RULES OF THE ASSOCIATION

1. NAME The Association shall be called ‘The Lancashire County Badminton Association’ (henceforth referred to as the ‘Association’). Wherever ‘Lancashire’ appears in these rules it shall be deemed to cover all the territory within the County Palatine of Lancashire as defined at 31 March 1974, except for that within the boundaries of the local government Counties of Cumbria and Cheshire. 2. OBJECTS The objects of the Association shall be to promote badminton generally in Lancashire; to take any action to further the interests of the game; to ensure that affiliated members shall observe only the Laws of Badminton and the regulations of the Badminton World Federation. 3. CONSTITUTION The Association shall be affiliated to Badminton England Limited. Members eligible for affiliation, at the discretion of Council, are: a) Clubs of which at least one of the objects is Badminton and which have their headquarters and/or courts in Lancashire. b) Leagues and District Associations in which all the clubs are indirectly affiliated to Badminton England Limited. Individual members of such clubs and leagues are indirect members of the Association. c) Schools and Youth Clubs whose playing members have an age limit of 19. Youth Associations and directly affiliated Youth Clubs and Schools are entitled to the normal privileges of affiliation. d) Individuals known as County Patrons. Patrons are entitled to receive:

i) A pass giving free admission to all events under the jurisdiction of the Association and a free programme when available

ii) Association Handbook

iii) All communications circulated to members.

4. ADMINISTRATION The management of the Association shall be vested in a Council consisting of ex officio members and not more than 25 ordinary members, who shall be elected in General Meeting . The ex officio members shall be the President, Past Presidents, Vice Presidents, the Honorary Secretary and the Honorary Treasurer . The ordinary members must be direct or indirect members of the Association under Rule 3. One third of all members of Council, with the exception of Past Presidents, shall retire each year by rotation, except that the Honorary Secretary and Honorary Treasurer shall retire annually, but shall be eligible for re-election. An ordinary member of Council who has not attended a meeting of Council or any of its committees for twelve consecutive calendar months, and a Vice President who has not so attended for twenty-four consecutive calendar months, shall automatically cease to be a member of Council and any of its committees . The Schools and Youth Committee may nominate 3 named members to sit on Council together with named alternates, 1 each representing the three areas administering junior badminton within LCBA. These members to be in addition to the Committee’s Chairman and Secretary The Badminton Umpires Association of England may appoint annually one named nominee and one named alternate to the Council. The Sport England (NorthWest) may appoint annually one named nominee and one named alternate to the Council. The Council at its first meeting shall elect from among its own members a Chairman for the ensuing year. The Council shall have the power, inter alia: a) To fill casual vacancies, but anyone so appointed shall serve only until the next Annual General Meeting. b) To appoint and delegate powers to committees for any purposes considered desirable. c) To authorise any committee to co-opt from outside Council any persons whose knowledge may prove helpful; provided that at no time may the number of coopted members of any committee exceed one third of the number of council members on that committee, unless expressly authorised by Council. d) To appoint from its number additional officers or assistant officers. e) To take disciplinary action against direct or indirect members of the Association for any infringements or attempted infringements of the Rules of the Association in accordance with the agreed Disciplinary Procedure.

f) To give a decision on any matter for which express provision is not made in these rules. g) To elect at its absolute discretion Honorary Vice Presidents, who shall not be members of Council, and who may attend but not vote at General Meetings. They shall be sent copies of all normal communications sent to other members of the Association. The Council shall meet not less than three times annually. Meetings shall be called at the discretion of the Chairman, or at the request in writing of at least seven members of council. The Chairman shall have a casting vote. At all meetings of Council five shall form a quorum. 5 FINANCE The financial year shall end on April 30th. Affiliation fees shall be due on August 1st and be payable not later than 30th October or upon election. Each club shall pay the LCBA fee for every player in that club at a rate to be decided by the Council on a yearly basis. A list of players is to be sent to the County Registration Secretary together with the appropriate fee by 30th October in that year. IT IS THE RESPONSIBILITY OF EACH LEAGUE to collect the club fees and remit them to the County Registration Secretary and ensure that every club in their league is affiliated to Badminton England and Lancashire County Badminton Association by 30th October in each year. Failure to do so will render the League subject to a penalty to be decided at the discretion of the Council and that the match results of each and every unaffiliated club, whilst they remain unaffiliated, be null and void. The annual rate of affiliation fees shall be: Clubs: £12.50 or £2.50 per Senior playing member (Badminton England: £10.00 or nil, LCBA £2.50). £7.50 or £2.50 per Junior playing member. (Under 19 on 1st January 2012) (Badminton England £5.00 or nil, LCBA £2.50) Schools and Youth Clubs: whose playing members have an age limit of 19 years, affiliated under

Payment shall be made in accordance with the total number of actual playing members listed at the time of payment, or, in the case of a newly affiliated club, at the date of affiliation. Payment for new members must be made within one month of being elected. After payment of the annual affiliation fees, members shall be entitled to receive the handbook of Badminton England Limited, when issued for that season. 6. GENERAL MEETINGS The Annual General Meeting of the Association shall be held at the discretion of Council before the end of June each year for the adoption of the Council’s report and audited accounts, any alterations to rules, the election of the officers and Council as required under Rule 4, the appointment of auditors and such other business as may be transacted in General meeting .The agenda and accounts shall be circulated at least three weeks in advance. All items to be placed on the agenda, including nominations for office and the Council, which must be proposed and seconded by direct or indirect members of the Association except in the case of retiring members, shall be sent in writing to the Honorary Secretary so as to reach him/her not later than the end of February. The written consent of any nominee for office or for Council must be sent with the nomination An Extraordinary General Meeting shall be convened upon a resolution of the Council or by the written request of not less than 15% of the members of the Association reckoned on voting strength. Such request shall state the purpose for which the meeting is required, and no other business shall be transacted. The meeting shall be held within one month of such requisition being received by the Honorary Secretary and the notice and agenda shall be circulated at least two weeks in advance. Accidental omission to give the required notice to any member shall not invalidate the proceedings at a General Meeting . The chair at a General Meeting shall be taken by the President. In the event of his absence then the meeting shall elect one of the Association’s Vice Presidents as chairman. If no Vice President is present or none is willing to serve, then the Meeting shall elect any other person, willing to serve, as chairman. The Chairman of Council shall not be chairman of a General Meeting. If no person is willing to serve then the Meeting shall be declared inquorate.

All clubs, leagues, youth associations, schools associations, youth clubs and schools directly affiliated may send two representatives to General Meetings, except that, based on affiliation fee figures, clubs other than youth clubs and schools with: 30 members may send 3 representatives 50 members may send 4 representatives 75 members may send 5 representatives 100 members may send 6 representatives All Council members and accredited representatives shall have one vote. No individual may represent more than one member, nor have more than the one vote, except the Chairman of the meeting, who shall have a casting vote. Any member whose affiliation fee for the previous year is unpaid shall not be entitled to be represented or to vote. The quorum for a General Meeting shall be fifteen persons entitled to vote. If there is no quorum for an Extraordinary General Meeting, the motion(s) on the agenda shall be deemed to have been defeated, and the meeting concluded. In the case of an Annual General Meeting, it shall be adjourned and another notification shall be circulated without a time restriction. At the adjourned meeting the members present shall form a quorum. Patrons may attend but not vote at General Meetings. Voting shall be by show of hands, provided that, if 25% of those present and entitled to vote demand it, voting shall be by ballot, in which case valid proxies shall be counted. Any member entitled to vote may send proxies corresponding to the number of their permissible representatives, or part thereof. 7. APPEALS FROM PENALTIES Any member wishing to appeal from penalties inflicted under Rules 4e or 5 has the right to appear personally before the Council, upon written notice being given to the Honorary Secretary. Such member shall be advised in writing within seven days of the Council’s decision. 8. RESIGNATIONS Any member wishing to resign shall give notice in writing to the Honorary Secretary not later than September 21st; otherwise the member shall be liable for the current affiliation fee.

9. AMENDMENT TO RULES No amendments or additions to these rules shall be made except in General Meeting in accordance with Rule 6. Two thirds of the votes cast must be in favour of any amendment or addition. 10. COUNTY COLOURS County Colours, in the form of badges, shall be awarded to those players who have played seven times for the first county team in the Inter County Championship. The Association shall present a player awarded county colours with one badge. Any further badges may be purchased from the Honorary Match Secretary. The badge shall be in the shape of a shield with a white ground, red rose with green spikes embroidered in the centre, and the letters L.C.B.A written at the foot. The letters and the edges of the badge shall be in light blue. 11. EXPENSES The council at its discretion, shall have the power to authorise the payment of travelling expenses to: The nominees of the Association attending meetings of the Council of Badminton England. Council and committee members for attending meetings representing LCBA. Players, senior and junior. Council and committee members, and others designated by Council or a committee for special responsibilities or duties, for tournaments, matches, exhibitions and special events authorised and approved by Badminton England and/or the Lancashire County Badminton Association 12. TOURNAMENTS A tournament shall not be held by any member unless authorised in writing by the Council of the Association. This shall not apply to tournaments for members of one club only. All tournaments which are promoted by the Association or held under its sanction shall be confined to members of clubs affiliated indirectly to the International Badminton Federation and to individual associate members of Badminton England. Members of affiliated clubs shall not compete in an unsanctioned tournament.

13. RESTRICTED CHAMPIONSHIPS Players competing in the Lancashire Restricted Championships must, at the date on which the entries close, be qualified by the regulations of the Inter County Championship to represent Lancashire. The names of successful applicants shall be notified to all Honorary Tournament Secretaries. The Tournament and Competitions Committee shall have the power to refuse the entry of anyone who, in its opinion, is too good for these tournaments . 14. EXHIBITION MATCHES An exhibition in Lancashire shall not be held except in collaboration with the Association, and unless authorised in writing in advance by an officer of the Association. Such authorisation shall not be given unless the officer is satisfied about the general arrangements, including playing conditions, finance, presentation and composition of the matches. Members of an affiliated club shall not play in an unauthorised exhibition. 15. DISSOLUTION Any resolution for dissolution shall be presented in accordance with Rule 6. A postal ballot shall be held as soon as is convenient. Two thirds of the votes cast, in accordance with Rule 6, must be in favour for any resolution to be carried. If the resolution be lost, a further resolution cannot be presented for five years. If, upon winding up or dissolution of the Association, there remains, after the satisfaction of all its debts and liabilities, any property whatsoever, the same shall not be paid to, or distributed amongst the members of the Association, but shall be given or transferred to some other body or bodies, institution or institutions, to be determined by a simple majority of the members of the Association at or before the time of dissolution, and in so far as effect cannot be given to the aforesaid provision then to some charitable object.

REGULATIONS FOR COMPETITIONS

COMPETITIONS 1 At the discretion of Council, the following competitions shall be run each season:

a) an inter-league league, hereinafter referred to as The Lancashire League;

TROPHIES

2 a) The winners of the first division of the Lancashire League shall hold for one year the cup presented by Mr J R Littlewood, and the winners of the second division the cup presented by the Bolton Badminton Club. The winners of the third division shall hold for one year the Heathway Cup. The winners of the fourth, fifth and sixth divisions shall hold for one year the Friendship Cups for those divisions. The winners of the seventh division shall hold for one year the Boundary Park Cup. b) It is the responsibility of all trophy holders to return them to the appropriate competition secretary at least 28 days before the date of the Annual General Meeting. Failure to do so will incur a financial penalty at the discretion of the Tournaments and Competitions Committee..

MANAGEMENT 3 The competition shall be managed by the Tournaments and Competitions Committee, hereinafter referred to as the ‘T & C’, which shall have the power, at its absolute discretion, to deal with any complaint or dispute, and to give a decision on any matter for which express provision has not been made in these regulations. ELIGIBILITY TO COMPETE 4 a) The Lancashire League shall be open to all leagues and district Associations affiliated to the Association upon payment of the appropriate entry fee. A league may enter any number of teams at the discretion of the T & C Committee.

b) The appropriate competition secretary must receive all entries, with entry fees, before May 31st. No entries will be accepted after this date. METHOD OF COMPETITION 5 a) The teams shall be placed in divisions composed according to strength. At the end of each season the top team shall be promoted and the bottom team relegated from each division. This shall not apply to the top team of the first division or to the bottom team in the lowest division. The T & C shall, at its absolute discretion, have the power to vary this. b) In all cases where two or more teams have an equal number of league points, the number of matches won shall determine their positions, and, if matches are equal, by the number of points won. c) A league or club may have two or more teams in the same division at the discretion of the T & C. In this case a player in one team may not play more than once for any other team in the same division in the same season. ARRANGEMENT OF TIES 6 a) Fixtures shall be arranged at a meeting of league or club representatives to be held not later than September 14th each year. A complete list of fixtures arranged shall be handed to the competition secretary, or a nominee, before the representative leaves the meeting. All leagues and clubs shall be given at least four weeks notice of the meeting. Any league or club failing to send a representative shall have it’s away fixtures arranged in its absence and sent to the Honorary Secretary with a list of opposing teams. Any such league or club must communicate forthwith with all opponents to arrange its home ties, and send a complete list of their home fixtures to the competition secretary as soon as possible b) When a league or club has two or more teams in the same division, the two higher teams must play each other in the first tie of the season. c) The dates of fixtures, once arranged and confirmed by the competition’s secretary, shall not be altered except for special reasons. Unavailability of players is not considered a special reason. If an alteration of date should be essential, the competition’s secretary must be advised in writing of the revised date and the reason for the alteration before the tie is played or before the original date, whichever is the sooner. If the reason given for the alteration is not considered a special one, the fixture shall be played on the original date. d) Any league or club whose fixtures are not completed by the end of April in any season, will be liable to any penalty at the absolute discretion of the T & C.

e) At least half of a team’s fixtures shall be played before 31st December. CONSTITUTION OF TIES 7 a) In the Lancashire League a tie shall consist of one ladies’ singles, two men’s singles, four ladies’ doubles, four men’s doubles and four mixed doubles matches. Each player or pair shall play only their opposite number. b) In this competition each player or pair must be placed strictly in order of ability in each event. Any complaint on this score must be made to the competitions secretary, in writing, to be received within seven days of the tie. The T & C shall have power to impose any penalty deemed suitable. CONSTITUTION OF TEAMS 8 a) In the Lancashire League a team shall consist of not more than six men and five ladies. b) A league or club shall appoint a captain for each tie but by default a team

shall choose its own captain

SUBSTITUTES 9. A player may play only once, or in only one pair, as appropriate, in each event. In

the event of a player being incapacitated after teams have been exchanged in

accordance with Regulation 8 (c), substitutes may be included only in accordance

with BE regulations for the Inter County Championship, provided any such

substitutes do not cause a team to consist of more players, men or ladies, than is

permitted in Regulation 8(a)

NOMINATION AND ELIGIBILTY OF PLAYERS

10. a) i) Each league entering two or more teams shall send in writing to the competition secretary, at least seven days before the first fixture of any team, the names of three men and of three ladies nominated as first team players, and, if a third team has been entered, also the names of three men and of three ladies nominated as second team players, and so on for each subsequent team. ii) The availability of the players shall have been ascertained first and they shall not be eligible to play for a lower team that season. iii) A player who has played more than once for a higher team in a doubles event shall not be eligible for a lower team. A player may play singles events for a higher team(s) without restriction except when the teams are in the same division (vide Rule 5 (c)

b) A player may not play for more than one league in the same season.

b) In the Lancashire League all players must be bona fide members of a c)

club and have represented that club in the league for at least fourteen days prior to the tie. ORDER OF PLAY 11. In the Lancashire League the order of play shall be, unless otherwise mutually agreed by the captains: singles, followed by men’s and ladies’ doubles, and the cross over men’s and ladie’s doubles, followed by the mixed doubles. ABSENCE OF PLAYERS 12. Any player or pair absent or unwilling to play when scheduled shall forfeit the match concerned by two games to love, except that thirty minutes grace shall be granted from the time for the start of play, unless otherwise mutually agreed by the two captains . DECISION OF TIES 13. In the Lancashire League if a team wins 9 matches to 6 or better it shall receive 3 league points: if they win 6 matches to 5 they will receive two league points. A team that loses by 8 matches to 7 shall receive 1 league point . ARRANGEMENTS AND EXPENSES OF TIES 14. a) The home league or club shall be responsible for all arrangements and shall bear all expenses incurred for the hire of courts, and other incidental items. b) i) The home team shall be responsible for the provision of suitable shuttles, but the cost shall be shared. The price charged shall not exceed the actual cost of the shuttles, or the current stipulated price, whichever shall be the less. ii) Synthetic shuttles may only be used only if both teams agree. c) Travelling expenses shall be borne solely by the team incurring them.

UMPIRES, SERVICE JUDGES OR SCORERS 15. a) In the Lancashire League umpires, service judges or scorers, shall be arranged by the home team if requested by either captain before or during

NOTIFICATION OF RESULTS 16. a) The results of each tie, with details as set out in the official form, signed by both captains, shall be sent by the home league to the competition secretary to be received within seven days of the conclusion of the tie. b) Failure to comply with this regulation shall render the league or club liable to a penalty at the discretion of the T & C. COMPLAINTS 17. Any complaint or dispute shall be in writing to the competition secretary to be received within seven days of the date on which the tie was played or scheduled to

be played.
