Fort Augustus on Loch Ness

Heading north from Edinburgh we pass the imposing ramparts of

Stirling Castle and drive through The Trossachs National Park, Rob

Roy country.

We cross the wilds of Rannoch Moor before stopping at dramatic

Glencoe, scene of the infamous massacre in 1692. Our journey

takes us through Fort William passing Ben Nevis, Britain’s highest

mountain, before entering the Great Glen.

Arriving at Fort Augustus on the banks of Loch Ness, you have the

chance to take a boat cruise on the loch, go for a walk or just relax

by the Caledonian Canal in this charming Highland village.

After a free picnic lunch our return journey takes us past

shimmering Loch Laggan before climbing over the wild and

lonely Drumochter Pass. Heading south, we enter Perthshire, a

land of forests, rivers and mountains. We view the spectacular

Forth Bridges before arriving back in Edinburgh around 8pm.

Cross the monumental Forth Road Bridge and enter the Highlands.

Our first stop is Dunkeld Cathedral, where the ghoulish tales and

beautiful architecture evoke a uniquely Scottish experience.

The next step of the journey takes you over the Drumochter Pass,

along the shimmering banks of Loch Laggen and into the

Great Glen.

Arriving in Fort Augustus you are seated by the friendly staff at

the award-winning restaurant at the Lovat Hotel and treated to

our exclusive ‘Taste of Scotland’ lunch. After lunch you have the

chance to ‘Nessie hunt’ on a walk to the shoreline or just relax by

the Caledonian Canal.

Leaving the famous loch we embark on a journey through some

of the most engrossing scenery that Scotland has to offer. You’ll

feast your eyes on Ben Nevis, Britain’s highest mountain; and

then marvel at powerful Glencoe. The final step of the tour takes

us past Stirling Castle and the battlefields that have shaped

St Andrews Cathedral

Departing Edinburgh we head to South Queensferry to stand

under the imposing Forth Bridge, one of Scotland’s greatest man-

made landmarks built in 1890, with views over the Firth of Forth.

Onwards we cross the water and travel into the Kingdom of Fife

and the ‘East Neuk’. This stunning coastline is dotted with

picturesque villages which still retain the character and charm of

bygone days.

St Andrews is our destination for the afternoon and we have

plenty of free time to explore this fascinating town. Home to

Scotland’s oldest University, and particularly famous for its

ancient golfing associations. St Andrews also boasts beautiful

beaches and the famous ruins of its Castle and Cathedral. Finish

off your visit with a locally made ice cream before we return to

Edinburgh early evening.

The medieval cathedral was one of the most important sites of pilgrimage in all of Europe

and the prestigious University is the oldest in Scotland; more recently being famous as the

meeting place of Prince William and Kate Middleton. The city is also known as the ‘Home of

Golf’ and is the location of the Royal and Ancient Golf Club.

The Kingdom of Fife is famous for its quaint little fishing villages. This trip

takes you on a journey through them and gives you the afternoon to spend in

the quintessentially Scottish town of St Andrews. Steeped in a wonderful

tradition of golf and education; and boasting famous views of the castle

ruins and beaches; it's hard to think of a better day out in Scotland.

We head out of Edinburgh and stop to take in the views of the

Forth Bridge, a masterpiece of Scottish engineering constructed in

the 19th century. Over the bridge we take the charming coastal

route through the Kingdom of Fife and its quaint fishing villages.

Once in St Andrews you have free time to explore the beautiful

town. You can see the beautiful white beaches, explore the

ancient University or even spend your time learning about the

history of golf; the choice is yours. Then take your seat and follow

the very British tradition of ‘taking Afternoon Tea’. It’s an

exceptional service with a unique view overlooking the 18th green

of the famous Old Course.  

Satisfied by plenty of tea, cakes and sandwiches, we then make

our way back through the Kingdom of Fife returning to Edinburgh

early evening.

The Hermitage

Leaving Edinburgh, we make our way to the ancient Scottish

capital of Stirling, its skyline is dominated by its castle and the

iconic Wallace Monument. We stop to hear tales of William

Wallace and his part in the medieval Wars of Independence.

We drive further into the Highlands with the chance to spot one

of Scotland’s famous residents, the ‘Hairy Coo’. We then travel

through the scenic beauty of Loch Lomond and The Trossachs

National Park. We pass the shimmering beauty of Loch Earn

before stopping for lunch at one of Scotland’s most famous

whisky distilleries.

After the chance to revive ourselves with a wee dram of the

‘water of life’, we head to the Hermitage in the heart of Perthshire

and take a short woodland walk to see the spectacular Black Linn

Falls on the River Braan. Our return journey visits the quaint

village of Dunkeld, in Macbeth country, where a stunning

cathedral sits comfortably by the banks of the River Tay. We

return to Edinburgh, passing the iconic Forth Bridge on the way.

The tour begins with a journey past Scotland’s ancient seat of

power, Stirling Castle. You’ll hear the stories that made William

Wallace legendary and see the battlefields and castles that have

influenced Scotland’s past and present.

Further north we arrive at the ‘The Famous Grouse Experience’,

one of the most celebrated distilleries of the Highlands.  You’ll be

taken on an informative tour before being escorted to the

exclusive ‘Warehouse 9’. This room’s unique aromas and

impressive displays are truly breath-taking; and your ‘private

nosing and tasting’ is the only whisky lesson you’ll ever need.

After a light lunch at the distillery’s restaurant we make our way

to Perthshire, where we take a gentle stroll through the

woodlands to the cascading Black Linn Falls on the River Braan.

Our return journey to Edinburgh will take a final stop to admire

the architectural delights of Dunkeld Cathedral, a building that

unites Scotland’s Gothic and Norman past.

Loch Lomond

We depart Edinburgh and head west through Scotland’s central

belt to Glasgow, allowing a glimpse of its industrial past. Then it’s

north to the ‘Bonnie Banks of Loch Lomond’ where we take time

at Luss to admire views of Ben Lomond. We explore Loch Lomond

and The Trossachs National Park stopping at the quaint Highland

village of Aberfoyle, a beautiful location at the southern edge of

the West Highland Fault Line which was often frequented by Sir

Walter Scott.

The afternoon is spent exploring Stirling. Take the chance to

discover impressive Stirling Castle, one of Scotland’s most

important structures both historically and architecturally. Many

have been crowned at Stirling Castle, including Mary Queen of

Scots, and it was central to William Wallace’s fight in the Wars of

Independence. Alternatively explore Stirling, geographically one

of the most significant towns in Scottish history. We return to

Edinburgh early evening.

We leave Edinburgh behind and pass Stirling with views of its

impressive Castle and the Wallace Monument. Then it’s into the

Highlands through the scenic beauty of Loch Lomond and The

Trossachs National Park, once home to the infamous cattle thief

and rogue, Rob Roy MacGregor. We follow the shoreline of

We then explore the peaceful Hermitage and take a short

woodland walk to see the Black Linn Falls on the River Braan. We

River Tay before returning south past the inspiring Forth Bridge.

BRAEMAR GATHERINGKnown as ‘The Games’, and originating from those believed to have been held by Malcolm

III in the 11th Century, an annual Highland Games Gathering is held at Braemar in Royal

Deeside on the first Saturday in September.

The Gathering is one of the most famous and has Her Majesty the Queen as patron.

Members of the Royal Family have traditionally been spectators since Queen Victoria

attended in 1848.

DAY ONE: Leaving Edinburgh, past stunning views of the Forth

Bridge, we enter the Highlands through Perthshire, a land of

forests, rivers and mountains. We visit the quaint village of

Dunkeld with its historic cathedral sitting on the banks of the

River Tay. We head further north into the Highlands before we

enter the Great Glen. At Fort Augustus, there is time to explore

the shores of Loch Ness and a chance to spot Nessie. The journey

continues to the famous Isle of Skye but first we take in the

spectacular Eilean Donan Castle, one of Scotland’s most famous

icons. Our home for the night is the Isle of Skye, the ‘Winged Isle’.

DAY TWO: We spend the day exploring the dramatic Isle of Skye

with its amazing scenery, myths and legends. Hear tales of Bonnie

Prince Charlie’s escape against the backdrop of the jagged Cuillin

Mountains. Highlights include the mysterious rock formation of the

Old Man of Storr, Kilt Rock with its cascading waterfall and

Dunvegan’s impressive castle. (Overnight: Isle of Skye)

DAY THREE: We explore the castle and gardens of Clan Donald

Skye, before taking the ferry to the west coast fishing village of

Mallaig. Here you can board the Jacobite Steam Train† to Fort

William, one of the most spectacular railway journeys in the

world. The train crosses the Glenfinnan Viaduct where a

monument to Bonnie Prince Charlie’s campaign now stands. We

head south through the dramatic scenery of Glencoe, wild

Rannoch Moor and the heart of Rob Roy country before arriving

back in Edinburgh.

Royal Deeside

DAY ONE: We leave Scotland’s capital and head for Dunkeld in the

heart of Perthshire with its impressive cathedral. Continuing

north, we pass through the Cairngorms National Park and arrive

at Culloden battlefield, scene of Bonnie Prince Charlie’s final

downfall. This afternoon take a cruise on Loch Ness or explore the

Highland capital, Inverness. We overnight in the Cairngorms

National Park with the option to sample some of Scotland’s

finest produce at an exclusive dinner with the group.

DAY TWO: We head to Spey Bay and the Scottish Dolphin Centre.

The Moray Firth is world renowned for bottlenose dolphins and

Spey Bay is the best land-based vantage point in the UK to see

of Cullen for the chance to sample a local delicacy ‘Cullen Skink’ a

creamy fish soup. The afternoon is spent exploring Speyside,

famous for its malt whisky production. We’ll take the opportunity

to visit Glenfiddich distillery, one of Scotland’s finest whiskies.

DAY THREE: This morning we visit Balmoral Castle. This

magnificent estate house is privately owned by the royal family

and is still used as a holiday home by Her Majesty The Queen. As

Her Majesty will be in residence from the 31st of July trips after

way back to Edinburgh we stop at the world famous golfing town

of St Andrews. Don’t forget to try Jannetta’s ice cream, a flavour

Portree

Starting in Mallaig, the train visits Arisaig, Britain’s most

westerly railway station, and from the coast you can see the

‘Small Isles’ of Rum, Eigg, Muck and the stunning white

beaches used in films such as ‘Local Hero’ and ‘Highlander’.

The Jacobite then passes through Glenfinnan where Bonnie

Prince Charlie raised his Standard to begin his ill-fated claim

to the throne in 1745.

We then cross over the viaduct with amazing views down

Loch Sheil before heading to Fort William in the shadow of

Ben Nevis, Britain’s highest mountain.

The Jacobite Steam Train is an outstanding way to take in the

DAY ONE: Leaving Edinburgh, we stop to view the Forth Bridge,

opened in 1890 for the passage of trains heading north. We then

travel on through the Kingdom of Fife with its stunning coastal

scenery before stopping at the ancient university town of St

Andrews. Known as the Home of Golf, the town also boasts the

magnificent ruins of a 12th Century Cathedral. We then travel on

to Aberdeen via Dunotter Castle and board the ferry for the

overnight journey to the Shetland Islands.

DAY TWO: After sailing into Lerwick we spend the morning

enjoying the main town of Shetland. We then spend the

afternoon in the north of the island exploring the fantastic coastal

areas of Lunna and Eshaness before we return for a night out in

DAY THREE: In the south of Shetland we will visit one of Scotland’s

finest prehistoric sites, before moving onto the old capital,

Scalloway with its imposing castle. We return to Lerwick to

prepare for the main event with some celebrations in town

DAY FOUR: The big day! You get to watch the junior Jarl

Squad (young Vikings) have their own parade before

the main event. Vikings make their way through the

streets culminating in the ceremonial burning of a full size

replica Viking Long Ship. Your Guide will be available

throughout the day to make sure you don’t miss any of

DAY FIVE: After breakfast, we venture north taking in the ancient

Tingwall Parliament and explore the west of the island. A return

to Lerwick allows free time for souvenir shopping or a visit to

the Shetland Museum before boarding our overnight ferry

DAY SIX: We make our way through Royal Deeside and

pass Crathie Kirk where the Royal Family worship when at

their Highland residence. We also visit the resting place

of John Brown, ghillie to Queen Victoria and made

famous in the movie starring Billy Connolly.

We are committed to making your tour with us as enjoyable as

possible no matter what your individual needs are. Nevertheless,

there are certain limitations that may arise due to the local and

rural nature of Scotland. The following is intended to provide

useful information for anyone travelling with us.

Our coaches generally pick up and drop off customers at our

overnight accommodation properties, although there may be a

short walk to meet the coach at some locations.

The accommodation establishments are of 3-star standard or

equivalent and are located in a mixture of small towns and rural

villages; some of which may have sloping streets and uneven

paths. The properties are generally less than one mile away from

the village/town centre and all the locations have taxis available

on request from the accommodation reception.

Guest houses only provide breakfast whereas hotels have dinner

and breakfast options available. There will always be vegetarian

options available but in more rural locations, gluten free and

dairy free options may be limited. It will not be possible for

guests to prepare their own food in guest house or hotel kitchens.

With only a very few exceptions all B&B and Highland Hotel

bedrooms have en-suite bathrooms. Level-entry showers, ground

floor bedrooms and adapted toilets are very limited, only

available on request and cannot be guaranteed.

There may be several steps before accessing the reception area

from the front entrance and Highland hotels do not have

lifts/elevators. Please contact us for advice about evacuation or

porters should you need assistance.

Once Highland Explorer Tours, a trading name of Radical Travel Group Limited, hereinafterreferred to as “the Operator”, confirms your booking a contract is made between theOperator and you upon the terms and conditions set out below. Your statutory rights are notaffected. In a booking with more than one passenger the ‘lead passenger’ will be deemed tohave accepted the terms and conditions on behalf of all passengers within the booking. The‘lead passenger’ is the passenger who makes the booking on behalf of all passengers in amulti-passenger booking and is named in the ‘lead passenger’ field within the booking.Within these Booking Conditions, “you” and “your” means all persons named on thebooking (including anyone who is added at a later date).

1. Booking/Acceptance1.1 The Operator accepts a booking on the understanding that a deposit or full payment hasbeen collected and held either by the Operator directly, or by an authorised travel agent onthe Operator’s behalf. Bookings made via the Operator’s own website are considered as madewith the Operator directly. 1.2 On confirmation of your booking, subject to availability and atthe Operator’s discretion, the Operator will reserve your place(s) on your selected products(“tours”). It is your (or on bookings involving more than one person, the lead passenger’s)responsibility, as the customer, to check the accuracy of your booking and travel dates. Acontract is only made between you and the Operator upon your booking being confirmed andaccepted and communication thereof to either you or your authorised travel agent(hereinafter referred to as “confirmation”). 1.3 On confirmation of your fully paid booking aBooking Statement indicating the amount paid and an e-ticket will be sent to either you oryour travel agent. 1.4 In order to reserve your tour: 1.4a) Tours costing £200 or less: fullpayment must be made at time of booking. 1.4b)Tours costing more than £200: a non-refundable deposit of £100, per person per tour is required, but if the booking is made within45 days of the nominated departure date, the full amount payable must be made at the timeof booking. This payment is in addition to any deposit required by your travel agent. Thedeposit is accepted as a first instalment of the tour price by the Operator only once thebooking has been confirmed in writing by the Operator or your travel agent. 1.4c) Theoutstanding balance of the tour price must be paid by no later than 45 days prior to thescheduled, nominated or confirmed tour departure date or the payment date specified in anypromotion, which shall be by the due date stated on the confirmation issued to you. Whilstevery endeavour will be made to remind you of the payment due dates, it is yourresponsibility to make this payment. If payment is not made to the Operator or to yourauthorised travel agent (for agent bookings) by the due date, the Operator may assume thatyou have cancelled your tour and cancellation charges in accordance with clause 3 below willbe levied by the Operator. 1.4d) Booking Statements confirming 'Full Payment' will not beissued until full payment has been received by the Operator or authorised travel agent. 1.5 Inthe case of bookings made within 45 days of tour departure, the full cost of the tour will bepayable immediately at time of booking. 1.6 The Operator reserves the right to cancel thebooking and apply cancellation charges should full payment not be received within the abovespecified periods. 1.7 If you wish to book to travel at student prices, you must have an ISIC, ITICor ISE student card, valid at the time of travel. Please note that University ID cards areaccepted at the operator’s discretion.

2.Travelling2.1 The Operator’s E-tickets/Booking Statements confirming ‘Full Payment’ are nottransferable. Your e-ticket /Booking Statement indicating that full payment has been mademust be produced at any time at the Operator’s request. Photo identification is required for alltours. 2.2 Baggage is restricted to one reasonable sized suitcase or backpack and one smallcarry-on bag per passenger (maximum combined weight 15KG). Baggage in excess of thislimit may not be carried. 2.3 It is your responsibility to check-in with the Operator 15 minutesprior to the specified departure time. The Operator will not be liable for any service that leavesor returns later than its specified time, even if as a result you miss a connecting service. TheOperator will use its best efforts to ensure that departure and return times are met.

3. Cancellations & Changes3.1. Cancellation of your booking must be in writing to either the Operator (direct or websitebookings) or the authorised agent through which the booking was made. If your booking wasmade through an authorised agent all amendments and cancellations must be made throughthem (they may also have cancellation charges in addition to those noted below - pleasecheck at time of reservation). When written notification has been received by the Operator afee will be levied to cover the administration costs incurred (25% of booking price being theminimum fee). The amount of the cancellation fee will be dependent on the number of daysprior to the departure date of the tour as follows (not including day of departure nor the dayof notification):-

3.2 Where a deposit has been made on a booking and the booking is cancelled by you or yourbooking agent prior to full payment being made, or in the circumstances of the balance notbeing received by the Operator or their authorised agent by the due date, no refund of thedeposit will be applicable, nor can it be credited or transferred to any other booking for a tourof a lower value. It may be possible to transfer the deposit to a booking for a tour of a highervalue. 3.3 Cancellation of individual passengers from a multiple booking where a groupdiscount applies (‘4 or more’ discount) may mean that the discount applied on booking will beforfeited, due to the qualifying criteria no longer being met. If the cancellation results in thequalifying criteria no longer being met then the prices for the remaining passengers on thebooking will be adjusted, and any forfeited discount will be reclaimed through deduction incalculating any refund due to the cancelling passengers. 3.4 Private Group / Bespoke Tours -specific cancellation fees apply to each tour, the Operator will inform you of these prior topayment. A non-refundable deposit will be required at time of booking to cover anyaccommodation, third party supplier, meals and attraction costs. Where bookings include

entrance fees to attractions, accommodation, involve accommodation upgrades or specificaccommodation requests any cancellation fees incurred by the Operator will be passed on toyou in addition to the standard private group / bespoke refund policy. 3.5 If after your bookinghas been confirmed, you wish to change to an alternative departure date, or wish to change toanother Highland Explorer Tours tour, you may do so subject to the tour being available and aminimum notice of 15 days prior to departure. All departure date changes will incur anadministrative fee of £25 per person per tour. Date changes will only be extended within the2015/16 operating season up to 3 months from the original departure date. 3.6 Tour changes toone of a lower value or seasonality will result in the loss of any special discounts applied tothe originally booked tour and will be subject to an administration fee equivalent to thecancellation fee on the original product. 3.7 Tour changes to one of higher value or seasonalitywill require the difference in price to be paid. This may also result in the loss of any specialdiscounts applied to the originally booked tours. 3.8 If the reason for your cancellation iscovered under your insurance policy, you may be able to make a claim under that policy.

4. Your Responsibilities4.1 The tour products offered are forms of transportation. For this reason the Operators’representatives cannot offer constant special attention or assistance should you have anyphysical disability requiring such attention. 4.2 Passengers must be aged 5 or over and beaccompanied by a person 18 years or over. There is no upper age restriction. 4.3 PASSENGERSWITH DISABILITIES are welcome on tours, provided that they are accompanied by a companioncapable of providing all necessary assistance and do not require special assistance from theOperator’s personnel. Any medical or physical condition requiring third party attention ortreatment must be advised in writing to our Reservations Team at the time the booking ismade. It is your responsibility to see to it that your letter is acknowledged with the bookingconfirmation. The Operator cannot guarantee travel in the absence of such anacknowledgement. Similarly if you wish to make a special request about any matterconcerning your travel or accommodation you must do so at the time of booking. Again, it isyour responsibility to produce an acknowledgement from our Reservations Team at the timeof travel. We will try to pass on any reasonable requests to the relevant suppliers but wecannot guarantee that your requests will be met. The fact that a special request has beennoted on your confirmation invoice or on any other acknowledgement is not confirmation thatthe request will be met. Failure to meet any special requests will not be a breach of contracton our part unless the request has been specifically acknowledged and confirmed as acceptedby our Reservations Team. The Operator reserves the right to refuse to carry anyone if it is feltthat the individual cannot cope with the requirements of the tour and who may requireservices and facilities that the Operator cannot guarantee will be available. The nature of thetours means that not every type of disability can be accommodated despite our reasonableendeavours. Most tours involve getting on and off coaches, sitting for long periods on coacheswithout toilet facilities, walking and other physical activities which may involve steps andstairs at sightseeing stops, visitor attractions and accommodation units. Coaches are notadapted to carry wheelchairs and do not have ramps, lift or low floor access. Collapsiblewheelchairs can generally be carried in the luggage hold but you must check in advance withour Reservations Team to ensure that this is the case for your tour. The Operator cannot carryany motorised wheelchairs under any circumstances. You agree not to hold the Operatorresponsible for any decision made by them or by any service provider to refuse to carry you,provide any facilities or accommodation to you, or to provide any service to you in theabsence of written acknowledgement and acceptance of your special request or of yourdisability from our Reservations Team. Please note that 100% cancellation charges wouldapply in these circumstances. 4.4 It is your responsibility to have a valid passport and allnecessary visas, permits and certificates on your person for your selected itinerary and to haveall necessary vaccinations and to comply with applicable laws. 4.5 You agree to comply withthe authority of the Operator’s representative and the laws and regulations of the countriesvisited, including customs and foreign exchange restrictions. If you do not do so, you may, atthe discretion of the Operator’s representative, be asked to leave the tour. No refunds will beissued in such circumstances. 4.6 You agree that the Operators’ representatives may takephotographs and films of you while you are a passenger. These may be used in the Operator’sGroup brochures and/or advertising and publicity material without obtaining any furtherconsent or payment in respect of such photographs and/or films. 4.7 You agree that theOperator may use any text written in comments books, recorded in customer surveys or inputto online forums, in Group brochures, websites and/or advertising and publicity materialwithout obtaining any further consent or payment in respect of comments. 4.8 There may betimes when the Operator’s personnel have to make a decision in the interests of safety. It is acondition of bookings that you comply with the authority and decisions of the appointedrepresentative of the Operator. If you do not comply with the said representative or are notcompatible with the general enjoyment and well-being of members of the tour, the Operatorreserves the right to refuse to allow you to continue the tour. In such a case the Operator willnot be liable for any refund, compensation or any additional costs incurred by you. TheOperator cannot accept liability for the behaviour of others on your tour nor if any facilities arecurtailed as a result of their actions. 4.9 The Operators do not tolerate any form of abuse,verbal or otherwise, of its personnel. Any passenger abusing or threatening personnel willautomatically forfeit their right to onward travel. 4.10 You are responsible for looking afteryour personal belongings whilst travelling. The Operator cannot be held responsible for anypersonal belongings left behind or damaged on any tour irrespective of the circumstances. 4.11It is the responsibility of the passenger to check the accuracy of dates booked upon receipt oftheir Booking Statement confirming ‘Full Payment’. 4.12 If you paid a Concession price onbooking, you will be required to prove this entitlement at check-in for each departure. Shouldyou not be able to do this, you will be charged the difference between the normal brochureprice and the discounted price in addition to an administration fee of 25 GBP.

5. Local Tours & Excursions5.1 You will have the opportunity to purchase local tours or excursions from your Guide/Check-In staff. These tours and excursions are run by local operators and you will be subject to their

terms and conditions. 5.2 Local tours and excursions purchased via Guides/Check-In staff arenon-refundable. It is your responsibility to meet the tour at the designated departure pointand time. Travel will only be permitted on presentation of the issued voucher to the namedoperator. 5.3 Local tour and excursion vouchers that are lost or stolen cannot be replaced.

6. Insurance6.1 There is no travel insurance cover included in the price of any tour or product representedin this brochure or on the website. 6.2 The Operator strongly recommends that you take outcomprehensive insurance cover for cancellation, medical expenses, personal accident, personalbaggage, money and public liability before you travel. You may also wish to indemnify theOperator against all third-party claims, actions, damages and remedies that may be broughtagainst the Operator in respect of your travel needs/requirements.

7. Changes by The Operator 7.1 Prices in this brochure are based on costs and exchange rates at October 1, 2014. Shouldthese costs change it may be necessary to make a surcharge on the price of your tour. Shouldthe total tour price increase by more than 10% you will have the right to cancel within 7 daysof notification without penalty. 7.2 No surcharge in respect of costs or currency fluctuationswill be made once payment of the deposit for your tour has been received. This guaranteeexcludes fuel surcharges and does not apply to any taxes, charges or levies imposed by anygovernment or their agencies. In exchange for these guarantees, no refund will be made ifcosts are reduced. The surcharge will only be made where the increase in cost will affect theprice of the tour by more than 2%. 7.3 The Operator reserves the right to vary, modify or cancelany itinerary, either part or wholly. If this is necessary, they will substitute alternativearrangements of comparable value, or at the Operator’s discretion provide a full or partialrefund. 7.4 The Operator reserves the right to alter or substitute the type of vehicle mentionedin the brochure or websites, depending on the number of passengers carried, which vary fromtour to tour.

8. Weather Conditions8.1. Under no circumstances can the Operator be held responsible for any delay, deviation orcancellation due to weather conditions, nor can any ticket be cancelled or amended by you atany time on the basis of weather conditions.

9. No Smoking Policy9.1. The Operator operates a No Smoking Policy on all its vehicles.

10. Dispute Procedures10.1 If you have a complaint in respect of any Operator, you should inform the Operator’sRepresentative at the time. Any complaint that cannot be resolved by the Representativeshould be submitted in writing within 28 days of the incident to The Customer ServicesManager, Highland Explorer Tours, 60 High Street, Edinburgh, EH1 1TB, Scotland, UnitedKingdom so that your complaint can be passed to and then investigated by the Operator. TheOperators will not consider complaints after the 28 day period. 10.2 The contract and allmatters arising in respect hereof shall be subject to Scots Law unless the Operator agreesotherwise in writing. 10.3 If any provision of this contract is held invalid or unenforceable byany court of competent jurisdiction, that provision shall be deemed to be re-written to giveeffect to the same purpose within the permitted limits of the law. The validity andenforceability of the other provisions shall not be affected. 10.4 If you are unsuccessful in anylegal action instituted against the Operator, you agree to pay all the Operator’s costs, includingbut not limited to attorney / client costs.

11. Contracting Parties11.1 The booking conditions detailed herein contain the entire contract between you and theOperator. No representation, term, warranty or condition can be expressed or implied byreference to any other writing, advertisement or conversation. This contract may only bevaried by a duly authorised officer or Director of the Operator in writing. 11.2 Your contract iswith the Operator. At any time, and at the Operator’s complete discretion, the Operator maynominate to you in writing any other company or person to have the benefit of some or all ofthose provisions of this contract, which the Operator may then specify, as if you had agreedthe provisions concerned directly with that company or person in the first place as well asagreeing them with the Operator. The Operator may at its complete discretion assign all or anyrights and liabilities arising under or by virtue of this or any other contract with you. 11.3 Allbookings with carriers and other service providers are subject to their terms and conditionsand limitations of liability. Please note that some of these limit or exclude liability in respect ofdeath, personal injury, delay and loss or damage to baggage. Whilst the Operator cannotaccept any responsibility for any loss as a result of such actions or as a result of any act oromission of any such third parties, the Operator will give reasonable assistance in helping toresolve any reasonable dispute. 11.4 Many accommodation arrangements referred to in thisbrochure are provided by third party providers (unless stated otherwise). They are subject tothe terms and conditions, and limitations of liability, imposed by the provider. 11.5 Every effortis made to ensure brochure accuracy at the time of going to print, however the Operatorcannot be held responsible for printing and typographical errors, or errors arising fromunforeseen circumstances.

12. ValidityThe programmes advertised in this brochure are valid for the 2015/16 operating season unlessstated to the contrary. These Terms and Conditions supersede all previous Terms andConditions issued and are valid for all reservations made on or after 1st October 2013, untilreplaced.
