KASHMIR: Police have not been

able to trace panchayat member

Nisar Ahmad Bhat who went

missing from Shopian in south

Kashmir on August 19.

Meanwhile, in an audio mes-

sage, terrorists have claimed to

have killed Bhat, police said. A

senior police officer said that

according to Bhat’s family, he

had gone to Shopian on Wednes-

day. “He has been missing since.

He (Bhat) was booked under

PSA in 1995. There are 12 FIR

against him and efforts are on to

trace him,” the officer said.

The officer also said that the

audio clip seems fake. “We are

investigating every aspect of

this case.” The 2.56-minute mes-

sage, purportedly released by

terrorists, claimed that Bhat

had been killed and buried.

He maintained that the tweets

put out by him were in good faith

In the written arguments sub-

mitted separately by Bhushan’s

counsel, senior advocate Rajeev

Dhavan, reliance was placed on

attorney general (AG) KK Venu-

gopal’s opinions regarding cor-

ruption and nepotism in the judi-

ciary. The AG , during the hear-

ing of the matter on August 20,

asked the apex court not to pun-

ish Bhushan while highlighting

that he himself made a speech in

1987 pointing out certain ills pla-

guing the judiciary.

“Contemnor’s (Bhushan)

comments were opinion made in

good faith founded on true facts.

Similar opinions were made

before (in 1987) by the Attorney

General. On this basis, the Attor-

ney General has counselled

against punishment,” Bhushan

said in his written submissions.

The court found Bhushan

guilty of the offence of criminal

contempt on August 14. Accord-

ing to the Contempt of Courts

Act, the offence carries a punish-

ment of up to six months in

prison or a fine up to ~2,000 or

both.

Bhushan posted two tweets,

one against the Supreme Court

on June 27 and another against

CJI Bobde on June 29.

Bhushan’s first tweet said:

“When historians in the future

look back at the last six years to

see how democracy has been

destroyed in India even without

a formal Emergency, they will

particularly mark the role of the

SC in this destruction, and more

particularly the role of the last

four CJIs.”

The second referred to CJI

Bobde and said: “The CJI rides a

~50-lakh motorcycle belonging

to a BJP [Bharatiya Janata

Party] leader at Raj Bhavan,

Nagpur, without wearing a mask

or helmet, at a time when he

keeps the SC on lockdown mode

denying citizens their funda-

mental right to access justice!”

Mehek Maheswhari, an advo-

cate, filed a petition before the

Supreme Court on July 9 seeking

initiation of contempt of court

proceedings against Bhushan

Bhushan stood his ground on

Monday, refusing to apologise to

the Supreme Court for his posts

on Twitter criticising the top

court and Chief Justice of India

(CJI) SA Bobde.

In a statement he submitted to

the apex court, Bhushan said the

views he expressed represented

his bona fide (good faith) beliefs

and, therefore, offering an apol-

ogy for expressing such beliefs

would be insincere.

“An apology cannot be a mere

incantation and any apology has

to be sincerely made. If I retract

a statement before this court

that I otherwise believe to be true

or offer an insincere apology,

that in my eyes would amount to

the contempt of my conscience

and of an institution (Supreme

court ) that I hold in highest

esteem,” he added in the supple-

mentary statement submitted

through advocate Kamini Jais-

wal .

According to the details avail-

able on the Supreme Court web-

site, the case will be taken up on

Tuesday to consider the effect of

the supplementary statement

submitted by Bhushan.

The Supreme Court, on

August 20, asked Bhushan to

reconsider his stance and offer

an apology by Monday failing

which, it cautioned the activist

lawyer, it would proceed against

him and punish him for criminal

contempt of court.

Even at the time, Bhushan

said that while he appreciated

the court’s move of giving him

time, he would not change his

mind.

“I believe that the Supreme

Court is the last bastion of hope

for the protection of fundamen-

tal rights, Today in these troub-

ling times, the hopes of the peo-

ple of India vest in this Court to

ensure the rule of law and the

Constitution and not an untram-

wari’s petition, the court took

suo motu {on its own}cognizance

of the matter and listed the case

for the first time on July 22 and

issued notice to Bhushan the

same day.

After a day-long hearing on

August 5, the Supreme Court

pronounced its verdict on

August 14, holding Bhushan

guilty of criminal contempt of

court. It however, kept the mat-

ter for further hearing on August

20 to decide on the sentence to be

imposed on Bhushan.

When the case was taken up

on August 20, Bhushan read out

a statement prepared by him. In

his statement, Bhushan

expressed dismay at the judg-

ment of August 14 convicting

him, stating that the conclusion

against him was arrived at with-

out providing any evidence of his

motives.

He said that he was standing

by his tweets, which he

described as an attempt to dis-

charge his duty towards the

country. He also invoked

Mahatma Gandhi’s stance in a

case slapped against him by the

British government.

“I can only humbly para-

phrase what the father of the

nation Mahatma Gandhi had

said in his trial: I do not ask for

mercy. I do not appeal to magna-

nimity. I am here, therefore, to

cheerfully submit to any penalty

that can lawfully be inflicted

upon me for what the Court has

determined to be an offence, and

what appears to me to be the

highest duty of a citizen,”

Bhushan said.

The three-judge bench headed

by justice Arun Mishra main-

tained that it could show leni-

ency only if Bhushan expresses

regret and reconsiders the state-

ment made by him on August 20

declining to apologise.

“We have given time to the

contemnor to submit uncondi-

tional apology, if he so desires.

Let it be filed by August 24,” the

order said.

dra Modi and several other

national leaders paid their

respects to the late Arun Jaitley

on Monday on the occasion of his

first death anniversary.

“On this day, last year, we lost

Shri Arun Jaitleyji. I miss my

friend a lot. Arunji served India

diligently. His wit, intellect, legal

acumen and warm personality

were legendary,” PM tweeted.

The ruling Bharatiya Janata

Party’s social media handle

posted a video with the message:

“He left us early but he also left

behind indelible imprints on the

Indian economy, law, govern-

ance and probity in public life.

His impeccable life will serve as a

guiding path for the talented

future generations.”

Union home minister Amit

Shah remembered Jaitley as “an

outstanding politician, prolific

orator and a great human being

who had no parallels in Indian

polity” and described him as

“multifaceted and a friend of

friends, who will always be

remembered for his towering leg-

acy, transformative vision and

devotion to the nation.”

Jaitley, 66, was admitted to

New Delhi’s AIIMS on August 9

after he complained of uneasi-

ness.

He died of multiple organ fail-

ure on August 24 last year.

Jaitley’s daughter Sonali Jait-

ley-Bakshi, a lawyer, posted a pic-

ture of her early childhood and

tweeted: “Today marks one year

without my father. Do I miss him?

Yes. Do I miss his presence?

Never, for he is always with me. I

love you, dad --- thanks for every-

thing.”

His son, Rohan Jaitley, shared

old photographs of the leader and

tweeted, “It’s been a year since

you left us, dad @arunjaitley. In

many ways, it feels like it was just

yesterday. The pain is still as

fresh. But so is my resolve to live

by your values, principles and

vision. You are always with us. So

missed, so loved.”

ISLAMABAD : Pakistan foreign min-

ister Shah Mehmood Qureshi

told a press conference in Islama-

bad on Monday that during his

recent visit to China, the issue of

Indian occupied Kashmir also

came up, where Beijing dis-

missed Indian claims over the

Valley. Qureshi said that China

had rejected India’s August 5

move and termed it ‘unilateral’.

Qureshi also explained that

the purpose of his recent visit was

to “understand [China’s] current

state of mind and gauge their

stance on India”. “I can tell you

that I didn’t see any hesitation,

their (China’s) stance is very

clear,” he said.

“China has made clear that it

views India’s measures of August

5, 2019 [in Kashmir] illegal,” said

Qureshi. China does not stand in

agreement with India’s position

were “leaning towards India”

was “dissolving”.

He referred to India’s conflict

with Nepal and the recent resolu-

tion passed by the latter’s parlia-

ment in that regard in addition to

“a lack of warmth” in India’s ties

with Bangladesh.

occupied Kashmir.

The Pakistan foreign minister

said that Prime Minister Imran

Khan raised the matter of IoK

before the United Nations, adding

that “India is running away from

the matter and lying to the global

community”.

Qureshi said that New Delhi’s

August 5 move had made matters

worse for the people of the occu-

pied territory. He said that anger

and frustration are on the rise in

the region due to restrictions and

a communications blackout.
