The Chairman called to order Hearing #2016-010, Gus Fabrication, Inc. for alleged violations of LSA-R.S. 32:1254.E.(9)(b) and

LSA-R.S. 32:1261.A.(2)(e). In attendance representing Gus Fabrication, Inc. was Kendal Broussard, President. A court

reporter was brought in to record the transcript of the hearing, which will be made a permanent part of the Commission’s files.

And after hearing the testimony adduced at trial, the receipt of documentary evidence into the record, and for reasons orally

assigned, the Commissioners of the Louisiana Motor Vehicle Commission (“the Commission”) make the following findings of fact

and conclusion of law:

Findings of Fact: Gus Fabrication, Inc. operated from an unlicensed location, 2304-A W est Main Street, Jeanerette, LA

70544, from January 1, 2015 through September 18, 2015; and

Gus Fabrication, Inc. sold six (6) new EMI/Atoka Trailers between January 1, 2015 and September 18,

2015 at the above-mentioned unlicensed location.

Conclusions of Law: In operating from the unlicensed location of 2304-A W est Main Street, Jeanerette, Louisiana and selling

six (6) new EMI/Atoka Trailers from that unlicensed location from January 1, 2015 through September

18, 2015, Gus Fabrication, Inc. violated LSA-R.S. 32:1254.E.(9)(b) and LSA-R.S. 32:1261.A.(2)(e).

Considering the forgoing and pursuant to the authority vested in the Louisiana Motor Vehicle Commission set

forth in LSA-R.S. 32:1251, et seq.:

IT IS ORDERED, ADJUDGED AND DECREED that Gus Fabrication, Inc. be and is hereby assessed a fine in the amount of ONE

THOUSAND AND NO/100 ($1,000.00) DOLLARS.

IT IS FURTHER ORDERED, ADJUDGED AND DECREED that Gus Fabrication, Inc. pay the cost of the full board hearing to the

Commission in the amount of ONE THOUSAND FOUR HUNDRED AND THREE DOLLARS AND SIXTY-ONE CENTS

LICENSING: Exempts certain vendors who sell trolling motors from licensing requirements

AN ACT

To amend and reenact R.S. 32:1252(25) through (27) and (45) and to enact R.S. 32:1252(46)(c)(vii) and (73), relative to trolling

motors; to provide for definitions; to restrict licensing requirements; and to provide for related matters.

Be it enacted by the Legislature of Louisiana:

Section 1. R.S. 32:1252(25) through (27) and (45) are hereby amended and reenacted and to enact R.S.

32:1252(46)(c)(vii) and (73) to read as follows:

§1252. Definitions

The following words, terms, and phrases, when used in this Chapter, shall have the meanings respectively

ascribed to them in this Section, except where the context clearly indicates a different meaning:

(25) "Marine dealer" means any person who holds a bona fide contract or franchise with a manufacturer or

distributor of marine products, except for any of the following:

(a) a A person engaged in the business of renting or selling new or used watercraft or boats adapted to be powered only

by an occupant's energy, and who holds a license as a recreational products dealer pursuant to the provisions of this Chapter.

(b) Any person engaged in the business of renting or selling new or used trolling motors who otherwise would not be

required to be licensed as any classification of dealer pursuant to the provisions of this Title.

(26)(a) "Marine motor" or "marine engine" means a motor that is a component of a marine product that is sold separately

from a boat when delivered to the marine dealer by the distributor or manufacturer.

(b) The term does not include trolling motors.

(27) "Marine product" means a new or used watercraft, boat, or motor designed for recreational or commercial use on

water and a boat or watercraft trailer. The term also includes an outboard motor or a boat with an inboard/outboard motor attached

to it. The term shall not mean include any of the following:

(a) a A watercraft designed for use primarily for commercial purposes or.

(b) new New or used watercraft or boats adapted to be powered only by occupant's energy.

(c) Trolling motors.

(45)(a) "Recreational products" means new and unused motorcycles, all-terrain vehicles, marine products, recreational

vehicles, and trailers as defined in this Chapter.

(b) The term does not include trolling motors.

(73) "Trolling motor" means any self-contained unit composed of an electric motor, propeller, and controls that may be

affixed to a boat and that acts as a source, but not typically the primary source, of propulsion for the boat.

AN ACT

To amend and reenact R.S. 32:1252(27), relative to marine products; to provide relative to the definition of marine product; to

exclude certain motors; and to provide for related matters.

Be it enacted by the Legislature of Louisiana:

Section 1. R.S. 32:1252(27) is hereby amended and reenacted to read as follows:

§1252. Definitions

watercraft or boats adapted to be powered only by occupant's energy.

The Executive Director advised the Commission Members the staff received inquiries regarding the advertising of “W arranty for

Life”, “Oil Change for Life” and “RV W arranty Forever”. The Executive Director reminded the Commission Members that there

had been a ruling regarding “Free Tire For Life”at June 14, 2004 Commission meeting, wherein “Commissioner Shetler made a

motion that the words “free” and “for life” are misleading, in that there were qualifications in order to get the tires and the programs

limited the amount of tires. Commissioner Bohn seconded the motion. The motion passed with a vote of 8 yeas and 2 nays. The

nay votes were cast by Commissioner Braxton and Commissioner Mann. It was also determined that the concept of tire programs

or the insurance program was not what was regulated by the Commission, it was the advertising and presentation of the programs

that would be regulated; therefore, each advertisement would have to be reviewed individually in order to decide if they were in

compliance with the law or rules considering the varying types of policies and programs offered.” After a brief discussion, Chairman

Brandt suggested to stay the issue for further review.

At this time Counselors Reggie reported to the Commission Members with regards to the previous pending issue, 961 Notice#2015-009, FCA US LLC, that Chrysler has wired the fine of 1.2 millions dollars on March 11, 2016.

The Executive Director advised the Commission Members there had been unforeseen legal expenses relative to several ongoing

litigations and pending hearings of motor vehicle and recreational products licensees. The Executive Director requested the

following amendment of Counselor Reggie's two-year contract be approved: “The total of all sums payable under this contract

including fees and reimbursement of expenses shall not exceed $414,000.00 for the period commencing February 1, 2014 and

ending on January 31, 2016.” After a brief discussion, Commissioner Duhon made a motion to approve the amendment to

Counselor Reggie’s current contract. Commissioner Bent seconded this motion and it was unanimously approved.

At this time, the Executive Director introduced the newly hired Commission Investigators Benjamin Guidry and Thomas Hoeflinger

to the Commission Members.

Boulevard, Metairie, Louisiana 70003, for alleged violations of LSA-R.S.32:1261.A.(2)(c) and Louisiana Administrative Code Title

46. Part V. Subpart 1. Chapter 7. Advertising §703.A.; §711.A.; §715.A.; §735.A.; §743.A.; and §751.A.1., 2., 3., 4., & 5.; §751.B.;

and §751.C. In attendance representing Premier Nissan, L.L.C. DBA Premier Nissan of Metairie was Allen Boudreaux, Esq., Jim

Evans, President, and Craig Collins, General Manager; and representing the Commission were: Commissioner Don Hargroder;

Counselor Gregory F. Reggie; Neil Rogers, Commission Investigator; Ingya Cattle, Assistant Executive Director; and the Executive

Director. The Executive Director advised the Commission Members the following Consent Judgment had been recommended

accepted and ratified by the Commission. Commissioner Bent made a motion to accept and ratify the Consent Judgment in this

matter. Commissioner Corley seconded this motion and it was unanimously approved.

46. Part V. Subpart 1. Chapter 7. Advertising §703.A.; §711.A.; §715.A.; §735.A.; §743.A.; and §751.A.1., 2., 3., 4., & 5.; §751.B.;

and §751.C. Therefore, based on the parties’ mutual consent;

IT IS HEREBY AGREED by and between Premier Nissan, L.L.C. DBA Premier Nissan of Metairie and the Louisiana Motor

Vehicle Commission that respondent waives:

A. Any further procedural rights or remedies afforded under the law;

B. The requirement that the Commission's judgment recites statement of a findings of fact and conclusions

of law; and

C. All rights to seek judicial review or otherwise to challenge or contest the validity of the judgment entered

pursuant to this agreement

IT IS HEREBY FURTHER AGREED the Notice of Hearing may be used in construing the terms of the order. No

Chairman Brandt asked for a review of the January and February financial statements of the Louisiana Motor Vehicle Commission,
