The Director, CIFNET, Kochi, invites Sealed quotations under two bid system

(1- Technical Bid, 2 –Price Bid) for Hiring a Monofilament Tuna Long liner fishing vessel from the

reputed firm as detailed below:

The tender forms can be obtained either from this office or through down load from our website

www.cifnet.gov.in. The down loaded tender forms will be accepted if accompanied by the Demand

Draft towards the cost of tender forms. Tender submitted without EMD will not be considered.

The Director, CIFNET, Kochi reserves the right to accept or reject any or all tender without

TERMS AND CONDITIONS OF THE TENDER SCHEDULE

1. Last date for receiving the Tender: Tenders are to be submitted in two separate envelops as detailed below:- Cover 1- Technical bid. Cover 2- Price Bid . Each envelope shall be super scribed as cover-1Technical Bid for hiring

of Tuna Long Liner fishing vessel due on 20.12.2012.

Cover-2 – Price Bid for hiring of Tuna Long Liner Fishing vessel due on

_____ ____All the tenders should be sent to the Director, CIFNET,

Foreshore Road, Kochi -16 by registered post/by hand so as to reach

this office on or before, 20.12.2012 at 1400 hrs.

2 Opening of Tender: The tender (Technical Bid) shall be opened, in

the presence of bidders/authorized representative, at 1430 hrs on

20.12.2012 at the CIFNET, Foreshore Road, Kochi-16. Those who

qualify as per the terms and conditions will only be considered for Price

Bid.

3. Tender Schedule Cost: Tender schedule cost (non refundable) of Rs.

500/- + Tax Rs. 25/- drawn on any Nationalised Bank and payable at

Kochi is to be paid in form of DD in favour of Director, CIFNET, Kochi-

16. The DD should be furnished along with the Tender.

4 Earnest Money Deposit (EMD): The successful bidder should furnish

the EMD/performance security for Rs. 5,00,000/- (Rupees five lakhs

only), in the form of a Demand Draft or Bank Guarantee valid through

during the validity period of the lease contract. This amount of

EMD/performance security shall be refunded to the party, at the end of

the lease contract. However, if the bidder violates any of the conditions

of the Tender, the EMD/performance security shall be forfeited.

5. Contract Period: The Deep Sea Fishing Vessel will be hired for a

minimum period of one year, which is further extendable as per the

Institute’s requirement. However, the contract will be liable to be

terminated at any time by CIFNET without assigning any reason.

6. Specifications of the vessel: The Deep Sea Fishing Vessel should be of

more than 20 mts. Over All Length (OAL), with Hydraulic long liner setter

and main liner spooler on board the vessel. The Main Engine should

have Horse Power of around 400 BHP. The tender should be submitted

with all details of vessel, year of built, copy of Registration documents,

port of Registry, OAL etc.

7. Type of Fishing: The Deep Sea Fishing Vessel should be suitable for

Tuna Long Line fishing, with all the required fishing gears for the said

type of fishing and suitable for imparting training activities.

8. Endurance Period: The endurance of the vessel should be for 20 days.

9. Voyage Days: Each voyage shall be for 5 to 7 days or as decided by

CIFNET.

10. Accommodation: Besides the regular manning crew required for the

Deep Sea Fishing Vessel, provision should be made for six additional

Berths, in order to accommodate minimum of five CIFNET trainees and

one Faculty onboard the vessel.

11. Manning: Manning of the Deep Sea Fishing Vessel shall be as per the

requirements/stipulations of MMD and will be made by the Lessor.

12. Availability: The Deep Sea Fishing Vessel shall be available for 24

hours a day, five days a week and twenty days a month, to CIFNET,

except for the maintenance period of the vessel.

13. Monitoring Services: Separate Log Books shall be maintained for

various purposes of hours of operation, fuel/Diesel consumption & fish

catch. This log book should be signed by the Skipper, Chief Engineer of

the vessel and representative of CIFNET and shall be made available for

verification at any time by the Operation Division of the Institute.

14. Area of Operation:- For training purpose of CIFNET, Kochi, Chennai &

Visakhapatnam centres as per sailing programme which will be

scheduled by CIFNET, within the Indian EEZ.

15. Equipment: The Deep Sea fishing vessel should be equipped with

working Echo Sounder, STD Monitor and other equipments as per the

MMD Rules/provisions and all other adequate equipments and

accessories required for tuna long lining operation.

16. Life Saving Equipment (LSA) and Fire Fighting equipments(FFA):

These equipments shall be provided by the party as per the

requirement of MMD as per MS Act alongwith validity certificate of

inspection.

17. Moblisation and Demobilisation charges: The Lessor shall bear all

the mobilization and demobilization charges, whenever the vessel is

required to be shifted from Kochi to any other port.

18. Payments: All the payments will be made on monthly basis for the

Bills after satisfactory performance submitted by the Lessor to CIFNET

on or before 10th of every month for the previous month’s performance.

CIFNET will make monthly payment for the deep Sea fishing vessel at

the hire charges in Indian Rupee in the form of Account Payee

Cheque/Demand Draft payable at the place of Lessor’s choice after

deduction of Taxes/other statutory charges as applicable if any. The

Lessor shall furnish the bank details to CIFNET.

19. Hire charges : The Hire charges for the vessel will be calculated on

daily basis for the Deep Sea Fishing vessel provided and will include the

cost of Diesel, Lube Oil, Water, salary and allowances of manning crews

on board, maintenance charges, insurance, cost of ice if required,

repairs/replacement of damaged fishing gears etc. The hire charges

may be quoted with taxes and other levies whatso- ever as applicable,

with the following breakup and furnished separately in the cover-2. Lease amount per day for the deep sea fishing vessel calculated

on the basis of fuel consumption for;

a) while at shore (hourly rate)

b) while on fishing (hourly rate)

c) while anchoring (hourly rate)

d) while idling (hourly rate)

20. Maintenance period: Break down if any shall be attended to

immediately by the Lessor. The Deep Sea Fishing Vessel shall be eligible

to avail 72 hours (3 days) maintenance period in a month i.e. 36 days

in a year during the period of the lease contract. The allowed

maintenance period can be availed only after prior written permission

from CIFNET. No hire charges will be paid during this maintenance

period. Accumulation of the maintenance period is allowed, to be

utilized by the Lessor, as and when required during the contract period.

21. Insurance: The Deep Sea Fishing Vessel shall be insured under

Marine Hull Insurance policy, by the Lessor. All the Crew Members

including the Officer/faculty and trainees of CIFNET on board shall be

insured under Workmens Compensation/Group Accident policy by the

Lessor. The premium amount shall be born by the Lessor. The MMD

provision in this regard shall be complied with by the Lessor.

22. Compliance with Statutory requirements: The party supplying

the vessel will be required to comply with all existing MMD Regulation

of LSA,FFA and Certificate of Inspection, as per the provision of DG

Shipping /M.S Act. All Certificates are to be provided on demand by the

CIFNET.

23. Fishing Gear/ Repair/replacement of Damaged Fishing Gear: The

Lessor shall supply the fishing gear and spares as per the specification

provided by CIFNET. The cost of the fishing gear and accessories and

cost of repair/replacement of damaged fishing gear shall be born by the

Lessor.

24. Fish Catches: All fish catches shall be properly preserved in refrigerant

compartment of the vessel maintaining minimum -20°C and should be

handed over to CIFNET after completion of voyage.

25. Maintenance and Break down charges: All maintenance and

Breakdown charges shall be born by the Lessor. In case of major

repair/damage to the vessel the Lessor shall arrange another similar

vessel for conducting the training.

26. CIFNET will not be responsible to spend or incur any amount towards

any other cost for the smooth operation of the vessel during the entire

contract period, other than the hire charges.

27. The manning crew provided by the lessor will be the employees of the

lessor and there will be no employee employer relationship, whatsoever,

between the manning crew and CIFNET. It is the responsibility of the

lessor that the manning crew does not indulge in any trade union

activities or agitate against the CIFNET. The lessor will solely be

responsible for any labour problems of the manning crew and CIFNET

will not have any responsibility/liability on these matters/issues.

28. Courts Jurisdiction: (i) In event of any dispute or difference between

the parties hereto, such disputes or differences shall be resolved

amicably by mutual consultation. If such resolution is not possible,

then the unresolved dispute or difference shall be referred to arbitration

of the sole arbitrator to be appointed by the Secretary, Department of

Animal Husbandry Dairying & Fisheries, Ministry of Agriculture on the

recommendation of the Secretary, Department of Legal Affairs (Law

Secretary), Government of India. The provisions of Arbitration and

Conciliation Act, 1996 (No. 26 of 1996) shall be applicable to the

arbitration under this clause. The venue of such arbitration shall be at

Ernakulam or any other place as may be decided by the arbitrator. The

language of arbitration proceedings shall be English. The arbitrator

shall make a reasoned award (The ‘Award’) which shall be final and

binding on the parties. The expenses of the arbitrator as determined by

the arbitrator shall be shared equally by the party to the agreement.

However, expenses incurred by each party in connection with the

preparation, presentation shall be borne by the party itself.

(ii) Pending the submission of and /or decision on a dispute, difference

or claim or until the arbitral award is published, the parties shall

continue to perform all of their obligations under this Agreement

without prejudice to a final adjustment in accordance with the such

award.

(iii) Subject to the above provisions, the courts at Kerala shall have

exclusive jurisdiction.

29. Agreement: The successful bidder shall accept the contract agreement

for leasing the Deep Sea fishing Vessel to CIFNET in non judicial stamp

paper worth Rs.______, incorporating all the

salient points of lease agreement. The contract agreement shall be

registered with the appropriate authorities.

30. The Director, CIFNET, Kochi reserves the right to reject any or all the

tenders and discontinue the contract at any time without assigning any

reasons(s) what so ever.

On Rs.100/-(Non judicial stamp paper) LEASE AGREEMENT.

This Agreement of lease is executed on ---------day of January 2012 between

the President of India represented by the Director i/c, Shri R.C. Sinha, S/o ---------

------------aged about ------, Central Institute of Fisheries Nautical and Engineering

Training (CIFNET) with its Head Quarters situated at Fine Arts Avenue, Kochi-

682016, Kerala, hereinafter referred to as the LESSEE or LEASE HOLDER which

expression shall mean his heirs, successors and assigns and M/s------represented

by its Managing Director/Managing Partner/Proprietor, Mr.--------S/o -----aged

about-----with its Administrative Office located at -----------, hereinafter referred to

as the LESSOR or THE OWNER, which expression shall mean and include his/their

heirs assigns and successor on the terms and conditions stipulated below;

1. The Lessor is the absolute owner of the Deep Sea Fishing Vessel MFV--------

with Registration No.------, which is more fully described in schedule 1, of the

agreement.

2. The Lessor hereby agrees to lease out his Deep Sea Fishing Vessel with the

detailed specifications, as mentioned in Schedule 1 of this agreement, to the Lessee

and the Lessee expresses his willingness for the same.

3. Earnest Money Deposit(EMD): The EMD/performance security of Rs.

5,00,000/- (Rupees five lakhs only) (as per GFR clauses) is paid to the Lessee by

the Lessor vide DD/Bank Guarantee _________dated _______. The EMD/performance

security shall be refunded to the Lessor at the end of the lease agreement. However,

if the Lessor violates any of the conditions of the lease agreement, the Lessee has

the powers to forfeit whole or part of the EMD/performance security, as deemed fit.

4. Contract Period: The Deep Sea fishing vessel will be hired for a period of one

year which is further extendable as per requirement of the Lessee. The lease

agreement will commence from the date of this agreement between the Lessee and

Lessor. However, the contract is liable to be terminated at anytime by Lessee

without assigning any reasons.

5. Type of Fishing: The Deep Sea Fishing Vessel shall be engaged in Tuna Long

Line fishing and for training purpose.

6. Endurance Period: The endurance of the vessel shall be for 20 days.

7. Voyage Days: Each voyage of CIFNET trainee’s shall be for 5 to 7 days, as per

the schedule of the Lessee.

8. Accommodation: Besides the regular crew and officers required for the Deep

Sea Fishing Vessel, the Lessor shall provide provision for 6 additional Berths,

in order to accommodate minimum of five CIFNET trainees and one Faculty

onboard the vessel.

9. Manning: Manning of the Deep Sea Fishing Vessel shall be as per the

MMD/MS Act provisions/requirements.

10. Availability: The Deep Sea Fishing Vessel shall be available for 24 hours a

day, 5 days a week and twenty days in a month, at the disposal of Lessee,

except during the maintenance period.

11. Monitoring Services: Separate Log Books shall be maintained for various

purposes of hours of operation, i.e. while at shore, fishing, anchoring, idling &

for fish catch. The log book will be verified and signed by the skipper and

Chief Engineer of the vessel and representative of Lessee and same shall be

available for verification at any time by the Operation Division of respective

centres of CIFNET.

12. Area of Operation:- For training purpose of CIFNET, Kochi,

Chennai & Visakhapatnam centres as per sailing programme scheduled by

CIFNET, within the Indian EEZ.

13. Equipment: The Deep Sea fishing vessel should be equipped with Echo

Sounder, STD Monitor as per the MMD Rules and all other adequate

equipments and accessories required for tuna long lining operation.

Fishing vessel, is inclusive of the cost of Diesel, Lub Oil, Water and salary and

allowances of crews on board, maintenance charges, insurance, cost of ice,

supply of fishing gear, repairs/replacement of damaged fishing gears and any

other expense if any, including taxes and other levies whatso- ever as

applicable. The hire charges details and breakup will be as per schedule II of

the agreement.

18. CIFNET will not be responsible to spend or incur any amount towards any

other cost for the smooth operation of the vessel during the entire contract

period, other than the hire charges.

B. Stern Trawl Fish trawl or shrimp trawl having a head rope length of 35 to 40 metre size and all steel ‘V’ form otterboard of suitable size with approximate weight 350kg to 400kg. For the smooth operation of the net, the vessel should have hydraulically driven winch with fully working condition with a drum size to stove 500 to 600 m steel trawl warp of 14mm to 16mm dia and with all accessories suitable for safe operation of the above trawl net in all weather conditions.

Bank, further agree with the Owner that the Owner shall have the fullest liberty without our consent and without affecting in any manner our obligations hereunder to vary any of the terms and conditions of the said agreement or to extend time of performance by the said Contractor (s) from time to time or to postpone for any time or from time to time any of the powers exercisable by the owner against the said contractor (s) and to forbear or enforce any of the terms and conditions relating to the said agreement and we shall not be relieved from our liability by reason of any such variation or extension being granted to the said Contractor (s) or for any forbearance, act or omission on the part of the Owner or any indulgence by the Owner to the said Contractor (s) or by any such matter or thing whatsoever which under the law relating to sureties would but for this provision have effect of so relieving us.

5. We undertake to pay the Government any money so demanded notwithstanding any dispute or disputes raised by the contractor (s)/supplier(s) in any -.quit or proceeding ending before any court or Tribunal relating thereto liability under this present being absolute and unequivocal.

The payment so made by us under this Bond shall be a valid discharge of our liability for payment there under and the contractor (s)/supplier (s) shall have no claim against us for making such payment.
