According to the decision of the HELCOM MARITIME 7/2008 meeting in St. Petersburg, Poland was invited to elaborate a first draft of the list of “black” and “red” chemicals based on the OSPAR chemicals and MARPOL Annex II and III as well as chemicals used on a Polish offshore platform, including giving preliminary categorization of the chemicals, to be agreed with Russia and Denmark and to be circulated to other Contracting Parties for approval with a view of adopting the list by HELCOM 30/2009. Poland prepared such a draft list and sent it to Denmark and Russia in the beginning of 2009 for comments. Further developed list was presented by Poland at the 30th HELCOM Meeting in March 2009. HELCOM 30/2009 discussed the proposal and welcomed the approach applied in formulating the draft list. Poland was also invited to present the list for adoption and discussion at HELCOM LAND 14/2009. HELCOM LAND 14/2009 took note of the information by Poland on elaboration of the list of “black” and “red” chemicals as a part of the Action Plan for the protection of the environment from offshore platforms and concluded that: 1. the suggested list of chemicals used on offshore platforms contained only “red” and “black” chemicals as decided in the HELCOM BSAP; 2. the chemicals had been compiled using same technical description as contained in MARPOL 73/78, Annex II;

PROTECTION OF THE ENVIRONMENT FROM OFFSHORE PLATFORMS Elaboration of the list of black and red chemicals derives form the HELCOM Baltic Sea Action Plan adopted by the ministers of environment of all Baltic Sea countries in November 2007. BSAP includes the Action Plan for the protection of the environment from offshore platforms to apply a “zero-discharge” principle for the offshore platforms in the Baltic Sea starting from 1 January 2010. One of the objectives of the offshore Action Plan is that: “All operators shall apply “zero-discharge” principle not later than 1 January 2010: - by 23 April 2008 all operators must have ceased discharges of all “black” chemicals; - operators must continue the process of substituting chemicals so that discharges of “red” chemicals cease no later than 1 January 2010.” However, the “black” and “red” chemicals have not been defined in the Plan and the decision was made that those should be elaborated by 2008. Poland prepared such a draft list and sent it to Denmark and Russia in the beginning of 2009 for comments. Further developed list was presented by Poland at the 30th HELCOM Meeting in March 2009. HELCOM 30/2009 discussed the proposal and welcomed the approach applied in formulating the draft list. Poland was also invited to present the list for adoption and discussion at HELCOM LAND 14/2009. HELCOM LAND 14/2009 took note of the information by Poland on elaboration of the list of “black” and “red” chemicals as a part of the Action Plan for the protection of the environment from offshore platforms and concluded that:

1. the suggested list of chemicals used on offshore platforms contained only “red” and “black” chemicals as decided in the HELCOM BSAP;

2. the chemicals had been compiled using same technical description as contained in MARPOL 73/78, Annex II;

3. a complimentary list to the above mentioned MARPOL List and containing chemicals not included in Annex II to MARPOL 73/78 had been elaborated, containing chemicals used on Polish platforms;

The Meeting decided to ask the Contracting Parties to inform whether they could agree to the MARPOL “red” and “black” lists.

The Meeting asked Poland to identify the CAS Nos. for all substances in the supplementary list, as currently four substances are still missing CAS Nos., in order for other Contracting Parties to assess the proposed classification as “red” chemicals.

The Meeting requested the Contracting Parties to inform on their principal agreement to the Polish approach during HOD 28/2009 (9-10 June 2009), with a view to discuss this issue further during the HELCOM LAND Workshop on 18-19 November 2009 and to adopt the List during HOD 29 in December 2009. This document contains the refined list of “black” and “red” chemicals elaborated by Poland, consisting of MARPOL Annex II substances (Attachment 3) and list of substances used on a Polish platform (Attachment 1), taking into account all the decisions from the meetings as well as comments sent by Denmark and Russia (Attachment 2) including latest instructions given by the HELCOM LAND. The list has been amended with missing CAS numbers as well as has been cross-checked with the OSPAR List of Substances/Preparations Used and Discharged Offshore which are Considered to Pose Little or No Risk to the Environment (PLONOR). PLONOR contains substances whose use and discharge offshore are subject to expert judgement by the competent national authorities or do not need to be strongly regulated. The “red” chemicals proposed by Poland are not included in the OSPAR’s PLONOR list so there is no inconsistence between the Polish proposal and OSPAR system. Actions requested by the Meeting: The Meeting is invited to consider the proposal and agree in principle on the list with view to discussing further any possible open issues during the HELCOM LAND Workshop on 18-19 November 2009 and adopting the list during HOD 29 in December 2009.

Attachment 1 A list of red” and “black” chemicals used on offshore platforms has been developed by Poland following the request by HELCOM MARITIME 7/2008 and based on comments submitted by Denmark and Russia. The list consists of substances from MARPOL Annex II (doc. "Provisional Categorization of Liquid Substances - MEPC 2/Circ.13 – Attachment 3) and the list of chemicals used on the Polish platform provided below. The CAS numbers have been added where appropriate. Poland proposes that the chemicals from the list of "black" and "red" chemicals should have the same technical description like the MARPOL once do, and so: X - should be treated as black chemicals - very harmful to the environment (may not be discharged to the environment) Y- red chemicals - harmful (should be avoided where possible due to low biodegradation, high bioaccumulation potential or high toxicity, and the components involved must be prioritized for replacement). As a supplement to the MARPOL list, the below list of chemicals that are used on Polish platform (but are not cited in the document MEPC 2/Circ.13) is to be included. I have from time to time been consulted in your process being the one in Denmark working for many years with permissions for the offshore industry to discharge chemicals to the sea. Allow me therefore to put in some comments to the set up for black and red chemicals in HELCOM. As I have told Torben we in OSPAR only have lists for green (PLONOR list) and black chemicals, but not for red and yellow chemicals. The lists for green and black chemicals are valid only for substances, not for products (which may be composed of several substances of which some can be green and some red or may be black; the product takes colour after the worst substance in the product). The reason that there is only lists for green and black substances is the limited number of substances in these groups compared to the other two groups (red and yellow). I don't know at which basis you have made a list of the about 40 products in your list of "red" and "yellow" chemicals. In Denmark we have given permission to use about 500 chemical products since 2002 of which approximately 200 is green, 140 is yellow, 160 is red and 0 is black. According to our national offshore action plan from December 2005 the red chemicals should, "where it is realistic possible" be substituted with green or yellow chemicals before 1st January 2009. In 2001 we in Denmark discharged appr. 700 tonnes red chemicals to the Northsea. In 2009 we expect this to be reduced to 12 tonnes for only 7 red chemicals for which it has not yet been possible to find any green or yellow substitute. In Norway and UK with a bigger production they have registered about 5000 offshore chemicals and new chemicals are registered every year. Therefore the work to set up a list for red and yellow chemicals will be enormous. Since 2005 it has been tried in OSPAR to set up a list of red chemicals which had been substituted in one country. Also with that purpose to agree upon whether the substances are red or yellow. From Denmark we last year supported this work by a list of red substances substituted in Denmark. I enclose a copy of this list for you. This work in OSPAR has not yet reached any conclusion or final list because of the size of the workload. In Denmark we are now based on our national offshore action plan at the stage where we will not allow any new red chemicals to be discharged. Therefore we don't need a list of red chemicals. It is up to every single operator and their chemical suppliers to prove that the chemicals applied for is not red through the evaluation methods developed by OSPAR. Dear Agnieszka, Thank you very much for your message below. We have considered the attached document once more in detail. Accordingly BSAP “zero-discharge” principle means a general approach to ensure the proper treatment of all kinds of offshore platform-generated wastes, including processing and consumption wastes, on land or on the offshore platforms according to Best Available Techniques and Best Environmental Practices and MARPOL 73/78, with the aim of avoiding discharges to the marine environment. As we have already mentioned there is no reference to any kinds of offshore platform-generated wastes such as “yellow” or any. We are speaking about avoiding any discharges to the marine environment. In Russia all kinds of offshore platform-generated wastes (including processing and consumption wastes) deliver to the land or treatment on the offshore platforms. The above mandatory requirements are included in the Russian legislation. Therefore we should have list of “black” and “red” chemicals only. As I understand after 1 January 2010 the above lists will not have any sense totally due to put into force “zero-discharge” principle. PROVISIONAL CATEGORIZATION OF LIQUID SUBSTANCES 1 Introduction 1.1 Whilst under normal circumstances chapters 17 and 18 of the IBC Code take precedence over List 1 of the MEPC.2/Circular, in this exceptional case the entries in Annex 1 – List 1: Pure and technically pure products, which apply to “all countries” and with no expiry date, supersede those in the IBC Code. 1.2 This circular is issued in accordance with regulation 6.3 of MARPOL Annex II, replacing all previously issued circulars under this title. 2 Lists of annexes 2.1 Annexes 1 to 4 provide lists of noxious liquid substances (NLS) with associated categories and minimum carriage requirements which have been established through Tripartite Agreements and registered with the Secretariat in accordance with the regulation referred to above. Annexes 5 to 8 are intended to facilitate the reporting of Tripartite Agreements and the interpretation of abbreviations used in annexes 1 to 4.

3 Observations related to the annexes 3.1 Language 3.1.1 As seen in the lists, most products are trade-named substances under n.o.s. entries. Since tradenames are not translated, the products are entered as notified and the lists are issued in English only. 3.2 Shading 3.2.1 Amendments to the Product Lists (annexes 1 to 5) are identified by shading the field in which the change has been made. 3.3 Country and Territory Codes (Annex 7) 3.3.1 The list of country and territory abbreviations mirrors that used in the Global Integrated Shipping Information System (GISIS), which is based on the UN/Locode, a geographic code scheme, developed and maintained by the UNECE, a Unit of the United Nations. These codes are listed in Annex 7: Part 1 of the Annex presents entries by Code order whilst Part 2 gives a listing by Country/Territory order. 3.4 Cleaning additives (Annex 10) 3.4.1 The Marine Environment Protection Committee, at its fifty-second session, adopted the revised MARPOL Annex II for the regulation for the discharge of Noxious Liquid Substances, which includes restrictions on the types of cleaning additives allowed to be used in tank washing operations as follows:

“13.5.2 When small amounts of cleaning additives (detergent products) are added to water in order to facilitate tank washing, no additives containing pollution category X components shall be used except those components that are readily biodegradable and present in a total concentration of less than 10%. No restrictions additional to those applicable to the tank due to the previous cargo should apply.”

3.4.2 All cleaning additives evaluated by the BLG Working Group on the Evaluation of Safety and Pollution Hazards of Chemicals (ESPH) and found to meet the requirements of paragraph 13.5.2 of the revised MARPOL Annex II are consolidated into annex 10 of the MEPC.2/Circular. 3.4.3 In line with the decision taken by the Marine Environment Protection Committee at its fifty-sixth session, cleaning additives in Annex 10 submitted before 1 January 2007, which were evaluated through MEPC/Circ.363, will cease to be valid on 1 August 2010. To maintain a listing beyond this date, a re-evaluation of the cleaning additives concerned, in accordance with the revised guidelines given in MEPC.1/Circ.590, is required. 3.4.4 To reflect the different classes of entry which will be possible until 2010, products are now recorded as having been assessed by either MEPC/Circ.363 and/or MEPC.1/Circ.590 accordingly. 3.4.5 Additionally, in order to facilitate any future liaison with additive producers that may be required, a record of the Administrations having submitted the cleaning additives on behalf of the manufacturers is now included for all new product entries to Annex 10.

4 Notification of new entries 4.1 Guidelines for the provisional assessment of liquids transported in bulk are set out in MEPC.1/Circ.512. When notifying the Secretariat of any provisional assessment made under Tripartite Agreement, Administrations are requested to:

.1 specify whether in Lists 1, 2, 3 or 4; and

.2 provide all relevant data to be included in the circular. 4.2 As the majority of products notified are classified by the calculation method and are candidates for List 2, it is particularly important to provide the information to IMO in a format that will facilitate efficient and accurate transfer to the database used to generate the various lists included in this circular. 4.3 For hard copies with candidates for List 2, the preferred method is to notify one product per page in the following format:

being delayed while the application is returned to the originator. 4.4 For products being notified as candidates for Lists 1, 3 or 4, the format shown in appendix 3 of the annex to MEPC.1/Circ.512 is preferred. 4.5 While stressing the importance of correct data being supplied to the Secretariat, it should be noted in particular that, when proposing a product for Lists 2 and 4, the component responsible for the greatest pollution potential should be specified following the word “Contains” in the Shipping Name. Such component is that with the highest value obtained from % x component factor. In the event of there being more than one component with equal highest scores, discretion may be used in deciding whether one or both should be identified (see MEPC.1/Circ.512). The name of the component should be one of those appearing in chapters 17 or 18 of the IBC Code or those in Lists 1 or 5 of this circular.

4.6 It should also be pointed out that any cargo offered for bulk shipment shall be indicated in the shipping document by the product name under which it is listed in chapter 17 or 18 of the IBC Code or the latest edition of the MEPC.2/Circular or under which it has been provisionally assessed. In this respect, special attention should be given to BLG.1/Circ.17 regarding the use of the proper shipping name in offering bulk liquid cargoes for shipment. 4.7 When shipping a pollution hazard only mixture, the appropriate n.o.s. entry in the IBC Code, together with the tradename and “product contains” information, would form the proper shipping name. For example, if the trade name is IMO 1234 and it contains “Calcium long-chain alkyl salicylate (C13+)” as the component with the greatest pollution potential, then the correct product name could be: Noxious liquid, N.F., (5) n.o.s. (IMO 1234 contains Calcium long-chain alkyl salicylate

(C13+)) S.T. 2, Cat. Y 4.8 The Master of a type 2 ship certified to carry n.o.s. (5) products would then know that he can accept the cargo without concern as to fire, toxicity and other safety hazards and that, in the event of an accidental spill, he could report the name of the substance responsible for the pollution to the coastal State authorities. 5 Tripartite contact addresses 5.1 In accordance with the MEPC resolution on Tripartite Agreements, resolution MEPC.109(49), Administrations are requested to note that contact points which have not informed the Organization of their latest contact details should be deemed to have accepted the Tripartite Agreements whilst other contact points should still follow regulation 6.3 of MARPOL Annex II. 5.2 It would, therefore, be appreciated if Administrations could verify that information included in annex 8 of this circular is correct and supply any useful additional information, for example, e-mail addresses. As the Secretariat has only been supplied with the addresses listed, those Administrations which have not supplied any focal point address are requested to do so. In this respect, it should be noted that in future the tripartite agreement contact points will also be available through the GISIS database.
