The government on Tuesday chose former Chief Justice of India H L Dattu for appointment as the next chairperson of the National Human Rights Commission (NHRC). The Indian Express had first reported that the NDA government was likely to offer the post to Dattu, who retired as CJI on December 2, 2015. The post of NHRC chairperson had been lying vacant since May 2015 after Justice K G Balakrishnan completed his nearly five-year-long tenure. A panel headed by Prime Minister Narendra Modi selected Dattu for the post. The meeting was also attended by Lok Sabha Speaker Sumitra Mahajan, Home Minister Rajnath Singh, leader of Opposition in Rajya Sabha Ghulam Nabi Azad and Deputy Chairman of Rajya Sabha P J Kurien. Leader of Congress party in Lok Sabha Mallikarjun Kharge did not attend the meeting. Under the Protection of Human Rights Act, 1993, the President appoints the chairperson and members of the NHRC on the recommendation of a committee comprising the Prime Minister, Lok Sabha Speaker, Union Home Minister, leaders of Opposition in Lok Sabha and Rajya Sabha, and Deputy Chairman of Rajya Sabha. The committee’s recommendation of Dattu for the post has been sent to President Pranab Mukherjee for his approval. On appointment, Justice Dattu will have a tenure of five years at the post. Among the former CJIs who were eligible for consideration were justices S H Kapadia, Altamas Kabir, P Sathasivam and R M Lodha. Of these, three had told the government that they were not interested in the job. Early in 2015, the government had sought Justice Sathasivam’s consent for the post but had to pull back in the face of a strong backlash, including a petition in Supreme Court to stall the proposed appointment.

Former Chief Justice of India H L Dattu has been appointed Chairman of the National Human Rights Commission (NHRC). The decision came a little over two months after Dattu’s retirement on December 2 last year and nine months after former NHRC chief Justice K G Balakrishnan retired on May 11, 2015. Justice Cyriac Joseph has been the acting chairperson during the interim period. The committee headed by Prime Minister Narendra Modi cleared the name of Dattu. The meeting was attended by Lok Sabha Speaker Sumitra Mahajan, Union Home Minister Rajnath Singh, leader of Opposition in Rajya Sabha Ghulam Nabi Azad and Deputy Chairman of Rajya Sabha P J Kurien. Justice Dattu, who joined the Supreme Court on December, 17, 2008, presided over the bench hearing the 2G case, black money case and Gujarat riot cases among others. Born on December 13, 1950, he started his practice as an advocate at the age of 25 in Bengaluru. He handled matters relating to civil, criminal, tax and Constitutional issues. He worked as government pleader for sales tax department from 1983, besides appearing in various capacities before the Karnataka High Court. He acted as senior standing counsel for I-T department between 1993 to 1995.

Cancer patient’s result withheld, NHRC sends notice to CBSE

The NHRC Tuesday issued notices to the Commissioner, Kendriya Vidyalaya Sangathan, New Delhi, and Regional Director, CBSE, Ajmer, for withholding the Class 10 result of a cancer patient. The NHRC said the CBSE had given permission to the student, suffering from blood cancer, to write her Class 10 exam. But her result remains withheld. As per the NHRC, Raunaq Shivhare approached her school, Kendriya Vidyalaya, No. 1, Gwalior, for her result but was asked to approach the CBSE. CBSE Director, Ajmer Regional Office, allegedly told her to seek information from the school. The commission has now called for a report within four weeks from the authorities concerned.
NHRC issues notice over withholding class 10th result of a cancer patient

The National Human Rights Commission has taken suo motu cognizance of a
media report that the Central Board of Secondary Examination (CBSE) had
given special permission to a student, suffering from blood cancer, to write her
class 10th examination. However, even seven months after the declaration of
the class 10th results, her result remains withheld despite having approached
several authorities.
The Commission has issued notices to the Commissioner, Kendriya Vidyalaya
Sangathan, New Delhi and Regional Director, Regional Office, Central Board of
Secondary Education (CBSE), Ajmer, Rajasthan calling for reports within four
weeks.
According to the media report, the student, Raunaq Shivhare, when
approached her school, Kendriya Vidyalaya, No. 1, Gwalior, Madhya Pradesh,
she was asked to approach the CBSE, which had held her result. The
Director,Ajmer Regional Office, CBSE turned her back to seek information from
the school. The victim has approached the Chief Minister of Madhya
Pradesh and Union Minister for Human Resource Development but she neither
received any reply from them nor her result was declared.
Inmates' late release from UP prisons gets NHRC attention
Feb 23, 2016, Agra: A human rights activist has approached the National Human Rights Commission (NHRC), New Delhi, over the Uttar Pradesh government's failure to release prisoners who have completed the minimum duration of 14 years in life imprisonment sentence cases. According to the activist, Naresh Paras, prisoners can be released by state orders on grounds of good conduct. The NHRC has accepted the application. Paras said, "There is a provision for releasing prisoners who have completed 14 years in jail or are above 60 years in age. The Supreme Court had removed several restrictions for their release on July 23, 2015. Following the SC order,inmates who had spent 14 years in prison were released by almost all state governments on January 26, 2016, but the UP government has not released any such prisoners." "The Madhya Pradesh government freed 700 inmates on August 15, 2015, within 20 days of the Supreme Court order paving the way for the release of such prisoners. Tihar inmates were released by the Delhi government on Republic Day this year. Almost all state governments have released such prisoners. The UP government has shown no regard to human rights of prisoners," Paras said. According to the activist, there are around 2,000 inmates in five central jails in the state of UP who have completed a minimum term of 14 years and a maximum term of 40 years. Of these, 200 are above 70 years, some prisoners are even in their 80s. These prisoners do daily chores with much difficulty and require assistance to move about. Because of old age, a majority of these inmates require medical facilities. Keeping them in jail is a clear violation of human rights," Paras said. "Most of the central jails in UP are overcrowded, and releasing those who have completed 14 years of imprisonment will improve the living conditions in jails," Paras added. "Every prisoner dreams to walk free. They wish to spend some time with their family and die in presence of their loved ones. None of them want to die in jail. Like other states, UP government should also set free prisoners who have spent
14 years in jail," Parsa said, adding, "You can judge a society by how well it treats its prisoners." In Agra central jail, 50 prisoners are in the age bracket of 60 to 70 years. Fifty are in the 70-80 age group and 16 are above 80 years.
