Dear Chairman Cochran:

Small and seasonal businesses across the country were dealt a fatal blow last week when the Department of Homeland Security (DHS) announced that the H-2B cap had been reached for the first half of the fiscal year. This devastating news follows a December announcement that employers may no longer use wage surveys to calculate appropriate wage levels for seasonal workers in their local geographic area. As Congress looks to complete the fiscal 2015 appropriations process for the Department of Homeland Security, the H-2B Workforce Coalition urges you to reinstate the H-2B returning worker exemption that was in place from 2005 through 2007. Please also direct the Departments of Homeland Security (DHS) and Labor (DOL) to resume allowing employers to use wage surveys to calculate appropriate wage levels.

Seasonal businesses rely on the H-2B program to fill temporary vacancies in seafood harvesting and processing, horse training, hospitality and amusement parks, forestry, landscaping, golf courses, circuses, carnivals, food concessionaires, construction, swimming pool maintenance, stone quarries and other industries. The seasonal nature of these businesses and industries means that they routinely face shortages of local workers during their peak work periods. By filling temporary jobs, H-2B workers not only keep these businesses open, they contribute to the creation of additional, year-round jobs for local workers.

Employers turn to the H-2B program as a last resort after an extensive recruitment effort to secure local workers that is required by the program. Despite the extensive costs and time associated with gaining approval from four government agencies, employers use the H-2B program because they are committed maintaining a legal workforce.

Sadly, the program limits the number of H-2B workers that may be hired each fiscal year to 66,000 (33,000 for each half of the fiscal year). The cap for the first half of the fiscal year was reached on January 26, leaving many employers who need workers before April 1 in the lurch. The cap for the second half of the fiscal year will likely be reached soon. In order to ensure that seasonal small businesses can continue to operate, Congress must re-instate the H-2B returning worker exemption that was in place from 2005 through 2007. This expired provision of law exempted from the cap H-2B workers who have complied with past visa requirements and

worked in the program during one of the preceding three years.

The cap announcement follows another devastating blow to the H-2B program. In December, in response to a court order, DOL stopped issuing prevailing wage determinations based on employer provided wage surveys. These surveys are important because in many cases, they allow employers to establish a more accurate representation of local wage rates than those provided by the DOL’s Occupational Employment Statistics (OES) database. The limited number of employers who are able to secure H-2B workers this year are now facing significantly inflated labor costs because they may no longer use valid wage surveys. Further, DOL recently announced plans to issue a declaratory order that would deny employers of their due process and right to appeal wage decisions by circumventing the ruling of the Department’s own administrative law judges.

As you work to finalize funding for DHS, we urge you to save small and seasonal businesses from the catastrophic economic losses that are resulting from arbitrary H-2B cap and the inability to use wage surveys. These losses will not only be felt by small businesses that use the H-2B program, but also by their American workers, the local community and companies that provide goods and services to these seasonal businesses. Please immediately re-instate the H-2B returning worker exemption and allow employers to use wage surveys to ensure that wage rates are appropriate for the local geographic area.
