On motion of COMM. BROOKS. which carried 4-0-1, the following Resolution was adopted:

A RESOLUTION TO AMEND THE OFFICIAL ZONING MAP

WHEREAS, the Municipal-Gwinnett County Planning Commission has held a duly

advertised public hearing and has filed a formal recommendation with the Gwinnett

County Board of Commissioners upon an Application to Amend the Official Zoning Map

from RA-200 to TND by BERNIE SMITH for the proposed use of a SINGLE-FAMILY

SUBDIVISION on a tract of land described by the attached legal description, which is

incorporated herein and made a part hereof by reference; and

WHEREAS, notice to the public regarding said Amendment to the Official Zoning

Map has been duly published in THE GWINNETT DAILY POST, the Official News Organ

of Gwinnett County; and

WHEREAS, a public hearing was held by the Gwinnett County Board of

Commissioners on JUNE 25. 2019 and objections were not filed.

NOW, THEREFORE, BE rr RESOLVED by the Gwinnett County Board of

Commissioners, this the 16th day of JULY 2019. that the aforesaid application to amend

the Official Zoning Map from RA-200 to TND is hereby APPROVED AS OSC with the

following enumerated conditions:

1. To restrict the use of the property as follows:

A. Single-family detached dwellings and accessory uses and structures, not to exceed 70 lots.

B. The minimum heated floor area per dwelling unit shall be 2,000 square feet for · one story homes and 2,400 square feet for two story homes.

C. Homes shall be constructed primarily of brick or stacked stone on front fa9ades, with accents of fiber-cement siding or shake. The balance of the home may be the same or of fiber-cement siding with a minimum two-foot brick or stacked stone water table.

D. All dwellings shall have at least a double-car garage. The garage doors shall be

located behind the front porch or stoop.

2. To satisfy the following site development considerations:

A. Primary conservation space shall be preserved and shall remain undisturbed with the exception of less than ten percent disturbance as referenced in the Rezoning Conceptual Plan for Alcovy Road, dated July 11, 2019.

B. A minimum 50-foot wide conservation space strip shall be provided around the perimeter of the property.

C. A specimen tree concept plan and tree survey shall be required with the submittal of a development permit application.

D. No direct lot access shall be allowed onto Alcovy Road.

E. The Alcovy Road frontage and project entrance shall be landscaped by the developer and maintained by the Homeowner's Association. Entrance shall include a decorative masonry entrance feature. Landscape and entrance feature

plans shall be subject to review and approval of the Director of Planning and Development.

F. Off-street unpaved trails and pedestrian connections to the conservation areas shal l be provided throughout the development. Trails shall be provided around

the detention ponds. Final layout and design of these features shall be subject to the review and approval of the Director of Planning and Development.

G. Natural vegetation shall remain on the property until the issuance of a development permit.

H. All grassed areas on dwelling lots shall be sodded.

I. All utilities shall be placed underground.

J. Building lots shall not be located within any required stream buffers or accompanying impervious surface setback areas.

A RESOLUTION TO AMEND THE OFFICIAL ZONING MAP

WHEREAS, the Municipal-Gwinnett County Planning Commission has held a duly

advertised public hearing and has filed a formal recommendation with the Gwinnett

County Board of Commissioners upon an Application by BUREL. LLC to Change the

Conditions of Zoning on a tract of land zoned C-2 and described by the attached legal

description, which is incorporated herein and made a part hereof by reference; and

WHEREAS, notice to the public regarding said Amendment to the Official Zoning

Map has been duly published in THE GWINNETT DAILY POST, the Official News Organ

of Gwinnett County; and

WHEREAS, a public hearing was held by the Gwinnett County Board of

Commissioners on JULY 23. 2019 and objections were not filed .

NOW, THEREFORE, BE IT RESOLVED by the Gwinnett County Board of

Commissioners, on this the 23rd day of JULY 2019. that the aforesaid application to

amend the Official Zoning Map is hereby APPROVED subject to the following

enumerated conditions:

1. To restrict the use of the property as follows:

A. Retail and service commercial and accessory uses; provided, however, that

the following uses shall be prohibited: adult entertainment establishments; automotive car wash (full and self-service); automotive parts stores; billboards or oversized signs; blue printing establishments; building, electrical or plumbing contractors; convenience food stores with or without fuel pumps; emission inspection stations; funeral homes and mausoleums; group and congregate personal care homes; hotels and motels; self-service

laundries; liquor stores; pest control businesses; locksmith shops; plumbing, electrical and home building supply showrooms and sales centers; radio, recording or television studios and broadcasting stations; recreation facilities (including bowling alleys, skating rinks, shooting ranges and movie theaters); recovered materials processing facility; taxidermist; yard trimmings composting facility; pawn shops; mechanic's shops and/or

garages; tattoo parlors.

B. Abide by all requirements of the Activity Center/Corridor Overlay.

C. 24-hour sales shall be prohibited.

2. To satisfy the following site development considerations:

A. Provide a 75-foot wide natural undisturbed buffer adjacent to resident ially zoned property.

B. Hours of dumpster pickup shall be limited to between 7:00 a.m. and 7:00 p.m.

C. Owner shall repaint or repair any graffiti or vandalism that occurs on the property within 72 hours.

3. To abide by the following requirements, dedications and improvements:

A. The location and design of the driveways shall be subject to Gwinnett and Georgia Department of Transportation review and approval.

B. Provide a center left turn lane into the development per the review and approval of the Georgia Department of Transportation.

C. Provide $40,000 for future improvements to Braselton Highway/Hog Mountain Road' intersection prior to the issuance of a development permit.

B. Buildings shall have a pitched roof (minimum 4:12 visible pitch) and finished with architectural treatments of brick and glass. Final building plans shall be submitted to the Director of Planning and Development for review and approval.

2. To satisfy the following site development considerations:

A. Provide a 50-foot wide natural buffer, und isturbed except for utility crossings and

replantings where sparsely vegetated, adjacent to residentially-zoned property.

B. Provide a landscaped strip outside the right-of-way of Braselton Highway and Pine Road in accordance with the site plan submitted for Commercial Development Permit 2019-00032 and presented at the July 23, 2019 Board of Commissioners public hearing.

C. Dumpsters shall be screened by a 100% opaque brick wall matching the building, at least six feet in height. Dumpster pickup shall be limited to between the hours of 7:00 a.m. and 7:00 p.m.

D. Outdoor lighting shall be contained in cut-off type luminaries and shall be directed in toward the property so as not to shine directly into adjacent residential properties.

A. Design required stormwater detention facilities and septic drainfields such that they do not encroach upon any required buffer area.

A RESOLUTION TO AMEND THE OFFICIAL ZONING MAP

WHEREAS, the Municipal-Gwinnett County Planning Commission has held a duly

advertised public hearing and has filed a formal recommendation with the Gwinnett

County Board of Commissioners upon an Application by MERITAGE HOMES to Change

the Conditions of Zoning on a tract of land zoned R-75 and described by the attached

legal description, which is incorporated herein and made a part hereof by reference; and

WHEREAS, notice to the public regarding said Amendment to the Official Zoning

Map has been duly published in THE GWINNETT DAILY POST, the Official News Organ

of Gwinnett County; and

WHEREAS, a public hearing was held by the Gwinnett County Board of

Commissioners on JULY 23. 2019 and objections were not filed.

NOW, THEREFORE, BE IT RESOLVED by the Gwinnett Coun.ty Board of

Commissioners, on this the 23rd day of JULY 2019. that the aforesaid application to

amend the Official Zoning Map is hereby APPROVED subject to the following

enumerated conditions:

1. To restrict the use of the property as follows:

A. Single-family detached dwellings and accessory uses and structures, not to exceed 129 lots.

B. The minimum heated floor area per dwelling unit shall be 2,400 square feet.

C. Homes shall be constructed with front facades of primarily brick or stacked stone. The balance of the home may be the same, or of fiber-cement siding or shake with a minimum two-foot high brick or stacked stone water table.

D. All dwellings shall have at least a double-car garage. The garage doors shall be carriage type style.

2. To satisfy the following site development considerations:

A. A minimum 25-foot wide landscape space strip shall be provided across the frontage of the property (along Auburn Road and Bailey Road).

B. The pump station and fencing shall not be located w ithin any buffers or landscape strips and vegetative screening shall be provided on all sides.

C. No direct lot access shall be allowed onto Auburn Road or Bailey Road.

D. The frontage and project entrance on Auburn Road and the Bailey Road frontage shall be landscaped by the developer and maintained by the Homeowner's Association and shall include a berm fencing landscaping. Berm and landscaping along Bailey Road shall stop at wetlands and/or buffers for stream. Entrance shall include a decorat ive masonry entrance feature. Landscape and entrance feature plans shall be subject to review and approval of the Director of Planning and Development.

E. Natural vege.tation shall remain on the property until the issuance of a

development permit.

F. All grassed areas on dwelling lots shall be sodded.

G. All utilities shall be placed underground.

H. Building lots shall not be located within any required stream buffers or

accompanying impervious surface setback areas.

I. Lots shall be located outside of state waters buffers, flood plain and

delineated wetlands.

J . Provide a 25-foot construction buffer along the western property line. Grading will be allowed in buffer to correct drainage issues with adjacent property

owner, Margaret Butler.

3. To abide by the following requirements, dedications and improvements:

A. A left turn lane on State Route 324 shall be provided at the project entrance

and on Bailey Road .

B. Entrance to the development shall be prohibited on Bailey Road.

C. Dedicate right of way to Gwinnett County at time of permit approval at Bailey Road for future additional turn lane onto State Route 324 to be constructed by

others.

A RESOLUTION TO GRANT A SPECIAL USE PERMIT

WHEREAS, the Municipal-Gwinnett County Planning Commission has held a duly

advertised public hearing and has filed a formal recommendation with the Gwinnett

County Board of Commissioners upon an Application for a Special Use Permit by LISA

FREEMAN for the proposed use of a PERSONAL CARE HOME (FAMILY) on a tract of

land described by the attached legal description, which is incorporated herein and made

a part hereof by reference; and

WHEREAS, notice to the public regarding said Special Use Permit Application has

been duly publ ished in THE GWINNETT DAILY POST, the Official News Organ of

Gwinnett County; and

WHEREAS, a public hearing was held by the Gwinnett County Board of

Commissioners on JULY 23. 2019 and objections were filed.

NOW, THEREFORE, BE IT RESOLVED by the Gwinnett County Board of

Commissioners, this the 23rd day of JULY 2019. that the aforesaid application for a

Special Use Permit is hereby APPROVED with the fpllowing enumerated conditions:

1. Limited to a state-licensed Personal Care Home (Family) providing residence and care for up to a maximum of six individuals (clients) residing in the home.

2. Exterior signage advertising the Personal Care Home shall be prohibited.

3. Any new building(s) or building renovations shall be of a traditional residential style, compatible with the homes in the surrounding area. Architectural elevations, building materials and colors shall be subject to review and approval

of the Director of Planning and Development prior to the issuance of a building

permit.

4. The Special Use Permit shall be valid for a two-year period, at which time the use shall cease or an application shall be made for renewal of the Special Use

Permit.

A RESOLUTION TO GRANT A SPECIAL USE PERMIT

WHEREAS, the Municipal-Gwinnett County Planning Commission has held a duly

advertised public hearing and has filed a formal recommendation with the Gwinnett

County Board of Commissioners upon an Application for a Special Use Permit by LINUS

IGBOKWE for the proposed use of an AUTOMOBILE REPAIR SHOP (BUFFER

REDUCTION) on a tract of land described by the attached legal description, which is

incorporated herein and made a part hereof by reference; and

WHEREAS, notice to the public regarding said Special Use Permit Application has

been duly published in THE GWINNETT DAILY POST, the Official News Organ of

Gwinnett County; and

WHEREAS, a public hearing was held by the Gwinnett County Board of

Commissioners on JULY 23. 2019 and objections were not filed.

NOW, THEREFORE, BE IT RESOLVED by the Gwinnett County Board of

Commissioners, this the 23rd day of JULY 2019. that the aforesaid application for a

Special Use Permit is hereby APPROVED with the following enumerated conditions:

1. Limited to light industrial uses, which may include an automobile repair shop as a special use. Salvage/junkyard activities shall be prohibited. No vehicle sales of any kind shall occur at this location. All repair activities shall take place indoors. No repairs may be conducted in the parking lot.

2. Salvage of inoperable vehicles and outdoor storage of automotive parts or tires shall be prohibited. No inoperable vehicles shall be stored on the property.

3. Any new buildings shall be of a brick, stacked stone and/or glass finish on all sides (stucco may only be used as an accent material). Final building elevations shall be submitted for review by the Director of Planning and Development.

4. The property owner shall stripe parking spaces in accordance with Gwinnett County parking standards.All vehicles must be parked in a striped parking space on a paved

surface.

5. The existing fence shall be fitted with screening slats or fabric, to provide an effective screen from view of Arcadia Industrial Circle. The paved area at the front of the lot, between Arcadia Industrial Circle and the front building fac;ade, shall be utilized for rear access and customer/employee parking only.

6. Provide a 20-foot wide natural undisturbed buffer adjacent to all residentially-zoned properties. The buffer shall be enhanced where sparsely vegetated.

7. Outdoor storage shall be limited to the rear of the property and screened per the requirements of the Unified Development Ordinance.

8. Dumpsters shall be screened by a 100% opaque brick or stacked stone wall with an opaque metal gate enclosure.

9. The property owner shall repaint or repair any graffiti or vandalism that occurs on the property within 72 hours.

10. Obtain all necessary development and building permits, and bring the site and

structure(s) up to all applicable zoning, development and building codes within 180 days of zoning approval.

WHEREAS, the Municipal-Gwinnett County Planning Commission has held a duly

advertised public hearing and has filed a formal recommendation with the Gwinnett

County Board of Commissioners upon an Application to Amend the Official Zoning Map

from RA-200 to R-75 by HARBORSTONE PROPERTIES. LLC for the proposed use of a

SINGLE-FAMILY SUBDIVISION on a tract of land described by the at.tached legal

description, which is incorporated herein and made a part hereof by reference; and

WHEREAS, a public hearing was held by the Gwinnett County Board of

Commissioners on JULY 23. 2019 and objections were not filed.

NOW, THEREFORE, BE IT RESOLVED by the Gwinnett County Board of

Commissioners, this the 23rd day of JULY 2019. that the aforesaid application to amend

the Official Zoning Map from RA-200 to R-75 is hereby APPROVED with the following

enumerated conditions:

1. To restrict the use of the property as follows:

A Single-family detached dwellings and accessory uses and structures.

B. The minimum heated floor area per dwelling unit shall be 2,000 square feet for one-story homes and 2,200 square feet for two-story homes.

C. Homes shall be constructed with front facades of primarily brick or stacked stone, or as craftsman-style. The balance of the home may be the same, or of fiber-cement siding or shake.

D. All dwellings shall have at least a double-car garage.

2. To satisfy the following site development considerations:

A No direct lot access shall be allowed to Bailey Road. Maintain a 50-foot building setback along Bailey Road.

B. The Bailey Road frontage shall be landscaped by the developer and maintained by the Homeowner's Association. Landscape plans shall be subject to review and approval of the Director of Planning and Development.

C. Natural vegetation shall remain on the property until the issuance of a development permit.

D. All grassed areas on building lots shall be sodded.

If the property becomes a part of Baylee Preserve, the developer shall close the Bailey Road storm drain cross drain at the Cobleigh property to reroute stormwater along the right of way of Bailey Road to the Apalachee River. Design, installation and approval shall be in accordance with Gwinnett County Stormwater and Gwinnett County D.O.T. regulations.
