WHAT IS COPYRIGHT LAW? HOW DID YOU KEEP TO COPYRIGHT LAW IN THE AUDIO AND VISUAL ELEMENTS OF

YOUR PRODUCTION? Copyright protects people’s original work or ideas whether it is ‘literary, dramatic, musical, graphic and audiovisual creations’. This prevents people from copying their work and claiming it as their own. If someone does break the law then they have either ‘reproduced, distributed, performed, publicly displayed or made into a derivative work without the permission of the copyright owner’. Then they suffer the consequences of being sued or heavily fined a way to avoid this is by either asking permission from the songwriter. (Not the actual artist since most of the time they don’t actually make the song.) Or purchase a song from a royalty free music library.

For our music video we did not use any pre-record footage, if we did we would have to ask permission. This is the same for audio, since we did not make up the song we had to ask the songwriter for permission. In addition my partner and I made sure our idea was completely original. We had to make sure that there weren’t any videos similar to anything else.

OFCOM

OFCOM REGULATION DESCRIBE THE PARTS OF THE CODE RELEVANT TO MUSIC

VIDEO PRODUCTION

HOW DID YOU KEEP TO IT IN YOUR PRODUCTION?

PROTECTING UNDER 18s For any video or program to be broadcasted before 9pm, the content must not include’ very explicit sexual practices, obscene material, very graphic violence, etc.’ If the target audience is aimed at children then the producer must take whilst making the video or program. They need to make it child friendly and ‘consider carefully the potential effect of their programming on younger viewers’. If not then this video or program will have to be shown after 9pm during the watershed period.

At 2:41 -2:42 of our music video we turned the bottle slightly to hide the actual brand of the bottle so children don’t go out and buy the alcohol. In addition since you couldn’t see the brand the audience could only assume that there was alcohol in the bottle. Yet inside the bottle was water. Towards the end of the music video the main actress is assumed to be smoking. However this is hard to tell due to the lightning. At the end the main actress implies she has taken some ‘drugs’ and overdosed. Though the audience can easily tell that the ‘drugs’ are in fact sweets.

HARM AND OFFENCE This regulation has a set standard of rules within specific categories which is allowed to be broadcasted. These

Offensive language: In the actual music video, one of the actresses swears therefore we just took away the voices

categories are:

Violence, dangerous behaviour, and suicide

- Suicides or self-harming should not be included in a program or video because this may be triggering for someone.

Exorcism, the occult and the paranormal

- An Occult activities should only be for entrainment purposes only and the viewers should know that.

Hypnotic and other techniques, simulated news and photosensitive epilepsy

- Hypnotic techniques must not be done directly into the camera and there should be a warning just before the program for people with epilepsy.

Broadcast competitions and voting

– Competitions and voting must be fair. So they mustn’t be misled and there rules and conditions must be clearly shown.

and only had the music playing an example of this is at (3:18 – 3:20.) Before we choose the song we analysed the (artist’s name) lyrics. There was no offensive language however if there was I would either mute out the word or phrase.

CRIME This regulation is stated to make sure that criminal activities are not produced due to the material broadcast. They do not want broadcasters to encourage people to recreate crimes e.g. ‘kidnapping or hijacking’. In addition they do not want any underground contacts that could lead to criminal activities and if criminal content is broadcasted they need to be justified by the broadcaster.

First we asked for permission of the location to avoid being stopped by the police. We also we made sure that we didn’t damage the area. We took precautious or removed scenes all together. Such as we originally had a scene where the main actor would burn a teddy bear. However we discovered that would a ruckus e.g. onlookers might call the police or something might catch fire.

FAIRNESS This regulation is to make sure that no one is treated unfairly to people or companies. Generally the producer needs informed consent from the people contributing in the work being produced. This includes is the contributor is ‘under the age of 18’however the producer needs permission from their parents.

In our music video there various ethnicities. Also my partner and I made sure that out actor and actresses we both free so that could film. Lastly we both asked them if they were happy with what they were doing and if there were any problems. In addition we had them sign a contract to show they agreed to

This makes sure that the contributor agrees to the conditions they would be working and for. In addition the producer has to be careful when producing a program or video that is based on facts because the actors may feel uncomfortable of acting out a scene. Therefore they have the right to withdraw any time given a reasonable explanation.

what they are signing up to.

PRIVACY This regulation is somewhat linked to the fairness regulation because broadcaster want to make sure that ‘they don’t want any unwarranted infringement on material.’ If this does happen the broadcaster has to gain consent from the person or organisation. However broadcasters are not allowed to show people suffering or in distress because that is a breach of privacy. Furthermore this includes people under the age of sixteen and vulnerable people.

We made sure to film when the public was around so we don’t see their faces. However there were some scenes where you could see the public but their faces were blurred. If any of the public didn’t want to be filmed my partner would hold up a sign saying that ‘if you walk past here, you have agreed to being filmed.’

INSURANCE

TYPE OF INSURANCE DESCRIBE WHAT THE TYPE OF INSURANCE COVERS

HOW WOULD IT HAVE AFFECTED YOUR

PRODUCTION MANAGEMENT?

PUBLIC LIABILITY Depending on which company you choose to hire their Public liability insurance can cover the ‘Damages to property and Bodily Injury to any person’ but they must be accidental. As stated above it depends on the company because only some companies may cover a specific location and there may be a limit on how much damaged you caused. E.g. if the ‘damage exceeds £250’.

We have to be careful not to damage any property and to see if the actual area is not a hazard to anyone. This means we had to carry out health and safety assessments before we start filming.

COMPLETION This insurance makes sure that the project is being completed on time so money does not go to waste. This means budget is

The actor or actresses have to sign a contract saying the will be a part of the music video. There were deadlines that we have to
