“Heidelberg is itself a resplendent romantic, where spring entwines the houses and courtyards

and everything ordinary with vines and flowers, and castles and forests tell a wonderful sto-

ry of times gone by, as though there were nothing evil in the world”, wrote the poet Joseph

von Eichendorff at the start of the 19th century in his memoirs. Heidelberg has succeeded in

preserving this irresistible magic right up to the present day. The Neckar, which winds pictur-

esquely through the green valley, and the romantic castle ruins, which tower over the roofs of

the scenic old town, attract several million visitors to the town every year. Heidelberg is linked

as inextricably to the castle – residence of the Electors of the Palatinate for almost five centu-

ries – as it is to the over 600-year old university. The history of the town is omnipresent. The

Heidelberg Philosopher’s Walk is widely known. At one time, scholars strolled here in stiff frock

coats to clear their minds with a walk. On the sunny side of the Heiligenberg, many scholars

often gained new insights, and there were always unique views of the town, the river, the Old

Bridge, the Castle and the almost 600-meter high “Königstuhl” (King’s Seat hill).

The Heidelberg Castle illumina-tions cast a spell on thousands of people every year. Bengali flares immerse Heidelberg Castle in mysterious red fiery glow. The Stift Neuburg Monastery has been on the outskirts of the town of Heidelberg for almost 900 years in what is now Ziegel-hausen. Embedded in the beau-tiful Neckar valley with a divine view of the winding river and the slopes of the Odenwald mountain range, the abbey is an attraction for both locals and tourists alike with a farm shop, restaurant and an organic brewery. After a tour through the winding alleys of the

old town, entirely new perspec-tives of the town will be opened up to you with a boat trip on the Neckar. You will travel along the banks of the river up to Stift Neu-burg Monastery with the Weissen Flotte. A guided tour through the abbey awaits you there. And then it’s up to the castle with the funicular railway. 8. Witches, oppressors and poor sinners:Straight out of Heidelberg’s judicial history

In earlier times, executions were real fairs. In 1762 the university was closed so the students could take part in an execution - an “abhor-rent example”. In this tour you will be led through the centuries with a “real” witch. On the way through the town, she tells of amusing or-dinances and gruesome punishments. Luther TourHeidelberg was a milestone en route to the Reformation – Luther’s not uneventful journey to Heidelberg in 1518 was his first theological appearance outside of Wittenberg after nail-ing his 95 theses to the door on October 31, 1517. On the invitation of the Augustine Or-der and Elector Ludwig V., he led the Heidel-berg Disputation in April 1518 in the local Au-gustine Monastery and, in doing so, defended the fundamental concept of his new theology – the full dependency of people on the grace of God. This interesting stroll will lead you on Luther’s trail through the town.

ABBEY

STIFT NEUBURG

Embedded in the Neckar valley, surrounded by lush green with a divine view of the winding river and the slopes of the Odenwald moun-tain range, the monastery is an attraction for both locals and tourists. The Benedictine ab-bey was founded back in 1130 by the Lorsch monastery and constantly battled a difficult economic situation until the monastery was dissolved in 1562. For a long time after that, the building was used for a variety of pur-poses, including as a “Jungfern-Stift” (con-vent), where noble women lived together as a “society of virtuous gentlewomen” (thus the current name Stift Neuburg - convent). Since 1927 it has once again been inhabited by monks according to the rule of St. Benedict. A farm shop with organic products from the region and a small organic brewery are con-nected to the monastery. Two Heidelberg attractions draw closer together, because with the castle ticket you have the option of reaching the romantic Heidelberg Castle comfortably, cheaply, and in an environmen-tally-friendly way by taking the funicular railway. The lower funicular rail to Molkenkur station is the most modern funicular railway and the upper one up to the Königstuhl is the oldest fu-nicular railway in Germany. Jump in, the experience it well worth it!

The lower funicular railway from the Korn-markt station via the Castle to the Molken-kur station is equipped to facilitate dis-abled access. Strollers must be carried on the steps. The conductors are happy to as-sist you. We recommend that families with small children use a buggy.

Low emission zone for cars and buses

As of 2010, there has been a “green zone” in effect in Heidelberg where only vehicles which meet certain exhaust conditions may drive. Vehi-cles which are used in the low emission zone must have stickers which designate their emission group. GENERAL TERMS AND CONDITIONSTerms and Conditions of Travel of Heidelberg Marketing GmbH for Group Package Trips

Dear guests,Insofar as a valid agreement has been reached, the fol-lowing Terms and Conditions shall form the content of the Travel Agreement concluded between you and Hei-delberg Marketing GmbH when you make a booking. They supplement and complete the statutory provisions of Ar-ticles 651a - m of the German Civil Code [Bürgerliches Gesetzbuch] and the information requirements for tour operators in accordance with Articles 4 - 11 of the Ger-man Ordinance on the Requirements for Information and Clear Documentation in Civil Law [Verordnung über In-formations- und Nachweispflichten nach bürgerlichem Recht]. Please read these Terms and Conditions of Travel carefully before making your booking.

1. Conclusion of Travel Agreement, Status of Group Con-tracting Agency and Group Representative1.1. The Group Contracting Agency is the institution, the association with or without legal capacity, the company or other legal entity under private or public law that commis-sions Heidelberg Marketing GmbH to provide the group trip.1.2. The Group Representative is the person acting on behalf of the Group Contracting Agency during the trip, in particular the responsible leader appointed by the Group Contracting Agency.1.3. In the case of trips involving private groups in the sense of these Terms and Conditions of Travel, the par-ticipants have the status of a traveler within the meaning of the statutory provisions and with the legal status of a beneficiary pursuant to the provisions of a contract for the benefit of third parties.1.4. A group trip can only be booked in writing. 1.5. For “travel offers with overnight accommodation”, at the request of the Group Contracting Agency and after agreeing the details, Heidelberg Marketing GmbH sends a binding offer to conclude a Travel Agreement to the Group Contracting Agency as an independent contrac-tual partner and payer. The Agreement shall only enter into force when Heidelberg Marketing GmbH receives the written order acceptance issued by the Group Con-tracting Agency within the acceptance period stipulated by Heidelberg Marketing GmbH. The customer is not en-titled unilaterally to make any alterations or additions to the written declaration of acceptance. 1.6. In the case of “other offers” (guided tours, excur-sions, boat trips), by submitting a booking, the Group Contracting Agency issues a binding offer to conclude a Travel Agreement with Heidelberg Marketing GmbH as an independent contractual partner and payer. The Group Contracting Agency shall be bound to its offer of an Agreement for 10 days. The Agreement shall only enter into force when the Group Contracting Agency receives the written booking confirmation/invoice from Heidelberg Marketing GmbH. Should the content of the booking con-firmation differ from the content of the Group Contract-ing Agency’s booking, or if Heidelberg Marketing GmbH first issues a binding offer to the Group Contracting Agen-cy without a booking having been made, the Travel Agree-ment shall enter into force based on the modified book-ing confirmation or on the offer of Heidelberg Marketing GmbH, provided the Group Contracting Agency notifies its acceptance in writing within the period stipulated by Heidelberg Marketing GmbH for this purpose, or within 10 days if no period is stipulated.

2. Contractual Bases, Services, Travel Agents, Third-Par-ty Brochures2.1. The contractual service obligation of Heidelberg Mar-keting GmbH is determined by the trip description togeth-

er with the booking confirmation and any supplementary information on the respective trip provided by Heidelberg Marketing GmbH to the Group Contracting Agency. In-sofar as Heidelberg Marketing GmbH has submitted an offer in the sense of paragraph 1.5 or paragraph 1.6 sen-tence 4 to the Group Contracting Agency, the foundation of the contractual service obligation shall be exclusively the content of this offer and any other information and statements referred to therein pertaining to the services of Heidelberg Marketing GmbH.2.2. Service providers (e.g., hotels, transport companies) and agencies are not authorized to enter into agreements, provide information or make assurances that differ from the agreed content of the Travel Agreement, are in excess of the contractually agreed services of Heidelberg Market-ing GmbH or contradict the travel description.2.3. Brochures for locations and hotels that are not issued by Heidelberg Marketing GmbH shall not be binding for Heidelberg Marketing GmbH and its service obligation, unless they have been rendered part of the object of the trip description or the content of the service obligation of Heidelberg Marketing GmbH by explicit agreement with the Group Contracting Agency.

3. Changes to the Service3.1. Changes to major travel services making up the agreed content of the Travel Agreement, which are nec-essary following the conclusion of the Agreement and are not made by Heidelberg Marketing GmbH in bad faith, shall only be permitted insofar as the changes are minor and do not have a negative impact on the overall make-up of the trip.3.2. This shall not affect any guarantee claims insofar as there are deficiencies in the modified services.3.3. Heidelberg Marketing GmbH is obliged to notify the Group Contracting Agency of major changes to services as soon as it learns of the reason for the change.3.4. In the event of a significant change to a major trip ser-vice, the Group Contracting Agency/the participants shall be entitled to withdraw from the Travel Agreement free of charge or to request participation in a trip of at least equal value assuming that Heidelberg Marketing GmbH is in a position to offer such a trip from its range at no additional charge to the Group Contracting Agency/the participant. The Group Contracting Agency/the participant must as-sert these rights against Heidelberg Marketing GmbH as soon as Heidelberg Marketing GmbH declares that the travel service will be modified or the trip canceled.

4. Payment4.1. All obligations on the part of the Group Contracting Agency/the participant to make advance payments and/or outstanding payments shall be conditional upon the obligation for Heidelberg Marketing GmbH to hand over a secured payment certificate pursuant to Article 651k of the German Civil Code.4.2. Heidelberg Marketing GmbH may either issue the Group Contracting Agency an overall secured payment certificate for all participants, or one secured payment certificate for each participant, with the proviso that the Group Contracting Agency is obliged either to hand over the certificates to the individual participants or to hold them in trust for the participants as Heidelberg Market-ing GmbH sees fit.4.3. Prior to the handover of a secured payment certifi-cate in accordance with the provisions of paragraphs 4.1 and 4.2, the Group Contracting Agency and the Group Representatives are expressly forbidden from request-ing or accepting any advance payments or outstanding payments of the trip price from the participants, or doing so earlier than on the due dates agreed with Heidelberg Marketing GmbH.

4.4. The Group Contracting Agency and its Group Rep-resentatives shall only be authorized to collect any pay-ments with regard to Heidelberg Marketing GmbH if this has been expressly agreed with the Group Contracting Agency and/or Group Representative. If such an agree-ment has been reached, collection shall take place by the Group Contracting Agency/Group Representative acting as trustees for Heidelberg Marketing GmbH.4.5. In accordance with the above provisions, and partic-ularly those relating to the secured payment certificate, the Group Contracting Agency must make an advance payment that is due immediately, as a separate obliga-tion that is independent of the obligations incumbent on the participants. The amount of the advance payment is equal to 10 % of the price of the trip.4.6. Insofar as Heidelberg Marketing GmbH has complied with its obligation to hand over the secured payment cer-tificate in line with the above provisions, the outstand-ing payment shall fall due 4 weeks prior to the start of the trip, when it has been established that the trip can no longer be canceled due to failure to reach an agreed minimum number of participants in accordance with para-graph 9 of these Terms and Conditions of Travel.4.7. Insofar as Heidelberg Marketing GmbH is prepared and in a position to provide the travel services constitut-ing the subject of the contract, and the Group Contracting Agency does not hold any statutory or contractual right of retention, no claim to usage of the travel services or handover of the travel documents shall exist without full payment of the trip price.4.8. If the advance payment and/or the outstanding pay-ment are not paid on or before the agreed payment dates, Heidelberg Marketing GmbH shall be entitled to withdraw from the Travel Agreement, after having issued a warn-ing and setting a deadline for payment, and to charge the Group Contracting Agency for the costs of withdrawal pursuant to paragraph 7 of these Terms and Conditions.

5. Payment Obligation of the Group Contracting Agency in the case of an Agreed Minimum Number of Partici-pants and Scaled Prices5.1. If a specific minimum number of participants has been agreed with the Group Contracting Agency as a basis for pricing, the Group Contracting Agency shall be liable for payment of the relevant trip price as an independent pay-ment obligation, irrespective of the actual number of par-ticipants and without prejudice to the right of Heidelberg Marketing GmbH to withdraw from the Agreement, where applicable in accordance with the provisions set out in paragraph 10 of these Terms and Conditions.5.2. If scaled prices have been agreed with the Group Contracting Agency in the sense that the price per par-ticipant increases if specific numbers of participants are not met, the Group Contracting Agency shall be liable for the relevant payments as independent contractual obli-gations, irrespective of the payment obligations of the participants themselves.

6. Withdrawal by the Customer Prior to Start of the Trip / Cancellation Costs6.1. The Group Contracting Agency and the trip partici-pants may withdraw from the trip at any point prior to its start. Withdrawal must be notified to Heidelberg Market-ing GmbH at the address stated in these Terms and Con-ditions. The Group Contracting Agency/trip participant is recommended to declare the withdrawal in writing. If the Group Contracting Agency is a trader or a legal entity un-der private or public law, it may only issue declarations of withdrawal in writing.6.2. In the event that the Group Contracting Agency or the participants withdraw prior to the start of the trip or that participants do not turn up for the trip, Heidel-

berg Marketing GmbH shall lose its claim to the price of the trip. However, this shall not affect the payment ob-ligations incumbent on the Group Contracting Agency pursuant to paragraph 5 of these Terms and Conditions. Heidelberg Marketing GmbH may, insofar as it is not re-sponsible for the withdrawal or a situation of force ma-jeure exists, demand appropriate compensation for the trip preparations made up to the withdrawal and for its outlay, depending on the relevant trip price. The Group Contracting Agency and participants shall be jointly and severally liable for these withdrawal costs.6.3. Heidelberg Marketing GmbH has scaled this com-pensation claim by time, i.e., taking into consideration how close the date of withdrawal is to the contractual-ly agreed start of the trip, as a flat-rate sum based on a percentage relationship to the trip price and, in calculat-ing the compensation, has taken into account the usual expenses saved and other possible conventional uses of the travel services. The compensation shall be calculat-ed as follows, in accordance with the date on which no-tification of withdrawal is received from the customer:a) For “travel offers with overnight accommodation”:• 10 % up to 31 days before the start of the trip• 25 % from the 30th day to the 21st day before the start of the trip• 50 % from the 20th day to the 15th day before the start of the trip• 80 % from the 14th day to the 7th day before the start of the trip• 90 % from the 6th day and in the event that the customer does not turn up for the tripb) For “additional offers” (guided tours, excursions, boat trips): 50 % from the 9th day to the 5th day before the start of the trip 90 % from the 4th day and in the event that the customer does not turn up for the trip6.4. In all cases, the Group Contracting Agency and the participants shall be at liberty to prove to Heidelberg Mar-keting GmbH that the latter did not incur any loss, or in-curred a significantly lower loss than the flat-rate sum it is demanding.6.5. Heidelberg Marketing GmbH reserves the right to claim specific sums higher than the flat-rates set out above. In this case, Heidelberg Marketing GmbH must name and prove a concrete figure for the compensation being claimed, accounting for any saved expenses and any other use of the travel services. 6.6. The Group Contracting Agency is advised to strong-ly recommend to the participants that they take out trip cancellation insurance and insurance to cover repatria-tion costs in the event of accident or illness; participants are strongly recommended to take out these insurance policies themselves, independently of corresponding measures and offers from the Group Contracting Agency.6.7. The above provisions shall not affect the customer’s right to provide a replacement participant pursuant to the provisions of Article 651b of the German Civil Code. In corresponding application of the statutory provision set out in Article 651b of the Civil Code, the Group Contract-ing Agency and the Group Representative shall also hold the right to provide replacement participants.

7. Changes to Reservations7.1. Following conclusion of the Agreement, the Group Contracting Agency/participant shall have no claim to changes regarding the date of the trip, the trip destina-tion, the location at which the trip starts, the accommo-dation, the type of transport or the pick-up or drop-off points in the case of bus tours (changes to reservations). If a change to a reservation is possible and is neverthe-less carried out at the wish of the Group Contracting Agency/participant, Heidelberg Marketing GmbH may, up to the date of the first cancellation stage specified in the cancellation costs, demand an administration fee of €20.00 per change from the person or organization ini-tiating the change.7.2. Insofar as it is possible to carry them out at all, later requests for changes to reservations can only be imple-mented following withdrawal from the Travel Agreement pursuant to paragraph 6, subject to the terms and con-

ditions set out therein, and simultaneous reregistration. This does not apply to requests for changes to reserva-tions that incur only minimal costs.7.3. The above regulations shall not affect special agree-ments concluded between the Group Contracting Agen-cy and Heidelberg Marketing GmbH with regard to ser-vice changes, service limitations, optional services and the amendment of allocations and participant numbers.

8. Unused ServicesIn the event that the Group Contracting Agency and/or the participants do not make use of individual travel ser-vices that have been offered to them in a proper manner for reasons attributable to them (e.g., due to early return or for other compelling reasons), they shall have no claim to a pro-rata refund of the trip price. Heidelberg Market-ing GmbH shall strive to obtain refunds for the expenses it has saved from the service providers. This obligation shall lapse in the case of extremely minor services or if a refund would contravene statutory or official provisions.

9. Withdrawal by Heidelberg Marketing GmbH due to Failure to Reach a Minimum Number of Participants9.1. In the event of failure to reach a minimum number of participants, Heidelberg Marketing GmbH may withdraw from the Agreement with the Group Contracting Agency and the participants pursuant to the following regulations:a) The minimum number of participants and the latest date for withdrawal by Heidelberg Marketing GmbH must be stated in the specific trip description or, in the case of standardized regulations for all trips or certain types of trips, in a general service description.b) Heidelberg Marketing GmbH must state the minimum number of participants and the latest date for withdraw-al in the booking confirmation, or make reference to the relevant statements in the brochure in said confirmation.c) Heidelberg Marketing GmbH undertakes to notify the participants of cancellation of the trip without delay if it is established that the trip will not take place due to failure to reach the minimum number of participants. d) Heidelberg Marketing GmbH shall not be permitted to withdraw later than 4 weeks before the start of the trip.e) In the event of cancellation, the customer may request participation in a trip of at least equal value assuming that Heidelberg Marketing GmbH is in a position to of-fer such a trip from its range at no additional charge to the customer. The customer must assert this right against Heidelberg Marketing GmbH immediately after the latter declares its intention to cancel the trip.9.2. In the event that the trip does not take place for this reason, the customer shall immediately be refunded any payments that he/she has made towards the price of the trip.

10. Termination on Grounds of Conduct10.1. Heidelberg Marketing GmbH may terminate the Travel Agreement without notice in the event that the Group Contracting Agency and/or the Group Represen-tative and/or the participant cause ongoing disruption, in spite of a warning from Heidelberg Marketing GmbH, or in the event that they behave contrary to contract to such an extent that the immediate termination of the Agree-ment is justified. In the event of behavior contrary to con-tract on the part of the Group Contracting Agency and/or the Group Representative, this shall only entitle Heidel-berg Marketing GmbH to terminate the agreements with the individual participants if and insofar as it becomes objectively impossible or unreasonable for Heidelberg Marketing GmbH to carry out the trips for the individ-ual participants due to said behavior on the part of the Group Contracting Agency and/or Group Representative.10.2. In the event that Heidelberg Marketing GmbH ter-minates the Agreement, it shall retain its claim to the trip price; however, it must allow offsetting of the value of the saved expenses and of the benefits that it obtains from another use of the unused service, including the pay-ments refunded to it by the service providers.

11. Obligations of the Customer11.1. The obligation to report deficiencies arising from

Article 651d, paragraph 2 of the Civil Code is set out in specific terms for trips with Heidelberg Marketing GmbH as follows:a) Irrespective of the corresponding independent obliga-tions incumbent on the Group Contracting Agency/Group Representative, the participant undertakes to notify Hei-delberg Marketing GmbH without delay of any deficien-cies that arise and to request a remedy.b) The participant shall be provided with information re-garding Heidelberg Marketing GmbH as an entity, the days and times when it is possible to make contact with it and its contact details at latest when sending the trav-el documents.c) In the event of the participant not giving notification of a deficiency, any claims on the part of the partici-pant will be entertained only if the participant through no fault of his own was unable to fulfill his obligation to give notification.11.2. Tour guides, agents and employees of service pro-viders are not entitled and not authorized by Heidelberg Marketing GmbH to confirm deficiencies or to recognize claims against Heidelberg Marketing GmbH.11.3. If a deficiency in the trip has a significant negative impact on said trip, the Group Contracting Agency or the participant may terminate the Agreement. The same ap-plies if the Group Contracting Agency/participant cannot reasonably be expected to travel as a result of a deficien-cy acknowledged as significant by Heidelberg Marketing GmbH. The following shall apply with regard to this right of cancellation:a) Cancellation shall only be permitted once Heidelberg Marketing GmbH or, where present and contractually agreed as a point of contact, its agents (tour operator, agency), have allowed a reasonable deadline set by the participant to pass without remedying the deficiency. b) A deadline does not have to be set if a remedy is im-possible or if Heidelberg Marketing GmbH/its agents re-fuse to seek a remedy or if immediate termination of the Agreement is justified by a particular interest of the par-ticipant.c) The Group Contracting Agency’s right to terminate the Agreement shall apply only to the participants for whom the aforementioned prerequisites for termination are in place, unless the deficiencies leading to termination are objectively so serious that the participants and/or the Group Contracting Agency itself cannot reasonably be expected to continue the trip.

12. Special Conditions for Trips Involving Private Groups12.1. Heidelberg Marketing GmbH shall not be liable for services and parts of services, irrespective of type, that are offered, organized, carried out and/or made available to the participants by the Group Contracting Agency/Group Representative in addition to the services of Hei-delberg Marketing GmbH, with or without the knowl-edge of Heidelberg Marketing GmbH. In particular, these shall include:a) Travel organized by the Customer to and from the points of departure and return contractually agreed with Heidelberg Marketing GmbH.b) Events before and after the trip and at the destination that are not included in the scope of services of Heidel-berg Marketing GmbH.c) Tour guides arranged by Heidelberg Marketing GmbH at the request of the Customer.12.2. Heidelberg Marketing GmbH shall not be liable for measures taken and omissions made by the Group Con-tracting Agency, the Group Representative or the tour guide, whose services are merely arranged by Heidelberg Marketing GmbH, prior to, during and after the trip, and particularly not for the fol-lowing if these have not been agreed with Heidelberg Marketing GmbH:a) Changesb) Instructions issued to local guidesc) Special agreements with the various service providersd) Information and assurances provided to the trip par-ticipants.12.3. Insofar as the liability of Heidelberg Marketing GmbH towards the trip participant is to be linked to the

trip price, only the trip price for the trip participant agreed between the Group Contracting Agency and Heidelberg Marketing GmbH will be definitive. No account is taken of any supplements whatsoever that are levied by the Group Contracting Agency from the trip participant.12.4. The Group Contracting Agency, the Group Repre-sentative and the tour guide, whose services are mere-ly arranged by Heidelberg Marketing GmbH, are neither entitled nor authorized in the name of Heidelberg Mar-keting GmbH to recognize complaints or claims brought by the trip participants before, during or after the trip.12.5. Notifications of deficiencies by trip participants that are made only to the Group Contracting Agency and/or Group Representative shall not be sufficient. However, the Group Contracting Agency/Group Representative un-dertakes to immediately inform the tour operator or agen-cy employed by Heidelberg Marketing GmbH for this pur-pose of any such notification of defects. If a tour operator or agency is not obliged to act as a point of contact for notification of deficiencies in accordance with the con-tractual agreements, notification must be made immedi-ately to the head office of Heidelberg Marketing GmbH.12.6. Irrespective of the obligations of the trip participants to issue notification of deficiencies and of the obligation incumbent upon the Group Contracting Agency/Group Representative to report deficiencies that have been no-tified to them and pass these onto Heidelberg Marketing GmbH immediately in accordance with paragraph 12.5, the Group Contracting Agency/Group Representative has an independent obligation to report deficiencies without delay and to request a remedy.12.7. Claims of the Group Contracting Agency and the trip participants will only be entertained if they are unable to comply with the aforementioned provisions through no fault of their own.

13. Restriction of Liability13.1. The contractual liability of Heidelberg Marketing GmbH for losses that do not arise from loss of life, phys-ical injury or damage to health shall be restricted to three times the price of the trip,a) insofar as the loss was not caused by the Group Con-tracting Agency/participant intentionally or due to gross negligence, orb) insofar as Heidelberg Marketing GmbH is liable for the loss incurred by the Group Contracting Agency/partici-pant solely through the fault of a service provider.13.2. The tort liability of Heidelberg Marketing GmbH for material damages which are not based on intent or gross negligence is limited to three times the price of the trip.13.3. Heidelberg Marketing GmbH shall not be liable for disruptions to services, personal injury and material dam-age in connection with services that are only arranged as third-party services (e.g., excursions, sporting events, theater visits, exhibitions, transport services to and from the advertised starting point and destination) if these ser-vices are explicitly labeled as third-party services in the trip description and the booking confirmation, stating the arranged contractual partners, such that the customer shall recognize them as not forming part of the travel ser-vices offered by Heidelberg Marketing GmbH. However, Heidelberg Marketing GmbH shall be liablea) for services that consist of transporting the participant from the advertised start point of the trip to the adver-tised destination, interim transport during the trip and accommodation during the trip,

b) if and insofar as the reason for any loss incurred by the Group Contracting Agency/participant resulted from the breach of obligations on the part of Heidelberg Market-ing GmbH relating to information, explanation or organi-zation. The above provisions shall not affect any liability on the part of Heidelberg Marketing GmbH due to the breach of its duties as a travel agent.

14. Claims and Statute of Limitations14.1. The Group Contracting Agency and/or participant must assert claims due to non-contractual performance of the trip within one month of the date for completion of the trip specified in the Agreement. If the deadline falls on a Saturday, Sunday, or an officially recognized public holiday in the place of declaration, the deadline shall be automatically extended to the next working day.14.2. Within the deadline, claims may only be assert-ed against Heidelberg Marketing GmbH at the address given below.14.3. After the deadline has passed, the Group Contract-ing Agency/participant may only assert claims if they have been prevented from meeting the deadline through no fault of their own. This deadline also applies to the reg-istration of luggage damage or luggage delivery delays in connection with flights, if warranty rights are assert-ed under sections 651c, paragraph 3, 651d and 651e, paragraphs 3 and 4 of the Civil Code. A claim for com-pensation for luggage damage must be lodged within 7 days and a claim for compensation for delayed luggage within 21 days of handover.14.4. Claims asserted by the customer in accordance with Articles 651c to f of the Civil Code for loss of life, phys-ical injury or damage to health where these arise from an intentional or grossly negligent breach of duty on the part of Heidelberg Marketing GmbH or one of its legal representatives or vicarious agents shall lapse according to the statute of limitations after two years. This shall also apply to claims for compensation for other loss or dam-age arising from an intentional or grossly negligent breach of duty on the part of the Heidelberg Marketing GmbH or one of its legal representatives or vicarious agents.14.5. All other claims asserted in accordance with Arti-cles 651c to f of the Civil Code lapse according to the statute of limitations after one year.14.6. The statute of limitations in the sense of paragraphs 14.3 and 14.4 starts on the day on which the trip should have ended according to the contractual agreements. Paragraph 14.1 sentence 2 shall also apply.14.7. While negotiations between the customer and Hei-delberg Marketing GmbH regarding the claim or the cir-cumstances on which the claim is based remain unre-solved, then the statute of limitations will be suspended until the customer or Heidelberg Marketing GmbH re-fuses to continue the negotia-tions. The statute of lim-itations shall begin at the earliest three months after the end of the suspension.

15. Regulations Relating to Passports, Visas and Health15.1. Heidelberg Marketing GmbH shall inform the Group Contracting Agency/the participant for nationals of a country within the European Union where the trip is offered of the regulations regarding passports, visas and health prior to conclusion of the Agreement, and of any changes to these prior to the start of the trip. For nation-als of other countries, the competent consulate will pro-vide the necessary information. It is assumed that there

are no special factors present with regard to the customer and any cotravelers (e.g., dual nationality, statelessness).15.2. The participant shall be responsible for procuring the necessary travel documents and carrying these with him/her, for any vaccinations that may be required, and for compliance with customs regulations and those per-taining to foreign currency. The participant shall be liable for any penalties that result from the failure to comply with these provisions, e.g., the payment of cancellation costs. This shall not apply in the event that Heidelberg Marketing GmbH has not provided information, or has provided information that was inadequate or incorrect.

16. Applicable Law and Place of Jurisdiction16.1. The contractual relationship between the Group Contracting Agency/participant and Heidelberg Market-ing GmbH shall be governed exclusively by German law. This shall also apply to the legal relationship as a whole. 16.2. The Group Contracting Agency/participant may only institute legal proceedings against Heidelberg Marketing GmbH at its head office. 16.3. Lawsuits brought by Heidelberg Marketing GmbH against the Group Contracting Agency/participant, shall be referred to the court having jurisdiction over the cus-tomer’s place of domicile. The agreed place of jurisdiction for lawsuits brought against Group Contracting Agencies/participants who are merchants, legal entities under public or private law, or persons domiciled or ordinarily resident abroad, or whose domicile or ordinary place of residence is unknown at the time the lawsuit is brought, shall be the head offices of Heidelberg Marketing GmbH.16.4. The above provisions shall not be applicable if and insofar as mandatory provisions applicable to the Trav-el Agreement within the EU member state to which the participant belongs are more favorable for the customer and/or the Group Contracting Agency than the above provisions or the correspond-ing German regulations.
