Standard clauses for residential agency

agreements for when you list your property for sale!

Agents (Real Estate Companies) can opt to use voluntary standard clauses in their residential agency agreements. These clauses were developed by the REAA and the REINZ in response to industry requests for clearer guidelines around commission and agency agreements.

The REAA recommends that all agents selling residential property use these clauses and are advising vendors to only enter into residential agency agreements with real estate agents who use the recommended standard clauses in their agency agreements.

Benefi ts of the residential standard agency agreement clauses:

The clauses provide certainty about:

• when an agency ends, and• when a commission needs to be

paid.

Advantages include:

• consumers are protected from the risk of being asked to pay commissions to two agents

• reduced risk of commission-related disagreements between agencies

• reduced risk of complaints to the REAA or REINZ.

For sole agency agreements, the standard clauses set out that:

• the sole agency agreement will automatically expire after 90 days if no end date is specifi ed

• an agent can only claim a commission if a sale and purchase agreement is signed

during the term of the agency agreement

For general agency agreements, the standard clauses set out that:

• agreements can be cancelled on seven days’ written notice

• an agent can only claim a commission if a sale and purchase agreement is signed during the term of the general agency agreement and where:

o the agent has been instrumental in bringing about the sale and purchase agreement, or

o the sale and purchase agreement is signed with someone introduced by the agent

Agencies using the residential standard clauses

On the REAA website there is a list of agencies ( Real Estate Companies) who have committed to using the standard clauses in their agency agreements when they list your property to sell.

So before you list your most valuable asset ask the salesperson if the Agent (Real Estate Company) they work for is using the preferred Agency Agreement clauses, for your peace of mind.

So, you’ve fi nally got around to re-decorating

your bathroom. You want it be luxurious – a haven in your own home and you know that getting the right bath is key to being comfortable.

Believe it or not, there are many diff erent styles available, in many diff erent shapes and sizes.

Firstly you need to consider how many people will be sitting in the bath at any one time – are you a couple that like to bath together? Or do you prefer to bathe alone?

For the ultimate in sensuality and relaxation try a double ended bath. They are perfect for two people but can be a generous option for those that want it all to themselves.

They come in a variety of sizes including 1700 x 700mm, 1700 x 750mm and 1800 x 800mm.

The term single ended bath may be a bit confusing. After all, don’t all bathtubs have to have two ends in order to hold in water? What the term single ended bath means is that there is only one end of the bath that can be used as a back rest because the faucet is located at the other ended.

Usually, one end of the bath is a vertical steep side (good if you are using it as a dual-purpose bath for showering in as well), and the other end is usually a sloped end for lying back against.

The usual/most common size of single-ended baths is 1700 x 700mm.

A roll top bath is a freestanding bath with edges which curve at the top, providing a distinctive rounded eff ect around the edge of the tub. Many people think that the look of a roll top bath is sleek and very classic; these tubs often appear in restored historic homes and period designs.

Alternatively, they can also be featured in more edgy modern design schemes, in which case they may be supported by cradles or raised on a dais for a very distinctive

look. There is something slightly indulgent but thoroughly deserved about sinking into a roll top bath and letting your cares dissolve with the bubbles.

The Shower Bath is popular because this type of bath cleverly provides the relaxation of a soak in the tub with the more practical side of showering.

Perfect peony poppiesIn the past I’ve extolled the virtues of both iceland and shirley poppies. Both are easy to grow and great for brightening up your garden and then your home as cut fl owers. Well, now let me introduce you to the peony poppy.

Much like other poppies, the peony variety enjoys sunny, well-drained and dry conditions and grows to around 70cm high. But unlike the shirley and iceland poppies it has multiple fl uff y fl owering layers of petals.

The peony bundle sold at Awapuni has at least nine seedlings, which are a mix of diff erent colours includ-

ing varying shades of pink, red and cream.

You can grab a bundle of peony (or any of our other poppy varieties such as iceland, shirley, ANZAC, oriental and champagne bubbles) seedlings next time you’re down at your local supermarket or Bunnings. Alternative-ly, head to www.awapuni.co.nz and have your seedlings delivered from our online store direct to your door.

As I said above, look for a sunny, warm and well-drained spot in your garden to plant your new seedlings. Garden beds next to the house are the perfect planting spot because of the cover and protection the house provides.

Once you’ve found the right spot sim-ply dig a little hole and plant. It pays to water them once they are planted, as this will help them get started. But after that they shouldn’t require much watering. If you do think they need a drink be careful not to overhead wa-ter as they don’t take kindly to it and can get squashed by wind or rain.

In around just six to eight weeks you can expect a fantastic injection of layered colour in your garden. Re-member, to de-head the fl owers when they die, and they will keep fl owering longer.

Eventually the plants will seed down and go dormant for winter. At this point, I’d recommend replanting the area with winter annuals like pansies. However, if you just leave the garden bed as it is, the poppies should re-grow next spring. But the colours may not be as bright as what you planted originally.

Although mould can be benefi cial in making penicillin and a great

cheese, it isn’t so wonderful when it’s in

your home!Spores can spread easily and are

almost impossible to eradicate. They can grow anywhere including carpet, clothing, food, paper and even in places not easily spotted such as inside your walls and above ceiling tiles.

Mould can also produce allergens and irritants (and, rarely, toxins) that may compromise your health.

So what can you do if you're concerned about mould growing in

your home?

Prevention is really the name of the game and to do that you need to control the moisture in your home.

Here are some tips on how to help.

1. Identify problem areas in your home and correct them. You can't mould-proof your home, but you can make it mould-resistant. Where are the problem areas? Do you notice frequent condensation on an upstairs window? Is there a water stain on the ceiling from a persistent leak? Preventing mould from growing or spreading might be as simple as ripping up carpet in a damp basement, installing mould-resistant products, or repairing damaged gutters

2. Dry wet areas immediately. Mould can't grow without moisture, so tackle wet areas right away. Seepage into the garage after a heavy rainfall, accumulation from

a leaky pipe, even a spill on the carpet should be dried within 24 to 48 hours. If you've experienced a fl ood, remove water-damaged carpets, bedding, and furniture if they can't be completely dried. Even everyday occurrences need attention: don't leave wet items lying around the house, and make sure to dry the fl oor and walls after a shower. Don't leave wet clothes in the washing machine, where mould can spread quickly. Hang them to dry — preferably

outside or in areas with good air circulation.

3. Prevent moisture with proper ventilation. It may be that your routine domestic activities are encouraging the growth of mould in your home. Make sure an activity as simple as cooking dinner, taking a shower, or doing a load of laundry doesn't invite mould by providing proper ventilation in your bathroom, kitchen, laundry room, and any other high-moisture area.

4. Equip your home with mould-resistant products. Building a new home or renovating an old one?

Use mould-resistant products like mould-resistant drywall or mould-resistant Sheetrock, and mould inhibitors for paints.

5. Monitor humidity indoors. You can measure humidity with a moisture meter purchased from your local hardware store. You'll also be able to detect high humidity by simply paying attention to potential problem areas in your home. Tell-tale signs of excessive humidity include condensation on windows, pipes, and walls. If you notice condensation, dry the surface immediately and address the source of moisture (for example, turn off a humidifi er if water appears on the inside of nearby windows).

Finally, educate yourself on your region's climate and how it responds to moisture. There is no one-size-fi ts-all solution when it comes to mould prevention. Knowing what works for your climate and your home is an important fi rst step.

Tall Ferns vs

Japan EA Networks Centre

Sunday, August 9 @ 2pmTickets are on sale for the Tall Ferns three-test series against Japan, including their game at the EA Networks Centre on Sunday 9 August.

The Ashburton game will be the fi rst international sporting event to be held at the new Centre.

EA Networks Centre manager Steve Prescott said he is delighted that the Tall Ferns have chosen to play in Ashburton. "It is a really big event on the basketball calendar as it is the fi rst home series for the Tall Ferns, outside of an Oceania Championship, in almost ten years. And the great thing is that we get to host the fi nal."

About 300 tickets are available for the event, with costs varying depending on the location of the seats.

Children’s seats will cost $10 anywhere around the court. Corporate tables will also be available. Tickets can purchased online from www.rams.org.nz

The fi rst two games in the Series will be played on Wednesday 5 August, and Friday 7 August, starting at 7pm. The Ashburton game on Sunday 9 August will begin at 2pm.

The series is part of the Tall Ferns build up to the Oceania Championships in August and qualifi cation for the Rio 2016 Olympic Games.

Head coach Kennedy Kereama says the focus of the series will be twofold. Firstly, to perform well against world-class opposition and secondly, to conclude preparations for the Melbourne and Tauranga Oceania Championships against the Opals, with the winner to qualify for Rio 2016.

"This series gives us a great platform to fi nish our preparation before playing the Opals. The Japanese are fi erce competitors and boast some of the best talent in Asia including Asami Yoshida and Mamiya Yuka. Both were named in the all-star fi ve at the 2013 Asian Championships. The Japanese play a very unique and quick style of basketball, which will be a great test."

Director of Japan’s Women’s National Team, Mr Masahiro Takahashi says, he hopes that this series will be "the beginning of a mutual friendship" among the Japanese and New Zealand basketball families.
