Pre-Trial Chamber II ound that there are not reasonable grounds to believe that Sang is an indirect co-perpetrator, because his contributiontothecommissionofthecrimeswasnotessential.Instead,theChamberwassatisedthattherewerereasonablegroundstobelievethatSang otherwise contributed (within the meaning o article 25(3)(d) o the Rome Statute) to the commission o the ollowing crimes againsthumanity: murder(article7(l)(a)); forcibletransferofpopulation(article7(l)(d));and
persecution(article7(l)(h)).
Alleged crimes (non-exhaustive list)
Pre-Trial Chamber II ound that there are reasonable grounds to believe that:
Immediately ater the announcement o the results o the presidential election and specically rom 30 December 2007 untilthe end o January 2008, an attack was carried out in locations including Turbo town, the greater Eldoret area (encompassingHuruma, Kiambaa, Kimumu, Langas, and Yamumbi), Kapsabet town and Nandi Hills town, in the Uasin Gishu and NandiDistricts,theRepublicofKenya.Theattackallegedlytargetedthecivilianpopulation,namelytheKikuyu,KambaandKisiiethnicgroups,whichwereperceivedasPNUsupporters.
In particular, the violence in the Uasin Gishu District (encompassing Turbo town and the Eldoret area) allegedly resulted in
1,475housesburnedanddestroyed,approximately230peopledead,505peopleinjuredand7,800peopledisplaced.IntheNandi District (encompassing Kapsabet town and Nandi Hills town), the attack allegedly ended in the death o 7 personsandtheinjuryofmorethan500.Anumberofhousesandbusinesspremiseswerealsolootedandburned.Theperpetratorslet three people dead on 8 January 2008 in Kapsabet town and killed others in the vicinity o the roadblocks erected abouttwokilometersfromKapsabettown.About32,000personswereallegedlyforcedtoseekrefugeatNandiHillspolicestationandinthesurroundingareas.
Allegedly, there was a plan to punish PNU supporters in the event that the 2007 presidential elections were rigged, whichallegedlyaimedatexpellingthemfromtheRiftValley,withtheultimategoalofcreatingauniformODMvotingblock.Inorder to implement the plan agreed upon, Ruto, Kosgey and Sang allegedly established a network o perpetrators belongingtotheKalenjincommunity.ThisnetworkcomprisedeminentODMpoliticalrepresentatives,representativesoftheMedia,formermembersoftheKenyanpoliceandthearmy,Kalenjineldersaswellaslocalleaders.Thenetworkwasallegedlyunderresponsible command and had an established hierarchy, with Ruto as leader, Kosgey as deputy leader and treasurer andSangastheoneresponsibleforcommunicativepurposes.Thenetworkpossessedthemeanstocarryoutawidespreadorsystematic attack against the civilian population, as its members had access to and utilised a considerable amount o capital,guns,crudeweaponsandmanpower.
William Ruto , in his capacity as the most representative Kalenjin leader and head o the organisation established together with Kosgey, who was Rutos deputy, the ODM Chairman, and the MP or Tinderet constituency providedessential contributions to the implementation o the common plan by way o organising and coordinating the commissiono widespread and systematic attacks that meet the threshold o crimes against humanity, in the absence o which the planwouldhavebeenfrustrated.WilliamRutoallegedly:(i)overallplannedandwasresponsiblefortheimplementationofthecommonplanintheentireRiftValley;(ii)createdanetworkofperpetratorstosupporttheimplementationofthecommonplan;(iii)directlynegotiatedorsupervisedthepurchaseofgunsandcrudeweapons;(iv)gaveinstructionstotheperpetratorsastowhotheyhadtokillanddisplaceandwhosepropertytheyhadtodestroy;and(v)establishedarewardingmechanismwith xed amounts o money to be paid to the perpetrators upon the successul murder o PNU supporters or destructionoftheirproperties.
Henry Kiprono Kosgey,allegedly(i)promoted,togetherwithRuto,thecreationofthenetworkofperpetrators;(ii)actively
organisedthemodalities oftheimplementationofthecommonplan, inhiscapacityasRutosdeputy;andthat(iii)hewas responsible fortheimplementationofthecommonplanin theNandiDistrict.Moreover,Kosgeywasallegedlyinchargeofmanagingthenancialresourcesoftheorganisationforthepurposeofimplementingthecommonplan;and(iv)broadcastingfalsenewsregardingallegedmurder(s)ofKalenjinpeopleinordertoinametheatmosphere.

Joshua Arap Sang , by virtue o his infuence in his capacity as a Kass FM radio broadcaster, allegedly contributed inimplementationofthecommonplanby:(i)placingKassFMatthedisposaloftheorganisation;(ii)advertisingtheorganisationsmeetings;(iii)fanningviolenceby spreadinghatemessagesandexplicitlyrevealingadesiretoexpeltheKikuyus;and(iv)broadcastingfalsenewsregardingallegedmurder(s)ofKalenjinpeopleinordertoinametheviolentatmosphere.
Key judicial developments
Opening o the investigation
On 5 November 2009, the ICC Prosecutor notied the President o the Court o his intention to submit a request or authorisation
to start an investigation into the situation in Kenya pursuant to article 15(3) o the Rome Statute, in regard to the 2007-2008 post-electionviolenceinKenya,inwhichapproximately1300peoplewereallegedlykilled.
On 6 November 2009, the Presidency o the Court assigned the situation to Pre-Trial Chamber II, composed o Judge Ekaterina
Trendalova(presidingjudge),JudgeHans-PeterKaulandJudgeCunoTarfusser.
On 31 March 2010, Pre-Trial Chamber II granted, by majority, the Prosecutions request to open an investigation into alleged crimes
againsthumanityinKenya.Theinvestigationcoverscrimesagainsthumanitycommittedbetween1June2002(thedateoftheRome
Statutes entry into orce or Kenya) and 26 November 2009 (the date the Prosecutors led the request or authorisation to start theinvestigation).
Summonses to appear and initial appearance hearing
On 15 December 2010, the ICC Prosecutor requested Pre-Trial Chamber II o the ICC to issue summonses to appear or six Kenyans
onthebasisthatthereexistedreasonablegroundstobelievethattheywerecriminallyresponsibleforcrimesagainsthumanity.
On 8 March 2011, Pre-Trial Chamber II, by majority, issued the decisions on the applications submitted by the Prosecutor andsummonedWilliamSamoeiRuto,HenryKipronoKosgeyandJoshuaArapSangtoappearbeforetheCourton7April2011;and
FrancisKirimiMuthaura,UhuruMuigaiKenyattaandMohammedHusseinAli,toappearbeforetheCourton8April2011.
On31March2011,theGovernmentofKenyaledanapplicationchallengingtheadmissibilityofthecasebeforetheICC.
