HEAVY ENGINEERING RESEARCH LEVY ACT AMENDMENT ORDER 2021

Proposal

1 This paper seeks authorisation for submission to the Executive Council of the Heavy Engineering Research Levy Act Amendment Order 2021.

Policy

2 The Heavy Engineering Research Levy Act Amendment Order 2021 (Appendix 1) will amend Schedules 2 and 3 of the Heavy Engineering Research Levy Act 1978 (the Act) by Order in Council, to ensure the Tariff item numbers and descriptions match those listed in the Working Tariff Document (the Tariff).

3 On 16 January, the Cabinet Business Committee (CBC-21-MIN-0012):

3.1 approved the proposed amendments to Schedules 2 and 3

3.2 invited the Minister of Research, Science and Innovation to issue drafting instruction to the Parliamentary Counsel Office to give effect to these amendments

3.3 authorised the Minister of Research, Science and Innovation to make decisions on any minor and technical matters that may arise during the drafting process.

4 On 2 February, Cabinet confirmed these decisions (CAB-21-MIN-0006).

5 The Act authorises the collection of a levy from the heavy engineering and related industries to provide funds for the Heavy Engineering Research Association (HERA) to promote and conduct industry good research into heavy engineering. Schedules 2 and 3 specify the items levied at two differentrates.

6 The changes to Schedule 2 will correct a 2016 administrative error that resulted in certain Tariff item numbers in Schedule 2 not matching those listedin the Tariff. The Tariff sets out tariff rates on imported goods and is maintained by Customs.

7 Because of this error, the Heavy Engineering Research Association (HERA) and Customs have been unable to collect the levy on these items since 1 January 2017. This has reduced the amount of funding for industry good research by around $330,000 over the past 3 years. HERA informed the

Ministry of Business, Innovation and Employment (MBIE) of this error in June 2020.

8 The changes to Schedule 3 are routine and will amend minor typesetting differences between Tariff item descriptions in Schedule 3 of the Act and the Tariff. These differences do not affect HERA or Customs’ ability to collect the levy. However, we want to take this amendment opportunity to ensure consistency of item classification between the two regulatory documents.

Timing and 28-day rule

9 The proposed changes will come into force on 26 August 2021, seven weeks after the Order in Council is made and is gazetted on 8 July 2021.

Compliance

10 These amendments to Schedules 2 and 3 by Order in Council are being madein order to accord with amendments made to the Tariff, and to comply with therequirements contained in Section 4(4) of the Act.

11 The regulations comply with:

11.1 the Treaty of Waitangi;

11.2 the rights and freedoms contained in the New Zealand Bill of Rights Act1990 or the Human Rights Act 1993;

11.3 the principles and guidelines set out in the Privacy Act 2020;

11.4 the Legislation Guidelines (2018 edition).

Regulations Review Committee

12 I do not consider that there are grounds for the Regulations Review Committee to draw the disallowable instrument or regulations to the attention of the House of Representatives under Standing Order 327.

Certification by Parliamentary Counsel

13 The draft regulations were certified by the Parliamentary Counsel Office (PCO) as being in order for submission to Cabinet.

Impact Analysis

14 The Regulatory Quality Team at the Treasury has determined that the regulatory proposals in this paper are exempt from the requirement to provide a Regulatory Impact Statement on the basis that they have no or minor impacts on businesses, individuals or not for profit entities.

Publicity

15 Once the Order in Council is made and gazetted, HERA will inform its members of the changes to the levied items through its website www.hera.org.nz.

16 Customs will also advise customs brokers and importers of the relevant leviedgoods that they need to update their systems for the changes in Schedule 2 ofthe Act.

Proactive release

17 I intend to release this paper proactively. Any redactions made will be consistent with the Official Information Act 1982.

Consultation

18 MBIE has consulted with Customs, The Treasury and HERA on the proposed amendments to Schedule 2 of the Act.

19 MBIE has consulted with Customs and HERA on the proposed amendments to Schedule 3 of the Act.

20 Industry consultation is not required on amendments to the Tariff item numbers and descriptions in Schedules 2 and 3. The Act only requires consultation with The New Zealand Manufacturers and Exporters Association (now known as the Manufacturers Network) on levy rate changes.

21 HERA has briefed their Board on the Schedule 2 administrative error. The Board comprises a range of industry members and the CEO of the Manufacturers Network.

Recommendations

I recommend that the Cabinet Legislation Committee:

1 note that on 16 January, the Cabinet Business Committee agreed to the amendments to Schedules 2 and 3 of the Act (CBC-21-MIN-0012);

2 note that the Heavy Engineering Research Levy Amendment Order 2021 will give effect to the decision referred to in paragraph 1 above;

3 authorise the submission to the Executive Council of the Heavy Engineering Research Levy Amendment Order 2021;

4 note that the Heavy Engineering Research Levy Amendment Order 2021 will come into force on 26 August 2021.
