I asked Bryn Lockwood theSustrans North LondonManager about this.“Sustrans main objective” he told me, “is topromote safe walking and cyclingthroughout the country. We are anxious toavoid these sorts of concerns and havevarious approaches to address them. Forexample we will install a monitor to measureuse by cyclists and pedestrians which willshow any significant increase in traffic. Thisis a pedestrian priority path and we will putup signs to clearly show that pedestrianshave priority to warn cyclists to slow down ifthey see pedestrians. If it proves necessarywe could in future add measures to slowcycles down”.Well, at least residents walking to the

AC v DCA team of lawyers, which includes family lawspecialists Julian Ribet of Levison MeltzerPigott and Deborah Bangay QC of 1 HareCourt, Dakis Hagen of Serle Court togetherwith David Ewart QC and James Rivett bothof Pump Court Tax Chambers, acting onbehalf of the Wife, have successfullyunwound a hugely complicated off shoreshare transaction instigated by the Husbandin an attempt to defeat his Wife’s financialclaims on divorce.

The judgment is the first reported decisionon the retrospective nature for legal andfiscal purposes of s37 of the MatrimonialCauses Act since it was first enacted byParliament 40 years ago and is the largestreported “set aside” by a Judge in familyproceedings of a disposition into trust.

The case (which is reported on ananonomised basis as AC v DC) containstwo decisions by leading Judges in theFamily Division of the High Court which willhave very important consequences for

EditorialConcerns about the under use of ourshopping paradementioned in the FebruaryHW News has lead to a substantialresponse. Some of the letters are included.There is widespread belief that difficultparking prevents residents using theshops. The shop-owners themselves areunanimous in their opinion that easierparking would make a major difference.One hour free parking with a small chargefor longer periods up to a maximum of twohours has been proposed. This sort ofsystem is in use elsewhere and has beensuccessful. An unloading bay would beinvaluable as would a space for disabledresidents. Clearly policing this sort ofparking would entail extra manpower andtherefore extra expense for Enfield.Nevertheless it is clearly needed. We areplacing petitions in the shops. Please signup if you agree and we will put a strongproposal to Enfield Council.Rod Armstrong

The Railway PathMany of youwill be familiar with the path fromWaggon Rd. to the Hadley Wood stationyard. It runs along the right hand side of therailway embankment as you look southwardsto the station. It belongs to Network Rail andis known as a ‘permissive path’ thus allowingpedestrian and cycle use.

Sustrans the national sustainabletransport charity who work to improvewalking and cycling paths throughout theUK have obtained permission from NetworkRail to surface this path so as to improve

parties engaged in complicated financialproceedings on divorce.The first decision (by Mr Justice Mostyn)

sets aside or annuls the complicated chainof transactions which transferred all theHusband’s shares (worth £54m) in a verysuccessful company to the Trustee of anoffshore Trust. Although the Trusteesubsequently transferred the shares to asub fund (which could potentially benefit theHusband, his Wife and other members ofhis family) neither the Husband, his Wife ortheir children had any right to the capital tobe contained in the Trust (even under thesub fund) and so once she was divorcedand ceased to be married to the HusbandtheWife would have no claims against theseassets. In his historic decision Mr JusticeMostyn found that “on any view the Wife’sclaims for a financial remedy were seriouslycompromised by these steps”.The second decision relates to the Court’s

approach to determining theWife’s financialclaims. Given the Husband’s ill health thefinal hearing of the wife’s application wasexpedited. Taking into account the lengthof the parties relationship, the nature oftheir separation and the fact that thepre-cohabitation wealth was thereafter“inextricably mingled”, the Judge agreedthat the Wife should not be held to the termsof the Prenuptial Agreement that had beenentered into by the parties (which wouldhave limited her financial claim to £500,000)and awarded theWife 40% as a “fair and justshare of the net assets of the parties”.One further twist meant that a number of

payments (totalling £7.8m), allegedlyawarded as incentives to the Directors of hisCompany by the Husband were ordered tobe “added back” into the asset schedule andbe treated as being assets belonging to theHusband prior to the assets being divided bythe Court. This ensured that theWife’s claimswere not prejudiced by the actions of theHusband and those acting on his behalf inagreeing to make those payments. This wasnotwithstanding the fact that the decision to

South AmericanHoliday.As many of you will have learned fromexperience – it is dangerous to read travelbooks – not in a physical way of course –as it leaves behind a lasting urge to visit thecounties read about. Thus it was that Iventured to South America. The books inquestion had been Travels in a Thin countryby Sarah Wheeler and in Patagonia byBruce Chatwin – both read many yearsago- but both of which had left a lastingimpression. The trip,with Saga, lasted only15 days but in that time we visited 4countries and covered an exciting tour withclockwork precision.Starting with a flight to Santiago – via –

Madrid – we arrived after a day of heavy rainwhich had left the surrounding mountainscovered in snow – a picturesque sightagainst the deep blue sky. Santiago is abeautiful city – well planned in the Frenchcolonial style with wide boulevardes and aneclectic mix of old and new buildings. Wespent three nights there which included aday trip to Valparaiso and a visit to Pablo

Neruda’s house – a frail construction whichappeared to be hanging on to the steephillside by it's toe nails.Next day there was a short flight to

Puerto Montt the capital of the Chilean lake district situated at the southern tip ofLake Llanquihue – my room in the timberedhotel had a wonderful view of three snowcapped volcanoes – one of which was themagnificent Osorno.Off again early the next day – this trip was

certainly not for wimps!! A full day includinga tour of the Vicente National Park –cataracts at Puella in full flood after theheavy rains. Then a catamaran trip acrosslake and finally reaching San Carlos deBariloche by coach driving along theedge of Lake Nahuel Huapi – which is 65miles long!! Bariloche is. a delightfulalpine style town situated beside thelake. but with a sad side. The many whiteheadscarves painted on the stones in thesquare represent some of the many youngpeople – not all dissidents- who simplydisappeared during the purges in the 70’s.On a lighter note there followed a ride in a

chair lift above the lakes with the mountainsas back drop and the condors circling.Next stop was Buenos Aires – another

beautiful city, the square housing the pinkpalace from which Eva Peron spoke to thepeople- and also lovely violet jacarandatrees in full bloom. I bravely ventured outalone and found the famous coffee shop– Tortini- all marble pillars and stainedglass – expecting the mafiosi to enter anyminute. Next day – off to the Iguazzu falls,the Argentinian side first – a 700m metrewalk across elevated metal walkwaysover the river – the roaring of the waterbecoming ever louder as we approachedthe falls. What a sight. We were at the fullheight of the falls which stretched in ahuge horseshoe in front of us, the watercascading down far below. Giant leecheslay in wait in the damp undergrowthwaving to try and latch on to unwary

passers-by. Snail eating kites – quiteenough for one day.The Brazilian side – visited the following

day – was quieter , approached along welltrodden paths through woodland and atground level so we could see the poolswhere last night’s water had fallen. Finallywe reached Diabalo – the confluence – overmesh walkways with the water churningbelow our feet and the sunbeams creatinga rainbow effect through the spray.On to Rio –up the 194 steps ( there is an

escalator!) to meet the statue of Christ theRedeemer- a massive creation caste inconcrete with a sandstone finish in the artdeco style- erected in 1912. Later a visit tosugar loaf mountain by the use of 2 cablecars – magnificent views- and the sunshone all the time.Well rather a whistle stop tour but there

was time on my last day to take myself offby taxi to the botanical gardens, a peacefulinterlude before returning to the UK.Betty Brough

I know there is a restriction in placeto stop commuters using the parade spacesbut feel that, at least on one side of the road,there should be timed parking slots of, sayhalf an hour to enable us to use the cleanersand general store and move on. Iunderstand that there are services like thehairdressers and beauticians that wouldprefer an hour’s parking but whichever wasdecided we believe that all day parkingshould not be allowed. What can we do,however, to persuade Enfield Council thatthere is a problem?Thank you for drawing the residents
