The 240th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education

(NCTE) was convened on 19th

– 20th

May, 2017 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar,

Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of the

provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the permission of

Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee for its due

consideration and appropriate decision.

But in 239th ERC Meeting (Part-5) held on 28

th April - 2 May 2017, the

Committee decided that VT be constituted. The decision of the Committee for

constitution of VT is withdrawn and the decision of 238th meeting is confirmed

for issue of refusal order to the institution.

the institution is fit for conducting D.El.Ed. course for 50 intake (one basic

unit) of additional intake instead of 100 (two basic units)

In view of the above, the Committee decided as under: Based on the above decision, the recognition order No. ERC/239.6.174(Part-

4)/D.El.Ed.(Addl. Intake)/2017/53039 dated 02.05.2017 be rectified with

additional intake 50 (one basic unit), thus making the total intake 100 (existing 50 intake + additional intake 50) for the session 2017-2018 instead

of additional intake 100 (two basic units). A rectified order be issued to the

institution.

that the institution submitted faculty list of existing B.Ed. course instead of

D.El.Ed. course, which is not relevant, therefore, the Committee decided to

rectify the decision and withdraw the SCN in respect of item No. 239.6.263.

that formal recognition order under clause 7(16) of the NCTE Regulation 2014

for applied D.El.Ed. programme with an intake 50 (one basic unit) from the

academic session 2017-18 be issued to the institution.

After careful observation, it was found that the institution has not applied for

the said programme for the academic session 2017-2018, therefore, the

Committee decided to rectify the decision and withdraw the formal recognition

order under clause 7(16) in respect of item No. 239.6.191.

ATTENTION! 1. The committee unanimously decided that the institution may reply in

response to the decision of the committee uploaded on the ERC website

without waiting for formal letters from the office of ERC. The replies so

received will also be considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website: www.ercncte.org for detail).

3. The institution needs to submit list of 10 schools for internship and school

based activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of

units either one or two if it was not submitted earlier.

5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any

course or training in Teacher Education without obtaining recognition or

permission under this Act, the qualification in teacher education obtained

pursuant to such course or training or after undertaking a course or training in

such institution, shall not be treated as a valid qualification for purposes of

employment under the Central Government, any State Government or

University, or in any school, college or other educational body aided by the

Central Government or any State Government.

6. The Committee suggested to prepare Data Bank for the teachers.

7. The institution needs to install Fire Safety equipment and submit

the Fire Safety Certificate if not submitted earlier.

ER-240.2 Court Case / After Court Case

1. 240.2.1

Anjali Memorial College of Education and Training, Plot No. - 15, 16, Vill -

After considering and examining the application along with the documents submitted by the institution, the

agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received

from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

(i) The institution was refused for recognition of B.Ed. course vide Order No. 49381 dated 27.09.2016 on

the grounds of NOC issued on 17th July, 2015 from the concerned affiliating body after the stipulated

date of 15th July, 2015.

(ii) The Appellate Authority of NCTE Hqrs. vide Order No. 89-693/2016 Appeal/2nd

Meeting/2017 dated

06.03.2017 has confirmed the Order of ERC.

(iii) Being aggrieved, the institution filed W.P. No. 10967 of 2017 against the ERC’s order and the Hon’ble

High Court of Calcutta vide Order dated 16.04.2017 directed inter alia “In the back drop of above

discussion, the NCTE is directed to revisit the issue of grant of recognition in accordance with Law to the

B.Ed. college proposed to be set up by the petitioner within a reasonable time frame, preferably not later

than six weeks from the date of communication of this order.”

(iv) As per direction of the Hon’ble High Court of Calcutta dated 16.04.2017, the ERC observed the matter

and found that the NOC issued for B.Ed. course after the stipulated date i.e. 17th

July, 2015 which is not

accepted for grant of recognition.

In view the above, the Committee decided as under:

The committee is of the opinion that application bearing Code No. ERCAPP2701 of the institution regarding

recognition of B.Ed. Programme is refused under section 14(3)(b) of NCTE Act 1993.

The ERC in its 237th meeting considered the matter and issued a letter to the institution on 18.04.2017 to submit

institution submitted reply vide letter Reference No. 29(SP)-2017 dated 01.05.2017 with an affidavit, copy of
