting of wood only. iv) land used for the grazing of cattle:
24. Assistance: refers to the support provided to PAPs in the form of ex-gratia payments, loans,
assets services, etc in order to improve the standard of living and reduce the negative impacts
of the project.
25. Below poverty line or BPL Family: means below poverty line families as defined by the
planning commission of India , from time to time ,
26. Compensation: The compensation will be referred as per RTFCTLLA Act and as defined in
revised project R&R Policy.
27. Cutoff Date: The date of Notification under Section 11 of RTFCTLLA Act will be the cut-off
date where the land acquisition will be required. For R&R the date of census survey is the cut-
off date.
28. Encroachers: are those persons who have extended their building, business premises or work
places into government lands.
29. Family: includes a persons ,his or her spouse, minor sons, married daughters minor brothers
,unmarried sisters, father, mothers and other relatives residing with him or her and dependent
on him or her for their livelihood : and includes ― nuclear family‖ consisting of a persons , his or
her spouse and minor children:
30. Affected Family means: i) a family whose land or other immovable property has been
acquired. ii) a family which does not own any land but a member or members of such family
may be agricultural labourers , tenants including any form of tenancy or holding of usufruct right,
share-croppers or artisans or who may be working in the affected area for three years prior to
the acquisition of the land whose primary source of livelihood stand affected by the acquisition
of land: iii) the schedule Tribes and other traditional forest dwellers who have lost any of their
forest rights recognized under the schedule Tribes and other Traditional forest Dwellers
(Recognition of forest Rights) Act ,2006 (2 of 2007) due to acquisition of land: iv) family whose
primary source of livelihood for three years prior to the acquisition of land is dependent on

forests or water bodies and includes gatherers of forest produce ,hunters, fishers , folk and
boatmen, and such livelihood is affected due to acquisition of land: iv) a member of the family
who has been assigned land by the state Government or the Central Government under any of
its schemes and such land is under acquisition: v) a family residing on any land in the urban
areas for proceeding three years or more prior to the acquisition of the land or whose primary
source of livelihood for three years prior to the acquisition of the land is affected by the
acquisition of such land:
31. Government: refers to the government of Karnataka.
32. Land acquisition: means acquisition of land under the RTFCTLLA Act 2013 and compensation
as per RTFCTLLA Act
33. Marginal farmer: means a cultivator with an un irrigated land holding up to one hectare or
irrigated land holding up half hectare:
34. Major impacts: refers to those impacts whose shelter or livelihood is affected Minor Impact: all
other impacts, which will be limited to one time payment of cash or giving advance notice.
35. Non-perennial Crop: Any plant Species, grown either naturally or through cultivation that lives
for a season and perishes with harvesting of its yields has been considered as a non-perennial
crop in the project. For example, paddy, sugarcane, groundnuts etc.
36. Notification: means a notification published in the gazette of the India or as the case may be
the Gazette of the state:
37. Perennial crop: any plant species that live for years and yields its products after, a certain age
of maturity is a perennial crop. Generally trees, either grown naturally or by horticultural and
yield fruits or timber have considered as perennial crop in the project. For example tamarind,
coconut, mango, teak, neem etc are perennial crops.
38. Replacement cost: of the acquired assets and property is the amount required for the affected
house hold to replace /reconstruct the lost assets through purchase in the open market.
Replacement cost will be calculated at PWDs current Schedule of Entitlement Matrix of the
project.
39. Small farmer: means a cultivator with an un-irrigated land holding up to two hectares or with
an irrigated land holding up to one hectare, but more than the holding of a marginal farmer.
40. Squatter (shop Creepers): means those persons who have illegally occupied government land
for residential, business or other purposes.
41. Tenants: are those persons having bonafide tenancy agreements, written or unwritten with a
private property owner with clear property titles. To occupy a structure or land for residence,
business or other purposes.
42. Vulnerable groups: persons belonging to Scheduled Caste or Scheduled Tribe, Women Headed
Households, Disabled, Widows, or Persons above sixty years of age.
43. Women headed household: a household that is headed by woman and does not have a male
earning member is a Woman headed Household. This woman may be widowed, separated or
deserted persons.
44. Bagar Hukum Government land which has been cultivated by farmers without permission and
whose application for title is pending for disposal before the competent authority.
45. Benami :- Made, held, done, or transacted in the name of another person—used in Hindu law
to designate a transaction, contract, or property that is made or held under a name that is
fictitious or is that of a third party who holds as ostensible owner for the principal or
beneficial owner. Benami Transactions are prohibited under the Benami Transactions
Prohibition Act of 1988.
46. Bhoomi: - The name given computerization of land records project in Karnataka. Bhoomi
means land in the local language of Kannada.

47. Booswadhana records :- Computerized records of land acquisition.
48. Chavadi:- Village community centre.
49. E-swathu :-Computerization programme covering a range of activities such as maintaining
and updating records with respect to ownership, extent dimension etc of the rural settlement
lands.
50. Gomal land :- Pasture lands set apart in a village for grazing purposes.
51. Gramathana :- Site inside village limits which are used for residential purposes.
52. Gundu Thopu :- Land used for planting trees for common use
53. Hobli :- A cluster of villages.
54. Inam land :- A grant of a village or land with total or partial exemption from the payment of
land revenue made to a person or an institution, and entered in the land records as an inam,
55. Jamabandi: - village land audit system.
56. Kaveri: - abbreviated from of Karnataka valuation and E-registration,
57. Kharab Land :- kharab land is awaste, non-arable land that is in possession of the
government.
58. Khata:- the khata is primarily an assessment of property with a view to levy property tax. The
document will contain details related to your location, the size of property, and the built up area
and will also have the survey numbers of the properties that border on all sides
59. mojani:- means survey in the local kannada language. It is also the name given to a software
used to issue issues per-mutation sketches which are a pre-requisite for any sale transaction to
happen
60. Pahani: - pahani is one of the local words used to describe record of rights or the records of
tenancy rights and cultivation (RTC).
61. Panchayat :- A local council of elected representatives which has autonomy; a decentralized
unit of administration.
62. Panchatantra: - software used to maintain accounts in local government offices.
63. Patta:- legal document issued by the government in the name of the actual owner of a
particular plot of land.
64. Phodi:- re-drawing the borders of a parcel of land with consequent changes in the cadastral
map.
65. Saguvali chit :- A grant certification which demarcates the extent of land grated to an
individual; without this certification the individual is not allowed to cultivate the land.
66. Sakala :- the name given to the time-bound delivery of services under the Karnataka guarantee
of services Act.
67. Shiristedar:- A revenue official in the office of Thasildhar.
68. Smashaana :- graveyard.
69. Suvarna paravnige- gruha nakshe : computerized building plan sanction system.
70. Taluk / tahsil:- An administrative unit below the sub-divisional level.
71. Zamindari:- A method of revenue collection in British India. The Zamindar or the landlord was
tasked with duty of collecting taxes from the peasants and hand it over to the colonial
authorities.
72. Words and expressions used but not defined in these rules, but defined in the Act or in any law
for the time being in force shall have the same meaning respectively assigned to them in the Act
or in any other law for the time being in force.

CHAPTER - 1
Executive Summary
1.1 Project and Public Purpose The proposed B. G. lane is laying between Munirabad (Dist. Raichur) and Telangana, budgeted
around 380 corers in 1997-98. The proposed railway lane travels through Ginigera, Gangavati
Sindhanur and Manvi talukas of Raichur district and it will connect Gadag, Koppal Bellary
districts and also direct connection between Hyderabad and Hubballi of Karnataka state.
Total length of proposed railway lane is 260 KMs and length in Karnataka is 200 KMs. There is
reduction of 150 KMs between Sikandarabad and Hubballi.
The budget of the proposed project is revised. As per revised, the expenses for this project is
700 corers and again it has revised to 1390.42 cores and 50% of the budgeted amount will be
invest by the Karnataka state government.
As defines in RFCTLARR 2013; Section 2(1) (a-f) of the RTFCTLARRA, 2013 the following as
public purpose for land acquisition within India:
1. Acquisition of land for purposes relating to the armed forces of India, national security or
defense, police, safety of the people;
2. Acquisition of land for Railways, highways, ports, power and irrigation purposes for use by
government or by government controlled corporations (also known as public sector
companies)
3. Acquisition of land for planned development or improvement of village or urban sites for
residential purpose to weaker sections of society in rural or urban areas:
1.2 Location
Social Impact Assessment (SIA) is conducted for 183 families belongs Sultanpura-1.
Sultanpura-2, Dibbanakheda, Turukatti, Javalgera, Ramatnhal, Banniganuru, Yapalaparvi
villages of Javalgera, Valkandini, Ragalaparvi holibes of Sihdnura Taluka, district Raichu.
1.3 Size and Attributes of Land Acquisition Extent of land acquisition is 203 acres and 9 guntas. As per village wise Sultanpura-1 17.18
acres, Sultanpura-2 18.16 acres, Dibbanakheda 14.17 acres, Turukatti 25.39 acres, Javalgera
44.29 acres. Out 203 acres 9.21 acres is of Kushki, 116.15 cares is of Agriculture and 69.18 is

of Lite Tari (Agriculture). Remaning extent of 8 acres 15 gunta existing 82 strucutres such as
residential, pump hosues, agriculture ponds, cannels.
1.4 Alternative consideration.
Technical feasible alternatives considered in civil designing and also taken the consideration of
availability of government land, waste land to reduce the affect on private properties of title/non
holders. Public consultation is meeting is conducted and incorporated the inputs from the
meeting while designing. ROB and RUB is proposed in almost all the places. Wherever the
public demanded for the bridge is in the process of consideration to walk from one side to
another side.
1.5 Social Impacts
As per the impact assessment the project affect both on social and demographic. Project will be
affect positively and negatively. The families who lost their structures partially they get benefit
positively in future. Study data reviles that; 183 families affecting in 8 villages. Within the
affected families 138 male 45 females are heading the family. In case of structure 10 residential
structures, 2 grave and grave yard (partially) and small temples are proposed to be affecting.
1.6 Mitigation Measures
As per new land acquisition act compensation to land holders shall be paid according to section
31(2), 38 (1) and 105 (3) rehabilitation and resettlement schedule- 2 will be compensated. As
per schedule-3, the infrastructure shall be developed and compensated Revenue Department.
Social Impact Management Plan should include the mitigation measures and the specific
functions regards to resettlement management.
1.7 Assessment of Social costs and benefit.
The Social Impact Assessment shall provide a conclusive assessment of the balance and
distribution of the adverse social impacts and social costs and benefits of the proposed project
and land acquisition, including the mitigation measures, and provide an assessment as to
whether the benefits from the proposed project exceed the social costs and adverse social
impacts that are likely to be experienced by the affected families or even after the proposed
mitigation measures, the affected families remained at risk of being economically or socially
worse, as a result of the said land acquisition and resettlement. The acquisition of land Section
2(1) (a-f) of the RTFCTLARRA, 20132(1)b (i), vi and vii define the following as public purpose

CHAPTER - 2 Detailed Project Description
2.1 Background of the project
The proposed project is implementing by the central government and during the
study the essential of the land acquisition is also studied. Total length of the project is
165.57 KMs and possibility of reduction 150 KMs travel beteween Munirabad – Hubballi
– Goa.
Social Impact Assessment is conducted for Social Impact Assessment (SIA) is
conducted for 183 families belongs Sultanpura-1. Sultanpura-2, Dibbanakheda, Turukatti,
Javalgera, Ramatnhal, Banniganuru, Yapalaparvi villages of Javalgera, Valkandini, Ragalaparvi
holibes of Sihdnura Taluka, district Raichur.
2.2 Project Developers background
The developer southwest railway is one of in 16 zones. The central office is based in Kolkatta.
Railway department is having 16 zones spread over Karnataka. Houra, Malda, Sidlhaha,
Asansol headed by the Manager. The southwest railway has developed A-1 category railway
stations which are very popular and it will also having the production unit of Raiway vagans,
railway engine.
2.3 Public Purpose
As defines in RFCTLARR 2013; Section 2(1) (a-f) of the RTFCTLARRA, 2013 the following as
public purpose for land acquisition within India:

defense, police, safety of the people;

2.4 Preliminary Phase: It has been taken care during the detailed design of the project preparation to minimize the loss
under land acquisition. Through suitable engineering design attempts have been made to
confine the project area in the government land and in available Right of way where feasible.
This has been done with proper consultation with the local people and affected communities.
Their suggestions were taken in the project design. Measures are also followed to minimize the
resettlement like Selection of the project sites covering government land, and preferred open
land instead of habitation and building structures etc. The ROB, RUB and curve improvement.

2.6 Alternative consideration.
Technical feasible alternatives considered in civil designing and also taken the consideration of
availability of government land, waste land to reduce the affect on private properties of title/non
holders. Public consultation is meeting is conducted and incorporated the inputs from the
meeting while designing. ROB and RUB is proposed in almost all the places. Wherever the
public demanded for the bridge is in the process of consideration to walk from one side to
another side.

2.7 Type and attributes and size of the land
Extent of land acquisition is 203 acres and 9 guntas. As per village wise Sultanpura-1 17.18
acres, Sultanpura-2 18.16 acres, Dibbanakheda 14.17 acres, Turukatti 25.39 acres, Javalgera
44.29 acres. Out 203 acres 9.21 acres is of Kushki, 116.15 cares is of Agriculture and 69.18 is
of Lite Tari (Agriculture). Remaining extent of 8 acres 15 gunta existing 82 structures such as
residential, pum phosues, agriculture ponds, canals.
2.8 Factors support to basic infrastructures facilities.
The Railways have played a vital role in building the economy and improving the lives of millions
of people in the world. The Railway network holds immense potential in improving the quality of
life by reducing reliance of private transport, reducing road congestion, providing an improved
infrastructure for growth and reduced environmental impacts through careful planning. This
increases connectivity and employment aspects directly and indirectly. The accidents will
reduce when compared with road transport facilities available. This joint venture of Karnataka
government and Railway will help the demand of people in the area and reduces length 150 km.
which will be economical factor for implementing agencies and people of Karnataka state. The
acquisition will start after SIA and SIMP is implemented and notification 11(1) will be issued for
land acquisition.
2.9 Linkages with line department: The forest, agriculture, horticulture, PWD,
grampanchayath, taluka panchayath, municipality zillapanchayath are contacted for valuation
and payment of compensation as per land acquisition Act 2013

2.11 Details of the Project
The proposed railway lane length is 16.5 KMs in Sindhanur block and having 3 railway stations.
So, the social impact assessment is conducted in Sindhanur block covered 183 project affected
families in 8 villages.
2.12 Description of District and Taluka
Raichur one of the district present in Karnataka state. This based in northeast and it is
surrounded by the Krishna River at North side and Tungabhadra in Western side. As per 2011
census population is 19,24,773. The sex ratio is 922 females per 1000 males and literacy level
is 60.46. Raihcur, Devadurga, Sindhanur, Manvi and Lingasuguru are the blocks present in the
Raichur district. It‘s around 409 KMs from Bengalore capital city. Thermal power is exist in the
Shkati Nagara and Yaramasana.

For the irrigation purpose water will flow from Tungabhadra and Krishna river. With this water
the main crop is paddy. The rice will exported and cotton is also one of the commercial crop.
Social impact assessment is conducted in Sidhanur Talka.

Sindhanur is around 380 KMs from Bengalore and as mentioned in the above this one of the
block in Raichur district. The distance from Raichur is 91 KMs. In Sindhanur there are 222

2.16 Definition of SIA The positive and negative impacts and SIA will be work as mediator between social impacts and
adverse impact.
Social Impact Assessment of any Land Acquisition is mandatory before acquiring the land for
the public purpose. Chapter II of the Right to Fare Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement Act 2013 of Government of India (The Gazette of
India Extraordinary Part II Section 1, Sept 27, 2013) clearly mentions, ―Whenever the
appropriate Government intends to acquire land for a public purpose, it shall consult the
Panchayat, Municipality or Municipal Corporation, as the case may be, at village level or ward
level, in the affected area and carry out a Social Impact Assessment study in consultation with
them, in such manner and from such date as may be specified by such Government by
notification‖
―Social Impact Assessment Study report shall, amongst other matters, include all the followings:
(a) assessment as to whether the proposed acquisition serves public purpose; (b) estimation of
affected families and the number of families among them likely to be displaced; (c) extent of
lands, public and private, houses, settlements and other common properties likely to be affected
by the proposed acquisition; (d) whether the extent of land proposed for acquisition is the
absolute bare minimum extent needed for the project; and (e) whether land acquisition at an
alternate place has been considered and found not feasible; (f) study of social impacts of the
project, and the nature and cost of addressing them and the impact of these costs on the overall
costs of the project vis-a-vis the benefits of the project: Provided that Environmental Impact
Assessment Study, if any, shall be carried out simultaneously and shall not be contingent upon
the completion of the Social Impact Assessment Study‖

2.17 Legal Aspects. The majority of impacts identified during the impact assessment can be reduced to low
significance following the implementation of mitigation measures. Based on the socio economic
conditions of the PAFs and impacts this chapter has been framed. It has been recommended
that, proper compensation given in time as per Schedule 1 and 2 of Right To Fair
Compensation And Transparency In Land Acquisition, Rehabilitation And Resettlement Act,
2013 (Also Land Acquisition Act, 2013) and Right to Fair Compensation and Transparency in
Land Acquisition, Rehabilitation and Resettlement Act (Amendment) Ordinance, 2015.

3.2 Methodology of the study: Both primary and secondary data was collected for the SIA
report. Attempt has been made to review data sets already available like government project

3.4 Collection of information As desired information such as demographic details, stastical information collected from the concerned department. The secondary information collected is incorporated during the survey. The physical, social, cultural status is understood from the railway and state government departments. 3.5. Field visit and Information dissemination:
Field study is conducted in the month of December 2018. District administration took active steps in
creating the awareness among the villagers regarding the study well in advance. Following the timelines
mentioned in the act, a notification was given by the district administration. The notification provided in the
states the list of possible affected survey numbers, extent of land to be acquired and GGV will be
conducting SIA study in the affected villages. Notification in this regard had also been uploaded on
website of the Deputy Commissioner, Raichur. Also, respective village presidents and other political
representatives were informed and requested to disseminate the information in all the villages. The SIA
team along with the help of local revenue officers, gram panchayat leaders conducted community
meetings with heads of the village, youth, educated persons before beginning a survey in a village. The
primary objective of this meeting was to create awareness among villagers about the SIA survey thus
helping in smoother execution.
3.6 Census Survey
Before conducting survey the project area studied and identified the boundary stone or any marks
available to identified. After that, conducted the survey by personal interview by visiting to the PAFs
houses. During the survey it was also identified that, PAFs, PAPs, and proposed structures to be
affecting.
3.7 Social and Economic Survey
To understand social – economic condition of PAFs social economic survey is conducted.
During the study structures are also identified which are proposed to be affected. Before
conduct of the survey concern officials such as social expert, consultants, SLAOs has given an
instruction to provide the proper information. In the said survey information like social status,

family details occupation, source of income, property, affected structure information, commercial
and self employment activities, type of occupation, opinion about the project and also about
their concerns about the rehabilitation and resettlements. All questions present in the survey
tools are pre coded except the opinion about the R&R. During the data collection Ration Card,
Voter ID, Electricity bills were verified as an residential proofs.
3.8 Data collection and Authentication.
Formats collected information from the field will be verified about the complete filling of the
formats. Incase any laps in data collection will be recollected. The formats are also given to
PAFs to get confirmation and authentication.
3.9 Data Analysis and Preparation of Report.
By making necessary corrections data analysis is done to write the report.
3.10 Public and community consultation.
Public consolation meeting is conducted in identified places. The information regarding conduct
of Grama Sabha is disseminated by issuing the handouts. This could help to the survey team to
gather the information about proposed social impacts from the commercial and other stake
holders (including women) and also PAPs. In the consultation meeting matters discussed about
grievances, social safeguard, generation of employment, providing and collect the information
etc. Methods are implemented during consultation are 1) Informal discussion at identified
places, 2) Public / Gramasabhas 3) Focus group discussions 4) Personal interviews 5) Meeting
others at village level these are the basic elements of the public consultation meeting.

The survey team made an effort to collect the maximum information which is required for SIA
study.

With the help of Maps and RTCs and secondary information collected are discussed in this
chapter. Total 192 families out of which 183 families information is collected. Remaining 9
families are not available during the conduct of survey. So, data disused in the chapter is of 183
families.

Socio Economic status and to determine the socio-economic condition of PAFs house hold

and negative impacts also about the Rehabilitation Resettlement sites.

The sex ratio is prime component of Human Development Index. This data was useful to
understand the contribution of the both sex male and female. Study found that, 436 male and
391 females were present in the project affected families. Sex ratio is 897. Still to determine
gender ratio the sample is not sufficient.

6.9 Social Categories
Studied different category social communities, among them Scheduled castes(SC), Scheduled
Tribes (ST), and Other Backward Castes were there. These groups are traditionally vulnerable
however, they were availing government privileges. Excluding general category, remaining
groups were required economic empowerment and rejuvenation. Especially SC and ST
categories should be consider as weaker section and provide (implement)special privileges
which ought to provided in rehabilitation action plan. However government programs existed for
OBC that should be implemented properly. During SIA study it has found that, majority of the i.e,
general category is 36% and SC is 13% ST is 28% and other social category is discussed below
table.

6.10 Mother tongue and localities
The study found that cent percent of the people were known Kannada and they used to transact
in the language and Urdu will also being used by the Muslim community.

Family size clearly indicates family member‘s relationship, social values, economic
condition and economical burden. By analyzing this data, it found that, 69% is of joint family and
69% is nuclear family and 2% are of single person families.

6.14 Information about livestock in project affected households
Project affected households were have different livestock. They were helpful to improve
economical condition. They procured various products from them and selling those products
their economical conditions were improved. Even though, some of the families kept livestock for
own use. Majority of the families holding land that will affected by the project, if their land
comes under the project area, they will be displaced. Hence, these aspects (livestock) should
be included in rehabilitation action plan and monetary support (compensation) should be
provided.

6.18 Information about holding of electricity connection
All house hold having cent percent of the households accomplish electricity connection.
6.19 Gender discrimination- problems
Since decade‘s discussion was going on about traditionally and socially, women were
considered as weaker section. Few periodicals explored 42 percent of women were
experiencing social vulnerability. When it considering employment sector with the backup of
education women stepping towards government and private sector jobs. Even though colonial
ruling in India has created new vistas of employment for women, their productive and
reproductive work at house were excluded from traditional statistical definition in census.
Majority women were working in unorganized and informal sector. Therefore they are facing no
security for job. Limited working time, no fixed salary and also women were facing physical and
sexual harassment at workplace. After 70 s women started to working at voluntary organization
their situation remains same.
Major marginally marginalized women were there. To improve women status, mere working with
the group is not enough; women and man both should understand gender socialization and
inculcate gender sensitivity. Women inequality deep rooted in our society hence, disparity
happening against women. Collective effort required from individual and institution for bringing
gender equity. These type of effort required gender policy. Various national and international
laws upholds this issue. The gender policy has some objectives among them, creating
commitment in institution about gender equity, creating gender accepting directive indicators
and adopting in institution, providing equal opportunity for male and female at workplace,
assured equal participation for women at all spares. We being the worker for social justice we
should inculcate values of equality. Because in this project should identify matriarchal family and
priority must be given for reducing gender inequality. Along with that, provide facilities for health
and nutritional improvement. They were suffering a lot with transportation problem, if they
would depend on railway facility, several problems might be solved and it would be considered
as safe journey. The decision taking ability is discussed in the below table.

SOCIAL IMPACTS
7.1 Framework and approach to identifying the impacts
Social impacts are the continuous process to arrive conclusion for implementation of the
projects is also involves management and it is impacts on the projects. The participatory renal
appraisal plays a major role in Gramsabha .Taking people into confidence and participating
them in project activities as stake holders by providing complete information. Sharing their views
and modifying the same. The set goal for any project will arrive by addressing the outcomes of
social impact issues envisaged at pre-planning level. This will give an opportunity to identify
local level problems direct and indirect effect on over all implementation of the project and also
concentrate on Rehabilitation and Resettlement issues of the project. The socio economic
survey will support with large impacts on farmers and impacts of acquisition. During the study,
interaction with department officers, elected representatives and affected families to
comprehensively. Address the issues of the project implementation. The overall impacts are
prepared accordingly and information on compensation aspects are also covered in consultative
meetings. Identification of project effected families, interacting on acquisition and allied losses,
placing the compensation of eligibility issued with PAF‘s. The effect of residential ,Commercial ,
Residential-Commercial ,industrial land, wet land, dry land, Bagyatha land, Gomala, Gramtana
land and other assets attached to it ,along with common property issues and utilities which are
effected during implementation of Land Acquisition. Well determination of social impacts by
conducting focused group discussion joint family Khatedars and implementation of other
government schemes, Health Issues, Education Issues, Livelihood issues, economic issues and
social, cultureal impacts before and after implementation of the project.

8.4 Means of Communications Based on the land assessment, land records and field verification, the Social Impact
Assessment shall also include an accurate estimate of the number of affected families and the
number of displaced families among them and enumerate all affected families: Provided that
where enumeration is not possible at least a representative sample shall be done by the Social
Impact Assessment Unit.
A socio-economic and cultural profile of the affected area must be prepared, based on available
data and statistics, field visits and consultations as per Form-II: Provided that in projects where
resettlement is required, the identified resettlement sites shall be visited and a brief socio-
economic profile of the land and its current resident population shall be indicated.
Based on the data collected in above processes listed and in consultation with the affected
communities and key stakeholders, the Social Impact Assessment shall identify and assess the

CHAPTER - 9
LEGAL ASPECTS, ACTS AND RULES
The acts and policy relevant to the study like The Right To Fair Compensation And
Transparency In Land Acquisition, Rehabilitation And Resettlement Act, 2013 (Also Land
Acquisition Act, 2013) and Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement Act (Amendment) Ordinance, 2015 are discussed in this chapter. It is
important to understand the regulations, legalities and procedures in implementing project to
identify the gaps and provide legal frame work in which the proposed Railway project will be
implemented with respect to social issues. Hence, chapter includes the details of Acts, Policies
and amendment bills etc. and entitlement matrix.
Central government has amended land acquisition act by the Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and which came
into force from 1 January 2014.
Whereas the draft of the Right to Fair Compensation and Transparency in Land Acquisition,
Rehabilitation and Resettlement (Karnataka) Rules, 2014 was published as required by section
112 of the Right to Fair Compensation and Transparency in Land Acquisition Resettlement Act,
2013 (Central Act 30 of 2013) in Notification No. RD 152 AQB 2013, dated: 21-06-2014, in Part
IV-A of the Karnataka Gazette (Extraordinary) dated: 21 inviting objections or suggestions from
all days from the date of its publication in the official Gazette. Whereas the said Gazette was
made available to the public on 21 and whereas, objections and suggestions received above
have been consider by the State Government. Now, therefore, in exercise of the powers
conferred by section 109 of the Right to Fair Compensation.
9.1 Rehabilitation and Resettlement Measures as outlined in RFCTLARR Act, 2013
Compensation for Land Land will acquired in accordance with provisions of Right to Fair Compensation and
Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and while
determining the compensation for land, the competent authority will be guided by the provisions
of Sec 26, Sec 27, Sec 28, Sec 29 and Sec 30 of RFCTLARR Act, 2013. The compensation
includes, the multiplying factor of 1 to 2 times of higher of guideline value or average of higher
50% of sale deed rates for last 3 years or any rates consented for PPP or private projects. In
addition, 100% solatium for involuntary acquisition of land will be added. If the residual land
remaining after acquisition is unviable, the owner of such land/property will have the right to
seek acquisition of his entire contiguous holding/property.

9.2 Compensation for structures and farm assets The replacement value of houses, buildings and other immovable properties will be determined
on the basis of latest PWD Standard Schedule of Rates (SSR) as on date without depreciation
and 100% solatium will be added to the structure compensation. While considering the PWD
SSR rate, PIU will ensure that it uses the latest SSR for the residential and commercial
structures in the urban and rural areas of the region. Wherever the SSR for current financial
year is not available, the PIU will update the SSR to current prices based on approved previous
year escalations. Compensation for properties belonging to the community or common places of
worship will be provided to enable construction of the same at new places through the local self-
governing bodies like Village Panchayat/Village council in accordance with the modalities
determined by such bodies to ensure correct use of the amount of compensation. Further, all
compensation and assistance will be paid to displaced persons at least 1 month prior to
displacement or dispossession of assets.
9.3 Compensation for Trees Compensation for trees will be based on their market value. Loss of timber bearing trees will be
compensated at their replacement cost and compensation for the loss of fruit bearing trees will
be decided by the PIU in consultation with the Departments of Forest or Agriculture or
Horticulture as the case may be. In line with the provision of RFCTLARR Act 2013, 100%
solatium will be added to the assessed value of the trees. Prior to taking possession of the land
or properties, the compensation will be fully paid and displaced persons will have the
opportunity to harvest crops/trees within 1-month from the date of payment of compensation.

As per SIA standard guideline, it is important to follow the SMP strategy for the proper
implementation of the project. The Social Impact Assessment process should also include the
preparation of a Social Impact Management Plan (SIMP), after submission of SIA report SIMP
plays very active role to take it further which will present the ameliorative measures to be
undertaken to address the social impacts identified in the course of the assessment. The Social
Impact Management team assessed the viability of impact mitigation and management
strategies with clear indication of costs, timelines and capacities has been given. This team set
up by District Commissioner/Assistant Commissioner, Revenue department. Social Impact
Management Plan should include the mitigation measures and the specific functions regards to
resettlement management. Many of the aspects also elaborated in previous and following
chapters.
(a) Measures specified in the terms of Rehabilitation and Resettlement and compensation
for all the categories of affected families as outlined in the Act;
(b) Measures to be undertaken by the requiring body in the project proposal and other
relevant project documents;
(c) Measures being undertaken by the requiring body, in response to the findings of the
Social Impact Assessment process and public hearings.
(d) Overall responsibility of planning, implementation and monitoring of land acquisition and
resettlement and rehabilitation activities in the Project; and Liaison lined agencies
support for land acquisition and implementation of land acquisition and resettlement.
(e) Ensure availability of budget for R&R activities;
(f) Coordinating with line Departments, especially with the LAC.
Some of the Major guidelines to be followed as per the No. RD 152 AQB 2013,
Bangalore, Date 17 Oct 2015.
9.4 Grievance Redressal Committee
There is already GRC is existing in all the department. Efficient grievance redressed
mechanism should be developed to assist the PAFs to resolve their queries and complaints.
Grievances of PAPs should be first brought to the attention of SMU. Grievances not redressed
by SMU should be brought to the Grievance Redressal Committee (GRC). The GRC should
address only resettlement issues. Grievances related to ownership rights and land
compensation can be dealt in court as per LAA. The main responsibilities of the GRC are to:
(i) Provide support to PAPs on problems arising from land/property acquisition;

(ii) Record PAPs grievances, categorize, and prioritize grievances and resolve them;
(iii) Immediately inform the SMU of serious cases; and Report to PAPs on developments
regarding their grievances and decisions of the GRC. Other than disputes relating to
ownership rights under the court of law and compensation, GRC should review grievances
involving all resettlement benefits. When any grievance is brought to the field level staff, it
should be resolved within three months from the date of complaint. The GRC should meet
every month (if grievances are brought to the Committee), determine the merit of each
grievance, and resolve grievances within three months of receiving the complaint—failing
which the grievance can be referred to appropriate court of Law for redressal by the PAP.
Records should be kept of all grievances received including: contact details of complaint,
date the complaint was received, nature of grievance, agreed corrective actions and the
date these were effected, and final outcome.
9.5 Monitoring and evaluation
Internal monitoring and external monitoring and evaluation mechanisms have been suggested.
Internal monitoring shall be taken up by the respective SIMP unit and PIU at the Department
concerned. The monitoring and progress reports shall be generated though MIS system. This is
systematically undertaken by the department concern. Revenue department and Railway
department will be taking care of the same. The external evaluation activities shall be carried
out through an independent Impact Evaluation Agency.
9.6 Implementation of the project
The implementation of the project will be planned as per overall implementation schedule of the
project. As a first step, all the affected families (both PAFs and PDFs) shall be paid 100%
compensation after a proper evaluation by the technical team as mentioned in RTFCTLARRA,
2013. The compensation should be paid before the commencement of civil works i.e. during
pre-construction phase. Monitoring & evaluation and grievance redresal shall be carried
throughout the life cycle of the project. The SIMP has three broad phases of implementation i)
Preparation of a detailed plan ii) Implementation phase iii) Monitoring and Evaluation. Following
format could be used for implementation of the project.

CHAPTER - 10
SOCIAL IMPACT MITIGATION PLAN (SIMP)
10.1 Introduction:
1. The Social Impact Assessment team shall collect and analyze a range of quantitative and qualitative land data, undertake detailed site visits, use participatory methods such as focused group discussions, participatory rural appraisal techniques and informant interviews in preparing the Social Impact Assessment report.
2. All relevant project reports and feasibility studies shall be made available to the Social Impact
Assessment team throughout the Social Impact Assessment process, as required. Any request for information from Social Impact Assessment team shall be met at the earliest but not exceeding seven days. The Deputy Commissioner or any authorized officer shall as far as possible furnish the information requested by the Social Impact Assessment team.
(3) A detailed assessment based on a thorough analysis of all relevant land records and
data, field verification, review and comparison with similar projects shall be conducted by the Social Impact Assessment team. The assessment shall determine the following, namely:-
a) total area of impact under the proposed project, including both land to be acquired
and areas that will be affected by environmental, social or other impacts of the project;
(b) Quantity and location of land proposed to be acquired for the project;
(c) The bare minimum required land proposed for acquisition;
(d) Possible alternative sites or location for the project and feasibility;
(e) Whether, the land proposed for acquisition in Scheduled Area is a demonstrable last
resort.
f) Land, if any, already purchased, alienated, leased or acquired. And the intended use
for each plot of land required for the project;
(g) The possibility of use of any public, unutilized land for the project and whether any of
such land is under occupation;
(H) Nature of the land, present use and classification of land and if it is an agricultural
land, the irrigation coverage for the said land and the cropping pattern;
(I) whether special provisions with respect to food security have been adhered to in the
proposed land acquisition;
(j) Size of holdings, ownership patterns, land distribution, number of residential houses
(Public and private) infrastructure available or to be provided in the proposed land and
assets; and

(k) Land price and recent changes in ownership, transfer and use of lands over the last
three years.
(4) Based on the land assessment, land records and field verification, the Social Impact
Assessment shall also include an accurate estimate of the number of affected families
and the number of displaced families among them and enumerate all affected families:
Provided that where enumeration is not possible at least a representative sample shall
be done by the Social Impact Assessment Unit.
(5) A socio-economic and cultural profile of the affected area must be prepared, based
on available data and statistics, field visits and consultations as per Form-II: Provided
that in projects where resettlement is required, the identified resettlement sites shall be
visited and a brief socio-economic profile of the land and its current resident population
shall be indicated.
(1) Based on the data collected in above processes listed and in consultation with the affected
communities and key stakeholders, the Social Impact Assessment shall identify and assess the
nature, extent and intensity of the positive and negative social impacts associated with the
proposed project and land acquisition as per Form-II.
(2) The Social Impact Assessment process shall also include the preparation of a Social Impact
Management Plan (SIMP), which will present the ameliorative measures to be undertaken to
address the social impacts identified in the course of the assessment. The Social Impact
Assessment team must assess the viability of impact mitigation and management strategies with
clear indication of costs, timelines and capacities. The Social Impact Management Plan shall
include the following measures, namely;
(a) Measures specified in the terms of Rehabilitation and Resettlement and compensation
for all the categories of affected families as outlined in the Act;
(b) Measures to be undertaken by the requiring body in the project proposal and other
relevant project documents; and
(c) Measures being undertaken by the requiring body, in response to the findings of the
Social Impact Assessment process and public hearings.
(8) The Social Impact Assessment shall provide a conclusive assessment of the balance
and distribution of the adverse social impacts and social costs and benefits of the proposed
project and land acquisition, including the mitigation measures, and provide an assessment

social impacts that are likely to be experienced by the affected families or even after the
proposed mitigation measures, the affected families remained at risk of being economically
or socially worse, as a result of the said land acquisition and resettlement.
10.2 Description of project:

10.3 The Preliminary Notification issued under sub-section
(1) of section 11shall be published in the affected areas by way of affixing written notice to the
effect on the Gram panchayat office and office of the village Accountant.
(2) After issuing the notice under sub-section (1) of section 11, the Deputy Commissioner shall
undertake and complete the exercise of updating land records within a period of two months as
specified hereunder
(a) Delete the names of dead persons
(b) Enter the names of legal heirs of the deceased persons
(c) Take effect of the registered transactions of the rights in lands
(d) Update all entries of the mortgage in the land records
(e) Make necessary entries in respect of all prevalent forest laws
(f) Make necessary entries in respect of assets like well, tree
(g) Make necessary entries of crops grown and their area
(h) Make entries in case of Government land
(i) Any other updating that is required.
(3) The authorized officer shall conduct preliminary survey of the land proposed for acquisition
and shall have all powers to carry out such survey in accordance with provisions of the Act.
(4) The Deputy Commissioner or the authorized officer shall after hearing objections and
making enquiry as provided under section 15(2) of the Act, shall submit his report along with his
recommendations to State Government whose decision will be final.

10.20 Conclusion and Recommendation
It was found that there are no adverse social impacts and costs associated with project.
Majority of the PAFs are cooperative for implementation of the project. The measures
suggested in the RFCTLARR Act and Social Impact Management Plan will address all the
possible impacts.
The cost of implementing the measures in comparison with the project cost is very less
hence; it is recommended that this project can be implemented. This will also bring long term
revenue to the state government and overall development of the project area.
Income restoration and mitigation of adverse impact can be meeting through benefits of
Rehabilitation Resettlement of LARR act 2013.
Project expenditure can be meeting as per the LARR act. 2013
Project affected financial assistance and compensation shall be paid as per the LARR act
schedule I and II.
Project shall be implementing as per the LARR act. 2013. A person in the affected family can avail certificate from concern Tahasilar and avail the
entitlements from the government. Any facilities available to physically challenged population shall made available or to connect.

Draft Social Impact Assessment Report is prepared on 23.01.2019 for Sultanpura -1,
Sultanpura -2, Dibbanakheda, Turukatti, Jalavalgera of of Javalgera Hobli and Ramatnal of
Vakkaldinni hobli of Sindhanur block, Dist Raichur on 23.01.2019. The said SIA report is
prepared as per Right Fair Compensation and Transferancy in Land Acquisition,
Rehabilitation and Resettlement Karnataka rules 2015. The SIA study is conducted by the
GGV Education and Rural Development Society and GGV Enterprises, Tumakuru. Meeting
conducted with the witness of officials of the GGV, public representatives, villagers, PAFs,
SLAOs and surveyors
