The results of this sampling event (see attachment) indicate petroleum contaminant levels remain above - Vermont Groundwater Enforcement Standards (VGES) for 1,3,5 Trimethyl Benzene, 1,2,4 Trimethyl Benzene and Napthalene in monitoring well MW-A (see attached site map). It is H&N's understanding that the Vermont Department of Environmental Conversation (VDEC) is interested in further remediation efforts at this site. To facilitate this process H&N has included a cost estimate for four months operation of a Vapor Extraction System (VES). This system would utilize bio-filters instead of carbon to reduce material and carbon disposal costs. H&N has effectively used this remediation option at other sites in Vermont with good results. Due to the limited scope of contamination and moderate historic volatile VES influent levels H&N believes this site an ideal candidate for bio-rernediation technology. 11 STANDARD TERMS AND CONDITIONS

1. This is not a not-to-exceed cost estimate. Costs will not exceed the total specified herein by more than 20% without prior authorization of the client.

4. Terms of Payment: Net 3 0 days, regardless of the outcome of the results of our services, or the permit processes. Interest of 1.5% per month may be charged on balances more than 6 0 days overdue. Signer agrees to pay interest and any reasonable attorney and court fees for collection of overdue bills.

5. These rates are valid through December 31, 2002. Hourly billing rates, equipment rental charges, etc. are subject to change at that time.

In recognition of the relative risks and benefits of the project to both the Client and H&N, the risks have been allocated such that the Client agrees, to the fullest extent permitted by law, to limit the liability of H&N and his or her subconsultants to the Client and to all construction contractors and subcontractors on the project for any and all claims, losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, so that the total aggregate liability of H&N and his or her subconsultants t o all those named shall not exceed $7,197.62, or H&Nrs total fee for services rendered on this project, whichever is greater. Such claims and causes include, but are not limited to negligence, professional errors or omissions, strict liability, breach of contract or warranty.
