vii. The fishery management plan as proposedin the letter dated 11-02-2008 should beimplemented in totality. Creatinghatcheries, establishment of fish farms andreservoir fishery has been proposed forconservation and fisheries developmentand suitable sites for establishment ofhatcheries should be identified inconsultation with the State FisheriesDepartment. The total budget of Rs. 55.75lakhs for fishery development andconservation should not be diverted for anyother purpose.

Being complied, as we are already inconsultation with State fisheriesdepartment for finalising the proposedplan for development of fisheries in thearea.An amount of ₹ 20 Lakhs deposited againstthe proposed ₹ 55.75 Lakhs in EMP (detailsare as below).Please refer Annexure-III

viii. The proposed afforestation programme indouble of degrade forest area of 15.6ha(10ha in north & 5.6 in East districts) usingnative plant species are identified for thisafforestation programme should be strictlyimplemented. Necessary forest clearanceunder Forest (conservation) Act, 1980should be obtained in this regard.

The project is in operation stage. Theentire C.A amount 33.31 Lakh is alreadydeposited to State forest department.

ix. The proposed green belt within the 39.1haof the project area along the network ofapproach roads, residential areas, officecomplex, dam site, around the periphery ofthe reservoir should be strictly adhered andalso proposed in - situ/ex - situ conservationof Orchids and take up rehabilitation ofthese species along the road from Rangpoto Ranipool which are ideal places forrehabilitation should be strictlyimplemented.

In addition to above, we have alsobeen a part of various afforestationprogrammes such as PrayavaranMahatosav, CM’s 10 Min to Earth,State Green Mission, WorldEnvironment Day etc.

In all these afforestationprogrammes as part of bio diversitymeasure only locally available soilbinding species are selected.




x. During lean season 4.92cumecs of water flowis available in the river. A minimum of 1cumof the water shall be released during the leanseason for maintaining the aquatic life in theriver

Part - B: General conditions

i. Adequate free fuel arrangement should bemade for the labour force engaged in theconstruction work at project cost so thatindiscriminate felling of trees is prevented.

Noted, Project is in operation stage, LPG isbeing provided/using at Kitchen.

ii. Fuel depot may be opened at the site toprovide the fuel (kerosene/wood/LPG).Medical facilities as well as recreationalfacilities should also be provided to thelabourers.

Local medical dispensary unit is set up.Ambulance is readily available at projectsite for any emergencies not only for theemployees but also open to the localpublic.

iii. All the labourers to be engaged forconstruction works should also bethoroughly examined by health personneland adequately treated before issuing themwork permit.

Project is in Operation stage; onlymaintenance activities and infra activitiesare being going on. All the labourers arethoroughly examined before hiring themfor various activities during operationstage. In addition to this, Medical campsare being conducting regularly.

iv. Restoration of construction area includingdumping area with levelling, filling up ofburrow pits, landscaping etc. area should beproperly treated with suitable plantation.

v. Financial provision shall be made in thetotal budget for safeguard measures.

vi. A multidisciplinary committee in consultationwith the Ministry should be constituted withEcologists, Environmental Scientists,Conservationists and experiencedadministrators etc., to oversee the effectiveimplementation of suggested safeguardmeasures.

Project is in Operation stage, duringconstruction of the project, the first meetingof Committee was convened for 12th and13th May 2016 and as per the programmesite visit was organized on 12th May 2016which was followed up with joint discussionson 13th May 2016 at meeting hall of HotelTibet, Gangtok.




vii. Six monthly monitoring reports should besubmitted to the Ministry and its regionalOffice, Shillong for review.

Six monthly reports are being submittedregularly to RMoEF&CC and MoEF&CC.

4. Officials from Regional Office MoEF,Shillong who would be monitoring theimplementation of environmentalsafeguards should be given full cooperation,facilities and documents/ data by theproject proponents during their inspection.

State Pollution Control Board’s officialsvisited site on 4th Feb. 2017.

Dr. V.P Upadhyay from RMoEF&CC,Shillong visited the site on 10.06.2017.

5. The responsibility of implementation ofenvironmental safeguards rests fully withSneha Kinetic Power Projects Limited &Government of Sikkim

Yes, being ensured of various safetymeasures implemented at project site.

6. The total amount of Rs. 2346.88 lakhs keptin the budgetary provisions in the letterdated 11.02.2008 for implementation ofenvironmental management plan should bestrictly adhered and not to be diverted forany purpose.

For instance, an amount of Rs. 40 Lacs inthree instalments have been depositedunder part of Disaster Management Planof EMP vide D.D. Nos 002755, dated25/11/2014, 334078, Dated: 3/6/2015and 362880, dated: 29/3/2016respectively for establishment of wirelesscommunication for Forest Department,Sikkim.

Detailed break-up of the expenditureincurred against EMP is provided asAnnexure-VI.

7. In case of change in the scope of theproject, project would require a freshappraisal.

Noted, EAC of MoEF&CC recommendedfor amendment in EC in its meeting heldon 24&25 of Aug, 2017, final letter isawaited from MoEF&CC.

8. The ministry reserves right to add additionalsafeguard measures subsequently, if foundnecessary and to take action including

Discussions at Dikchu, East Sikkim, 16th November 2007. Action Taken by SKPPLQ.11. Is there any provision inthe project and develop ournatural and religious sites?

Ans. Yes, the main site in the projectarea is "GURDUNG". Its height isaround 80 mts. The dam to beconstructed will not have any impacton it as the water will flood up to 20mts only. We have kept enoughprovision for the protection of theGURDUNG.

Ans. Yes, we have a provision forconstructing a community center butthe place will be finalized only afterthe discussion with common peopleand area MLA. I am also planning tohave a milk collection centre inconsultation with Sikkim Milk Union.


In place of Community Centre,Computer Training center withInstructor has been provided atDikchu which was inaugurated byour Honorable Power Minister,Sh. Sonam Gyatsho

Q.27.Do you have anyprovision to construct theroad between Dikchu toLingdok 9th mile?


Ans. No, so far we do not have anyprovision for the construction of theseroads will not be of that muchimportance for the project. On top ofthat acquiring the land for the road,construction of bridges and control ofslides will add a huge cost to theproject.

Q.28.Is there any provision fortraining of Jhoras of LakshapKhola, Tintek Khola andothers?


Ans: Yes, it is clearly stated in the EMPreport.


The matter will be taken up asper specific site requirementonly, if required.



Q.38.What will be the normsfor the employment in theproject?

Q.47. Is there any provisionfor construction of crematoryshed and footpath leading tothe same?


Ans. No, not now. We can take this uplater once the project starts.


Crematorium shed works forLingdok, East Sikkim has beallocated to Local and has beencompleted.

Q.51. Will the Companyconstructs an additionalbuilding within Lingdok 9thmile PHSC?

Public of Nampong block,Dikchu

Ans. We do not have such provisionnow, but we will help in strengtheningsome of the dispensaries around theproject site.


Construction of additionalbuilding is completed. In additionto this, material for strengtheningof existing Lingdok PHC building isalready given.

3. Construction of temple at Tumin area, Dikchu was carried out for an amount of Rs. 4.6Lacs

4. Fund of ₹ 10 lacs in 2 instalments i.e as ₹ 4 lacs and Rs.6 lacs was contributed forconstruction of Gumpa at Tanek village

5. Renovation works were taken up at Chemistry Lab of Government Girls SeniorSecondary School, Deorali, Gangtok costing to about ₹ 3.5 lacs.

6. Equipment’s like Heater, Water Filter & Fire Extinguishers Cylinders etc., were suppliedto Dikchu Primary Health Centre for an approximate cost of ₹ 20,000/-

7. Cleanliness and sanitations works were carried out at our various project locationsunder the scheme named ‘SWACHH BHARAT ABHIYAN – 2014’. This was activelyparticipated both by Employees and Locals

8. Repair works were taken up at various locally available government establishments suchas schools, Health centres/GPU. In addition to this, at government school we evencarried out construction of wash rooms.

9. Not only provided financial help during earth quake but also supplied many constructionmaterials to locals such as cement, aggregate etc.

10. Renovation works were taken up at Panchayat Bhawan, Phudong, North Sikkim costingto about ₹ 1 lac.

11. Construction of foot path Adit-II to Lower Rongong, Phudong, North Sikkim was carriedout for an amount of ₹ 4.35 lacs

12. Repair works were taken up at Foot Bridge at Lingdok over Dikchu River, costing to ₹1.38 lacs.

13. Construction material such as cement/sand/ aggregate and CGI sheets etc. provided forGUMPA, Mandir, Church and Govt. Schools, at Lingdok/Tanek/ Dikchu/Phudong costingto about. ₹ 30 lacs

14. Equipment’s like Heater, Water Filter & Blankets etc., were supplied to PhodongPrimary Health Centre for an approximate cost of ₹10,000/-




15. Construction of RCC foot Bridge at Tanek village, North Sikkim was carried out for anamount of ₹ 4 lacs

Dr. R. Vasudeva, Dr. J.P. Shukla and Dr. Govind Chakrapani could not present due to pre-occupation. The deliberations held and the decisions taken are as under.

As Dr. Sharad Kumar Jain, Chairman was not available on 25.08.2017 due to pre-occupation, meeting was held under the Chairmanship of Dr. D.M. Morein the Ministry of Environment, Forest & Climate Change at Narmada Meeting Hall, Ground Floor, Jal Wing, Indira Paryavaran Bhawan, Jorbagh Road, New Delhi. The following members were present:

The PP submitted an application during August, 2016 mentioning that some project parameters have been changed during the construction phase, i.e. after getting EC in 2008 and requested the Ministry for an amendment in EC. The PP also mentioned that in the EC letter dated O 1.04.2008, a condition has been stipulated at SL No. 7 i.e. "in case of any change in the scope of the project, then the project would require a fresh appraisal' and hence an amendment is requested in the EC. Thereafter, the Ministry requested PP to submit a detailed report regarding changes and requested Regional Office, MoEF& CC, Shillong to submit the latest status of compliance of the EC conditions vide Circular dated 30.05.2012. The Ministry again wrote to Regional Office, MoEF, Shillong to inspect the site and submit a latest factual report including para-wise compliance to EC conditions, changes in the scope

For Dikchu HEP (96 MW) in North &East Sikkim Districts of Sikkim, environmental clearance (EC) has been accorded on 01.04.2008 as per EIA Notification, 1994 and 2006. The EC is valid for 10 years. The FC clearance has been obtained on 09.02.2010 and 21.03.2013. As per the records, about 97% of the construction works have already been completed till now.

The Project Proponent (PP) and the Consultant, M/ s R.S. Environ link Technologies Pvt. Ltd, Gurgaon, made a detailed presentation of the project and inter-alia, provided the following information:

been obtained till date, the period after 14.06.2008 is considered as violation of EIA Notification, 2006, therefore, the committee suggested that the Ministry may take a separate call on the this issue.

11. Provision of e-flow should be ensured for the sustenance of aquatic life in the downstream river.

111. Land acquired for the project shall be suitably compensated in accordance with the law of the land with the prevailing guidelines.

iv. Total power requirement to be provided and its firm linkage to be supported with documents.

v. Proof of application for diversion of forestland for non-forest purpose will be submitted to the Ministry within one month.

vi. Detailed information on species composition in particular to fish species from any previous study /literature should be included.

vi. A detailed irrigation management plan should be worked out so that at least 10% of the CCA would be covered by micro irrigation scheme.

vi. The issue of conjunctive irrigation may also be considered in the project right from the formulation stage.

vi, Wildlife clearance is to be obtained from the Competent Authority as per the Wildlife (Protection) Act, 1972.

vi. Wildlife Conservation plan be prepared for the area located within the project and implemented by the project proponent in consultation with the State Forest Department.

vi. Wildlife Conservation plan also to be prepared for the impacted area due to construction of the project outside the project area and implemented by the local state Forest Department.

1. The muck generation quantity is much beyond the EC quantity. Further, consolidation and compaction of dumps have not been done. The debris is finding ways into the river due to poor strength of retaining wall. And thus, no reclamation of muck disposal areas.

11. Fisheries Management Plan for the project remains unattended. During meeting of Multidisciplinary Committee, the officials of the State Fisheries Department informed that they could take up this work.

m. Forest clearance has been obtained for 9.5 ha forestland, which is beyond 7. 794 ha area as originally planned.

rv. The status on raising plantation in 15.6 ha area along with details of site, species planted, etc. is yet to be submitted to the RO, Shillong including development of green belt in 39.1 ha of the project area along the network of approach of the reservoir.

v. In-situ/ ex-situ conservation of orchids and rehabilitation of the species along the road from Rangpoo to Ranipool has not yet been initiated as yet.

vi. The amenities and facilities provided to workers are very poor. Better facilities are required to modernize the kitchen, dining area, drinking water, etc.

vu. The dumping sites need to be completely reclaimed to avoid soil and sediment run off from dumps. A reclamation plan with time bound implementation schedule is required to be prepared.

viii. Sufficient funds to be provided for reclamation of all the 6 dumping sites.

The RO, Shillong has submitted (i) monitoring report carried out during 12- 13.05.2016 on the status of compliance of EC conditions, (ii) Multi-disciplinary Committee Report and (iii) changes in HRT, location of Powerhouse, etc. The RO, Shillong, among other things, mentioned the following:

The PP applied for applicability of EIA Notification, 2006 to the proposed project and thereby consideration of ToR/scoping clearance by the EAC, if any, on onlinl0.08.2017 in the website of the Ministry. The PP informed that an additional Spillway of Hirakud Dam built across river Mahanadi near Sambalpur, Odisha is one of the earliest major multi-purpose river valley projects of India, which was completed in 1957.Spanning an area of 743 km2 when full, the reservoir is the most important water infrastructure of the state contributing water for generating 307.5 MW of hydropower, irrigating 2,64,478 ha of Culturable Command Area annually in Bargarh, Bolangir and Subarnapur Districts; and providing flood protection to 9,500 km-' of Mahanadi Delta, which is thickly populated. Total length of the dam and dykes is 25.8 km. The length of the main dam is 4,800 m with two spillways. The left spillway has 40 sluice gates and 21 crest gates. The right spillway has 24sluice gates and 13 crest gates. The total discharging capacity of both the spillways is42,450 m3/s (15 lakh cusec). Taking into account of the operational constraint of few gates the effective discharge is about 36,806 m3/s (13 lakh cusec). The Central Water Commission (CWC) in 1997, reassessed the Inflow Design Flood with up to date data. The revised design flood was computed as 69,632 m-' / s(24.5 lakh cusec). In order to safely release the inflow design flood, the CWC advised to construct additional spillways at suitable locations. A joint expert team comprising of CWC, Egis-consultants of DRIP and World Bank visited Hirakud Dam site in March, 2015 to finalize the proposed feasible locations for the additional spillway. The conclusive recommendation for the best alternatives is (l)At the left bank in the 2nctsaddle at left of Gandhi hillock with 5 nos. of spillway gates to discharge 3 lakh cusecs of flood water into the river Mahanadi just downstream of left spillway and (2) Another at 13, 100 ft. of right dyke with 8 nos. of spillway gates to discharge 4 lakh cusec flood water through a spill channel to Jhanijore Nallah which meets river Mahanadi near Dhama, downstream of Sambalpur Town. The option (1) will be taken up in the first phase for which the World Bank has agreed for necessary funding. The Govt. of Odisha has administratively approved the project. The layout of the spillway and spill channel has been finalized. The Ministry of Water Resources, River Development and Ganga Rejuvenation, Government of India is closely monitoring the progress of the project, as it is related to the safety of the prestigious Hirakud dam. After deliberations and considering all the facts of the project as presented by the PP, the EAC noted that the minor changes in the project parameters but these changes have not materially changed the basic configuration, scope, etc. Thus, the EAC recommended that the changes made by the PP, shall be amended in the EC accordingly.

Vide CAG Report No. 39 of 2016, it has also been mentioned that the muck is being dumped at 6 locations in North and South Districts, instead at 4 locations as proposed in the EMP.
