In our last Review our Chairman, Andrew Haining, wrote about the stability that Guernsey can offer to UK residents who are now beginning to focus their attention on the real possibility of a Labour Government being just around the corner. The ongoing, and seemingly increasing uncertainty around Brexit and the well reported rise in popularity of Jeremy Corbyn are continuing to focus the minds of not only business owners and entrepreneurs but also people who work in industries which are geographically portable or those who are employed in industries already established in Guernsey. Our unemployment figures have fallen again so there are opportunities to be seized both in terms of employment and the selection of properties currently available on the Open Market.
New Tax CapIn our latest Budget, described by the President of the Policy and Resources Committee, Gavin St Pier, as fair, innovative and confident, Guernsey has introduced a reduced tax cap with effect from January 1st 2018. In simple terms when a new resident pays at least £50,000 in document duty on the purchase of an Open Market property they will be able to benefit from a reduced tax cap of £50,000 per annum for the year of purchase and three subsequent years. In broad terms, a new arrival purchasing an Open Market property for at least £1.5 million should be able to benefit from this scheme. This welcome proposal reinforces Guernsey’s wholehearted commitment to attracting new residents to the Open Market and underlines its recognised benefit to the Island.
Investor and Entrepreneur VisasFor those non EU passport holders wishing to live in Guernsey’s Open Market there are two options available provided they have an entry visa from the British Consular representative in their country of residence and £1million under their control.
They can either take the Investor Visa route which requires an investment of £750,000 in the Island which could be: • deposited in a GSFC regulated Guernsey
bank; or• used for the purchase and retention of an
Open Market property (in addition to the property in which the applicant lives) of a value of no less than £750,000; or
• by the Investment of £750,000 into another Guernsey opportunity of the applicant’s choosing that is considered satisfactory by the States of Guernsey.
The alternative would be to take the Entrepreneur Visa route which has a requirement to invest £200,000 in a new or existing Guernsey Company which the applicant will manage themselves.

I learnt about lots of lovely byte-guzzling apps to help me multitask my way through the day, introduced to a number of life hacks websites, and numerous other mind-boggling tricks, shortcuts, novelty methods that increase productivity and efficiency.
Alternatively, you could just move to Guernsey. Many of us have heard the adage, “How you spend your day, is how you spend your life.” Well, I’m certainly thrilled to no longer be waging the twice-daily war with my fellow commuters; I’m delighted to be home in time for the Archers (often the lunchtime episode too), and, should the urge occur, I can get to the court, pitch, field (insert appropriate venue) for a 6pm start.
There is an ease associated with the quality of life here which is hard to describe. There’s a wonderful sense of community which fizzes out of every issue of the Press, the island’s daily paper. There are delicious and ever-inventive restaurants, which don’t just rely on local produce – award-winning Chinese anyone? Competitively graded schools are ensuring that the island’s next generation are as well educated as the City-boys and gals working in Guernsey’s ever-changing financial, legal, trust and international business scene. And even when you are stuck in a motionless traffic jam, you are at least presented with the most breathtaking views.

As consumers become increasingly aware of the implications their spending habits have (both directly and indirectly) on those connected through all levels of the global supply chain, their altruism becomes a key driver for change. The trade-off that existed in the past (the ability to obtain cheaper goods in return for a distinct lack of consideration for ‘pesky’ social and environmental factors) is no longer tolerated – we now expect both attributes to be fulfilled, without compromise, before parting with our cash. Gone are the days where companies were able to score a quick margin windfall by moving manufacturing to sweat-shops located abroad in order to exploit the foreign country’s non-existent child labour policies.
There is no doubt that technological advances have made the world a smaller place. Perhaps this has contributed to the change in attitude – it’s harder to gloss over issues when they are happening on your own doorstep. As we have become ever more globally connected, the ability to act ignorant and isolate issues that don’t directly affect us becomes increasingly difficult. Regardless of the underlying cause, the fact remains that companies that fail to recognise this trend (and react accordingly) are at severe risk of losing their customer base, which could have dramatic financial consequences for even the most established businesses.
When it comes to our own investor base, we have certainly seen a pick-up in the number of ethically related questions we receive. As you might expect, in recognition of this, we have increased the attention we give to environmental, social and governance (ESG) concerns when conducting our own research - much more so than when these factors were considered to be less important to the financial buoyancy of a company.
The general perception is that companies who are more ESG compliant will benefit from the natural tailwind provided by the increasing numbers of ethically driven consumers/investors. We actually view the opportunity somewhat differently. For us, recognition of ESG does not guarantee tailwinds. Instead, the failure of a company to acknowledge these issues and act responsibly forms a deterrent to investment. This is a subtle but important difference. The idea that ESG is the Holy Grail (and that any company which demonstrates strong policies will automatically result in superior performance) is both unrealistic and naïve - a company with no demand for its products will remain an undesirable investment. However, the revelation that a company’s directors have incentives to act in a manner that is not aligned with the aspirations of their shareholders is a good enough reason to forgo an investment.
It’s hard to escape the fact that, recently, ESG has been a buzzword within the investment management industry. As fundamentally driven investors, the hype associated with anything perceived as being ‘new and shiny’ raises a number of alarm bells for us. It can be very tempting to buy into the latest fad; often with disastrous consequences. However, ignoring a trend in motion can have equally as undesirable effects. With that in mind, for investors looking to capitalise on this trend, we would suggest investors simply expand their existing criteria of what defines a “quality company” to include an awareness of ESG.
An example I like to refer to is tech-giant Apple - best known for its beautifully designed products and cutting-edge innovation. In a Family Fortunes-esque move, if we were to survey 100 people and asked them to name the first thing they associate with Apple I think we’d be hard pushed to find anyone who came back with ‘environmentally aware’. Yet, in 2016, 96% of the electricity used at its global facilities came from renewable sources, 99% of the paper used in its packing is from recycled or responsibly managed sources and recycled tin (exclusively) is now used for the solder on the main circuit boards of the iPhone. Sure, in some instances these sustainability-focused goals are directly financially beneficial (they help reduce costs and thus improve margins) but they also demonstrate an alignment with the attitudes of their underlying consumers – which, as highlighted above, can prove vital in retaining customers and ensuring Apple’s products remain relevant.
As with Apple, the very best businesses will already be well aware of their customers’ changing attitudes and will have made significant steps in adapting to accommodate these. As a result, investors in quality companies are likely to have existing exposure to this trend, although it might be unbeknown to them. The humble chameleon has been around for 80 million years – perhaps testament to the idea that a company’s ability to adapt can help to ensure it’s longevity in a fast changing world.

THE DOCUMENT DUTY (GUERNSEY) LAW, 2017
This will replace the current legislation with the intention
of simplifying the document duty regime.
The new law will:
• Introduce anti-avoidance provisions
• Create an o� ence of making false or misleading statements
• Introduce an appeals process against decisions
of H M Gre� er
The current rates of duty payable are not due to change
with the implementation of this law.
THE DOCUMENT DUTY (ANTI-AVOIDANCE) (GUERNSEY) LAW, 2017
This law represents a new system, imposing duty on
transactions which are not conveyances but have an e� ect
comparable to the transfer of an interest in real property
akin to a conveyance.
Currently, upon a conveyance, the document is registered
at the Gre� e and the transfer of ownership and the
consideration is clearly ascertainable for the purpose of
assessing duty. However, a transfer of shares in a company
which owns a Guernsey property does not attract duty,
and is not a registrable document.
The purpose of the new law is to ensure that these types of
transactions will attract duty going forward and be treated in
the same way as conveyances registered at the Gre� e.
The general principle will be that duty will be charged on all
transactions which:
1. Confer on a ‘transferee’ a signifi cant benefi t in real property
(i.e. enjoyment of the benefi t of ownership of real property,
such as the right to enjoy or occupy it)
2. Are made in return for payment in money of money’s worth and
3. Are not exempt under the law
There is a list of exceptions which you can access on our website.
Duty will be payable on the market value of the Guernsey
property that is the subject of the transaction. In the majority
of cases (but not always) this will be the consideration paid.
IN SUMMARY
Other than the new provisions applying to the transfer of
shares, the legislation simply enacts many of the existing
practices surrounding the collection of duty.
The new laws are due to come into force on or around
15 November 2017.
