PUBLIC NOTICE Registration / Recognition of all Child Care Institutions and Organizations established for Children in Need of Care and Protection and in conflict with law under the Juvenile Justice (Care & Protection of Children) Act, 2015 and Juvenile Justice (Care and Protection of Children) Model Rules, 2016 in NCT of Delhi, in compliance of directions issued by Hon’ble Supreme Court of India in Writ Petition (Civil) No. 473/2005 in the matter of ‘Sampurna Behrua’ v/s Union of India and Ors.

The Juvenile Justice (Care & Protection of Children) Act, 2015 and Rules framed there under, provides for Registration / Recognition u/s 41 (1) of all institutions and organizations running institutions for children in need of care & protection and in conflict with law, including children’s home, specialized adoption agency, open shelter, observation home, special home 50(1), 65 (1), 43(1) 47(1), 48(1). Any person or persons, in-charge of such Child Care Institutions & organizations providing these services should apply on the prescribed application forms (for child care institutions and open shelters) within 30 days for Registration / Recognition Certificate under the respective provisions of the aforesaid Act to “The Director, Department of Women &

Child Development, NCT of Delhi, 1-Canning Lane, K.G. Marg, New Delhi” along with the relevant documents. The details of requisite documents to be submitted alongwith the application form is available in the Terms of Reference on www.wcddel.in

Any person having information regarding such unregistered Child Care Institution may

report at above address. It is reiterated that in case of non compliance legal action under section 42 of JJ Act, 2015 and IPC shall be taken in case any Child Care Institution is found running without obtaining valid registration certificate u/s 41(1) of the JJ Act, 2015 with imprisonment which may extend to one year or a fine of not less than one lakh rupees or both. Every thirty days delay in applying for registration shall be considered as a separate offence.

All institutions & Organizations having valid Registration / Recognition certificate under

the Juvenile Justice (Care & Protection of Children) Act, 2000 on the date of commencement this act need not apply for registration again under the new Act, as the same are deemed to have been registered under the Juvenile Justice Act, 2015.

However, all child care institution whose registration certificate has either expired or is

due to expire and have applied for renewal of registration certificate are advised to re-submit application for registration of child care institution / open shelter under the Juvenile Justice (Care & Protection of Children) Act, 2016 in Form 27.

Term of Reference:-

Registration / Recognition Certificate of all Institutions and Organizations established and

run for Children in need of Care and Protection and in conflict with law under the

Juvenile Justice (Care & Protection of Children) Act, 2015 in NCT of Delhi and Rules

thereof.

The Juvenile Justice (Care & Protection of Children) Act, 2015 provides for

Registration / Recognition of all institutions and Organizations running institutions for

children in need of care & protection and in conflict with law, including children’s home,

specialized adoption agency, open shelter, observation home, special home under section

41 (1), 50(1), 65 (1), 43(1) 47(1), 48(1). Any person or persons, in-charge of such Child Care

Institutions & organizations providing these services should apply within 30 days for

Registration /Recognition Certificate under the respective provisions of the aforesaid Act to

“The Director, Department of Women & Child Development, Govt. of NCT of Delhi,

Pandit Ravi Shankar Shukla Lane, K.G. Marg, New Delhi” along with the relevant

documents. The Juvenile Justice (Care & Protection of Children) Act, 2015 (Act 2 of 2016) and

Juvenile Justice (Care and Protection of Children) Model Rules, 2016 alongwith details of

the requisite documents to be submitted with the application in Form - 27 is available in the

Terms of Reference on www.wcddel.in

All institutions & Organizations having valid Registration / Recognition certificate

under the Juvenile Justice (Care & Protection of Children) Act, 2000 on the date of

commencement of this act need not apply for registration again under the new Act, as the

same are deemed to have been registered under the Juvenile Justice Act, 2015 and should

apply for renewal of their Registration / Recognition Certificate three months before the

expiry of its current Registration / Recognition Certificate.

However, all child care institution whose registration certificate has either expired or

is due to expire and have applied for renewal of registration certificate are advised to re-

submit application for registration of child care institution / open shelter under the Juvenile

Justice (Care & Protection of Children) Act, 2016 in Form 27.

Any unregistered institution & Organization running institutional or non-institutional

Care Services for children in need of care & protection and in conflict with law without

obtaining Registration Certificate u/s 41(1) of the JJ Act, 2015 are liable for legal action u/s 42

of the Act with imprisonment which may extent to one year or a fine of not less than one lakh

rupees or both. Every thirty days delay in applying for registration shall be considered as a

separate offence.

The following documents are required to apply/renew the Registration / Recognition

Certificate under the provision of The Juvenile Justice (Care & Protection of Children)

Act,2015 :-

1. Application in FORM 27 of the Juvenile Justice (Care and Protection of Children) Model Rules, 2016 for registration of child care institution and open shelter.

2. Copy each of rules,

3. Copy of byelaws,

4. Copy of memorandum of association,

5. List of governing body,

6. List of office bearers,

7. List of trustees,

8. Copy of balance sheet of preceding three years,

9. Copy of statement of past record of social or public service provided by the institution to the State Government

10. Copy of a declaration from the person or the organization regarding any previous conviction, record or involvement in any immoral act or in an act of child abuse or employment of child labour.

11. Copy of a declaration from the person or the organization that it has not been black listed by the Central or State Government;

Any person/public in possession of information about any such institution which is

being run in their locality without obtaining Registration / Recognition Certificate under

Juvenile Justice Act,2015 may inform to “The Director, Department of Women & Child
