agreement. *Specialty breaks are not considered a meal

Rates for services scheduled on major US holidays are charged at two times the normal rates listed.

Please find the following Banquet and Catering policies applicable to your signed contract or Banquet

Event Order (BEO):

Food and Beverage:

• All Food and Beverage items are to be purchased exclusively from the hotel, served on premises

and must be dispensed only by the hotel staff during all catering functions.

• Prices are subject to change in the event of any increase of food, beverages or other operation

costs. Prices will be confirmed six months prior to function.

Deposits and Payment Requirements

All deposits received will be applied towards the functions final grand total.

• Advance deposits are non-refundable if cancellation occurs less than 30 days prior to the event.

• A $500.00 deposit is due upon receipt of signed contract either in cash, credit card, check, or

cashier’s check. The deposit reserved the date, time and meeting space you require.

• Advance payment based on the anticipated number of guests attending, the menu desired and

room rental or set-up fees are due 60 days prior to the function.

• Functions booked less than 60 days in advance but more than 30 days in advance the amount due

to reserve the room will be either $500.00 or 50% of the balance due, whichever is greater.

• For any function booked less than 30 days prior to the event’s date, payment in full will be

required.

• Final payment is due 7 days prior to your event with your minimum guarantee and a credit card on

file.

Guarantee Policy & Confirmation

• Menu selections must be confirmed 14 days prior to the function.

• We require a confirmation of guaranteed attendance at least 7 days in advance of all functions.

Your final bill will be based on the guaranteed number, plus any charges over and above.

• No refund will be given should your count fall below your guaranteed count given 7 days prior to

the event.

• Meals will be prepared for your guaranteed figure; however, if you wish, the room will be set for 5%

over the guaranteed and our Banquet Kitchen will make every effort to duplicate your menu for the

additional guests. In the event it cannot be done, a substitute entrée will be provided.

• In the event we do not receive a guarantee, we will consider the number of guests estimate on the

catering contact as the guarantee.

Service Charge and Tax

• All food, beverage, room rental and setup fees are subject to Hawaii state sales tax and 20%

service fees. All banquet prices are subject to change.

• Please be advised that when “service charges” are called for, the hotel does not distribute 100% of

such charges as tips to its employees; a portion is used to pay for costs or expenses other than

wages and tips.

Engineering, Electrical, and Audio-Visual

• Any electrical or engineering requirements must be specified to our Catering Department at least

14 days prior to the function. Charges will be based on labor involved and electrical usage.

• Audio-Visual equipment and services are available in-house on a rental basis. Orders may be

placed through our Catering Department and should be placed at least 14 days in advance.

Shipping and Receiving

• Small packages for meetings may be delivered to the hotel no more than 3 days prior to the

function and must be arranged with our Catering Department.

• Items should be addressed to the catering representative. Packages should be marked “Hold for

Arrival” and list the date and name of the event clearly on all labels.

Loss of Merchandise

• The Hilton Garden Inn Kauai, Wailua Bay does not accept any responsibility for the damage or

loss of any merchandise or article left in the hotel prior to, during, or following your function.

Noise Disturbance

• If the hotel determines that excessive noise from the banquet room is taking place, or receives

complaints from other guests the hotel reserves the right to refuse further service and will escort all

guests out from banquet room after the group has been notified once with a warning. Restitution

will be determined by the hotel for any refunds made due to noise complaints.

CATERING POLICIES

1. If no guarantee is received the Hotel will prepare and charge for the number of persons estimated from the catering

contract.

2. All banquet checks must be signed by the person in charge of a designated representative at the completion of each

function. Any discrepancy in counts or charges should be identified and resolved at that time.

3. Musical performances: you are responsible to insure that any musician or DJ publicly performing music at an Event

shall hold valid, current license from ASCAP, SESAC and BMI for any and all music played and you certify this to be

the case. You agree to hold us harmless from claim or expense from ay unlicensed performance.

4. A deposit is required for all catering functions unless prior credit /payment arrangements have been established with

the Hotel.

5. Any request made the day of the function to change room setup are subject to a $100 labor fee. Any extension of

function times will result in a fee of $100 per hour. Food and beverage will be served for the amount of time listed by

the menu choice. Should this time be adjusted or extended on the day of the event, a $100 fee will be charged for

every 30 minutes over the allotted time.

6. No food or beverages will be permitted to be brought into any banquet/meeting room. The Hilton Garden Inn Kauai

Wailua Bay is the only licensed authority to sell and serve liquor for consumption on the premise, therfo0re, liquor is

not permitted to be brought on property and will result in a $250 fee if outside liquor is discovered on property. In

accordance to the liquor laws of the State of Hawaii, a guests must be 21 years of age or older to consume alcoholic

beverages.

7. Outside audio visual equipment is not permitted without Hotel approval.

8. Function guests will be admitted to the banquet room and expected to depart at the time stated on the Banquet Event

Order.

9. Due to local and state health ordinances, unused food or beverage cannot be removed from the Hotel.

10. The Hotel may request that the customer obtain and pay for bonded security personnel when valuable merchandise or

exhibits are displayed or held overnight in the Hotel.

11. The Hotel is not responsible for damage to or loss of any items left in the Hotel prior to or following any function.

12. The customer is responsible and shall reimburse the Hotel for any damage, loss, or liability incurred by the Hotel by

any of the customers guests or any person or organizations contracted by the customers to provide any service of

goods before, during and after the function.

13. Any items to be put on any meeting or lobby walls or any directional signs must be approved by the Hotel.

14. The Hotel shall no be liable for non-performance of this contract when such non-performance is attributable to labor

troubles, disputes or strikes, accidents, government regulations of or restrictions upon travel or transportation,

non-availability of food, beverages, riots, national emergencies, acts of God and other cause whether enumerated

herein or not, which are beyond reasonable control of the Hotel, prevent or interfere with the Hotel’s performance.

15. Where appropriate, the term “Hotel” refer to the Hilton Garden Inn Kauai Wailua Bay, its officer, directors, agents,

employee and independent contractors and not intended necessarily to refer to the particular buildings where the

function is held.
