    AGREEMENT TO RESCIND FORECLOSURE SALE AND REINSTATE MORTGAGE

    This Agreement (the "Release") is made between Wells Fargo Bank, N.A.("Wells Fargo") , Federal Home Loan Mortgage Corporation (Freddie Mac) and JenniferJ. Austin (UAustin"), as of the ' 6 J 1 . . . day of September, 2006.

    WHEREAS, On December 16, 2003, Austin executed a note in favor of WellsFargo Home Mortgage in the amount of $138,700.00;

    WHEREAS, the note was secured by a rnortqaqe in the property located 95 MillStreet, Worcester, Maasachusetts;

    WHEREAS, Wells Fargo Bank, N.A. successor by merger to Wells Fargo HomeMortgage, Inc. is the holder of the note and mortgage;

    WHEREAS, a foreclosure sale was held at the property on June 8, 2006 and aforeclosure deed was recorded on July 24,2006 in Book 39428, Page 266;

    WHEREAS, the foreclosure deed purported to transfer title to the property toFreddie Mac;

    WHEREAS, all parties desire to rescind the foreclosure sale and allow Austin toremain the owner of the premises and the mortgage to Wells Fargo to be reinstatedand to remain in full force and effect;

    NOW, THEREFORE, and in consideration of the mutual promises and releasescontained in this Agreement, the parties hereby agree as follows:
