AND WHEREAS the said Judge, Seventh Industrial Tribunal has submitted tothe State Government its Award on the said Dispute.

AWARD

This industrial dispute was in between Debobroto Chakraborty, Code No. 000332689.

CIO. Sri Sudhir Kumar Chakraborty, 8/1/721, Adarshapara, Post Office-Bidyadharpur (East),

Via-Shyarnnagar, Dist. 24-Parganas(N), Pin-743127 and 1) Mis. Hindustan Unilever Ltd.

o'Brook House', 1, Shakespeare Sarani, Kolkata-700071 and 2) Mis. Hindustan Unilever Ltd.,

'Unilever House', B. D. Sawant Marg, Chakle, Andheri East, Mumbai-400009 originated from

and application under Section 2A(2) of Industrial Disputes Act raised by the workman.

Thereafter notice was issued upon the opposite party and he submitted written statement.

Question of maintainability was raised by the company and evidence was adduced to that

point. At the stage of evidence of company the parties to this litigation started to stop their

appearance. Show cause notice was issued as to why the period under consideration shall not

be allowed ex-parte. Finally on 23.02.2017 the workman Debobrato Chakraborty was present in

person and filed a verified petition stating that he is not at all intended to proceed further and

prays for passing an award for disposal of the case as non-prosecution of the prayer for

withdraw the same. Ld. Advocate appearing on behalf of the a.p. Company submitted that the

company will make entire legal dues, if any, liable to be paid by the company and in view of the

prayer the workman is examined and he candidly submits that he wishes to withdraw the case.

Accordingly, the workman is permitted to withdraw the case and the case is disposed of as non­

prosecution and award is accordingly passed showing disposal of the case as withdrawal as well

as dismissal for non-prosecution.

This is the award of this Tribunal which shall be communicated to all concerned.
