A PROCLAMATION TO ESTABLISH THECENTRAL STATISTICS AUTHORITY

WHEREAS, it is necessary to organize thestatistical activities of the ~ountry in an effective andintegrated manner to

I ensure. the collection,compilation, analysis and supply of timely andaccurate statistical data that are required for planningand monitoring social and economic developmentprograms, research and control, policy formulationand administration purposes;

WHEREAS, it has become imperative to issuelegislation, which is compatible with the country'slevel of development of statistical system, to definethe responsibilities and duties of statistical dataproviders, producers and users as well as that of theAuthority and its employees;

In this Proclamation, unless the context otherwiserequires:-

1) "Ministry" or Minister" means the Ministry orMinister of Finance and EconomicDevelopment, respectively;

2) "Authority" means the Central StatisticsAuthority;

3) "Statistics" in its singular form refers to thescientific methods adopted in the collectionand analysis of facts, while in its plural formrefers to numerical facts;

4) "data" means a mass of numerical factcollected by counting or measuring;

5) "census" means the collection, compilation,evaluation and dissemination of basic datapertaining to economic, social anddemographic sectors through a completeenumeration of units in a well defmedterritory at a specified time;

6) "sample survey" means the collection,compilation, evaluation and dissemination ofbasic data pertaining to economic, social anddemographic sectors through a method ofselecting representative portions from thetotal units thereof;

7) "continuous registration" me,ans therecording, at national, regional state orlower administrative Sub-division level,or vital events or' economic and socialestablishments on a continuous basisfollowing legally prescribed procedures;

8) "administrative records" means the statisticaldata collected and compiled by governmentagencies or institutions or nongovernmentalorganizations while discharging their routineactivities;:-

9). "national statistical program" means an, official document to be prepared periodically

to serve as working document for theAuthority;

10) "national level statistics" means collectingdata from field, which could give afterprocessing and compilation statistical resultsat urban or rural or country level;

11) "designated statistics" means statisticsclassified as such by the Authority;

12) "regional state" means any regional statesreferred to under Article 47 of theConstitution of the Federal DemocraticRepublic of Ethiopia and includes the AddisAbaba and Dire Dawa city administrations;

13) "government agency or institution" meansany organ of the federal or regional stategovernment and includes any publicenterprise owned by the federal or regionalstate governments;

14) "person" means a natural or juridical person.

3. Scope of Application

11 This proclamation shall apply to alleconomic, social and demographic datacollection, compilation and disseminationstatistical activities;

2/ Though the provision of Sub-Article 1 ofthis Article, the proclamation shall notapply to any confidential information heldby defense and public security.

4. Establishment

1/ The Central Statistics Authority (hereinafterthe "Authority") is hereby established as anautonomous federal government agencyhaving its own legal personality;

2/ The Authority shall be accountable to theMinister

The Authority shall have its Head Office in AddisAbaba and may have branch offices elsewhere, asmay be necessary.

6. Objectives

The objectives ofthe Authority are:

11 to collect, process, analyse and disseminatethe necessary socio-economic anddemographic statistical data throughcensuses, sample surveys, continuousregistration and administrative recordingsystems; and

2/ to provide technical guidance and assistanceto government agencies and institutions intheir endeavor to establish administrativerecording, registration and reporting systems;and build the capacity required for providingdirectives and consultations in databasecreation and development of administrativerecords and registration systems.

7. Powers and Duties

The Authority being the country's statistical"information center shall have the following

powers and duties:

1) collect and cause the collection ofstatistical data through censuses, samplesurveys, administrative records andcontinuous registration; process, compile,analyze, publish and disseminate theresults thereof;

2) prepare periodically short, medium andlong-term national statistical programs anddraft budget and upon approval, executethe programs within the given budget andmonitor their implementation by othergovernment agencies and institutions;

3) provide advisory services on statisticalactivities to government agencies orinstitutions and private organizations uponrequest;

4) undertake studies and research with respectto statistical methods and ensure theutilization of the results thereof;

5) provide appropriate basic short-term,training to personnel of governmentagencies and institutions, non-governmental organizations and the private sectorwho are engaged in statistical activities;

4.

6) issue and follow up the implementation ofprograms and directives with a view toimproving the country's statistical systemand to avoid duplication of efforts instatistical activities;

7) prescribe the system for the collection,compilation, classification and flow ofstatistical data; detennine the type andparticulars of statistical data to be collectedand the period of collection; and monitorthe execution of same;

8) maintain internationally accepted standardswith respect to the statistical data collectedin the country in order to make themcomparable to data produced by othercountries, international organizations andthe United Nations;

9) ensure that the data collected throughnational censuses and surveys meet the/demands of regional states;

10) upon request, provide assistance in guidingand coordinating the statistical work ofregional states with regard to matterspertaining to the collection, organization,analysis, and preparation of publicationand dissemination of statistical data; andfollow up the establishment of statisticalregistration system;

11) solicit fmancial, material and technicalsupport from other countries andinternational organizations for carrying outstatistical activities and submit same forthe approval of the Ministry;

12) cooperate with international qrganizations,government agencies and i~titutions andother organizations, upon / making themcover certain costs and settjhg priorities, inundertaking specific surveys falling outsidethe scope of its plans and !programs;

13) provide the necessary/advise to statisticaltraining institutions iP. the use of externaltechnical assistance/programmes includingfellowships in trajtling in all branches ofstatistics;

14) design and monitor the implementation ofstatistical recording and reporting systemsto be followed by government agencies orinstitutions and other organizations;

15) collaborate with national professionalassociations in the fields of statistics andrelated disciplines and sponsor statisticalconferences as appropriate;

16) require payment of service charges for thedissemination of survey and census resultsand for accessing raw data;

17) advise the government on all matters ofstatistical activities;

18) perform such other activities assigned to itunder other provisions of this Proclamationor by other relevant laws; and ensure theapplication of statistical laws, regulationsand directives.

8. Organization of the Authority

The Authority shall have:

1/ a General Manager to be appointed by thePrime Minister on the recommendation of theMinister;

2/ the required Deputy General Managers to beappointed by the Prime Minister on therecommendation of the Minister inconsultation with the General Manager; and

3/ the necessary staff.

9. Powers and Duties of the Authority

1/ The General Manager shall be the chiefexecutive officer of the Authority and shall,subject to the general directives of theMinistry, direct and administer the activitiesof the Authority.;

2/ Without limiting the generality of Sub-Article(1) of the Article, the General Managershall:-

a) exercise the powers and duties of theAuthority stated in this Proclamation;

. b) employ and administer employees of theAuthority in accordance with the federalcivil service laws;

c) prepare and submit to the Ministry thework programs and budget as well as theactivity reports of the Authority;

d) effect expenditure in accordance with thework program and budget approved forthe Authority;

e) represent the Authority in all its dealingswith third parties.

31 The General Manager may delegate part ofhis powers and duties to the officials andother employees of the Authority to theextent necessary for the efficientmanagement of the Authority.

10. Powers and Duties of the Deputy GeneralManagers

The Deputy General Managers shall:

1I co-ordinate and direct the activities of thedepartments and services placed undertheir respective supervision;

21 act on behalf of the General Manager in hisabsence and on the basis of specificdelegation of power given to each of them;and

31 perform any other activities assigned tothem by the General Manager.

11. Establishment of Statistics Council

The Council shall have the following powersand duties:

1/ to approve the national statistical programproposed by the Authority;

2/ to review the implementation of nationalstatistical programs;

3/ to approve suitable strategies in the creationand maintenance of statistical databasesspecifically from administrative recordsand registration;

4/ to issue directives on the improvement ofthe national statistical system includingcapacity building of institutions and humanresources development; and

5/ to establish sub-committees as may benecessary.

13. Meetings of the Council

1/ The Council shall meet once a year;provided, however, that it may hold ameeting at any time where necessary.

2/ The presence of more than half of themembers of the Council shall constitute aquorum.

3/ Decisions of the Council shall be passedwhen supported by simple majority vote;provided, however, that the chairpersonshall have a casting vote in case of a tie.

4/ Without prejudice to the provisions of thisArticle, the Council may adopt its ownrules of procedure.

14. Budget

The budget of the Authority shall be drawnfrom the following sources. The Implimenta-tion of budget is according to the rule of budgetand administration

1/ budget allocated by the government;

2/ revenue the Authority collects from servicecharges; and

15. Books of Accounts

II The Authority shall keep accurate andcomplete books of accounts.

21 The books of accounts and financialdocuments of the Authority shall beaudited annually by the Auditor General orby auditors designated by him.

16. Obligations to Provide Statistical Data

1/ Any business organization holding abusiness license or applying for a new oneshall have the obligation to register byentering data pertaining to its general statusin a questionnaire or fonn issued by theAuthority and presented to it through thelicensing government agency;

21 Any person required by the Authority tofurnish statistical data shall provide thedata within the time specified by theAuthority.

3/ The owner or possessor of any land, building,commercial vehicle, airplane, vessel or dwellinghouse shall have the obligation to allow accessto the employee or representative of theAuthority, upon presentation of hisidentification card or letter of authorizationissued by the Authority, for the purposes ofstatistical data collection during the time from6:00 a.m. to 6.00 p.m.

41 Any person or government agency orinstitution shall furnish statistical datathrough an interview, telephone or postalinquiry when so requested by theAuthority.

51 Statistical data to be furnished by any personshall be accurate and complete and shall beobtained within the time limit specified bythe Authority and free of charge.

6/ Any data producer shall have the obligationto fill in, sign and return a questionnairewhen so requested by the Authority.

7/ Any person or government agency orinstitution shall be obliged to submit to theAuthority copies of reports of statisticalsurveys under take by it.

17. Confidentiality of Information

1/ Unless otherwise the Authority is orderedby a court:

a) no statement given by a person or partthereof;

b) no answer given to any questionforwarded to a person; or

c) no report, abstract or document containingparticulars of any such statement or answerso arranged as to render possibleidentification of such particulars with anyperson; shall be published, submitted inevidence or shown to any person notengaged in the execution of a dutypursuant to this Proclamation.

2/ The provisions of Sub-Article l(c) of thisArticle shall not prevent or restrict thepublication of any such report, abstract ordocument where the particulars thereinrender identification possible merely byreason of the fact that they are unique andrelate to a business or undertaking which isthe only business or undertakihg within itsparticular sphere of activity; provided,however, that in no case shall suchparticulars render possible theidentification of the costs of production of,or the profits arising from such business orundertaking.

18. Prohibition

No person may conduct surveys or censuses on anational level without the permission of theAuthority.

19. Penalties

1/ Any person engaged in the execution of astatistical activity and who: It the penalhigher punishment it prescribed on the penalcode this will have effect.

a) uses, directly or indirectly, statisticalinformation acquired by virtue of suchengagement for his personal gain orwithout lawful authority, publishes suchinformation or communicates it to anyperson;

shall, upon conviction, bepunishable to imprisonment up tothree years.

b) knowingly compiles or issues any falsestatistical information or fills in statisticalform or questionnaire without approachingthe data producer and with fabricated data, ortransfers such erroneous information:

shall be punishable by simple imprisonmentnot lesser than three months or in the casewhere the offence affects severely the databeing collected, compiled or disseminated thepunishment may be increased up to threeyears of imprisonment.

b) When the person required to furnishstatistical data fails to furnish suchdata the punishment may be raisedup to one-year imprisonment.

3/ if the offence referred to in Sub-Article 2(a)of this Article is committed by a juridicalperson, the fine may be up to ten thousandBirr.

4/ if the offence referred to in Sub-Article 2(b) of this Article is committed by ajuridical person, the fine may be up tothirty thousand Birr.

5/ when the offence is committed by a juridicalperson, the responsible head or employeeof the organization shall be punished bythe penalty provided under Sub-Article2(a) or 2(b) of this Article.

20. Power to issue Regulations and Directives

liThe Council of Ministers may issueregulations that may be necessary for theimplementation of this Proclamation.

21 The Authority may issue directives that maybe necessary for the implementation of thisProclamation.

21. Repealed and Inapplicable Laws

1/ The Central Statistical Office Order No.79/1972 and the Central StatisticalProclamation No. 303/1972 are herebyrepealed.-

21 No law, regulations, directives or practiceinconsistent with this Proclamation shallhave force or effect with respect to mattersprovided for in this Proclamation.

22. Transfer of Rights and Obligations

The rights and obligations of the CentralStatistics Office established under Article 41(11) of Proclamation No. 8/1987 and continuedfunctioning pursuant to Article 57 ofProclamation No. 41/1993 are herebytransferred to the Authority.
