The process of selling and buying real estate can be overwhelming and stressful especially when

considering the amount of paperwork and preparation involved with these transactions. Most sellers in New Zealand still rely on real estate professionals to sell their homes rather than selling privately.

Are purchasers better protected when purchasing through real estate professionals? – “most absolutely.” This is especially so if the purchaser lacks sufficient experience in property investment.

Generally, selling one’s property privately is not classified as being “in trade” and hence these activities are often not captured by the Fair Trading Act 1986. What this then means for consumers is that if a private seller misrepresents the property or fails to disclose important facts about the property, then the only remedy available is in civil action which can lead to significant cost and time delay with no guaranteed outcome. More importantly, the onus of proof in these civil actions lies solely with the person bringing the claim.

In comparison, if the property was offered “in trade” via a real estate agent, then an option exists for a complaint to be made to the Commerce Commission. Under the Fair Trading Act, the Commerce

Commission has the role to enforce this Act by investigating and prosecuting traders. The Commission can also ask the Court to order compensation for consumers who have suffered loss. The Consumer Law Reform Bill proposes to take this step further and include an additional provision under the Fair Trading Act which will place the onus on the person making representation (i.e. the trader) to substantiate the representation, failing which an offence will be established.

The Real Estate Agents Act 2008 was enacted to protect consumers. The compulsory licensing regime under this Act was also designed to protect consumers so that they get to deal with real estate professionals who must comply with strict requirements and professional standards and are required to keep up with continuing education.

So my message to potential buyers of real estate is to make most of this protection provided and choose to deal with persons licensed under the Real Estate Agents Act 2008. This is the very reason most properties sold in New Zealand are through estate licensees who are members of the Real Estate Institute of New Zealand (‘REINZ’) can use the title ‘MREINZ’ on the business card or other marketing materials.

REINZ members also are bound by strict

codes of ethics and are expected to develop and enhance the real estate industry by providing excellent customer care and upholding excellent standards of practice that are open, ethical and honest.

Anyone keen to improve his or her sense of well-being after the weeks of rain we’ve had would do well to consider

putting in a swimming pool.

It certainly focuses the mind on the idea of summer, and with spring already underway, there’s no time to waste.

Improved technology and construction methods mean domestic pools are no longer beyond the reach of the average family. Nor do they take six months to build. These days you can find a supplier, order a pool, and have it delivered the same week, if not the same day, for a price which will not break your heart. However, while paying for it might be a bit easier than it used to be, making all the decisions around pool ownership remains a challenge.

The design and construction causes considerable disruption to the surrounding garden, and in most families the pool has to satisfy a number of needs.

He may want a lap pool, she a plunge pool, the teenagers a massive, in-ground resort-style pool where they can entertain mates and play loud music, and the littlies a round plastic thing on the lawn with a blow-up water slide on the side.

For the average Kiwi family, it’s likely an above-ground, kitset model will be the simplest and cheapest option. It can be delivered for you to put together yourself, with a plumber and electrician for the tricky bits. Some of these pools even incorporate a current so you can effectively combine a lap pool with a plunge pool and kill two birds with one stone.

Once the budget has been set and the type of pool decided upon, you need to consider

where it’s going to go. The current trend is to locate a pool close to the house and incorporate it into an outdoor living space. That way, it becomes part of the area where you entertain, and it’s also easy to supervise children around the water.

The other alternative is to site it well away from the house and create a new area of landscaping to accommodate it. If this is your choice, you need to think about whether it will be visible from the house (again, supervision of children is a consideration) and that the

further away from the house, the more cost to connect to services such as power and water.

To compare the locations you’re considering, take a tape measure, a stringline and some pegs and mark the area out. You’ll quickly be able to tell whether your pool is going to destroy existing landscaping, where the sun will be, how sheltered the spot is, and what impact there will be from existing trees. If you don’t want to spend hours sucking leaves

out of the pool, taker a close look at what is nearby. A stand of eucalyptus alongside could drive you mad.

If possible, leave your stringline in place for a few days, and walk around the area frequently. This will give you an idea of how the pool fits into the environment, and how much garden is left over. A great, big pool sounds fabulous, but it’s no fun if there isn’t any room to sit around the edge and relax.

Before you so much as put a shovel in the earth, check with the local council about rules around swimming pools. They have strict requirements so you will need to look at resource consent, building consent and at satisfying other requirements that are often challenging, sometimes difficult, and occasionally prohibitive.

For example, anyone who builds a pool is required to fence it, even if it’s tiny and so shallow you have to lie down to get wet. The Fencing of Swimming Pools Act requires people with pools (including spa pools) to put fences around them to a height of 1.2 metres. The fence can only enclose the immediate pool area but may include things used in association with the pool, such as changing sheds. You can’t fence the whole back yard which includes the clothesline or the vegetable garden and expect to comply with the Act, because children generally come and go in these areas freely. So find a pool company that’s prepared to look at the regulations with you and work out how they can be met while still giving you the pool you want. Make sure you have a clear understanding of what is involved and the time frame for the work to be done, and with luck, a long, wet summer will be in store.

Repair those nasty holes

If you are getting ready to list your home for sale, don’t let prospective buyers be put off by those holes in walls and damages. They can look

expensive to repair, however they are relatively easy fixes and the ideal DIY project.

Although Gib board is tough, it can withstand only limited abuse.

A door flung open with too much force can produce a doorknob-size hole in the wall which although looks scary and expensive, is a fairly easy repair.

The method of repair obviously differs depending on the size of the hole. If the hole is small and it has not broken through the Gib, it can be easily filled, sanded and painted. However, if it is door knob or fist-size, it will need a backing to support the plaster. If any larger the section of Gib ideally needs to be replaced, retaped, plastered and painted.

Here we will repair a fist-size hole.

■ Prepare the area by removing loose plaster-board and cutting back with a utility knife to a sound surface. Keep a piece of painted plaster-

board to colour-match the paint if you have no luck finding any leftover tins.

■ Cut a piece of Gib board to slide into and behind the hole but longer on two sides to glue behind the hole.

■ Push a nail or screw through from the back and hold it from the front. Then glue behind the hole and hold firmly until the glue grabs. Allow to dry, then push the nail into the wall out of sight.

■ Mix up enough plaster required to fill the hole or use pre-mixed, which can take a little longer to dry. Plaster comes in a variety of drying times – 20, 45, 90 minutes etc depending on how much you are using at any one time.

■ Using a broad knife, fill the hole level with the wall and allow to dry and shrink back.

■ Apply a second coat of plaster over the hole, feathered out, and allow to dry.

■ Sand level with the wall using a sanding block or similar then, for a perfect finish, skim coat or plaster using a fine finishing compound to cover any sanding marks and imperfections. Allow to dry fully and lightly sand with a fine paper or foam sanding block.

■ Remove any dust from the wall then undercoat the plastered area using a sealer undercoat. It is important to use an undercoat for adhesion but it must be a sealer undercoat to seal the plas-ter. Being more porous than the painted area, it will show a different sheen level when painted. Ideally the sealer undercoat should be rolled to achieve the same finish as the rest of the wall. Allow to dry fully for maximum adhesion.

■ Paint it out. If you have the paint used, you’re half way there. If not, most paint stores are happy to match and supply smaller amounts – usually 1 litre minimum as you need to paint the wall out to the next break or corner. Even if you have the exact paint used and only paint the re-paired area you will notice a difference in sheen level when the light hits the wall.

■ Cut up the ceiling, corners and floor of the re-paired wall and roll out two top coats. When dry it should be impossible to see where the dam-age was.
