The information you provide

i. ACE fully accepts its responsibility toprotect the privacy of customers and theconfidentiality and security of informationentrusted to ACE.

ii. The information You provided when Youtook out Your Policy, together with otherinformation You provide at any later date,will be used by ACE and its groupcompanies to help them meet Your needsincluding supplying You with productsand services You have requested, initiallyor at any later date, supplying You withinformation about additional products andservices and improving their products andservices, and the operations of the WebSite. ACE may disclose Your informationto their service providers and agents forthese purposes as well as any agents Youhave appointed to act on Your behalf. Forthese purposes ACE may, if necessarytransfer Your information Abroad tocountries which do not have the samelevel of data protection as Ireland. If ACEdoes make such a transfer, ACE will takereasonable steps to ensure that Yourinformation is protected.

iii. The information You provided to us isprocessed by us to confirm Your identity,process Your application or request and torecord and cross reference particulars inthe event of claim in insurance industrydatabases for fraud prevention purposes.In certain cases, this may involve thesharing of Your information with otherinsurance providers, third parties toprocess and administer Your claim,

process Your payments or privateinvestigators. Guidelines for sharing ofinformation in this regard are contained ina Code of Practice on Data Protection forthe Insurance Sector which has beenapproved by the Data ProtectionCommissioner.

iv. Where You have provided informationabout another person in connection withthe purchase and performance of thisinsurance Policy You confirm that theyhave appointed You to act for them, thatthey have consented to the processing oftheir personal data, including sensitivepersonal data and they have consented tothe transfer of their information Abroad.You also agree to receive on their behalfany data protection notices from ACE.

ACE may:i. If You have given ACE permission, contact

You by mail, telephone or e-mail to letYou know about any goods services orpromotions that may be of interest to Youand/or share Your information withorganisations that are ACE’s businesspartners.

You have the right to withdraw Yourconsent at any time and have Your detailsremoved from future marketingprogrammes. It will help ACE if Youprovide Your full name, postal address,and insurance Policy. Please allow 40 daysif You wish to have Your name removedfrom marketing programs for Your requestto become effective.

ii. Monitor and/or record Yourcommunication with them either itself orby reputable organisations selected byACE, to ensure consistent servicing levelsand account operation.

a) It may be necessary for You to provideadditional information includingsensitive personal data, for exampledetails relating to Your health, in orderthat ACE can assess and pay anyClaims.

b) ACE may only obtain this informationor ask third parties such asindependent medical examiners toobtain this information with Yourexpress prior consent. By submitting aClaim You are expressly consenting toACE obtaining and using suchinformation to enable ACE to assessand pay such Claim.

c) ACE will not disclose any Claimsdetails to any other third party withoutwritten permission from thePolicyholder and/or claimant.

d) ACE will keep information about Youonly for so long as it is appropriate.

e) In accordance with Your SubjectAccess rights, if You ask, ACE will tellYou what information ACE holdsabout You and provide it to You inaccordance with applicable law. Anyinformation which is found to beincorrect will be corrected promptly.

1.1 Definitions

The following words and phrases will alwayshave the same special meaning whereverthey appear in the Policy in bold type andstarting with a capital letter. AdditionalDefinitions appear in Sections 6, 7, 8 and 12.

AbroadOutside Ireland.

AccidentA sudden identifiable violent external eventthat happens by chance and which could notbe expected; or unavoidable exposure tosevere weather conditions.

ACE; ACE’sACE European Group Limited; of or pertainingto ACE European Group Limited.

ACE Assistancea) The telephone advice, information and

counselling services; and orb) The travel assistance and emergency

medical and repatriation services,arranged by ACE.

Cancellation CostsCosts for unused travel and/oraccommodation (including ski hire, ski schooland ski lift passes if Winter Sports are shownas covered on the Policy Schedule) which aPerson Insured has paid or is contracted topay and which cannot be recovered from anyother source.

Child, ChildrenYour offspring and the offspring of YourPartner, extending to include a step child orchildren and a legally adopted child orchildren, each of whom must be:a) Under 18 years old (or under 23 years old

if still in full-time education) on the dateYou purchase cover; and

b) Dependent on You or Your Partner evenif he or she does not live with either ofYou; and

c) Unmarried or living with a Partner.

Claim(s)Single loss or a series of losses Due To onecause covered by this Policy.

Curtailment Costs1. A proportion of the costs for unused

travel and/or accommodation (includingski hire, ski school and ski lift passes ifWinter Sports are shown as covered onthe Policy Schedule) which a PersonInsured has paid or is contracted to payand which cannot be recovered from anyother source. The amount paid will becalculated on a pro-rata basis for thenumber of days between the date aPerson Insured returns home, and his orher original planned return date.

2. Reasonable additional travel andaccommodation costs necessarilyincurred in returning an Insured Personhome provided that:a) Such travel is of a standard no greater

than the class of transport on theoutbound journey; and

b) The standard of accommodation isnot superior to that of the Holiday.

Doctor A doctor or specialist, registered or licenced topractise medicine under the laws of thecountry in which they practise who is neither:a) A Person Insured; orb) A relative of a Person Insuredunless approved by ACE.

Due ToDirectly or indirectly caused by, arising orresulting from, in connection with.

EuropeAndorra, Austria, Belarus, Belgium, Bosnia-Herzegovina, Bulgaria, Canary Islands, Croatia,Czech Republic, Denmark, Estonia, Finland,France, Germany, Greece, Hungary, Iceland,Ireland (annual cover only) Italy, Latvia,Liechtenstein, Lithuania, Luxembourg,Macedonia, Madeira, Mediterranean Islands(including Majorca, Menorca, Ibiza; Corsica;Sardinia; Sicily; Malta, Gozo; Crete, Rhodesand other Greek Islands; Northern andSouthern Cyprus), Moldova, Monaco,Morocco, Netherlands, Norway, Poland,Portugal, Romania, Russian Federation (Westof Urals), Serbia and Montenegro, Slovakia,Slovenia, Spain, Sweden, Switzerland, Tunisia,Turkey, Ukraine, and United Kingdom, Isle ofMan, the Channel Islands.

Albania, although in Europe, is excluded fromthis definition. If a Person Insured wishes tovisit Albania or is likely to travel outside thecountries specified they need ACE’sWorldwide cover.

ExcessThe first €90 of any Claim which each PersonInsured must pay except for a) A loss of deposit only Claim when the

Excess is the first €10 of any Claim; or b) A Claim for medical and additional

expenses in European Union countrieswhen there is no Excess where areduction is obtained using a EuropeanHealth Insurance Card.

HijackThe unlawful seizure or taking control of anaircraft or other means of transport in which aPerson Insured is travelling as a passenger.

HijackersThe perpetrators of a Hijack.

Holiday, HolidaysTrip(s) devoted entirely to pleasure, rest, orrelaxation, where travel begins and ends inIreland.

Immediate FamilyYour Partner or fiancé(e) or the grandchild,Child (including fostered and adoptedchildren), brother, sister, parent, grandparent,grandchild, step-brother, step-sister, step-parent, parent-in-law, son-in-law, daughter-in-law, sister-in-law, brother-in-law, aunt, uncle,nephew, niece of You or Your Partner, oranyone noted as next of kin on any legaldocument, all of whom must be resident inIreland.

Ireland; IrishThe island of Ireland and its islands exceptNorthern Ireland; of or pertaining to Ireland.

OSGOSG Travel Claims, Merrion Hall, Strand Road,Sandymount, Dublin 4.

Parent or Legal GuardianA person with parental responsibility, or a legalguardian, both being in accordance with Irishlaw.

Partnera) Your spouse; orb) Your civil partner registered pursuant to

the Civil Partnership and Certain Rightsand Obligations of Cohabitants Act 2010;or

c) Your cohabiting partner (as defined in theCivil Partnership and Certain Rights andObligations of Cohabitants Act 2010) i.e.an adult of the same or opposite sex whohas lived with You in an intimaterelationship for five years, or for two yearswhere there is a child or children of therelationship; or

d) Someone of either sex with whom youhave been living for at least three monthsas though they were your spouse or civilpartner.

Period of InsuranceFor annual multi-trip cover:The period of cover between and inclusive ofthe dates shown as Effective From: and To: onthe Policy Schedule commencing at 00.01 orany later time the Policy Schedule is issued onthe earlier date shown and finishing at 24.00on the later date shown.

For single trip cover:The period of cover commencing at 00.01 orany later time the Policy Schedule is issuedand ending either when You arrive at Yourreturn destination in Ireland, or at the end ofthe trip duration shown on Your PolicySchedule, whichever is sooner. Dates refer toLocal Standard Time at Your address as shownin the Policy Schedule.

Person(s) InsuredYou, Your Partner and Children if they areshown as insured on the Policy Schedule.

Public ConveyanceAn air land or water vehicle operated underlicence for the transportation of fare-payingpassengers.

Rearrangement CostsReasonable travel and accommodation costsnecessarily incurred in rearranging a Holidayprovided that:a) No claim has been made or will be made

for Cancellation Costs or CurtailmentCosts

b) Travel is of a standard no greater than theclass of transport originally booked; and

c) The standard of accommodation is notsuperior to that originally booked

d) The total amount payable will not exceedthe cost of the original Holiday

e) The rearranged Holiday must be bookedand fully paid no later than 6 months afterthe date of commencement of the originalHoliday.

Specially Designated ListMeans names of a person, entities, groups,corporate specified on a list who are subjectto as trade or economic sanctions or othersuch similar laws or regulations of the UnitedStates of America , United Nations, EuropeanUnion or United Kingdom.

Total Underlying LimitThe maximum policy limit in respect ofmedical expenses Abroad under a PersonInsured’s Private Medical Insurance.

Travelling CompanionsFriends, associates or companionsaccompanying You on a Holiday.

WarArmed conflict between nations, invasion, actof foreign enemy, civil war, military or usurpedpower.

Winter SportsSkiing (including skiing outside the area of thenormal compacted snow or ski slope, i.e. off-piste), tobogganing, snow boarding and iceskating (other than on an indoor rink) butexcluding competitive winter sports (including,but not limited to, ski or ski bob racing, monoskiing, ski jumping, ski boarding, ice hockey orthe use of bobsleighs or skeletons).

You; Your The Policyholder shown in the PolicySchedule; of or pertaining to the Policyholdershown in the Policy Schedule.

1.2 Holidays Covered

The type of Policy You have chosen, single tripor annual multi-trip, is shown on the PolicySchedule.

A. Single trip PolicyA single trip Policy covers a HolidayAbroad or in Ireland, during the Period of Insurance. Winter Sports cover isincluded if shown as covered on the PolicySchedule.

B. Annual multi-trip PolicyAn annual multi-trip Policy covers allHolidays during the Period of Insuranceprovided they meet the followingconditions:i. No individual Holiday Abroad

continues for more than 30consecutive days; and

ii. No more than 90 days in total arespent on Holidays Abroad in anyPeriod of Insurance; and

iii. Each Holiday in Ireland includes atleast 2 nights spent inaccommodation that is booked beforethe Holiday begins.

Up to 21 days Winter Sports cover isincluded in any Period of Insurance, ifshown as covered on the Policy Schedule.

1.3 Persons Insured

There is no cover under the Policy unless all ofthe following conditions are met:

a) Each Person Insured must be:i. A resident of Ireland

Resident in Ireland for a minimum of180 days per calendar year

ii. Under 75Aged under 75 years on the date Youpurchase cover, and

b) Children travelling without You or YourPartner will only be insured under afamily annual multi-trip Policy, and thenonly if they are travelling:i. In the company of an adult (i.e.

someone not defined as a Childunder this Policy) You or Your Partnerknow (other than on an organisedschool, college or university trip); or

ii. As an unaccompanied minor on ascheduled air service which operatesan unaccompanied minor scheme,and then only if they are travellingwith the intention of joining, or beingsubsequently joined by, another adultinsured under this Policy.

1.4 When cover operates for aHoliday

a) Insurance cover for Cancellation underPart III Section 1 – Cancellation,Curtailment and Rearrangement beginswhen a Holiday is booked, if this Policy isin force at the time of booking, or whenYou purchase this Policy.

b) Insurance under all other Sectionsoperates for a Holiday that takes placeduring the Period of Insurance andincludes travel directly to and from thehome of each Person Insured providedthe return home is completed within 24hours of:i) Return to Ireland; orii) Departure from pre-booked

accommodation following a Holidaywithin Ireland which is covered underan annual multi-trip Policy.

c) If the return of a Person Insured from aHoliday is unavoidably delayed Due To aClaim, he or she will continue to beinsured without any additional premiumfor the period of the delay.

d) If there is a change to this Policy it willbegin on the Effective From date shownon the subsequent Policy Schedule that isissued to record the change in cover.

1.5 Claims Conditions

ACE has the right to refuse to pay any Claimif:a) At the time You applied for this Policy, you

were unable to make the statements weasked you to make, and which appear inYour Policy Schedule under the Sectionentitled “Your declaration to us”; or

b) The Claim is Due to any reason specifiedas not being covered in Your PolicySchedule under the Section entitled “Yourdeclaration to us”.

1.6 Making a Claim

We do not recommend you sendfinancial or personal sensitive details via emailas it may not be secure whilst in the publicdomain.

CLAIM FORMS: You can print off and use aclaim form from SuperValu's Web Site atwww.SuperValutravelinsurance.ie

Reporting Lost or Stolen PropertyType of lost or stolen propertya) Money, Valuables or Personal Property

You must notify the local Police within 24hours of discovery and provide ACE with acopy of their written report.

b) Travellers’ chequesYou must notify the local branch or agentof the issuing company.

c) Any property lost or stolen from a hotelYou must notify the hotel management(in addition to the local Police).

1.7 Annual Declaration

Prior to each Anniversary Date, ACE willrequest You to confirm Your agreement to aset of statements similar to those confirmedby You when You applied for this insurance. IfYou are unable to confirm these statementsYou must contact ACE. If You do not, this mayaffect Your cover or Your entitlement to Claimunder this Policy.

PART II

ACE Assistance

i. Medical Emergency and Referral and ii. Personal Assistance Services

i. Medical Emergency and ReferralServicesACE Assistance will provide a PersonInsured with the following services, in anemergency, when he or she is on HolidayAbroad.

a) Medical ReferralProvision of the names and addressesof local Doctors, hospitals, clinics anddentists when consultation ortreatment is required, arrangementsfor a Doctor to call, and, if necessary,for a Person Insured to be admittedto hospital.

b) RepatriationIf the Doctor appointed by ACEAssistance believes treatment inIreland is preferable, transfer will bearranged by regular scheduledtransport services, or by air or roadambulance services if more urgenttreatment and/or specialist care isrequired during the Holiday.

c) Payment of BillsIf a Person Insured is admitted tohospital Abroad, the hospital orattending Doctor will be contactedand payment of their fees up to thepolicy limit will be guaranteed so thatthe Person Insured does not have tomake the payment form their ownfunds.

d) Drug Replacement Assistance with the following:i. Replacement of lost drugs or

other essential medication; orii. Lost or broken prescription

glasses or contact lenses, whichare unobtainable Abroad

iii. Sourcing and delivery ofcompatible blood supplies

ACE Assistance will not pay for thereplacement costs of any item or thecosts of sourcing and delivering bloodsupplies.

e) Transmission of Urgent MessagesTo relatives or business associates.

f) Unsupervised ChildrenI. Organisation of an accompanying

Child’s return home, with asuitable escort when necessary, if the Child is left unsupervisedbecause You or Your Partner (ifshown as insured on the PolicySchedule) are hospitalised orincapacitated

II. Medical advice and monitoring,until You or Your Partner returnhome, if a Child who has beenleft in Ireland becomes ill orsuffers injury.

ii. Personal Assistance ServicesACE Assistance will provide a PersonInsured with the following services, in anemergency, when he or she is on HolidayAbroad.

The Person Insured will be responsiblefor paying fees and charges for non-insured facilitation services provided e.g.

the Person Insured will be responsiblefor paying a translator for his or herservices but they will not be charged byACE Assistance for locating thetranslation service.

a) Transfer of Emergency FundsTransfer of emergency funds up to€250 per trip if access to normalfinancial/ banking arrangements is notavailable locally.

In order to reimburse ACE Assistancethe Person Insured must authoriseACE Assistance to debit his or hercredit or charge card with the amountof the transfer, or make alternativearrangements to deposit the funds inACE Assistance’s account in theUnited Kingdom.

If the emergency transfer isnecessitated by theft or loss ofpersonal money, a Claim may bemade under the Policy.

b) Message RelayTransmission of urgent messages torelatives or business associates ifmedical or travel problems disrupt aHoliday travel schedule.

c) Tracing Personal PropertyTracing and re-delivery of PersonalProperty that has been lost ormisdirected in transit if the Carrier hasfailed to resolve the problem.

(PLEASE NOTE: the Person Insuredmust have their Personal Propertytag number available.)

d) Replacement Travel DocumentsAssistance with the replacement oflost or stolen tickets and traveldocuments, and referral to suitabletravel offices. ACE Assistance will notpay for any item.

e) Lost Credit CardsGiving advice on how to contact theappropriate Card Issuers if credit orcharge cards are lost or stolen. DataProtection legislation prevents ACEAssistance from contacting the CardIssuers directly.

f) Emergency Translation Facility Translation service if the local providerof an assistance service does notspeak English.

g) Legal HelpReferral to a local English-speakingLawyer, Embassy or Consulate if legaladvice is needed, and arrangement ofpayment of reasonable emergencylegal expenses or bail, against aguarantee of repayment.

CONDITIONPrompt advice and assistanceWhilst ACE Assistance will make every effortto ensure advice or assistance is providedpromptly and in good faith it cannot acceptliability for loss or damage of any kind thatmay arise or result from the use, or intendeduse, of the ACE Assistance/MedicalReferral/Personal Assistance services.

SECTION 1. Cancellation,Curtailment or Rearrangement(Maximum payable €3,000 per PersonInsured)

A. CoverACE will pay either Cancellation, orCurtailment or Rearrangement Costs up to€3,000 if it becomes necessary to cancel,curtail or rearrange a Holiday Due To:i. the death, serious injury, sudden illness,

complications in pregnancy (as diagnosedby a doctor or specialist in obstetrics) ofYou or or Your Immediate Family

ii. the compulsory quarantine, on the ordersof a treating Doctor, of Persons Insured orTravelling Companions provided thatsuch cancellation, curtailment orrearrangement is confirmed as medicallynecessary by a Doctor

iii. a Public Conveyance being cancelled orcurtailed because of adverse weather,industrial action, or mechanicalbreakdown or derangement

iii. the compulsory quarantine, jury service orsubpoena of a Person Insured orhijacking of the conveyance in which he orshe is travelling

iv. unemployment of a Person Insuredwhich qualifies for payment under anyapplicable statute

v. serious damage making a PersonInsured’s home uninhabitable; or

vi. the presence of a Person Insured beingrequired by the Police following a burglaryor attempted burglary at his or her home.

illnessii) Or a sudden deterioration in

health.NOTE: This exclusion applies toimmediate family even if they are notinsured on the policy.

iii. If a strike or industrial action is publicknowledge when this Policy is taken outor a Holiday is booked

iv. If an aircraft, sea vessel or train iswithdrawn from service on the orders ofthe recognised regulatory authority in anycountry

v. If a Person Insured is called as an expertwitness or if his or her occupation wouldnormally require a Court attendance

vi. If a Person Insured was unemployed orknew they might become unemployed atthe time a booking was made

vii. If any other adverse financial situationnecessitates cancellation, curtailment orrearrangement of a Holiday

viii. The Excessix. Any loss, charge or expense Due To:

a) A delay in notifying the tour operator,travel agent, or transport oraccommodation provider that it isnecessary to cancel a booking

b) Disinclination to go on a Holiday; orc) Prohibitive regulations by any

government or public authority of anycountry

x. A charge or expense paid for or to bedischarged with any kind of promotionalvoucher

xi. If You, or any other Person Insured, wereaware of any reason, either at the time aHoliday was booked or at the time Youpurchased this Policy, why that Holidaymight have to be cancelled

xii. If a trip is cancelled as the result ofregulations made by any government orpublic authority.

SECTION 2. Travel Delay(Maximum payable €150/€3,000 per PersonInsured)

A. CoverIf a Person Insured is delayed for at least 12hours on the outbound or return journeybecause the scheduled departure of a PublicConveyance is affected by a strike, industrialaction, adverse weather, mechanicalbreakdown/derangement, or grounding of anaircraft due to mechanical or structural defect,ACE will pay:i. A €20 benefit for the first full 12 hours

delay and a €10 benefit for eachsubsequent full 12 hours delay up to amaximum benefit of €150; or

ii. Up to €3,000 for Cancellation,Curtailment or Rearrangement Costs if aHoliday is abandoned after a delay of atleast 24 hours of the scheduled departurefrom Ireland.

B. Exclusions (General Exclusions apply as well)

ACE will not payi. The Excess if a Holiday is abandoned;ii. If a Person Insured does not:

a) Check-in before the scheduleddeparture time shown on his or hertravel itinerary; or

b) Provide ACE with written details fromthe airline, shipping company, coachor train operators describing thelength of, and reason for, the delay

iii. If an aircraft, sea vessel, coach or train istaken out of service on the instructions ofa Civil Aviation Authority, Port Authority orsimilar authority

iv. If a strike or industrial action could bereasonably expected when a Holiday isbooked

v. A charge or expense paid for or to bedischarged with any kind of promotionalvoucher.

SECTION 3. Missed Departure(Maximum payable €500 per PersonInsured)

Cover under this Section applies only toHolidays Abroad.

A. CoverACE will pay up to €500 for necessary andreasonable accommodation and travelexpenses to enable a Person Insured to reachhis or her scheduled destination if he or shearrives too late at the airport, sea port, coachor train station to commence a bookedjourney from or to Ireland Due To:i. The car he or she is using for travel

breaking down or being involved in anaccident; or

ii. The Public Conveyance he or she is usingfor travel failing to arrive on schedule.

B. Exclusions (General Exclusions apply as well)

ACE will not pay:i. Accommodation and travel expenses

where the means of transport and/oraccommodation used is of a standardsuperior to that of the booked journey orHoliday

ii. If the Person Insured does not provideoriginal written:a) Evidence from a motoring

organisation or garage that the carused for travel is roadworthy andproperly maintained; or

b) Details from the operators of publictransport used for travel of the lengthof, and reason for, the delay

iii. The Excessiv. If the Person Insured has not allowed

sufficient time for the journeyv. For a missed departure caused by strike or

industrial action that could be reasonablyexpected when the Holiday was booked.

SECTION 4. Personal Accident(Maximum payable €30,000 per PersonInsured)

DEFINITIONSThe following words and phrases will have thesame special meaning in this Sectionwherever they appear in bold italic type andcommence with a capital letter. AdditionalDefinitions appear in specific Sections andGeneral Definitions apply as well.

Bodily InjuryPhysical injury that is caused by an Accidentand within 24 months directly results in death,Loss of Sight, Loss of Limb or PermanentTotal Disability.

Loss of LimbAmputation or total and permanent loss ofuse of one or more hands at or above thewrist or of one or more feet above the ankle(talo-tibial joint).

Loss of Sighti) In both eyes when the Person Insured’s

name has been added to the NCBIregister of Blind Persons on the authorityof a qualified ophthalmic specialist

ii) In one eye when the degree of sightremaining after correction is 3/60 or lesson the Snellen Scale (which means thePerson Insured is only able to see at 3feet that which they should normally beable to see at 60 feet) and ACE is satisfiedthat the condition is permanent andwithout expectation of recovery.)

Permanent Total DisabilityA disability which has lasted for at least 12months from which ACE believe the PersonInsured will never recover and which stopsthe Person Insured from carrying out gainfulemployment for which that Person Insured isfitted by way of training, education orexperience.

CoverIf a Person Insured is injured or becomes ill(including becoming ill Due To complicationsin pregnancy (as diagnosed by a doctor orspecialist in obstetrics) provided that iftravelling within 12 weeks of the expecteddate of delivery they provide a medicalcertificate issued by a doctor or midwifeconfirming the number of weeks of pregnancyand that their are fit to travel to their HolidayAbroad. The certificate must be dated noearlier than 5 days before the outbound traveldate) during a Holiday Abroad,

ACE will pay:i. For medical (excluding dental),

repatriation or travel expenses he or sheincurs, within 12 months of incurring thefirst expense including optical expenses

ii. Dental expenses he or she receives for therelief of pain only

Medical expenses must be for necessaryhospital, surgical or other diagnostictreatment, given or prescribed by a Doctor,and include charges for staying in ahospital or nursing home.

Repatriation must be:a) Authorized by ACE Assistance;b) Necessary on medical grounds; andc) To Ireland.

iii. Costs for additional travel and hotelexpenses including those for any oneother person if a Person Insured has to beaccompanied on medical advice or a Childneeds to be escorted home

iv. If a Person Insured dies, up to €10,000:a) For cremation or burial charges in the

country in which he or she died; orb) To transport his or her body or ashes

back to Ireland.

B. Exclusions(General Exclusions apply as well)

ACE will not pay:i. Any amount recovered under a reciprocal

health agreement with any countryii. For any treatment not confirmed as

medically necessaryiii. Any expenses incurred in the Person

Insured’s country of residenceiv. Any additional travelling expenses not

authorised by ACE Assistance if a PersonInsured has to return home earlier thanplanned or be repatriated from a Holiday

v. For medical treatment that a PersonInsured travelled Abroad to obtain

vi. For medication a Person Insured is takingbefore and which he or she will have tocontinue taking during a Holiday

vii. For surgery, medical, dental or preventativetreatment which can be delayed in theopinion of the Doctor treating a PersonInsured until he or she returns to Ireland

viii. For dental expenses other than for therelief of pain only

ix. Any additional costs for single or privateroom accommodation

x. Any expenses incurred due to a tropicaldisease where the Person Insured has nothad the vaccinations or taken themedication appropriate and customary forthe country being visited, unless they havewritten confirmation from a Doctor thatthey should not be vaccinated or take themedicine on medical grounds

xi. Additional travel and hotel expensesincurred which have not been authorizedin advance by ACE Assistance

xii. Cremation or burial Costs in Irelandxiii. The Excess, except where the Person

Insured has obtained a reduction in thecost of medical expenses in EuropeanUnion countries by using a EuropeanHealth Insurance Card.

NOTE: All original receipts must be kept andprovided to support a Claim.

SECTION 6. Hospital Benefit(Maximum benefit €400 per Person Insured)

A. CoverIf a Person Insured is a hospital in-patientduring a Holiday and has a Claim under his orher Private Medical Insurance or Part IIISection 5 MEDICAL AND ADDITIONALEXPENSES, ACE will pay a benefit of €20 foreach full 24 hours he or she spends in hospitalup to a maximum of €400 for each Holiday.

SECTION 7. Personal Property(Maximum payable per Person Insured -Personal Property €1,500; Mobility Aids€500, Essential purchases €200, Mobility Aidhire €500, Essential medication courier costs€300).

Mobility Aid/Mobility AidsAny crutch, walking stick, walking frame,wheeled walking frame, walking trolley,evacuation chair, wheelchair, poweredwheelchair or mobility scooter constructedspecifically to aid persons suffering fromrestricted mobility but excluding any golfbuggy or golf trolley or any item covered underPersonal Property.

Personal PropertyAny suitcase, trunk or container of a similarkind and its contents, and any article worn orcarried by a Person Insured which is not aMobility Aid not excluded under B. Exclusions.

Repair and Replacement CostsThe cost of repairing partially damagedproperty, or, if property is totally lost ordestroyed or uneconomical to repair, the costof replacing property as new less a deductionfor wear, tear or depreciation.

NOTE: ACE will pay a reasonable proportion ofthe total value of a set or pair to repair orreplace an item that is part of a set or pair.

Valuables Cameras and other photographic equipment,telescopes and binoculars, Audio/Videoequipment, (including radios, cassette/compact disc players, Ipods, mp3 and mp4players, camcorders, DVD, video, televisionsand other similar music and video players,mobile phones, satellite navigation equipment,computers and computer equipment,(including PDA’s, personal organizers, laptops,Ipads, notebooks, netbooks and the like),computer games equipment (includingconsoles, games and peripherals), jewellery,watches, furs, precious and semi-preciousstones and articles made of or containing gold,silver or other precious metals.

A. Coveri. If Personal Property is lost, damaged or

stolen during a Holiday, ACE will payRepair and Replacement Costs up to€1,500 and /or

ii. If any Mobility Aid owned by the PersonInsured or for which they are responsible,necessarily taken by the Person Insuredon Holiday or hired by or loaned to thePerson Insured whilst on Holiday, is lost,damaged or stolen during such HolidayACE will pay up to €500

iii. ACE will also reimburse:a) The cost of essential items of clothing

and toiletries up to €200 that aPerson Insured has to purchasebecause Personal Property is lost ormisplaced for at least 12 hours by anairline or other Carrier

b) Reasonable and necessary costs up to€500, incurred by:i) A Person Insured during a

Holiday, in hiring, Mobility Aids;and/or

ii) ACE Assistance in courieringMobility Aids to the Person

Person Insured on Holiday andwhich have: • Been misplaced for at least

12 hours by an airline orother Carrier

• Otherwise lost or damagedduring the Holiday

ii. Following discovery by the PersonInsured that they accidentallyomitted to take them on Holiday.

i. ACE will not pay a) The Excessb) More than €250 for a single item,

pair or set, or part of a pair or setc) more than €250 for golf clubs, bags

and accessoriesd) More than €250 for Valuables in total

and will only pay if the Valuables areattended by a Person Insured or arein a safety deposit box at the timethey are lost, damaged or stolen

e) For any items stolen from anunattended vehicle unless they werein the locked boot of the vehicle or inthe luggage space at the rear of alocked estate car or hatchback undera top cover and out of view, and there

is evidence of forced entryf) Unless a loss or theft is reported to

the Police (and the hotelmanagement if the loss or theftoccurs in a hotel) within 24 hours ofdiscovery and ACE is provided with acopy of the original written Policereport and report to the hotelmanagement as applicable

g) For loss, theft or damage to: i) Personal Property more

specifically insured or recoverableunder any other insurance policy

ii) Personal Property leftunattended in a public place

iii) Personal Property stolen froman unattended vehicle unless theywere in the locked boot of thevehicle or in the luggage space atthe rear of a locked estate car orhatchback under a top cover andout of view, and there is evidenceof forced entry

iv) Personal Property in the custodyof an airline or other Carrierunless the loss or damage isreported in writing to the airlineor other Carrier within 24 hoursof discovery and ACE is providedwith a copy of the original writtenairline or Carrier report

v) Personal Property Due Toleaking powder or fluid carriedwithin the Person Insured’sluggage

vi) Household goods, samples ormerchandise, bonds, securities ordocuments of any kind; or

vii) Dentures, hearing aids,prescription glasses, sunglasses ,prescription sunglasses contact orcorneal lenses (except asdescribed in A iii c)

viii) Antiques, musical instruments,pictures, typewriters, portabletelephones, any computerequipment not defined under

Valuables (including but notlimited to PDAs, personalorganisers, laptops and electronicnavigation equipment),televisions, sports equipmentwhilst being used (except forWinter Sports equipment ifWinter Sports cover is shown ascovered on the Policy Schedule),vehicles or their accessories,watercraft and ancillaryequipment, glass, china or similarfragile items and pedal cycles

ix) Any mobility scooter caused bytheft or attempted theft ormalicious persons, whilst leftunattended unless, it has beenlocked in a secure room or, anykey required to operate themobility scooter has beenremoved and any manufacturerssecurity devices employed or, it isotherwise secured fromunauthorised removal

x) Mobility scooter tyres and/oraccessories unless the Mobilityscooter is damaged at the sametime

xi) Hired Mobility Aids unless theircondition has been inspectedprior to hire and any defectsnoted

h) For depreciation in value, normalwear and tear, denting or scratching,damage by moth or vermin, electrical,electronic or mechanicalderangement, or damage due toatmospheric or climatic conditions

i) For delay, detention, seizure orconfiscation by customs or otherofficials.

ii. ACE will not pay any Claim wherea) Personal Property, Mobility Aids

essential medication, dentures,hearing aids, prescription glasses,contact or corneal lenses have been

lost or misplaced by an airline orother Carrier unless ACE is providedwith original written confirmationfrom such airline or other carrier orthe tour representative that weredelayed for at least 12 hours after thePerson Insured arrived at his or herdestination

b) Mobility Aids have been lost ordamaged unless such loss or damageis insured under Cover ii of thissection and the Person Insured hascomplied fully with the relevant termsand conditions of cover

c) Personal Property, Mobility Aids,essential medication, dentures,hearing aids, prescription glasses,contact or corneal lenses, have beenlost or misplaced on a journeyreturning a Person Insured toIreland.

MoneyCoins, banknotes, traveller’s cheques, postalor money orders, travel tickets, pre-paidvouchers and non-refundable pre paid entrytickets.

Credit CardCredit, charge, cheque, bankers or cashdispenser card.

A. CoverACE will pay i. Up to €500 if Money which is held by a

Person Insured for his or her personaluse is lost or stolen during a Holidaywhilst a) Being carried by a Person Insured; orb) Left in a safety deposit boxor

ii. up to €500 if a Person Insured sustainsfinancial loss directly as a result of aCredit Card, being lost or stolen during aHoliday and subsequently being usedfraudulently by any person other than:a) A member of the Person Insured’s

family; orb) The Person Insured’s employer

where the card is issued on thePerson Insured’s behalf

- provided that the Person Insured hasfully complied with all the terms andconditions under which such Credit Cardhas been issued.

B. Exclusions (General Exclusions apply as well)

ACE will not pay:i. The Excess;ii. More than €50 if the carrier is under 16

years oldiii. For delay, detention, seizure or

confiscation by customs or other officialsiv. Unless a loss or theft is reported to the

Police (and the hotel management if theloss or theft occurs in a hotel) within 24hours of discovery and ACE is providedwith a copy of the original written Policereport and report to the hotelmanagement as applicable

v. For traveller’s cheques: a) Unless the loss or theft is reported

immediately to the local branch oragent of the issuing company; or

b) If the issuing company provides areplacement service

vi. For depreciation in value or shortage dueto any error or omission

vii. For loss of a Credit Card unless thePerson Insured complies with theconditions of the issuing company.

SECTION 9. Loss of Passport/ Driving Licence Expenses(Maximum benefit €500 per Person Insured)

A. CoverACE will pay up to €500 to cover:i. The cost of obtaining any temporary

replacement travel documents required toenable a Person Insured to return toIreland, including any additional traveland accommodation costs incurred by oron behalf of the Person Insured during aHoliday; and

ii. The replacement passport or drivinglicence fee payable

following the loss or theft of his or her originaldocuments during a Holiday.

B. Exclusions(General Exclusions apply as well)

ACE will not pay:i. For delay, detention, seizure or

confiscation by customs or other officialsii. Unless a loss or theft is reported to the

Police (and the hotel management if theloss or theft occurs in a hotel) within 24hours of discovery and ACE is providedwith a copy of the original written Policereport and report to the hotelmanagement as applicable

iii. For a passport or driving licence stolenfrom an unattended vehicle unless it wasin the locked boot of the vehicle or in theluggage space at the rear of a lockedestate car or hatchback under a top coverand out of view, and there is evidence offorced entry.

SECTION 10. Hijack(Maximum benefit €500 per Person Insured)

Cover under this Section applies only toHolidays Abroad

A. CoverIf a Person Insured is held hostage byHijackers during a Holiday, ACE will pay abenefit of €50 for each full 24 hours he or sheis held hostage up to a maximum benefit of€500 for each Holiday.

B. Exclusions(See General Exclusions)

SECTION 11. Personal Liability(Limit of Liability €2,500,000 per PersonInsured)

See Part II for services provided by ACEAssistance which are relevant to this Section.

A. CoverACE will indemnify a Person Insured againstall sums which he or she is legally liable to payas damages in respect of: i. Accidental bodily injury (including death

illness or disease) to any personii. Accidental loss of or damage to material

propertywhich occurs during the Period of Insurancearising out of the Holiday.

The maximum that ACE will pay under thisSection for all damages as a result of any oneoccurrence or series of occurrences arisingdirectly or indirectly from one source ororiginal cause shall be €2,500,000 (hereaftercalled the Limit of Liability).

ACE will in addition pay Costs and Expenses.

Costs and Expenses shall mean:i. All costs and expenses recoverable by a

claimant from a Person Insuredii. All costs and expenses incurred with the

written consent of ACEiii. Solicitors’ fees for representation at any

coroner’s inquest or fatal accident inquiryor in any Court of Summary Jurisdiction

in respect of any occurrence to which thisSection applies - except that in respect ofoccurrences happening in or claims or legalproceedings brought or originating in theUnited States of America and Canada or anyother territory within the jurisdiction of eithersuch country, Costs and Expenses describedin i., ii. and iii. above are deemed to beincluded in the Limit of Liability.

B. Exclusions(General Exclusions apply as well)

ACE will not provide indemnity for anyliability:i. In respect of bodily injury to any person

who is: a. Under a contract of service with a

Person Insured when such injuryarises out of and in the course of theiremployment by the Person Insured

b. A member of the Person Insured’sfamily

ii. In respect of loss of or damage toproperty in the care custody or control ofa Person Insured. However this Exclusionshall not apply in respect of loss of ordamage to buildings and their contentsnot belonging to but temporarilyoccupied by a Person Insured in thecourse of the Holiday

iii. Liability in respect of bodily injury loss ordamage caused directly or indirectly inconnection with ownership, possession ofor use by the Person Insured of:

a. Mechanically propelled vehicles(otherthan golf buggies used on golf courseand not on public roads); or

b. Aircraft, hovercraft or watercraft (otherthan manually propelled watercraftless than 30 feet in length used oninland waters)

c. Firearms (other than sporting guns)iv. Liability in respect of bodily injury loss or

damage caused directly or indirectly inconnection with:a. The ownership, possession or use of

land or building other than anybuilding temporarily occupied by aPerson Insured in the course of aHoliday; or

b. Any wilful or malicious act; or c. The carrying on of any trade business

or professiond. Activities or volunteer work organised

by, or under the auspices of, acharitable, voluntary, not for profit,social or similar organisation whenliability for such activities or workshould reasonably be included withinthe organisation's own Public Liabilitypolicy.

v. Any liability assumed by the PersonInsured under any contract or agreementunless such liability would have attachedin the absence of such contract oragreement

vi. Punitive or exemplary damages

C. Conditions applying to this Sectioni. No admission, offer, promise or indemnity

shall be made without the consent of ACEwhich shall be entitled to take over andconduct in the Person Insured’s namethe defence or settlement of any claim orto prosecute in the Person Insured’sname for its own benefit any claim forindemnity or damages or otherwise andshall have full discretion in the conduct ofany proceedings and in the settlement of

any claim and the Person Insured shallgive all information and assistance as ACEmay require. Every letter, claim, writ,summons and process shall be forwardedto ACE on receipt. Written notice shall begiven to ACE immediately the PersonInsured shall have notice of anyprosecution or inquest in connection withany circumstances which may give rise toliability under this Section

ii. ACE may at any time pay to the PersonInsured in connection with any claim orseries of claims the Limit of Liability forthis Section (after deduction of anysum(s) already paid as compensation) orany lesser amount for which suchclaim(s) can be settled and upon suchpayment being made ACE shall relinquishthe conduct and control of and be underno further liability in connection withsuch claim(s) except for the payment ofcosts and expenses recoverable orincurred prior to the date of suchpayment

iii. The Person Insured shall as though theywere the Insured observe, fulfil and besubject to the terms, Exclusions andProvisions of this Section.

SECTION 12. Overseas LegalAdvice & Expenses(Maximum payable €30,000 per PersonInsured)

See Part II for services provided by ACEAssistance which are relevant to this Section.

Cover under this Section applies only toHolidays Abroad.

DEFINITIONSThe following words and phrases will havethe same special meaning in this Sectionwherever they appear in bold italic type andcommence with a capital letter. AdditionalDefinitions appear in specific Sections andGeneral Definitions apply as well.

Legal Expensesi. Fees, expenses, costs/expenses of expert

witnesses and other disbursementsreasonably incurred by the LegalRepresentatives in pursuing a claim orlegal proceedings for damages and/orcompensation against a third party whohas caused accidental bodily injury to orillness of a Person Insured or inappealing or resisting an appeal againstthe judgment of a court, tribunal orarbitrator

ii. Costs for which a Person Insured islegally liable following an award of costsby any Court or tribunal or an out ofCourt settlement made in connectionwith any claim or legal proceedings.

Legal RepresentativesThe solicitor, firm of solicitors, lawyer,advocate or other appropriately qualifiedperson firm or company appointed to act onbehalf of the Person Insured.

Any One ClaimAll claims or legal proceedings including anyappeal against judgment consequent uponthe same original cause, event orcircumstance.

A. CoverIf during a Holiday a Person Insured sustainsbodily injury or illness which is caused by athird party ACE will pay up to a benefitamount of €30,000 to cover Legal Expensesarising out of Any One Claim.

B. Exclusions (General Exclusions apply as well)

In respect of each Claim under this insuranceACE will not pay for:i. Any Claim reported to ACE more than 24

months after the beginning of the incidentwhich led to the Claim

ii. Any Claim where it is ACE’s opinion thatthe prospects for success in achieving areasonable settlement are insufficientand/or where the laws, practices and/orfinancial regulations of the country inwhich the incident occurred wouldpreclude the obtaining of a satisfactorysettlement or the costs of doing so wouldbe disproportionate to the value of theClaim

iii. Legal Expenses incurred before receivingACE’s prior authorisation in writing unlesssuch costs would have been incurredsubsequent to ACE’s authorisation

iv. Legal Expenses incurred in connectionwith any criminal or wilful act

v. Legal Expenses incurred in the defenceagainst any civil claim or legal proceedingsmade or brought against the PersonInsured unless as a counter claim

vi. Fines, penalties compensation or damagesimposed by a court or other authority

vii. Legal Expenses incurred for any claim orlegal proceedings brought against:

a) A tour operator, travel agent, carrier,insurer or their agents where thesubject matter of the claim or legalproceedings is eligible forconsideration under an ArbitrationScheme or Complaint Procedure;

b) ACE or their agents; orc) the Person Insured’s employer

viii. Actions between Persons Insured orpursued in order to obtain satisfaction of ajudgement or legally binding decision

ix. Legal Expenses incurred in pursuing anyclaim for compensation (either individuallyor as a member of a group or class action)against the manufacturer, distributor orsupplier of any drug, medication ormedicine

x. Legal Expenses chargeable by the LegalRepresentatives under contingency feearrangements

xi. Legal Expenses incurred where a PersonInsured has:a) Failed to co-operate fully with and

ensure that ACE is fully informed at alltimes in connection with any claim orlegal proceedings for damages and orcompensation from a third party; or

b) Settled or withdrawn a Claim inconnection with any claim or legalproceedings for damages and orcompensation from a third partywithout the agreement of ACE. In suchcircumstances ACE shall be entitled towithdraw cover immediately and torecover any fees or expenses paid

xii. Legal Expenses incurred after a PersonInsured has not:a) Accepted an offer from a third party to

settle a claim or legal proceedingswhere the offer is consideredreasonable by ACE; or

b) Accepted an offer from ACE to settle aClaim

xiii. Legal Expenses which ACE considersunreasonable or excessive orunreasonably incurred.

C. Special Conditions applicable to thissectioni. Legal Representatives must be qualified

to practise in the Courts of the countrywhere the event giving rise to the Claimoccurred or where the proposed defendantunder this Section is resident

ii. The Person Insured has the right to selectand appoint a Legal Representative oftheir choice to represent them in any legalinquiry or legal proceedings (provided anyappointment of a Legal Representative isnot on a contingency fee basis, where theLegal Representative charges a proportionof the amount recovered as a fee). ThePerson Insured shall provide ACE withdetails of the selected LegalRepresentative’s name and address. ACEmay provide information about LegalRepresentatives in their local area if thePerson Insured asks ACE to do so

iii. The Legal Representatives and the PersonInsured must co-operate fully with andensure that ACE is fully informed at alltimes in connection with any claim or legalproceedings for damages and orcompensation from a third party. ACE isentitled to obtain from the LegalRepresentatives any information,document or advice relating to a claim orlegal proceedings under this Insurance. Onrequest the Person Insured will give to theLegal Representatives any instructionsnecessary to ensure such access

iv. ACE’s authorisation to incur LegalExpenses will be given if a Person Insuredcan satisfy ACE that:a. There are reasonable grounds for

pursuing or defending the claim or legalproceedings and the Legal Expenseswill be proportionate to the value of theclaim or legal proceedings; and

b. It is reasonable for Legal Expenses tobe provided in a particular case. Thedecision to grant authorisation will takeinto account the opinion of the Legal

Representatives as well as that ofACE’s own advisers. If there is adispute, ACE may request, at thePerson Insured’s expense, an opinionof a barrister as to the merits of theclaim or legal proceedings. If the Claimis admitted, a Person Insured’s costs inobtaining this opinion will be coveredby this Insurance

v. Any dispute between the Person Insuredand ACE (about ACE’s liability over a claimor the amount to be paid, where theamount of the claim is €5,000 or more)must be referred (within 12 months of thedispute arising) to an arbitrator appointedjointly by the Person Insured and ACE. Ifthe Person Insured and ACE cannot agreeon an arbitrator, the President of the LawSociety of Ireland will decide on thearbitrator and the decision of that arbitratorwill be final. ACE may not refer the disputeto arbitration without the Person Insured’sconsent where the amount of the claim isless than €5,000. If the Person Insureddoes not refer such a dispute to arbitration(in the case of a claim for €5,000 or more)or to the Irish courts (in the case of a claimfor less than €5,000 or where You haveagreed with us, after the dispute betweenthe Person Insured and ACE has arisen,that the claim will be dealt with byarbitration), within 12 months, ACE willtreat the claim as abandoned

vi. ACE may at its discretion assume control atany time of any claim or legal proceedingsin the name of the Person Insured fordamages and or compensation from a thirdparty

vii. All Claims within this section must besubmitted to ACE in writing within 90 days

viii. Any Legal Expenses incurred without thewritten agreement of ACE shall entitle ACEto withdraw cover immediately and torecover any fees or expenses paid to thePerson Insured

ix. ACE may at its discretion require the

Person Insured to obtain at the expenseof the Person Insured an opinion of abarrister agreed by the Person Insuredand ACE as to whether or not there arereasonable grounds for continuing topursue or defend any claim or legalproceedings. ACE will pay such expenseif the opinion indicates that there arereasonable grounds for pursuing ordefending the claim or legal proceedings

x. ACE may at its discretion offer to settle acounter-claim against the Person Insuredwhich it considers to be reasonableinstead of continuing any claim or legalproceedings for damages and/orcompensation by a third party

xi. The Person Insured shall be responsiblefor the repayment to ACE of all sums paidby ACE in respect of the Legal Expenseswhere: a. An award of costs is made in favour

of the Person Insured in the claim orlegal proceedings; or

b. Costs are agreed to be paid to thePerson Insured as part of anysettlement of the claim or legalproceedings

xii. If a conflict of interest arises, where ACEare also the insurers of the third party orproposed defendant to the claim or legalproceedings, the Person Insured has theright to select and appoint other LegalRepresentatives in accordance withProvision 2 of this Section

xiii. If the Legal Representatives refuse tocontinue acting for a Person Insured withgood reason or if a Person Insureddismisses the Legal Representativeswithout good reason the cover ACEprovides will end at once, unless ACEagrees to appoint other LegalRepresentatives.

SECTION 13. Pet Care(Maximum payable €150 per PersonInsured)

Cover under this Section does not apply to aHoliday in Ireland.

A. CoverIf a Person Insured is injured or becomes illduring a Holiday Abroad, and is:i. Delayed from returning to Ireland as a

direct result of their being a hospital in-patient during a Holiday

ii. Is repatriated to Ireland and directlyadmitted to hospital as an in-patient andhas a valid Claim under Part III Section 7MEDICAL AND ADDITIONAL EXPENSES,for such Medical or Repatriation costs,ACE will reimburse the Person Insuredfor pet care fees incurred up to amaximum of €150 for each Holiday.

B. Exclusions (General Exclusions apply as well)

ACE will not pay pet care fees for time spentby a Person Insured in an institution notrecognised as a hospital in the country oftreatment.

SECTION 14. Winter SportsTHIS SECTION IS OPTIONAL; IT APPLIESONLY IF IT IS SHOWN AS INSURED ON THEPOLICY SCHEDULE AND THE ADDITIONALPREMIUM HAS BEEN PAID. (SEE GENERALEXCLUSIONS - WINTER SPORTS).

A. CoverACE will pay:i. Up to €20 for each full 24 hour period,

limited to €200 where it is necessary for aPerson Insured to hire Winter Sportsequipment for Winter Sports that is: a) Lost or broken in an Accident; orb) Lost or misplaced by an airline or

other Carrier on the outward journeyfrom Ireland and delayed for at least12 hours after the arrival of thePerson Insured at his or herdestination

ii. Up to €75 for each full week, or aproportionate amount for shorter orlonger periods, limited to €300 to coverthe value of an unused ski pass belongingto a Person Insured, and hire or tuitionfees which a Person Insured cannotrecover following:a) An Accident or illnessb) Loss or theft of his or her ski pass

iii. €20 for each full 24 hour period, limitedto €200 if a Person Insured is unable toski because there is a lack of snow in thepre-booked resort and no alternativeskiing available

iv. Up to €100 for additional and necessarytravel and accommodation costs if aPerson Insured’s outward or returnjourney is delayed by an avalanche formore than 12 hours from the scheduleddeparture time on his or her travel ticket.

B. Exclusions (General Exclusions apply as well)

ACE will not pay:i. For delay, detention, seizure or

confiscation by customs or other officialsof winter sports equipment

ii. Unless a loss or theft is reported to thePolice (and the hotel management if theloss or theft occurs in a hotel) within 24hours of discovery and ACE is providedwith a copy of the original written Policereport and report to the hotelmanagement as applicable

iii. If a Claim is paid under Part III Sections 2or 3

iv. If a Claim is Due To participation incompetitive winter sports including, butnot limited to, ski or ski bob racing, monoskiing, ski jumping, ski boarding, icehockey, or the use of bobsleighs orskeletons.

4.1 General Exclusions(Exclusions that apply to the whole Policy)

ACE will not be liable to make any paymentunder this Policy where any event that wouldotherwise be insured is Due To

i. Air travel/sportsa) Participation in aerial pursuits or

sports including but not limited to:ballooning, bungee-jumping, gliding,hang-gliding, microlighting,parachuting, paragliding orparascending; and

b) Air travel, unless the Person Insured istravelling as a fare-paying passenger ina fixed wing aircraft which is providedby a licensed airline or air chartercompany.

ii. BusinessBusiness of any description that isundertaken on a Holiday.

iii. Currency Currency exchange.

iv. Hazardous activitiesParticipation in or training for:mountaineering requiring the use of ropesor guides; potholing; any organisedsporting holiday or trip; travelling on amotorcycle over 125cc; competitive wintersports including, but not limited to ski orski bob racing, mono skiing, ski jumping,ski boarding, ice hockey, or the use ofbobsleighs or skeletons; racing of any kind(except for racing on foot); scuba diving todepths in excess of 30 metres; and speedor endurance tests.

v. Illegal actsAny illegal act of a Person Insured.

vi. Misuse of alcohol/drugsa) Misuse of alcohol or solvents by a

Person Insuredb) Drugs ingested by a Person Insured

except for drugs which are properlyprescribed; and

c) The Person Insured driving a vehicleof any kind whilst the alcohol level inhis or her blood exceeds the legal limitof the country where he or she isdriving.

vii. Psychological conditionsPost traumatic stress disorder or a relatedsyndrome or any psychological orpsychiatric condition diagnosed before aHoliday begins.

viii. Radiation a) Ionising radiation or contamination by

radioactivity from any nuclear fuel orfrom any nuclear waste resulting fromthe combustion of nuclear fuel; or

b) The radioactive, toxic, explosive orother hazardous properties of anyexplosive nuclear assembly or nuclearcomponent of such assembly.

ix. Sanction CountryThis Policy does not cover, and theCompany will not in any event be liable topay any claims arising directly or indirectlyfrom, caused by, a consequence of, arisingin connection with or contributed to byany of the following:• Any loss or expenses with respect to

Cuba or a specially designated person,

entity, group or company on theSpecially Designated List or which ifreimbursed or paid by the Companywould result in the Company being inbreach of trade or economic sanctionsor other such similar laws orregulations

• Arising out of or relating to any travelto, from or in Cuba or any travel whichstarts, ends or has a scheduled stop inCuba

• Arising out of or relating to any PersonInsured whose main residence is inCuba; and/ or

• Which would result in the Companybeing in breach of United Nationsresolutions or trade or economicsanctions or other laws of theEuropean Union, United Kingdom,Ireland or United States of America.

x. Sonic wavesPressure waves from aircraft and otherairborne devices travelling at sonic orsupersonic speeds.

xi. Specified diseasesa) Infection with Human Immune

Deficiency Virus (HIV) or other formsof the virus, Acquired ImmuneDeficiency Syndrome (AIDS) and AIDS-Related Complex (ARC); or

b) Sexually transmitted disease.

xii. Suicide/self-injury a) Suicide, attempted suicide or

deliberate self-inflicted injury by thePerson Insured regardless of the stateof their mental health; or

b) Needless self-exposure to dangerexcept in an attempt to save humanlife.

xiii. WarWar or any act of War whether War isdeclared or not.

xiv. Winter SportsWinter Sports unless the WINTER SPORTSSection is shown as covered on the PolicySchedule; any competitive winter sports,including but not limited to, ski or ski bobracing, mono skiing, ski jumping, skiboarding, ice hockey, or the use ofbobsleighs or skeletons.

4.2 General Conditions(Conditions that apply to the whole Policy)

i. ContractThis Policy, the Policy Schedule and anyinformation provided in Your applicationwill be read together as one contract.

ii. Legal Interpretation and LanguageCurrent legislation allows the parties tothis contract to choose which law is usedto interpret this Policy. You and ACE agreethat:i. This Policy will be governed and

interpreted in accordance with theLaw of Ireland and only the IrishCourts will have jurisdiction in anydispute; and

ii. Communication, of and in connectionwith this Policy, shall be in the Englishlanguage.

iii. Observing Policy Terms & ConditionsACE will not be liable to make anypayment under this Policy if a PersonInsured or his or her personalrepresentative(s) do not observe and fulfilits Terms, Exclusions and Conditions.

iv. Your duty to avoid or minimise a ClaimYou and each Person Insured must takeordinary and reasonable care to safeguardagainst loss, damage, Accident, injury orillness as though You were not insured. IfACE believes You or any Person Insuredhave not taken reasonable care ofproperty, the Claim may not be paid. Theitems insured under this Policy must bemaintained in good condition and kept ingood repair.

v. InterestACE will not pay interest on any benefitpayable under this Policy unless paymenthas been unreasonably delayed by ACE

following receipt of all the requiredcertificates, information and evidencenecessary to support the Claim.

vi. Other taxesACE is required to notify you that othertaxes or costs may exist which are notimposed by us.

vii. Stamp DutyThe appropriate Stamp Duty has been orwill be paid to the RevenueCommissioners in accordance with theprovisions of the Finance Act 1950 asamended.

viii. Moneys payable in IrelandAll moneys which become due andpayable by ACE under this policy shallbeing accordance with Section 93 of theInsurance Act 1936, payable and paid inIreland.

4.3 Claims Provisions

i. A Person Insured must:a) Notify SuperValu travel claims

immediatelyE-mail [email protected] immediately ordownload a claim form from this WebSite (www.supervalutravelinsurance.ie)and send it to SuperValu travel claimsas soon as possible and within 30days of becoming aware of anythinglikely to result in a Claim. A personalrepresentative can do this if thePerson Insured cannot

b) Authorise ACE to take over Authorise ACE and/or ACE’s agentsand affiliates to take over the handlingof any medical Claim, includingpermitting and requiring ACE and/or

ACE’s agents and affiliates to haveaccess to all relevant medical records,if a Claim is to be made under thisPolicy

c) Supply details & documents Supply at his or her own expense anyinformation, evidence and receiptsACE requires including medicalcertificates signed by a Doctor, Policereports and other reports

d) Protect propertyTake all reasonable steps to protectany item or property from further lossor damage and to recover any lost orstolen article

e) Send ACE summons, writs etcSend ACE any original writ, summons,legal process or other correspondencereceived in connection with a Claimimmediately it is received and withoutanswering it.

ii. A Person Insured must not do thefollowing without ACE’s writtenagreement:a. Admit liability

Admit liability, or offer or promise tomake any payment; or

b. Dispose of itemsSell or otherwise dispose of any itemor property for which a Claim is beingmade, or abandon any item orproperty to ACE.

iii. Each Person Insured must recogniseACE’s right to:a) Pay, repair or replace

Choose either to pay the amount of aClaim (less any Excess and up to anyPolicy limit) or repair, replace or

reinstate any item or property that isdamaged, lost or stolen

b) Inspect & dispose of itemsInspect and take possession of anyitem or property for which a Claim isbeing made and handle any salvage ina reasonable manner

c) Handle a Claim in Your nameTake over and deal with the defence orsettlement of any Claim in his or hername and keep any amount recovered

d) Pay in euroSettle all Claims in euro

e) Be reimbursed promptlyBe reimbursed within 30 days for anycosts or expenses that are not insuredunder this Policy, which ACE pays to aPerson Insured, or on his or herbehalf

f) Receive medical certificatesBe supplied at the expense of thePerson Insured with appropriateoriginal medical certificates beforepaying a Claim under the MedicalExpenses, Hospital BenefitCancellation, Curtailment orRearrangement and Personal AccidentSections in part III

g) Carry out medical examinationsRequest and carry out a medicalexamination and insist on a post-mortem examination, if the law allowsACE to ask for one, at ACE’s expense

h) Repatriate you when appropriateAt ACE’s sole discretion to repatriate aPerson Insured provided there is nomedical advice to the contrary.

iv. ACE will not be liable to pay a Claim andmay cancel the Policy immediately ineither of the following circumstances:a) Dishonesty

If a Claim is in any way dishonest; or

b) Fraud If a Person Insured or anyone actingon his or her behalf, uses fraudulentmeans to benefit under this Policy.

PAYING CLAIMSDeathi) If the Person Insured is 18 years or over,

ACE will pay the Claim to the estate of thedeceased Person Insured and the receiptgiven to ACE by the personalrepresentatives shall be a full discharge ofall liability by ACE in respect of the Claim

ii) If the Person Insured is a minor, ACE willpay the Claim to You if they are a Partner.If the minor is not a Partner ACE shallmake the payment to their Parent orLegal Guardian. The Partner, Parent orLegal Guardian’s receipt shall be a fulldischarge of all liability by ACE in respectof the Claim.

All other Claimsi) If the Person Insured is 18 years or over,

ACE will pay the Claim to the PersonInsured and their receipt shall be a fulldischarge of all liability by ACE in respectof the Claim

ii) If the Person Insured is a minor ACE willpay the Claim to that minor if they are aPartner. If the minor is not a Partner ACEshall make the payment to their Parent orLegal Guardian for the benefit of thatminor. The Partner, Parent or LegalGuardian’s receipt shall be a full dischargeof all liability by ACE in respect of theClaim.

4.4 Ending or changing Yourcover

i. 14 day cancellation optionIf You are not satisfied with this policy andhave not taken a Holiday or made a claimon a Holiday protected by the coverprovided, You may return it to ACE within14 days and ACE will cancel it. If thishappens, the Policy will have provided nocover and ACE will refund any premiumsYou have paid.

ii. Cancellation after 14 days, annual multi-trip Policies onlyIf You write and tell ACE to cancel anannual multi-trip Policy, ACE will cancel itfrom the date Your letter is received or anylater date You stipulate. ACE reserves theright to charge you a premiumproportionate to the cover that has beenin force up to the date of yourcancellation, and a reasonableadministration charge for any costsincurred.

iii. Cancellation after 14 days, single tripPolicies onlyIf You write and tell ACE to cancel a singletrip Policy, ACE will cancel it from the dateYour letter is received. ACE will provide apro-rata refund for any single trip policiescancelled prior to the commencement ofthe journey. ACE do not provide any returnpremiums for a journey that hascommenced.

iv. Changing Your PolicyYou must e-mail or write to ACE if eitherYour insurance needs or any of theinformation You have given ACE changes.A change in circumstances may affect Yourcover, even if You do not think a change issignificant, and ACE may need to changethis Policy. ACE will update the Policy andissue a new Policy Schedule each time achange is agreed.

v. if ACE wants to cancel or change YourPolicya) ACE reserves the right to make

changes or add to these policy terms;for legal regulatory or taxation reasons;and/or to reflect new industryguidance and codes of practice

b) If ACE wants to cancel Your policy ormake any changes other than thoseabove, ACE will write to You at thelatest address ACE has for You. ACEwill then cancel or change the policy30 days after the date of the letter

c) If ACE cancels the policy ACE willrefund any premium You paid for thecancelled period provided You havenot made a claim under the Policyduring the current Period ofInsurance.

4.5 Automatic ending of cover

A. Single trip PoliciesCover will end when the Period ofInsurance ends unless a Claimunavoidably delays the return of a PersonInsured from a Holiday, when cover willcontinue without any additional premiumfor the period of the delay.

B. Annual multi-trip Policiesa) Automatic ending of cover:

i. Your cover will end on the firstdate Your premium is due afterYour 75th birthday

ii. Your Partner’s cover will end onthe first date premium is due aftertheir 75th birthday or earlier ifYour cover ends beforehand

iii. Cover for Children will end on thefirst date premium is due aftertheir 18th birthday (or 23rdbirthday if still in full-timeeducation) or earlier if:• Your cover ends beforehand;

or • They get married; or • They start living with a

Partner; or• They stop being dependent

b) If a Holiday continues beyond theexpiry of this Policy or a Holiday hasbeen booked which begins after theexpiry date of this Policy You mustselect a new Policy if You wish coverto continue. If You do not select a newPolicy, the remaining period of theHoliday or any future Holiday whichhas been booked will not be coveredafter the expiry date of this Policy.
