Subject: Final Seniority List of Sub-Inspectors of the J&K Excise and State Taxes Departments, as it stood on 09 .12.2019.

Whereas; the Final Seniority List of Sub-Inspectors of the J&K Excise and State Taxes Departments (Subordinate) Service was issued vide Government Order No.192-FD of2017 dated 15.06.2017; and

02. Whereas; the Seniority List of the Sub-Inspectors of Excise and State Taxes Departments is required to be updated by excluding the names of those officials, who have either been promoted to the next higher post substantively or have retired on superannuation, and including those who have been appointed to the post of Sub­Inspectors by direct recruitment or promotion; and

03. Whereas; in order to update the seniority list, a tentative Seniority List of Sub-Inspectors of the Excise and State Taxes Departments, Division-wise, indicating the position as on 09.12.2019, was notified vide Notice dated 13.12.2019 for inviting objections from the concerned officials within a period of 21 days from the date of the issuance of the Notice; and

04. Whereas, representations from the following officials through the concerned Heads of Departments were received, which have been scrutinized under

rules; and 05. Whereas, on the recommendations of Commissioner State Taxes and Excise Commissioner, following requisite modifications/corrections have been incorporated in the seniority list:

The Official figuring at S.No. 53 in the Tentative Seniority List of Sub-Inspectors, Division Jammu has in his objection submitted that his qualification has been shown as Matric whereas he has passed 1 O+ 2 and consequently, the necessary correction has been made accordingly in the list. The Official figuring at S.No. 70 in the Tentative Seniority List of Sub-Inspectors, Division Jammu, has in his objection submitted that his qualification has been shown as BSc, whereas his qualification is M.Sc/B.Ed and consequently the necessary correction has been done accordingly in the list. The Official figuring at S.No. 110 in the Tentative Seniority List of Sub-Inspectors, Division Jammu, has in his objection submitted that his qualification has been shown as BSc, whereas his qualification is BSC/LLB and consequently the necessary correction has been made accordingly in the list. The Official figuring at S.No.144 in the Tentative Seniority List of Sub-Inspectors, Division Jammu, has in his objection submitted that his qualification has been shown as Matric whereas his qualification is Bachelors of Arts (BA) and consequently the necessary correction has been made accordingly in the list. The Official figuring at S.No. 52 in the Tentative Seniority List of Sub-Inspectors, Division Jammu, has in his objection submitted that his qualification has been shown as Matric in place of 1 O+ 2 and consequently the necessary correction has been made accordingly in the list. The Official figuring at S.No. 141 in the Tentative Seniority List of Sub-Inspectors, Division Jammu, has in his objection submitted that his qualification has been shown as Matric in place of BSC and consequently the necessary correction has been made accordingly in the list.

The Oflicial figuring at S.No. l 50 in the Tentative Seniority List of Sub-Inspectors, Division Jammu, has in his objection submitted that his qualification has been shown as IO+ 2 in place of BSC and consequently the necessary correction has been made accordingly in the list. The Official figuring at S.No. 60 in the Tentative Seniority List of Sub-Inspectors, Division Jammu has in his objection submitted that his name has been shown as "Davinder" whereas his name is as "Darvinder" and his qualification has also been shown as Matric in place of B.A. Consequently the necessary correction has been incorporated in the list.

11 Rajesh Singh The Official figuring at S.No. 114 in the Tentative Seniority list of Jammu Division has in his objection submitted that his DOB has been shown as 03-11-1983 whileas his Date of Birth is 11-1-1983 and Consequently the necessary correction has been done accordingly in the list.

12 Vinay Kumar The Official figuring at S.No. 136 in the Tentative Seniority list of Jammu Division has in his objection submitted that his qualification has been shown as Matric in place of BSC. In this case, the necessary corrections, can be considered as and when the verification report regarding qualification is received from concerned HOD.

13 Balwan Singh The Official figuring at S.No. 145 in the Tentative Seniority list of Jammu Division has in his objection submitted that his DOB has been shown as 25-2-1985 whileas his DOB is 25-12-1985 and His qualification has also been shown as Matric in place of B.A. Consequently the necessary correction in respect of DOB has been made accordingly in the list on the recommendations of HOD.

However, corrections with regard to the qualification, can be considered as and when the verification report regarding qualification is received from concerned HOD.

Sumil Khajouria The Official figuring at S.No. I JO in the Tentative Seniority list of Jammu Division in his objection submitted that his qualification has been shown as BSC instead of Degree in Bachelors of Law and consequently the necessary correction has been made accordingly in the list.

Gourav Gupta The Official viz. Shri Gourav Gupta figuring at S.No. I 08 in the Tentative Seniority list of Jammu Division has filed his objection regarding fixation of his seniority. In this regarg, the concerned HOD has informed that Shri Anurag Sharma, Sub-Inspector was appointed vide Govt. order No. 42-F of2015 dated 17-3-2015 with the directions that inter-se-seniority of the appointee shall be strictly in accordance w~th the ~erit secured by the candidate as per the select hst furnished by the J&KSSB vide letter No. SSB/Sel/Secy/014/3549-55 dated 13-5-2014. His appointment was delayed due to the fact that Service Selection Board had withheld the recommendations for some candidate including Shri Anurang Sharma among others as is also mentioned in Govt. order No. 178-F of 2014 dated 24-7-2014. Shri Gourav Gupta Sub­Jnspector was appointed vide G.O. No. 113-GAD of 2015 dated 29-2015 and as such he is junior to Shri Anura~ Sharma, Sub-Inspector.

05. Now, therefore, without prejudice to and subject to the outcome of writ petitions, if any, pending in any competent court(s ), the final seniority list of Sub-Inspectors of the Excise and State Taxes (Subordinate) Services, Division­wise, as on 09.12.2019 is, hereby, issued fanning Annexures "A" & "B" to this Government Order.

06. In case any official feels aggrieved with the position assigned to him in the above Seniority List, he may file a review petition, as per the relevant provisions of the Jammu and Kashmir Civil Services (Classification, Control and Appeal) Rules, 1956. The review petitions, if any, containing facts, as have not been considered or as have come to light now and which have a material bearing on the issue of determination of seniority, should reach this office within a period of one month from the date of issuance of this order failing which the

~Seniority list shall be deemed to have attained finality.

07. The date(s) of birth as well as category certificate (s) recorded/indicated against the official in the Fina\ Seniority List shall not be taken as authentic and shall be subject to the verification from the Service Books/Matriculation Certificates/ other relevant records as prescribed under norms.
