INTRODUCTORYPROVISIONS

Definitions

1. Intheseregulations,unlessthecontextotherwiseindicates,awordoranexpressiondefinedintheAct,theLocalAuthoritiesAct,ortheRegulationshasthesamemeaning,and-

“Court”, in relation to labourmatters,means theLabourCourt referred to in section 115 of theLabourActandtheSupremeCourt,andinallothermattersamagistrate’scourtortheHighCourtortheSupremeCourt;

“annualleavecycle”meanseachperiodof12consecutivemonthsforwhichamemberisemployedbytheCouncil,computedfromthedaythemembercommencedhisorheremploymentwith theCouncil,butexcludesanyperiodofabsencefromworkwithoutpayorsuspensionandtheanniversarydateforcalculationofanyleavecycleisextendedwiththetotalnumberofdaysofsuchabsenceprecedingallanniversarydates;

“authorizedofficer”meansamemberwhohasbeenappointedasanauthorizedofficerundersection11oftheRoadTrafficandTransportActandregisteredinacategorydeterminedunderregulation2oftheRoadTrafficandTransportRegulationspublishedunderGovernmentNoticeNo.53of30March2001;

“areaofjurisdiction”meansthemunicipalareaof theMunicipalityofWindhoek;

“basicwage”,forthepurposeofcalculatinganybasicconditionofemployment,meansthatpartofremunerationinmoneyofamember,includingthecashequivalentofpaymentinkind,ifany,paidinrespectofworkdoneduringthehoursordinarilyworked,butdoesnotinclude-

(a) allowances, including travel and subsistence, housing, motor vehicle, transport, andprofessionalallowances,whetherornotbasedonthebasicwageofthemember;

(b) aserviceallowancepaidinsteadofpaymentforovertimeworked,nighttimeandstandbyallowances,

(c) additionalpayforworkonaSundayorapublicholiday;

(d) paymentsinrespectofpension,annuityormedicalbenefitsorinsurance;

“boardofinquiry”meansaboardofinquiryreferredtoinregulations9,19,or22;“CityPoliceChief”,meansthepersonappointedasHead;

“CityofWindhoek”meanstheMunicipalityofWindhoek;

“Council”meanstheMunicipalCouncilfortheMunicipalityofWindhoek,andwherethecontextrequires,theemployer;

“Employees’CompensationAct”means theEmployees’CompensationAct,1941 (ActNo.30of1941);

“financial year” means the financial year of the Council referred to in section 82 of the LocalAuthoritiesAct;

“gratification”,includes-

(a) moneyoranygift,loan,fee,reward,commission,valuablesecurityorpropertyorinterestinpropertyofanydescription,whethermovableorimmovable;

(b) anyoffice,dignity,employment,contractofemploymentorservicesandanyagreementtogiveemploymentorrenderservicesinanycapacity;

(c) any payment, release, discharge or liquidation of any loan, obligation or other liability,whetherinwholeorinpart;

(d) anyvaluableconsiderationorbenefitofanykind,anydiscount,commission,rebate,bonus,deductionorpercentage;

(e) anyforbearancetodemandanymoneyormoney’sworthorvaluablething;

(f) any service or favour, including protection from any penalty or disability incurred orapprehendedorfromanyactionorproceedingsofadisciplinary,civilorcriminalnature,whetherornot already instituted, and including theexerciseor the forbearance from theexerciseofanyrightoranyofficialpowerorduty;

(g) anyrightorprivilege;

(h) anyaid,vote,consentorinfluence,oranypretendedaid,vote,consentorinfluence;

(i) anyoffer,undertakingorpromise,whetherconditionalorunconditional,ofanygratificationwithinthemeaningofanyoftheprecedingparagraphs;

“grievance”meansanyfeelingofdissatisfaction,injusticeorunfairpracticeorworkingconditionsexperiencedbyamemberor,inthecaseofa“collectivegrievance”agroupofidentifiedmembers,relevanttohisorherortheirjoborhisorherortheirworkingenvironment,butexcludestheexecutionofalawfulinstruction,achargeofmisconductorasentenceimposedafteradisciplinaryhearingorincapacityordisciplinaryinquiry;

“Head”meansthepersonappointedunderregulation5oftheRegulationsastheHeadoftheService,andincludesanActingHead;

“Inspector-General”meanstheInspector-GeneraloftheNamibianPolicereferredtointheAct;

”LabourAct”meanstheLabourAct,2007(ActNo.11of2007);

“LocalAuthoritiesAct”meanstheLocalAuthoritiesAct,1992(ActNo.23of1992);

“medicalpractitioner”meansapersonwhoisregisteredassuchintermsoftheMedicalandDentalProfessionsAct,2004(ActNo.10of2004),andincludesapersonwhoisregisteredasanurseormidwifeintermsoftheNursingAct,2004(ActNo.8of2004);

“managementcommittee”meansthemanagementcommitteeoftheCouncilasdefinedin section1oftheLocalAuthoritiesAct;

“member”, excluding amember of the ServiceAdvisory Committee and of a Service SelectionCommittee,meansapersonappointedasmemberoftheService,andwhereapplicable,includes,theHead,DeputyHeadandSeniorSuperintendent;

“misconduct”means-

(a) thecommissionoromissionofanactreferredtoinregulation55;

(b) anycontraventionofanyotherprovisionoftheseregulations,theActorRegulations;

(c) thecommissionofanycrimeoranyoffence;

(d) thecontraventionofanyCouncilResolutionornoncompliancethereof;

“officer”meansanofficerholdingarankassetoutinAnnexure1;“officialleave”meansanofficialpaidleavetoattendafuneralofadeceasedmemberapprovedunderregulation36(7);

“overtime”meanstimeworkedinexcessofthehoursamemberordinarilyworksinanyordinaryworkingday,butdoesnotincludeanyworkdoneon-

(a) aSunday;or

(b) apublicholiday,

ifitisanordinaryworkingdayforthatmember;

“PensionFund”meanstheRetirementFundforLocalAuthoritiesandUtilityServicesinNamibiaoranyotherpensionfundestablishedundersection27(1)(c)(ii)(bb)oftheLocalAuthoritiesAct,andincludesaunitedpensionfund,towhichtheCouncilmaycontributeonbehalfofmembers;

“privatework”,includesanyenterpriseorworkconductedorperformedbyamemberoutsidehisorhernormalfunctionsasamember;

“publicholiday”meansanypublicholidayreferredtoin,ordeclaredunder,section1ofthePublicHolidaysAct,1991(Act26of1991);“Regulations”meanstheRegulationsforMunicipalPoliceServicesmadeundersection43C(2)oftheAct,andpublishedunderGovernmentNoticeNo.l84of16October2002;

“remuneration”means the totalvalueofallpayments inmoneyand inkindmadeorowing toamemberarisingfromtheemploymentofthatmember,butexcluding-

(a) anysubsistenceandtravelallowancepaidtothememberfortheattendanceofadhoceventsofwhatsoevernature;

(b) thevalueofanyaccruedannualleaveofthemember;

(c) serviceallowance;and

(d) anyotherpaymentmadeorowing toamember thataCourt foundnot tobe included in“remuneration”;

“RoadTrafficandTransportAct”meanstheRoadTrafficandTransportAct,1999(ActNo.22of1999);

“Service”meanstheWindhoekMunicipalPoliceServicereferredtoinregulation2;

“serviceallowance”meansanallowancepaidunderregulation29;

“staffmember”meansanypersonemployedpermanentlyortemporarilyonafull-timeorpart-timebasisorunderacontractofemployment,inapostonoradditionaltothefixedestablishmentoftheCouncil,and includes theChiefExecutiveOfficerandexcludes,exceptasotherwiseprovided insection94CoftheLocalAuthoritiesAct,themembersoftheServiceandindependentcontractors;

“supervisor” when used with regard to a member means that member’s immediate supervisorbut,forpurposesofregulations55and56,includesaUnitCommander,Superintendant,aSeniorSuperintendant,aDeputyHeadandtheHead;

“theAct”meansthePoliceAct,1990(ActNo.19of1990),asmadeapplicabletoamunicipalpoliceserviceby regulation10of theRegulations to the extent specified in column1, andmodified incolumn2,ofAnnexure2totheRegulations;

“unit”meanstheoperationalunitasestablishedundersubregulation6(1)forpurposesofthefixedestablishmentoftheService;“unitcommander”meanstheSeniorSuperintendentreferredtoinsubregulation6(1);

“urgentwork”meansanyemergencyworkwhich,ifnotattendedtoassoonaspossible,couldresultinharmto,orendangerthelife,personalsafetyorhealthofanypersonorthatofthepublicgenerallyorcouldresultintheseriousdamagetoordestructionofproperty;

“week”,inrelationtoamember,meanstheperiodof7dayswithinwhichtheworkingweekofthememberfalls;and

“weeklyinterval”meanstheperiodbetweentheendofoneordinaryworkingweekofamemberandthestartofthatmember’snextworkingweek,ifany.

PART2

WINDHOEKCITYPOLICESERVICE

Continuation of service

2. TheMunicipalPoliceServicefortheMunicipalityofWindhoekestablishedbytheCouncilundersection43C(1)oftheActreadwithregulation2oftheRegulationsandknownastheWindhoekCityPoliceService,acronyms“WCPS”or“CityPolice”iscontinuedandconsistsofallpersonsappointedasmembersintermsofregulation10readwithregulation69.

3. (1) TheCouncilmayestablish,undersection30(1)(w)oftheLocalAuthoritiesAct,anadvisorycommitteetobeknownastheServiceAdvisoryCommitteetoadvisetheCouncilgenerallyonmattersaffecting,orrelatingto,theService.

(2) TheServiceAdvisoryCommitteeconsistsofonerepresentativeof-

(a) NamibianDefenceForce;

(b) NamibianPoliceForce;and

(c) NamibianCorrectionalService,

appointedbytheCouncil.

(3) TheServiceAdvisoryCommitteemay,withthepriorconsentoftheCouncil,co-optamaximumofthreepersonsandwhichpersonshavedeliberativerightsasmembers,buthavenorighttovote.

(4) TheCouncilmay refer anymatter to the ServiceAdvisoryCommittee that fallswithinthetermsofreferenceoftheCommittee,asdeterminedbytheCouncilfromtimetotime,forinvestigation,considerationandadvice.

(5) TheServiceAdvisoryCommitteemayonitsownmotioninvestigate,considerandadviseorappointasubcommitteeconsistingofelectedCommitteememberstoadvisetheCouncilortheChiefExecutiveOfficeronanymatterfallingwithinitsresponsibilities.

(6) TheChiefExecutiveOfficermayassignanymemberorstaffmembertoassisttheServiceAdvisoryCommitteeintheexerciseandperformanceofitspowersandfunctionsunderthisregulation.

(7) TheCouncilmayadoptrulesregulatingtheconveningandholdingofmeetingsoftheServiceAdvisoryCommittee,procedurestobefollowedatsuchmeetingsandmattersincidentalthereto.

(8) TheServiceAdvisoryCommitteemaynotincurexpenseswithoutthepriorconsentoftheCouncil.

(9) TheServiceAdvisoryCommitteemaynotissueinstructionstotheHeadortoanymember.

(10) TheCouncilmaydetermine,andfromtimetotimeadjust,asittingallowanceformembersoftheServiceAdvisoryCommitteewhoarenotmembersoftheServiceorinthefull-timeserviceoftheCouncil.

4. (1) The management committee may appoint committee, to be called theServiceSelectionCommittee,undersection26(1)oftheLocalAuthoritiesActtoadvisetheHeadandmakerecommendationstotheManagementCommittee,ontheappointmentoffitandproperpersonsasmembersassetoutinregulation10. (2) TheCommitteeconsistsof-

(a) twopersonsnominatedbytheDirector-GeneraloftheNamibianCentralIntelligenceServiceandappointedbythemanagementcommittee;

(b) twopersons nominated by theMinister responsible for theNamibianPolice andappointedbythemanagementcommittee;

(c) twopersonsnominatedbytheMinisterresponsiblefortheNamibianDefenceForceandappointedbythemanagementcommittee;and

(d) theHead,whomaynotbeapartoftheCommitteewheneverhisorherpositionisbeingdiscussed,inwhichcaseapersonnominatedbytheChiefExecutiveOfficermustsitintheplaceoftheHead.

(3) TheCouncilmay,upon recommendationby themanagementcommittee,adoptaRecruitment,SelectionandEmploymentPolicy,whichPolicymust-

(a) conformwith-

(i) National Security Legislation and Standards for the recruitment andemployment of members of Police Force, inclusive of any Cabinetresolutionsthereon;and

(ii) theAffirmativeAction(Employment)Act,1998(Act29of1998)andtheCouncil’sAffirmativeActionPolicyinsofarastheyrelatetoPoliceForce;

(b) containatleast-

(i) apre-interviewassessmentforthepurposeofshortlistingapplicants,whichassessmentmustatleasttest-

(aa) arithmeticskills;

(bb) problemsolvingskills;

(cc) spatialaptitude;

(dd) verbalskills

(ee) writtencommunicationskills;

(ff) physicalskillsandabilities;

(gg) audio-visualskills;

(hh) whethertheapplicantmeetstherequirementssetoutinparagraphs(c),(d)and(g)ofregulation10(3)andisnotbarredbytheprovisionsofparagraph(h)ofregulation10(3)frombeingemployed;and

(ii) theauthenticityofthequalificationssubmitted,

whichtestsandenquiriesneednotbeconductedbytheCommitteeitself;

(ii) aninterviewassessmentbytheCommitteetoconfirmandamplifyatleasttheresultsofthepre-interviewassessment;and

(iii) a post interview assessment of applicants short listed after the interview

assessment,beingatleast-

(aa) asecurityscreeningbyoronbehalfof themembersrepresentingNationalIntelligence;

(bb) a criminal record screening by or on behalf of the membersrepresentingtheNamibianPolice;and

(cc) amedicalexaminationcoveringtherequirementsofparagraph(e)ofregulation10(3).

(4) TheCouncilmayadoptrulesregulatingtheconveningandholdingofmeetingsoftheCommittee,procedurestobefollowedatsuchmeetingsandmattersincidentalthereto.

(5) TheCommitteemaynotappointasanemployer,itsownemployeesbuttheChiefExecutiveOfficermaydesignateanymemberorstaffmembertoassisttheCommitteeintheexerciseofitspowers,functionsanddutiesunderthisregulation.

(6) TheCommitteemay not incur expenseswithout having the prior consent of theCouncilthereto.

(7) TherecommendationsoftheCommitteetotheManagementCommitteemustbeinwriting,isconfidentialandmayonlybedisclosedtopersonsinvolvedintheappointmentsconcerned.

(8) AmemberoftheCommitteemustdiscloseanyinterestthatheorshemighthaveinwritingandmustwithdrawfrom,andmaynotbepresentat,anydiscussionofsuchmatter.

(9) Any rules made under subregulation (4) may provide that a member failing todisclosehisorherinterestinamattermaylosehisorherseatontheCommittee,andtheprocesstobefollowedinthatregard.

(10) TheCouncilmaydetermine,andfromtimetotimeadjust,asittingallowanceformembersof theCommitteewhoarenotmembersof theServiceorwhoarenot in the full-timeserviceoftheCouncil.

(11) TheHeadmustsubmittherecommendationsoftheCommitteetotheChiefExecutiveOfficer.

Determination and distribution of establishment

5. (1) TheCouncilmustdeterminethefixedestablishmentoftheService.

(2) TheHead,subject to thedirectivesof theChiefExecutiveOfficer, is responsibleformakingrecommendationstotheCouncilastothenumbers,grading,regarding,conversionorabolitionofpostsconstitutingpartofthefixedestablishmentoftheService,includinganyreductioninorreorganizationorreadjustmentoftheService.

(3) TheChiefExecutiveOfficer, after consultationwith theHead,maydesignate orsecondortransferastaffmemberonthefixedestablishmentoftheCounciltorenderadministrative,technicalorothersupportservicestotheServiceforitsoperationalrequirementsandamemberorstaffmembersodesignatedorsecondedortransferredmustrendersuchservicerequiredundertheseregulations

(4) Anyre-organizationcontemplatedinsubregulation(2)whichinvolvesexpendituremustbeapprovedbytheCouncil,andmaynotbecarriedoutunlesspriorapprovalforsuchexpenditurehasbeenobtained.

(5) Subject to section94Cof theLocalAuthoritiesAct,nothing in these regulationspreventstheServicefrombeingpartofadepartmentreferredtoinsection28oftheLocalAuthoritiesAct,nordoesitpreventtheHeadofbeingtheheadofsuchadepartment.

6. (1) Subject toregulation5(2), theServicemustbedividedintosuchunitsastheCouncilmay from time to timedetermine,but everyunit isunder the commandof aSeniorSuperintendentwhomaycommandmorethanoneunit.

(2) Subjecttoregulation5,theCouncilmaysubdivideaunitintodifferentbranchesorsectionsandassignsuchdesignationtosuchbranchesorsectionsandthemembersattachedtheretoastheCouncilthinksfit.

(3) TheranksintheServiceinorderofprecedencearesetoutinAnnexure1.

(4) TheChiefExecutiveOfficer,ifheorshethinksitexpedientfromtimetotime,maytemporarilyconferahigherrankonanymember,andsuchmemberholdssuchtemporaryhigherrankatthepleasureoftheChiefExecutiveOfficer.

(5) Amembertowhomarankreferredtoinsubregulation(4)hasbeenconferredhasthepowersandauthorityapplicabletosuchrank,butsuchmemberisnotentitledtothehigherscaleofbasicwageorallowancesapplicabletosuchrankiftheappointmentisforaperiodoflessthan30days.

(6) Anofficer,irrespectiveoflengthofserviceorseniorityinserviceorrank,isdeemedto be the superior of anymember overwhom such officer exercises authority or towhom suchmemberisreporting.

(7) The Council may determine by way of directives the dress and clothing of themembersoftheService,andthecontrolordisposalofanyarticleoruniformorequipmentbyanymember.

Powers and functions of Chief Executive Officer

7. (1) ThepowersandfunctionsoftheChiefExecutiveOfficerareasconferredandimposedbytheAct,theLocalAuthoritiesAct,theRoadTrafficandTransportAct,1999(ActNo.22of1999),theRegulationsandtheseregulations.

(2) Subjecttoanylimitationimposedbyanyofthelawsreferredtoinsubregulation(1),theChiefExecutiveOfficermay-

(a) exerciseorperformanyorallsuchpowersorfunctionspersonally;

(b) instructamemberorastaffmembertodosounderhisorherinstructionandcontrol;or

(c) appointapersonorpersonsfromoutsidetheServicetoadvisehimorherinrespectoftheexerciseandperformanceofsuchpowersandfunctions.

Appointment of Head, Deputy Head and senior superintendent

8. (1) TheCouncilmust appoint on itsfixedestablishment, in accordancewithregulation5(1)oftheRegulations,afitandproperpersonasCityPoliceChieftobetheHeadoftheService.

(2) TheCouncil,ontherecommendationoftheChiefExecutiveOfficer,mayappointmorethanoneDeputyHeadorSeniorSuperintendentoftheService.

(3) ApersonappointedasHead,aDeputyHeadoraSeniorSuperintendentmustenterinto awritten agreementof employmentwith theCouncil and that agreement, in addition to theRegulationsandtheseregulations,governtheemploymentrelationshipbetweentheCouncilandtheHead,aDeputyHeadoraSeniorSuperintendent.

Inquiry into incapacity of, or misconduct by, Head, Deputy Head or senior superintendent 9. (1) Regulation19inrespectofincapacityinquiryappliestotheHead,DeputyHeadorSeniorSuperintendent,butsubjecttothefollowingmodifications-

(a) the board of inquiry referred to in subregulation (1) of that regulation is to beappointedbytheChiefExecutiveOfficerandmustconsistof-

(i) apersonhavingknowledgeandexperienceinlabourlaw,aschairperson;

(ii) twoothersuitablepersonswhoarenotintheemploymentoftheCouncil,andoneofwhommustbeamemberoftheNamibianDefenceForce,theNamibianPoliceForce,theNamibianCentralIntelligenceortheNamibianCorrectionalServicewhichpersonmustholdarankequalto,orhigherthan,thatoftheHead,DeputyHeadorSeniorSuperintendent;

(b) Theword“Head”inrespectofsubregulations(2)and(3)ofthatregulationistobeconstruedasthe“ChiefExecutiveOfficer”;

(c) “member”, when used in relation to the person whose alleged incapacity is thesubjectoftheinquiry,istobeconstruedasthe“Head”,“DeputyHead”or“SeniorSuperintendent”;and

(d) “Head”insubregulations(4)and(5)ofthatregulationistobeconstruedas“Council”.

(2) Regulation20inrespectofmisconductappliestotheHead,DeputyHeadorSeniorSuperintendent,butsubjecttothefollowingmodifications-

(a) “member”, unless the context requires otherwise, to be construed as the Head,DeputyHeadorSeniorSuperintendent;

(b) “Head”insubregulations(1),(2),(3),and(4)ofthatregulationistobeconstruedasthe“ChiefExecutiveOfficer”;

(c) paragraph(a)ofsubregulation(3)ofthatregulationisreplacedwiththefollowingparagraph:

“(a) aboardofinquirythatconsistsof-

(i) a person having knowledge and experience in labour law, aschairperson;

(ii) twoothersuitablepersonswhoarenot in theemploymentof theCouncil, and one of whommust be a member of the NamibianDefenceForce, theNamibianPoliceForce, theNamibianCentralIntelligence or the Namibian Correctional Service which personmustholdarankequalto,orhigherthan,thatoftheHead;”;

(d) “Head”insubregulations(7)and(8)istobeconstruedas“Council”.

(3) Before the appointment of the board referred to in regulation 20(3), the ChiefExecutiveOfficermaysuspendtheHead,DeputyHeadorSeniorSuperintendentfromofficependingtheinquiryreferredtoinregulation20,andmayliftthesuspensionatanytime.

(4) TheHead,DeputyHeadorSeniorSuperintendentisnotentitledtoanybasicwageinrespectoftheperiodofhisorhersuspension,excepttotheextentastheCouncilmaydirect.

(5) During the period of his or her suspension the Head, Deputy Head or Senior

Superintendent isdeprivedof thepowers,duties, functionsandauthorityvested inhimorherasHeadbuttheHeadcontinuestobesubjecttothesamedisciplineandpenaltiesasifheorshehasnotbeensuspended.

(6) Theword“Head”inthisPart,whereapplicableandforpurposesofregulations15to18includesaDeputyHeadandaSeniorSuperintendent.

(7) Regulation22inrespectofappealsfromaninquiryheldunderregulation19or20doesnotapplytotheHead,DeputyHeadorSeniorSuperintendent,butisdealtwithasarevieworanappealtotheapplicableLabourCourt.

PART4

APPOINTMENT,PROMOTIONANDTERMINATIONOFSERVICE

Appointment of member

10. (1) Ifthemanagementcommittee,ontherecommendationoftheHead,needstofillapostonthefixedestablishmentoftheService,whetherbypromotionorappointmentortransfer,themanagement committeemust have regard to the qualifications, relativemerit, efficiency andsuitabilityofthepersonbeingconsideredforappointmentorpromotion.

(2) ApersonwhowishestobeappointedasamemberintheServicemust-

(a) applyonaformdeterminedbytheCouncil,andconfirmedunderoathorbywayofsolemnaffirmationonthatformthattheinformationfurnishedbyhimorherisaccurateandcorrect;

(b) allowhisorherfingerprintstobetaken;

(c) furnishproofthatheorshehasnotbeenconvictedofacriminaloffencecontainedinSchedule1totheAct;

(d) submithimselforherselftoamedicalexamination;

(e) furnishproofofhisorherage;

(f) furnishproofofhisorhereducationalqualifications;and

(g) sit for an examination or undergo such educational or aptitude tests or physical,healthormentaltestsastheCouncil,afterconsultationwiththeInspector-General,maydetermine.

(3) Subject to this regulation, the Council’s Affirmative Action Policy and theRecruitment,SelectionandEmploymentPolicy,apersonmaynotbeappointedasamember,unless-

(a) thepersonhascompletedtheprobationperiodprescribedbyregulation26;

(c) heorshe isaNamibiancitizen;

(d) heorsheisnotunder18yearsofageandnotover50yearsofage;

(e) heorsheisfreefromanymentalorphysicaldefect,diseaseorinfirmitywhich,inthereasonableopinionoftheCouncil,willormayinterferewiththeproperexecutionofhisorherdutiesornecessitateshisorherretirementbeforereaching60yearsofage;

(f) heorshehasnotbeenconvictedofacriminaloffencereferredtoinparagraph(c)ofsubregulation(2);

(g) heorshehaspassedatleastthegrade12examinationoranexaminationequivalenttothatgradeorhigherorthetrainingdeterminedundertheseregulations:ProvidedthattheCouncilmayforgoodreasonsexistingwithregardtospecificappointmentsrelaxtherequirementofthegrade12examination;

(h) heorshehasnotbeendismissedfromanyemploymentasaresultofmisconductofwhichdishonestyorpoorhumanrelationsareelements;

(i) he or she is prepared to take the declaration of accession to office contained in Annexure4.

(4) TheCouncilmaywaive the requirement referred to in subregulation (3)(e)withrespecttoanyphysicaldefect,diseaseorinfirmityinexceptionalcircumstances.

(5) Despite subregulation (3)(c), the Council, with the approval of the MinisterresponsibleforPolice,mayauthorize theappointmentofapersonwithspecializedexperienceorknowledge,whoisnotaNamibiancitizen,intheServiceinatemporarycapacityforsuchpositionsasidentifiedandapprovedbytheCouncil,buttheperiodforwhichthepersonisappointedmaynotexceedthreeyears.

(6) AnypersonappointedasamemberoftheServiceunderthisregulationmusttakethedeclarationreferredtoinsubregulation(3)(i)onadatetobedeterminedbytheHead,orassoonaspracticableafterthatdate.

(7) Uponappointmentasamember,acertificateofappointmentreferredtoinregulation13,mustbeissuedtohimorher.

(8) Despitesubregulation(7)-

(a) no appointmentmade by the Council in terms of this regulation is invalid onlyduetothefactthatthepersonorauthorityconcerneddidnotissueacertificateofappointmentascontemplatedinsubregulation(7);

(b) functionperformedbyamemberoftheServiceunderthisregulationisinvalidduetothefactthatthemembercannotproduceacertificateofappointmentwhenrequestedtodosobyaperson in relation towhomsuchfunctionhasbeenperformed,dueto thefact thatsuchcertificatewasnot issuedby theCouncilascontemplated insubregulation(7).

Prohibition of certain actions

11. (1) ApersonwhohasappliedforemploymentintheServicemaynotofferareward,gratificationorbenefitto,orattempttoofferareward,gratificationorbenefitto,orundulyinfluence,anyCouncilor,amemberoftheServiceSelectionCommitteeormemberorastaffmemberforthepurposesofbeingsoappointed.

(2) Apersonwhocontravenessubregulation(1)isregardedasunfitforappointmentintheService,andmaybesubjecttodisciplinaryactionifheorshehasalreadybeenappointed.

Advertisement of vacancies

12. TheCouncilmustadvertisebywayofanoticeattheCouncilofficesorinanewspapercirculatinginNamibiaeveryvacancyforapermanentpostonthefixedestablishmentoftheService,butthisdoesnotapplytothepositionoftheHead,aDeputyHeadoraSeniorSuperintendent.

Certificate of appointment

13. (1) Thecertificateofappointmentreferredtoinregulation10(7)mustbeintheformofAnnexure5.

(2) Amembermustcarryhisorhercertificateofappointmentonhimorherwhilstonduty.

(3) Amembermustproducehisorhercertificateofappointmentwhenrequestedtodosobyanyperson.

(4) Amembermust,uponterminationorsuspensionofhisorherservicesinanymanner,returntotheCouncil,hisorhercertificateofappointment,inthecaseofanauthorizedofficer,theregistrationcertificateissuedtohimorherbytheMinisterresponsiblefortransportationtheuniformandanyotherequipmentoritemissuedtohimorherforthepurposeofperformanceofhisorherdutiesintheService.

Promotion

14. (1) TheHead,beforeheorsherecommendsthepromotionofanymembertotheCouncil totherankofDeputyorSeniorSuperintendentorthepromotionofamembertothemanagementcommittee,ofahigherrank,mustsatisfyhimselforherselfthatthememberisinallrespectsfittoholdthehigherrank.

(2) If theHeadgenerally,orinspecificinstances,considersitnecessary,heorshemaycause trainingtobeprovided,orcauseexaminations tobeconducted insuchsubjectsasmaybedeterminedbyhimorherasqualificationstobepossessedbymembersonpromotion.

(3) TheHead, inaddition toconsiderationofanyother relevant factor,mustuse thePerformanceManagementSystemoftheCouncilasthebasistodeterminethefitnessofamemberforpromotion.

Resignation of member

15. (1) Amembermay tender theresignationofhisorherappointmentwith theHeadbynoticeinwriting,whichresignationmayonlybewithdrawnwiththewrittenpermissionoftheHead.

(4) Amemberwhoresignsmust,uponresignation,handovertotheHead,hisorherappointmentcertificate,inthecaseofanauthorizedofficer,theregistrationcertificateissuedtohimorherbytheMinisterresponsiblefortransportationtheuniformissuedtohimandanyotherequipmentoritemissuedtohimorherforthepurposeofperformanceofhisorherdutiesintheService.

Retirement

16. (1) Subjecttosubregulation(4),thePensionFundsAct,1956(ActNo.24of1956)andtheIncomeTaxAct,1981(ActNo.24of1981),amembermustretireasprovidedforintheRulesofthePensionFunds.

(2) Amemberwhohasattained55yearsofage,subjecttothelegislationandtheRulesreferredtoinsubregulation(1),maygivewrittennoticetotheHeadofhisorherwishtoretirefromtheServiceatanytimebeforeattainingtheageof60years,andmustbeallowedtoretire.

(3) TheHead,DeputyHeadorSeniorSuperintendentwhohasattained50yearsofagemay,subjecttothelegislationandtheRulesreferredtoinsubregulation(1),retirefromtheServicebeforeheorsheattains55yearsofageand,ifheorshesoretires-

(a) isdeemedtohaveretiredundersubregulation(2);and

(b) isentitledtosuchpensionasprovidedforintheRulesofthePensionFundtowhichheorshebelongs.

(4) Despitesubregulation(1),theCouncilmayretainamember,withhisorherconsent,inhisorherpostbeyondtheageof60yearsforfurtherperiodswhichmaynotexceedfiveyearsintotal.

(5) Amembermayonlyberetainedundersubregulation(4)ifitisintheinterestoftheServiceorgenerallyinthepublicinterest.

Discharge of members

17. (1) TheCouncilmayunderregulation9readwithregulations19and20andtheHeadmayunderregulation19or20dischargeamemberfromtheService-

(a) onaccountofindisposition,ill-healthorinjuryredundancyappointmentorelectiontoapublicoffice,abolitionofhisorherpost,thereductioninthenumericalstrength,the re-organizationor re-adjustmentof theService,orpromotionofefficiencyoreffectivenessoftheService;

(b) subjecttoregulation18,onaccountofasentenceimposedonthemember;

(c) onaccountofunfitness forhisorherduties,or incapacity tocarryouthisorherdutiesefficiently;

(d) onaccountofmisconduct.

atanytimeaftersuchabsencehascontinuedfor aperiodof7consecutivedaysorlonger;

(b) whereaHeadoramemberisnotdischargedunderparagraph(a)andsuchabsencecontinues for a periodof 30 consecutivedays ormore, suchHeadormember isdeemedtohavebeendischargedfromtheServiceonaccountofmisconductwitheffect from the date immediately after the Head or the member’s last date ofattendanceathisorherlastplaceofduty;

(c) wheretheHeadoramemberhasbeendischargedunderparagraph(a)orisdeemedtohavebeendischargedunderparagraph(b)andevidenceisprovidedtotheCouncil,inthecaseoftheHead,ortheHead,inthecaseofamember,thattheabsencewasforreasonsbeyondthecontroloftheHeadormember,andthatheorshewasunabletoinformtheHeadortheHead,ofthereasonsforhisorherabsencetheCouncilortheHead,mayreinstatetheHeadorthememberinhisorherformerpostorinanyotherpostuponsuchconditionsastheCouncilortheHeadmaydetermine;

(d) afterthereinstatementreferredtoinparagraph(c),thetheperiodofabsencefromduty is deemed to have been annual leave without pay or leave on such otherconditionsasmaybedeterminedbytheCouncil,inthecaseoftheHead,orbytheHead,inthecaseofanyothermember.

Discharge on account of sentence imposed

18. (1) Amemberwho is convictedof anoffence and is sentenced to a termofimprisonmentwithouttheoptionofafine,isdeemedtohavebeendischargedfromtheServiceonaccountofmisconductwitheffectfromthedatefollowingthedateofsuchsentence,butifthetermofimprisonmentiswhollysuspendedthememberisnotdeemedtohavebeendischarged.

(2) Amemberreferredtoinsubregulation(1)whose-

(a) conviction is set aside following an appeal or review and is not replaced by aconvictionforanotheroffence;

(b) convictionissetasideonappealorreview,butisreplacedbyaconvictionforanotheroffence,whetherbyacourtofappealorrevieworthecourtoffirst instance,andsentencedtoasentenceotherthanasentencetoatermofimprisonmentwithouttheoptionofafinefortheotheroffence;or

(c) sentencetoatermofimprisonmentwithouttheoptionofafineissetasidefollowinganappealorreviewandisreplacedwithasentenceotherthanasentencetoatermofimprisonmentwithouttheoptionofafine,

may,notlaterthan30calendardaysafterthemember’sconvictionissetasideormember’ssentenceisreplacedbyasentenceotherthanasentencetoatermofimprisonmentwithouttheoptionofafine,applytotheHeadtobereinstatedasamember.

(3) If theHead receives an applicationbyapersonwhose conviction is set aside ascontemplated in subregulation (2)(a), themanagementcommitteemay reinstate suchpersonasamemberwitheffectfromthedateuponwhichthememberisdeemedtohavebeendischarged.

(4) IftheHeadreceivesanapplicationbyamemberwhoseconvictionisreplacedorwhosesentenceisreplacedascontemplatedinsubregulation(2)(b)or(c),themanagementcommitteemayontherecommendationoftheHeadunderthedirectivesoftheHead-

(a) reinstatesuchpersonasamemberwitheffectfromthedateuponwhichheorsheisdeemedtohavebeendischarged;or

(b) causeaninquirytobeinstitutedinaccordancewithregulation19intothesuitabilityofreinstatingsuchpersonasamember.

(5) Thisregulationmaynot-

(a) be construed as precluding any administrative action, investigation or inquiry intermsoftheseregulationswithrespecttothememberconcerned;and

(b) preclude the taking of any lawful decision or action in consequence or anyinvestigationorinquiry.

Incapacityinquiries

19. (1) TheHeadmaydesignatethreepersonsofwhom,onemustbeamember,onemustbeapersonwithexpertiseinIndustrialRelationsandonemustbeapersonwithappropriatelegalqualifications, tobeknownasaboardof inquirywho, ingeneralor inaspecificcase,mayinquireinto-

(a) thefitnessofamember to remain in theServiceonaccountof indisposition, ill-health,diseasesorinjury;

(b) thefitnessorcapacitytoperformhisorherdutiesortocarrythemoutefficiently;

(c) the fitness of a member to remain in the Service if the member’s continuedemploymentconstitutesa risk for theState,anyperson residing in themunicipalareaoranypropertysituatedwithinthemunicipalarea;

(d) aninjuryallegedtohavebeensustainedbyamemberinanincidentarisingoutoforinthecourseofhisorherdutyoradiseaseorindispositionallegedtohavebeencontractedinthecourseofhisorherdutyoranysubsequentincapacitationallegedtobeduetothesameinjury,diseaseorindisposition;

(e) the death of amember alleged to have been caused as a result of circumstancesreferredtoinparagraph(d);

(f) thefitnessofamembertoremainintheServicewherethememberhasbeenfoundguiltyofacriminaloffenceinacourtoflaw;

(g) anyothermatterwhichtheHead,inconsultationwiththeChiefExecutiveOfficer,considersnecessarytoinquireinto.

(2) TheHeadmaydesignateanypersonwho,ingeneralorinaspecificcase,istoleadevidenceataninquirycontemplatedinsubregulation(1).

(3) Ifaninquirycontemplatedinsubregulation(1)istobeconducted,theHeadmustgive thememberwhois thesubjectof the inquiryat least14consecutivedays’writtennotice toappearbeforetheboardofinquiry,andsuchnoticemustsetoutthegroundsoftheinquiry,andsuchmemberhastheright-

(a) tobepresentattheinquiryandbeheard;

(b) tobeassistedorrepresentedattheinquirybyanyothermember,labourconsultantorbyalegalpractitionerofhisorherchoice;

(c) togiveevidence;

(d) tocallwitnesses,includingamedicalpractitioner;

(e) tocross-examineanypersoncalledasawitnessinsupportofanyallegation;and

(f) tohaveaccesstodocumentstobeproducedattheinquiryorotherwiseproducedinconnectionwiththeallegedincapacity,buteitherpartymaybeallowedtoproducefurtherdocumentsiftherearegoodreasonsforlateproductionandthepartyentitledto access is thereafter given a reasonable opportunity to consider such furtherdocuments.

(4) After the conclusion of an inquiry referred to in subregulation (3), the board ofinquirymust-

(a) compileareportonitsfindingsandrecommendtotheHeadoneofthefollowing-

(i) noactionmaybetakenagainstthemember;

(ii) thememberbedischargedfromtheService;

(iii) that member be reduced in rank or remuneration or both rank andremunerationtotheextentrecommended;or

(iv) anyotherappropriatestepsbetakenagainstthemember,includingreferraltoadisciplinaryinquiryintermsofregulation20orregulation21.

(b) inwritinginformthememberwhoisthesubjectoftheinquiryofitsfindingsandrecommendations.

(5) TheHead,on receiptof the recommendationscontemplated insubregulation (4),may-

(a) acceptandimplementanyrecommendation;or

(b) alteranyrecommendation,afterhavinggiventhemembertheopportunitytoaddresshimorherontheproposedalteration,asheorshethinksreasonableandfairunderthecircumstances.

Disciplinary hearings

20. (1) Subjecttosubregulation(9),ifamembercommitsanactoromission,theHeadoranothermemberdesignatedforthatpurposebytheHead,mustassoonaspossiblewithinaperiodnotexceedingthreecalendarmonthsfromthedatetheHeadortheothermemberdesignatedbytheHeadbecomesawareoftheallegedmisconduct,chargethememberinwritingwithmisconduct,andthechargemust-

(a) asnearaspossible,beintheformofForm1ofAnnexure6and;(b) containadirectioncallinguponthememberchargedtofurnishtheHeadwithin14

workingdaysofreceiptofthecharge-

(i) awrittenadmissionordenialoftheallegedmisconduct;and

(ii) awrittenexplanationregardingtheadmissionordenialofthemisconductwithwhichthememberischarged,ifthemembersoelect.

(2) Ifthememberchargedwithmisconductadmitsthatheorsheisguiltyofmisconduct,andthepersonchargingthememberacceptstheadmission,thememberisdeemedtobeguiltyofmisconductascharged,andthememberdesignatemustrecommendtotheHeadanypenaltyreferredtoinsubregulation(7).

(3) Ifthememberchargedwithmisconductdeniesthechargeofmisconductorfailstocomplywiththedirectioncontemplatedinsubregulation(1)(b),theHeadmustappoint-

(a) aboardofinquiryconsistingofthreepersonsofwhom,onemustbeamember,onemustbeapersonwithexpertise inIndustrialRelationsandonemustbeapersonwith appropriate legal qualifications, to inquire into the charge ofmisconduct ofthemember, but a personwhohasparticipated in the formulationof the chargeagainsttheaccusedorininvestigatingthemisconductofwhichtheaccusedmemberisaccusedofisnoteligibleforappointmentontheboardofinquiry;and

(b) anypersontoleadevidenceinsupportofthecharge;

(c) onepersonfromamongstthemembersoftheboardofinquiryappointedintermsparagraph(a),astheChairpersonofthatboard.

(4) Atahearing in termsof subregulation (3) thememberchargedhas similarly therightsreferredtoinregulation19(3).

(5) Attheconclusionoftheinquiryintermsofsubregulation(3)theboardofinquirymustinformthememberchargedwithmisconductofitsfindings.

(6) Ifthememberchargedwithmisconductisfoundguilty,theboardofinquirymust grant-

(a) thatmemberanopportunitytoplacebeforeitmitigatingfactors;and

(b) thepersonleadingevidenceanopportunitytoplacebeforeitanyaggravatingfactors.

(7) After hearing the mitigating and aggravating factors, the board of inquiry mustcompileareportonitsfindings,andrecommendtotheHeadoneofthefollowings,thatthemember-

(a) be cautioned or reprimanded and indicate the period for which the caution orreprimandisvalid;

(b) be reduced in rank or remuneration or both rank and remuneration to the extentrecommended;

(c) beorderedtorepaythewholeorpartofanylossproventohavebeensufferedbytheCouncilastheresultofthemisconduct;

(8) Afterconsideringthereportandanyrecommendationreferredtoinsubregulation(7),theHeadmay-

(a) acceptandimplementsuchrecommendation;or

(b) alter a finding or a recommended penalty, after having given the member theopportunitytoaddresshimorherontheproposedalteration,asheorshethinksfairandjustinthecircumstances;

(c) sendthematterbacktotheboardofinquirytoholdafurtherinquiryandtoreportitsfindingsandmakerecommendationsintermsofthatsubregulation.

(9) TheChiefExecutiveOfficermayextend theperiod referred to in sub regulation(1)toafurtherperioddependingoncircumstancestochargeamemberiftheinvestigationintothemisconducthasnotyetbeencompletedduetothecomplexityoftheinvestigationoranyoutstandinginformation.

Procedures of board of inquiry

21. (1) Aboardofinquiryappointedunderregulation9,19or20,mustdetermineitsownprocedures,andthechairpersonmust-

(a) makesurethattheinquiryisconductedinsuchamannerasheorsheconsidersfairandmostsuitabletotheclarificationoftheissuesbeforetheboardand,generally,tothejusthandlingoftheproceedings;and

(b) sofaraspossible,seektoavoidformalityintheproceedings.

(2) Asimplemajorityofthemembersoftheboardformsthequorum.

(3) Thedecisionofthemajorityofthemembersoftheboardofinquiryconstitutesthedecisionoftheboard,butadissentingmembermustgivereasonsinwritingforhisorherdissentingvote.

Appeals

22. (1) A member who is dissatisfied with a decision of the Head in terms ofregulations19or20orwhoisdischargedintermsofregulationl7(2)(b)or18(1)mayinwritingnotifytheHead,ofhisorherintentiontoappealtotheCouncilagainstsuchdecisionordischargenotlaterthan7workingdaysfromthedateheorshereceivedthenoticeofsuchdecisionordischarge,orsuchotherperiodastheHeadmayallow.

(2) ThenoticeofappealtotheCouncilreferredtoinsubregulation(1)must-

(a) beasnearaspossiblebeintheformofForm3inAnnexure6;

(b) bedeliveredtotheHead;and

(c) setoutthegroundsofappeal.

(3) TheHead,within30calendardaysofreceiptofthenoticeofappeal,mustsubmitto theCouncil thenoticeof appeal, the report and the recommendationsof theboardof inquiry

referred to in regulation 19 or 20 and reasons for any alterationmade by theHead to any suchrecommendation,ifany.

(4) Thenotingor executionof an appeal under this regulationdoesnot suspend thedecisionoftheHeadorthedischargeofthememberwhoappealed.

(5) The Council, after considering all the documents submitted to it in terms ofsubregulation(3)andafterhavinggiventheappellantorhisorherrepresentativeanopportunitytoaddressitormakesuchotherwrittenororalrepresentation,may-

(a) allowtheappealinwholeorinpart;

(b) replaceasentence,afterhavinggiventhemembertheopportunitytoaddressitontheproposedalteration,withthesentenceitconsidersfairandjust;or

(c) dismisstheappeal.

Powers of board of inquiry

23. (1) Forthepurposesofaninquiry,thechairpersonofaboardofinquiryorthepersonappointedtoleadtheinquiry,may-

(a) subpoenaanypersontoappearasawitnessatsuchinquiryat the timeandplacespecifiedinthesubpoenainordertoansweranyquestionortoproduceanydocumentorthingunderhisorhercontrolwhichisrelevanttothematterinquestion;and

(b) callanypersonpresentatsuchinquiryasawitness,andmustadministeranoathor affirmation to thewitness, and, if thewitness is to give evidence through aninterpreter,toaninterpreter.

(2) Thesubpoenareferredtoinsubregulation(l)(a)mustbeorderedbythechairpersonoftheboardofinquiryconcernedorthepersonappointedtoleadtheinquiry,andmustbeissuedbytheHeadandbeservedbyanymember,personally,onthepersonsubpoenaed,andthepersonsubpoenaedisentitledtowitnessfeesandallowancesasdeterminedbytheCouncil.

(3) ThesubpoenamustasnearaspossiblebeintheformofForm5ofAnnexure6.

suspension of members

24. (1) Subject to subregulation (2), theHead, after consultationwith theChiefExecutiveOfficer,maysuspendanymemberfromhisorheroffice-

(a) pendinghisorhertrialforacriminaloffence;or

(b) pendinganinquiryascontemplatedinregulation18(4)(b)or19(1)(c)or20;

(c) afterhisorherconvictionofacriminaloffence;or

(d) duringanyperiodofhisorherarrestanddetentionforacriminaloffenceorduringorpendinganinvestigationofanaverredcriminaloffence.

(2) If theHeadwishes to suspendamemberunder this regulation, theHead, exceptwhere it is in the interestof theService thatamemberbe immediatelysuspended,maygive thememberanopportunitytomakerepresentationsastowhyheorsheshouldnotbesuspended.

(3) Duringtheperiodofhisorhersuspensionamembermaynotexercisethepowers,duties,functionsandauthorityvestedinhimorherasamember,butheorshecontinuestobesubjecttothesamedisciplineandpenaltiesasifheorshehasnotbeensuspended.

(4) Amemberwho is suspended from office, in respect of the period of his or hersuspension,isnotentitledtoanybasicwage,excepttotheextentastheHead,atthewrittenrequestofthemember,maydirect.

PART5

TERMSANDCONDITIONSOFSERVICE

Applicability of personnel rules and conditions of service of Council

25. (1) The personnel rulesmade by theCouncil under section 27 of the LocalAuthoritiesAct,exceptforrulesmadeundersections27(1)(c)(ii)(bb)and(iii)and94andofsection94A(1)(d),donotapplytomembersoftheService.

(2) TheCouncil, in addition to the conditions or terms of service provided in theseregulations,maydeterminethebasicwageandotherbenefitsorallowancesthatthemembersareentitledto.

(3) Thebasicwage,benefitsorallowanceorotherconditionsandtermsofservicewhichareapplicabletoamembermaynotbereducedoralteredwithoutthemember’sconsent,exceptinaccordancewiththeprovisionsofanylaworfollowinganinquiryunderregulation9,aninquiryunderregulation19oradisciplinary inquiryunderregulation20,but thissubregulationdoesnotapplyinrespectofaserviceallowancepaymentifsuchpaymentisnolongerapplicable.

(4) Ifamemberhasreceivedanoverpaymentonhisorherremunerationoranyotherpaymentduetothememberorawrongcalculationofleavedaysdue,asaresultofthenegligence,errororwhateverreason,themembermustrepaytheCouncilsuchoverpaymentorthevalueoftheleavedaysdueonconditionsandtermstobeagreedupon,andfailingsuchagreement,inreasonableinstallmentsasdeterminedbytheHead.

(5) Nodeductionofanyrepaymentintermsofsubregulation(4)maybemadewithouttheauthorisationofthemember,andatotaldeductionbyagreementmaynotexceedone-thirdofthemonthlybasicwageofthemember,andnointerestmaybecharged,butifthememberrefusetoauthorizesuchdeductionstheHeadmayauthorizemonthlydeductionsnotexceeding10percentofthebasicwageofthemember.

(6) Subregulation(5)doesnotapplywhereaCourtordersrepaymentoftheamountduewithorwithoutpaymentofinterest.

(7) Where the overpayment or leave days exceeded, leave days available and duereferredtoinsubregulation(4)iscausedbythememberorreceivedortakenbythememberknowingittobeanoverpaymentorleavedaysexceeded,suchcausationoracceptanceconstitutesmisconductbythememberasreferredtoinregulation55.

Probation period

26. (1) Apersonappointedasamemberisappointedonprobationinaccordancewithsubregulation(2).

(2) Apersonwhohasbeenappointedasmemberunderregulation10,beforehisorherappointmenton thefixedestablishment isconfirmed,mustservea12calendarmonthsprobation

period, and if after the first 12 calendarmonths probation the appointment of amember is notconfirmed, the probation period may be extended for a further six calendar months period andthereafternofurtherextensionmaybeallowed.

(3) Amemberwho isonprobationmustbeappraisedquarterlyduring theprobationperiodandiftheperformanceofthememberisunsatisfactoryheorshemustbeinformedinwritinginwhatrespectsitisunsatisfactory.

(4) Amemberwhoisonprobationandwhoseperformanceisunsatisfactorymustbegiventhereasonableassistance,trainingordevelopmenttoenablethemembertomeettherequiredstandards.

(5) Atleast1calendarmonthbeforecompletionofanyprobationperiodbyamember,theHeadmust issue a certificate inwhich he or she certifies that themember is suitable or notsuitabletobeappointedpermanentlyonthefixedestablishmentandacopyofsuchcertificatemustbehandedtothemember.

(6) IftheHeadcertifiesthatthememberisnotsuitableforappointmentheorshemayrecommendthattheprobationperiodbeextended,andmustinthatcasealsostipulatethenatureandextentofassistance,trainingordevelopmentthememberrequirestomeettherequiredstandardsandmustensurethatsuchassistance,trainingordevelopmentisprovided.

(7) Amemberwho isonprobationmust contribute to andbecomeamemberof thePensionFundandmedicalaidfundapprovedbytheCouncilandoftheSocialSecurityCommissionintermsoftheSocialSecurityAct,1994(ActNo.34of1994),exceptwherethePensionFundoramedicalaidfundregulationsprovidesotherwise.

(8) Whenever a Head, Deputy Head or Senior Superintendent is on probation thereference to “Head” in subregulations (5) and (6)must be construed as a reference to theChiefExecutiveOfficerand the reference to“member” in thosesubregulationsmustbeconstruedasareferencetotheHead,DeputyHeadorSeniorSuperintendent.

Working days and hours

27. (1) Subjecttosubregulation(2),amembermustperformhisorherfunctionsanddutiesonanydayoftheweek.

(2) TheCouncilmustdeterminetheordinaryworkinghoursofthemembers,andthemembersmustcomplywithsuchworkinghours,butthenormalworkinghourssodeterminedmaynotexceed-

(a) 45hoursperweekinrespectofmembersworking5daysperweek;or

(b) 60hoursperweekor10hoursperdayor10hourspershiftinrespectofmembersworkingsixdaysperweek.

(3) Subregulation(2)doesnotapplywhilethememberperformsurgentworkorwhilethememberperformsworkconnectedwiththearrival,departure,provisioning,loadingorunloadingofatruckorothervehicleusedforthetransportationofpassengersorperishablegoodsoranyStatemotorcadeorforeigndignitaryprocession.

Overtime

28. (1) TheHeadmayrequireanymembertoworkovertimeandamember,whoissorequired,mustworkovertime.

(2) Despiteanyotherprovisionsoftheseregulationstothecontrary,theCouncilmustpayamemberwhoperformsadministrativedutiesduringafiveorsixdayworkingweekforanyovertimeactuallyworked at a rateof at least one and ahalf times thehourlybasicwageof themember,butwhenamemberwhoordinarilyworksonaSundayorpublicholidayworksovertimeonaSundayorpublicholiday,theCouncilmustpaythatmemberforthetimeworkedovertimeatarateofatleastdoublethehourlybasicwageofthemember.

service allowance

29. Subjecttoregulations28and31,theCouncil-

(a) maypaymemberswhoworksixdaysaweekafixedserviceallowanceasdeterminedbytheCouncil,insteadofovertimeorstandbyduty,onthebasis,determinedbyitirrespectiveofwhetherstandbydutywasrenderedornotorovertimewasworkedornot,andifovertimewasworkedirrespectiveofthehourssoworked,duringthemonththatthepaymentismadefor;

(b) mustdiscontinuepaymentoffixedserviceallowancetoamember,ifandwhenthememberisdesignated,seconded,rotatedortransferredorre-organizedtoaunitorsectionunderregulation5(3)whereaserviceallowanceisnotpayable,butsubjecttopaymentofovertimeunderregulation28ifandwhenovertimeisworked.

standby duty

30. (1) The Council may require a member who is off duty to be available toperformanydutyafterthatmember’sordinaryworkinghoursinacaseofurgentworkorwhentheServicerequireshisorherservice,andwherethereisapossibilitythaturgentworkmayarisethenthemembermaybeplacedonstandbydutybytheHeadandsuchamembermustbeavailabletogoondutyatanytimewhenrequiredtodoso.

(2) Amemberwhoisnotondutymaynotleavetheareaofjurisdictionwithoutinforminghisorherimmediatesupervisorofhisorherintendedabsenceandhisorhercontactnumbersduringhisorherintendedabsencefromtheareaofjurisdiction.

(3) Amemberwhoisonstand-bydutymaynotleavetheareaofjurisdictionwithoutthewrittenpermissionofhisorherimmediatesupervisor,whichpermissionmayincludeconditionsregardingtherecallofthemembertogoonstandbydutyortogoonduty.

(4) Theserviceallowancepayableunderregulation29includesastandbydutypaymentcomponentandnofurthercompensationbecomespayableforbeingplacedonstandbyduty.

Application for annual or special leave

31. (1) AmemberwhowishestotakeannualorspecialleavemustapplyforsuchleaveofabsenceintheformdeterminedbytheCouncilatleast14daysbeforeheorshetakessuchleave.

(2) Anapplicationforleavereferredtoinsubregulation(1)maybeapprovedonlybytheHeadorthepersontowhomtheHeadhasdelegatedthatpowerandthemembermaynottakeleaveunlessanduntilithasbeenapproved.

(3) If,intheopinionoftheHead,itisimpossibletoapplyforannualleaveasrequiredundersubregulation(1),themembermustapplyforannualleavenotlaterthan2workingdaysafterheorshehasreturnedfromtheannualleave,butthemembermustinformtheHeadorDeputyHeadorhisorhersupervisorofhisorher intendedabsenceand the reasonswhy itwas impossible totimeouslyapplyforleave.

(4) Ifanapplicationforleavehasbeenapproved,theapplicationformmustbeforwardedto thepersonwho is responsible forkeeping leave records, and thatpersonmustensure that thenecessaryentryismadeintheleaverecords.

(5) Allleaveowingto,andleavegrantedtoandusedbyamember,mustberecorded,eithermanuallyorelectronically,inaleaverecord,whichmustbekeptforsuchpurposes.

(6) A1eaverecordofthemembermustbeavailableforinspectionbythememberatallreasonabletimesduringordinaryofficehours.

(7) If theCouncil inadvertently grants to amembermore days of annual leave thanthememberisentitledto,theCouncilmaydeductthenumberofexcessannualleavedaysgrantedfromtheannualleavedayswhichstandtothecreditofthememberorwhichmayinfutureaccruetothatmemberoronterminationofservicethevalueofsuchleavemaybedeductedfromthefinalremunerationpayabletothemember.Annual leave

32. (1) TheCouncil,onapplicationbyamember,mustgranttothememberannualleaveonfullremunerationinrespectofeachperiodof12consecutivemonths(leavecycle)forwhichthememberisemployedbytheCouncil,onadatedeterminedbyit,whichdatemaynotbelaterthan4monthsaftertheexpirationoftheleavecycleofthemember,butamembermay,beforethe4monthsexpire,agreeinwritingtoextendthe4monthperiodbyafurther2months.

(2) Despite subregulation (1), but subject to subregulations (10), (12) and (13) ofregulation35,theCouncilmaynotgranttoamembertheleavereferredtointhatsubregulationtorunconcurrentlywithanyperiodofsickleavegrantedintermsofregulation35,orwithaperiodofnoticeofterminationofcontractofemploymentorinlieuofmaternityleavethatmustbetaken.

(3) Thenumberofannualleavedaysis-

(a) GroupA:36workingdaysperannuminrespectofamemberwhoisonEorFband;

(b) GroupB:32workingdaysperannuminrespectofamemberwhoworksafivedaysperweekandwhoisonDorlowerband;and

(c) GroupC:38.40workingdaysperannuminrespectofamemberwhoworksasixdaysperweek;

(d) GroupD:44.80workingdaysperannuminrespectofamemberwhoworkssevendaysperweekandwhoisontheDorlowerband.

(4) Everymembermusttakeatleast24consecutivecalendardaysannualleaveduringanyleavecycle,butthatperiodofleavemaybereducedbythenumberofdayswhichthememberwas, during the relevant leave cycle, grantedoccasional leaveon full remuneration at his orherrequest.

(5) Subjecttoregulation33,theCouncilmaynotrequireorpermitamembertoperformanyworkasamemberduringhisorherannualleave,exceptincasesofurgentworkorwherethegeneralworkloadoftheServicerequiresit.

Cancellation, interruption or postponement of annual leave

33. (1) Despiteanyotherprovisionoftheseregulations,theHeadafterconsultationwiththeChairpersonoftheManagementCommittee,mayatanytimecancel,postponeorinterrupttheleavegrantedtoamemberunderregulation32(1),iftheHeadthinksitnecessaryintheinterestsoftheServiceorinthepublicinteresttodoso.

(2) Ifamember’sannualleavegrantedunderregulation32(1)iscancelled,postponedorinterruptedundersubregulation(1),theCouncilmust-

(a) paytheexpensesincurredinrespectofcommitmentsmadebythememberbeforeheorshewasnotifiedofthecancellation,postponementorinterruption;

(b) paythetravellingexpensesofthememberfortheforwardandreturnjourney,ifthememberwasrequiredtotraveltoresumeduty;and

(c) regardthememberasbeingondutywhiletravellingtoresumeduty.

(3) Thecancellation,postponementorinterruptionofannualleaveundersubregulation(1)mustbeconfirmedinwriting.

(4) If the annual leave applied for by amember is refused, cancelled, postponed orinterruptedthereasonsfortherefusal,cancellation,postponementorinterruptionmustbenotedintheleaverecord,andthemembermust-

(a) be credited with the number of leave days remaining after the cancellation orinterruptionoftheannualleave;and

(b) be permitted to take leave within 12 months after the refusa1, cancellation,postponementorinterruption.

Compulsory annual leave

34. Ifamemberhasmorethan130workingdaysannualleavetohisorhercredit,thatmemberisrequiredtotakeatleast30workingdaysannualleaveduringtheperiodtobedeterminedbytheHead,orinrespectoftheHead,DeputyHeadorSeniorSuperintendenttheChiefExecutiveOfficermaydetermineandrequiresuchHead,DeputyHeadorSuperintendent,totakeatleast30workingdaysannualleave.

sick leave

35. (1) Duringanysickleavecycle,amemberisentitledtosickleaveasfollowsduringthefirst12monthsofemploymentofthemember,aonedaysickleaveforevery26daysworked,andthereafter-

(a) notlessthan30workingdays,ifthememberordinarilyworksnotmorethanfivedaysperweek;and

(b) notlessthan36workingdays,ifamemberordinarilyworkssixdaysormoreperweek.

(2) Subjecttosubregulation(3),theCouncilmustpayamemberanamountequaltothedailybasicwageofthememberforeachdayofabsenceonsickleave.

(3) Despitesubregulation(2),theCouncilmaynotpayamemberforabsenceonsickleaveinanyofthefollowingcircumstances,ifthemember-

(a) hasbeenabsentfromworkformorethantwoconsecutivedays;and

(b) failstoproduceamedicalcertificateissuedbyamedicalpractitioner,

totheextentthatthememberisentitledtopayment-

(i) in terms of theEmployeeCompensationAct, 1941 (ActNo. 30 of 1941), if thememberisabsentfromworkduringanyperiodofincapacityarisingfromanaccidentorascheduleddisease;

(ii) inrespectofthesuchleaveunderanyotherlegislation.

(4) A member is entitled to 120 calendar days’ sick leave in the aggregate on fullremuneration,and120calendardays inaggregateonhalfremunerationduringeachperiodof36consecutivemonths(sickleavecycle).

(5) Amemberwho isgrantedsick leave in termsof theseregulationsmaynot leavetheareaofjurisdictionoftheCouncil,exceptwiththepermissionoftheHeadorwherethemedicalpractitionerrecommendingthesickleavestipulatesotherwise.

(6) Subjecttosubregulation(7),sickleaveaccruestoamemberonthefirstdayofthesickleavecycleandasfromthatdaythefullcomplementforthesickleavecycleconcernedmaybegrantedtothemember.

(7) Notmorethanfourworkingdayssickleaveonfullremunerationandfourworkingdays sick leaveonhalf remuneration for everycompletedmonthof servicemaybegranted toamemberduringthefirstyearofservice.

(8) Subjecttosubregulation(9),thesickleavewhichisprovidedfor anyparticularsickleavecyclebutisnotusedduringthatcyclelapsesattheendofthatcycleandmaynotbecarriedforwardtothenextsickleavecycle.

(9) Despitesubregulation(8),amembermustbecreditedwiththefollowingsickleavedays(accumulatedsickleave)attheendofasickleavecyclewhichmustbecarriedforwardtothenextsickleavecycle-

(a) onedayaccumulatedsickleaveonfullremunerationforeveryeightdayssickleavewithfullremunerationthatarestandingtothemember’screditattheendofthesickleavecycle;and

(b) onedayaccumulatedsickleaveonhalfremunerationforeveryeightdayssickleavewithhalfremunerationthatarestandingtothecreditofthememberattheendof thesickleavecycle.

(10) Ifamemberisabsentfromdutythroughincapacityforaperiodofmorethantwocalendardays,sickleavemaybegrantedtohimorheronlyif,onapplicationforsickleave,heorshesubmitsamedicalcertificatefromamedicalpractitionerinwhich-

(a) the medical practitioner certifies that he or she had seen the member and hadexaminedhimorherandthedateheorshehaddoneso;

(b) thenatureoftheincapacityisclearlydescribed;

(c) itisdeclaredthatsuchmemberisunabletoperformhisorherduties;and

(d) theperiodnecessaryforhisorherrecoveryisalsoindicated,

providedthattheCouncilmay,initssolediscretion,acceptacertificatefromamedicalpractitionerwhichdoesnotcontainallelementslistedhereinsavethatitcontainsacleardescriptionofthenatureoforthecauseoftheincapacity.

(11) TheHeadmayrequirethesubmissionofamedicalcertificateinrespectofaperiodoflessthantwodaysabsencefromduty.

(12) Despitesubregulations(7)and(13),theCouncil,ifitissatisfiedthattheabsenceofthememberwasingoodfaithduetoincapacityandthatgoodreasonsexistwhyamedicalcertificatewasnotsubmitted,mustexemptsuchmemberfromthesubmissionofamedicalcertificateinrespectofacontinuousperiodofsickleaveofnotmorethan14consecutivedays.

(13) Sickleavewithorwithoutremunerationinrespectofwhichamedicalcertificatewasnotsubmitted,maybegrantedonlyforamaximumof14calendardaysduringanyyearendingon31Decemberandanyfurtherabsencemustbecoveredbythegrantingofannualleaveor,ifthememberhasnoannualleavedaystohisorhercredit,annualleavewithoutbasicwage.

(14) TheHead,atanytime,maycompelanyapplicantforsickleavetosubjecthimselforherselftoexaminationbyamedicalpractitionerappointedbytheCouncilandifthecertificatefromsuchmedicalpractitionerdifferssignificantlyfromthemedicalcertificateaccompanyingtheapplication,theHead,inaccordancewiththemedicalcertificateissuedbythemedicalpractitionerappointedbytheCouncil,may-

(a) curtailorrefusetograntsuchsickleave;or

(b) ifthesickleavehasalreadybeengranted,curtailorcancelsuchsickleave.

(15) If a member to whom annual leave is granted under regulation 32(1) becomesincapacitatedafterhisorherannualleavehasbegun,thatportionofhisorherannualleaveduringwhichheorsheisincapacitated,maybeconvertedintosickleave,if-

(a) themembersubmitsamedicalcertificateinwhichamedicalpractitionercertifiesthat he or she had seen and examined the applicant, the nature of the incapacitysufferedfromandthattheapplicanthadtostayinbedduringtheperiodforwhichsickleaveisapplied;and

(b) sufficientsickleavecreditisavailable.

(16) Amembertowhomsickleaveisgrantedonhalfremunerationorwithoutbasicwageandwhohasthenecessaryannualleavecredit,maychoosewhetherheorshewishestotakeannualleaveinplaceofsickleaveonhalfremunerationorwithoutbasicwage.

(17) NothingintheseregulationsprecludesamemberfromleavingtheServiceonthegroundsofill-healthbeforethemaximumoranyperiodofsickleavehasbeengranted.

(18) IncaseswherethePensionFundorwherethePensionFund’sRulesallowit, themedicalpractitioneroftheCouncildeclaresamembertotallymedicallyunfitforthepositionthatheorsheoccupies,thatmember’sservicemustbeterminatedbytheCouncilonthedateonwhichhisorhermedicalunfitnesshasbeenacceptedbythePensionFundorthedatedeterminedbythemedicalpractitionerandinsucheventaninquiryunderregulation19isnotrequired.

(a) “incapacity”meansinabilitytoworkowingtoanysicknessorill-healthorinjuryexceptinjuryorsicknesscausedbyamember’sownmisconduct;and

(b) any inability towork,causedbyanaccidentorascheduleddiseaseasdefined insection2oftheEmployees’CompensationActisonlyregardedasincapacityduringanyperiodinrespectofwhichnocompensationispayableintermsofthatAct.

(20) Despitethedefinitionof“incapacity”insubregulation(19),theCouncilmayregardalcoholismordrugaddictionasincapacityandmayintermsofthisregulationgranttoamemberwhoisanalcoholicordrugaddict,sickleavewithfullremuneration,but-

(a) ifmedicallycertifiablesymptomsforalcoholaddictionordrugabuseoccurafterthememberhasbeenpermanentlyappointed,thatpersonmaybegrantedsickleavewithfullremunerationonlyonceduringhisorherperiodofservicewiththeCouncilforthepurposesofreceivingspecialisedtreatmentatanapprovedinstitution;or

(b) when medically certifiable symptoms for alcohol addiction or drug abuse occurduringamember’sprobationperiodorwhile thememberhasnotbeenappointedpermanently,theCouncilmay,inaccordancewiththeseregulations,terminatetheserviceofthatmember.

Compassionate and officialleave

36. (1) Amember,duringeachperiodof12monthsofcontinuousemploymentisentitledtofiveworkingdays’compassionateleavewithfullypaidremuneration.

(2) Amemberisentitledtocompassionateleaveifthereisadeathorseriousillnessinthefamily.

(3) Amemberwhowishes to takecompassionate leavemustapplyforsuchleaveofabsenceintheformdeterminedbytheCouncilassoonaspossiblebeforeheorshetakessuchleave.

(4) If,intheopinionoftheCouncil,itisimpossibletoapplyforcompassionateleaveasrequiredundersubregulation(3),themembermustapplyforcompassionateleavenotlaterthan2workingdaysafterheorshehasreturnedfromthecompassionateleave,butthemembermustinformtheHeadorDeputyHeadorhisorhersupervisorofhisorherintendedabsence.

(5) Compassionateleave-

(a) doesnotformpartofannual,sickormaternityleave;

(b) does not entitle the member to any additional remuneration on termination ofemployment;and

(c) ifnotusedduringtheperiodreferredtoinsubregulation(1),lapsesattheendofthatperiod.

(6) Forthepurposesofthissection“family”means-

(a) achild,includingachildadoptedintermsofanylaw,customortradition;

(b) aspouse;

(c) aparent,grandparent,brotherorsister,ofthemember;or

(7) Membersmaybegrantedofficialpaidleaveinordertoattendafuneralofdeceasedmemberwithfullypaidremuneration,and-

(a) amemberwhowishestotakeofficialleaveunderthisregulationmustapplyforsuchleaveofabsenceintheformdeterminedbytheCouncilassoonaspossiblebeforeheorshetakessuchleave;

(b) theHeadmaygrantofficialleaveforanymemberwhowillactaspallbearerandanadditionalsixmemberstoattendthefuneralofadeceasedmember,butwiththepriorwrittenconsentof theChiefExecutiveOfficer, theHeadmaygrantofficialleavetoagreaternumberofmembers,butnotmorethanthenumberthattheChiefExecutiveOfficerhadagreedto,toattendthefuneral;

(c) ifmoremembersapplyforcompassionateleavetoattendthefuneralofadeceasedmemberthentheHeadmaygrantcompassionateleavetothenumberofmembersasheorshemaydetermine;

(d) iftheoperationalrequirementsoftheServiceallowitthemembersgrantedofficialleavemaybeallowed touseaCouncilvehicle for the journeyat thecostof theCouncil;or

(e) iftheoperationalrequirementsdonotallowtheuseofaCouncilvehicletheCouncilmay pay its normal kilometer allowance for the use of a private vehicle uponconditionthatthemembersconcernedasfaraspossibletravelinonevehicle;

(f) nosubsistenceallowanceispayableunderthissubregulation;

(g) officialleaveunderthissubregulation-

(i) doesnotformpartofannual,maternityorsickleave;and

(ii) doesnotentitlethemembertoanyadditionalremunerationonterminationofemployment.

(9) TheHeadmaygrantamaximumoffiveworkingdaysofficialleavetoamemberduringanyperiodof12months,butwiththepriorwrittenapprovaloftheChiefExecutiveOfficersuchperiodmaybeexceededtotheextentsoapprovedbytheChiefExecutiveOfficer.

(10) Subregulations (4), (5) and (6)of regulation31 apply to this regulationwith thenecessarymodifications.

(11) Inthisregulationthewords“funeralofadeceasedmember”meansthefuneralofamemberwhodiedfromanycause,butexcludingsuicide,whilstintheemployoftheService.

Bonus leave

37. (1) TheCouncilmustgranttoamemberwhowasintheserviceoftheCouncilat thedate the regulations repealedby regulation71came intooperationand thereafterwhohascompletedaminimumoffiveyearscontinuousservice,abonusleave,andthereafterforonemorefiveyearserviceperiod,butonlytoamaximumoftwo5yearsserviceperiodswhereaftertherighttobonusleavelapses.

(2) Thenumberofleavedaystobegrantedforabonusleavemustbeasfollows-

whichleavedayswillduringthefirstperiodoffiveyearsnotaccrueproratashouldservicesbeterminatedbeforetheexpiryofthefirstperiodoffiveyears;and

(b) foreachcompletedyearorportionthereofofcontinuousserviceaftertheperiodofthefirstfiveyears-

(i) 12,33workingdaysforamemberwhoholdsthepositionofHeadorDeputyHeadorSeniorSuperintendent and everymemberworkingfivedays perweek;and

(ii) 14,79workingdaysforanyothermember.

(3) TheCouncil,atthewrittenrequestofamembermadeatleast14daysbeforethedate(relevantanniversarydate)thatpaymentisrequired,maypaythememberacashamountnotexceedingoneday’sbasicwageofthememberforeverydayofbonusleavecredit,inlieuofabonusleave.

(4) A bonus leave, which has not been used or paid out in cash amount, may beaccumulated to amaximumof two times the number of days referred to in subregulation (2)(a)irrespectiveofwhethersuchleavepartiallyaccruedbeforetheregulationsreferredtoinsubregulation(1)cameintooperation.

(5) Ifamemberdies,thevalueofallbonusleaveduetohisorhercreditmust,subjecttoawillofthatmember,bepaidintohisorherestateorthebeneficiariesnominatedbythememberunderthePensionFundRules.

(6) Ifamember’scontractofserviceisterminated-

(a) before themembercompletesfiveyearscontinuousservicewith theCouncil, theCouncilmaynotpayoutanycashvalueofthebonusleave;or

(b) afterthememberhascompletedfiveyearscontinuousservicewiththeCouncil,theCouncilmustpayouttothememberthecashvalueofthebonusleavestandingtothemember’scredit.

(7) Despite subregulations (2)(a) and (6)(a), if the Council terminates a member’scontractofserviceonaccountofredundancyorinterestoftheServiceascontemplatedinregulation17(l)(a),theCouncilmustpayaproratashareofthecashvalueofthebonusleavethatwouldhaveaccruedtothememberhadtheCouncilnotterminatedhisorhercontractofservice.

(8) Forthepurposeofthisregulation-

(a) when calculating the period of five continuous years of service, annual leavewithoutremunerationorspecialleavewithoutremuneration,maynotbetakenintoconsideration;

(b) anycashvalueofbonusleavemustbecalculatedaccordingtothefollowingformula-

(a) “a”representsthenumberofbonusleavedaystothecreditofamember;and

(b) “b”representstheannualbasicwagereceivedbyamemberonthedayhisorhercontractofemploymentisterminated.

(10) Subregulations (4), (5) and (6)of regulation31 apply to this regulationwith thenecessarymodifications.

(11) Bonus leave which has accumulated under the former conditions of service isdeemedtohaveaccumulatedforcalculationpurposesascontinuousserviceinaccordancewiththeseregulations, but amemberwhohasnotyet accruedfiveyears continuous service at thedate theregulationsarerepealed,suchproratayearsofservicebeforesuchdate,areaddedproportionatelytotheyearsofservicesthatfollowsthedateofrepeal,forentitlementasthefirsttermbonusleaveandthereafterforonemorefiveyearserviceperiod,butonlytoamaximumoftwofiveyearsserviceperiods.

special leave

38. (1) TheHead,mustgranttoamemberspecialleavewithfull remuneration,ifthemember-

(a) isselectedbyasportsbodyregisteredwiththeNamibiaSportsCommission,orasportsbodyfortheuniformedservicesto-

(i) takepartinasportstouroutsideNamibiawhetherascompetitor,coachormanageroranyotherofficial;

(ii) representNamibia,asacompetitor,coachormanageroranyotherofficialataninternationalsportingeventinNamibia;

(iii) accompanyaforeignnationalteamvisitingNamibia,asarepresentativeofaNamibiansportsbodyorganizingthetour;

(b) issummonedaswitnessinproceedingsbeforeacourtoflawortoproducedocumentsonbehalfoftheCouncilorinconnectionwiththemember’sofficialduty;

(c) hastostudyandsitforanexaminationasapprovedbytheCouncilinaccordancewiththeCouncil’sTrainingandStudyAidPolicy,butsuchspecialleave-

(i) maynotbetakenearlierthan60daysbeforethedateonwhichtheexaminationinrespectofwhichleaveisgrantedistobeheld;

(ii) maybegrantedonlyonceperapprovedcourse;

(d) isappointedasaboardmemberofacompanyinwhichtheGovernmentholdsthemajorityofsharesoraprofessionalbodyestablishedbylawforboardmeetingsandconferences;or

(2) Specialleavegrantedundersubregulation(1)(a)or(e)maynotexceed10workingdaysintotalineveryfinancialyear,andifthe10daysperiodistobeexceededthemembermustmotivateinwritingtotheChiefExecutiveOfficerthegroundsforexceedingthatperiod.

(3) TheCouncil,onapplication,maygranttoamemberspecialleave-

(a) without basicwage if themember has no annual leavedays to his or her credit,andtheCouncil issatisfiedthat thecircumstancesjustify thegrantingof leaveofabsence;or

(b) onfullremunerationorwithoutbasicwageiftheCouncilsoapproves;or

(c) withoutbasicwagewherethememberhasnoannualleavetohisorhercreditforpurposesofaccompanyhisorherspouseabroadonadiplomaticmission.

(4) Subjecttoregulation35(17),theCouncilmaygranttoamemberspecialleaveonfullremunerationifthememberisunabletoperformhisorherdutiesonaccountofanaccident-

(a) towhichtheEmployees’CompensationActapplies;or

(b) which is covered by the insurance policy of the Council, if any, in respect of amemberwhoisnotcoveredbysection3oftheEmployees’CompensationAct,

but thatmember,duringtheperiodofincapacity,maynotreceivepaymentfromtheCouncil, theEmployees’CompensationCommissionerortheinsureroftheCouncilwhichwillresultinhisorhertotalincomefortheperiodofincapacityexceedingtheamountofremunerationwhichheorshenormallyreceivesfromtheCouncil.

(5) Everymemberwhoappliesforspecialleave,insupportofhisorherapplication,mustsubmitacertificatestatingthereasonsfortheapplicationofspecialleaveorsuchotherproofastheCouncilmayrequireandsuchmembermaynotproceedwithtakingspecialleavebeforeithasbeenapproved.

(6) Subregulations (4), (5) and (6)of regulation31 apply to this regulationwith thenecessarymodifications.

Maternity leave

39. (1) Subject to subregulation (3), a female member who has completed sixmonths’continuousservicein theemploymentof theServiceis,withaviewtoherconfinement,entitledtonotlessthan12weeks’maternityleave,calculatedasfollows-

(a) beforeheractualdateofconfinement-

(i) sheisentitledtocommencematernityleavefourweeksbeforeherexpecteddateofconfinement,ascertifiedbyhermedicalpractitioner;and

(ii) sheisentitledtomaternityleavefortheentiretimefromthecommencementofhermaternityleaveascontemplatedinsubparagraph(i),untilheractualdateofconfinement;

(b) afterherdateofconfinement,sheisentitledto-

(ii) in the case of a member whose date of confinement occurred less thanfourweeksafterthecommencementofhermaternityleave,theamountofadditionaltimerequiredtobringhertotalmaternityleaveto12weeks.

(2) The member must provide the Council with a certificate signed by a medicalpractitionerconfirming-

(a) theexpecteddateofconfinementbeforetakingmaternityleave;and

(b) theactualdateofconfinementonherreturnfromleave.

(3) Duringanyperiodofmaternityleave,theprovisionsofthecontractofemploymentremaininforce,andtheCouncilmust,duringtheperiodofmaternityleave,paytothemembertheremunerationpayabletothatmemberexceptthebasicwage.

(4) TheCouncilmustnotdismissamemberduringhermaternityleaveorattheexpiryofthatleaveon-

(a) anygroundsofcollectiveterminationorredundancy;or

(b) anygroundsarisingfromherpregnancy,delivery,orherresultingfamilystatusorresponsibility.

(5) Subregulation(4)doesnotapplyif-

(a) theCouncilhasofferedthemembercomparablealternativeemployment;and

(b) shehasunreasonablyrefusedtoacceptthatoffer.

(6) AmemberwhohasbeengrantedmaternityleavemustcontinuetopayherportionofthecontributionstowardsthePensionFundandmedicalfundonamonthlybasis. (7) Subregulations (4), (5) and (6)of regulation31 apply to this regulationwith thenecessarymodifications.

(8) Maternityleavethathadbeengrantedmaynotrunconcurrentlywithorbeconvertedtoanyotherformofleave.

Extended maternity leave

40. (1) Ifamedicalpractitionercertifiesthat-

(a) due to complications arising from pregnancy or delivery, it is necessary for thehealthofthemember,theCouncilmustgrantthatmemberextendedmaternityleaveinexcessoftheperiodsreferredtoinregulation39,uptoamaximumequaltothegreaterof-

(i) onemonth;or

(ii) theamountofaccruedsickleavethatthememberhasatthattime;or

(b) duetocomplicationsarisingfrombirthorcongenitalconditions,itisnecessaryforthe health of themember’s child, theCouncilmust grant thatmember extended

(i) onemonth;or

(ii) theamountofaccruedsickleavethatthememberhasatthattime.

(2) Ifamedicalpractitionerissuesacertificateintermsofbothsubregulation(1)(a)and(b),theperiodsofextendedmaternityleavemustrunconcurrently.

(3) Aperiodofextendedmaternityleavemustrunimmediatelybeforeorimmediatelyfollowingamember’smaternityleaveintermsofregulation39.

(4) Duringanyperiodofmaternityleave,theprovisionsofthecontractofemploymentremaininforce,andtheCouncilmust,duringtheperiodofmaternityleave,paytothemembertheremunerationpayabletothatmemberexceptthebasicwage.

(5) TheCouncilmaynotdismissamemberduringhermaternityleaveorattheexpiryofthatleaveon-

(a) anygroundsofcollectiveterminationorredundancy;or

(b) anygroundsarisingfromherpregnancy,delivery,orherresultingfamilystatusorresponsibility.

(6) Subregulation(5)doesnotapplyif-

(a) theCouncilhasofferedthemembercomparablealternativeemployment;and

(b) shehasunreasonablyrefusedtoacceptthatoffer.

(7) AmemberwhohasbeengrantedextendedmaternityleavemustcontinuetopayherportionofthecontributionstowardsthePensionFundandmedicalfundonamonthlybasis.

(8) Subregulations (4), (5) and (6)of regulation31 apply to this regulationwith thenecessarymodifications.

(9) Extendedmaternityleavethathadbeengrantedmaynotbeconvertedtoanyotherformofleave.

Payment of leave credit at termination of contract of employment

41. (1) WhereamemberdieswhileheorsheisintheService,theCouncilmustpaytothemember’sestateorthebeneficiariesnominatedbythemember,intermsofthePensionFundRules,hisorherfullremunerationinrespectofanyannualleavewhichaccruedtohimorher,butwasnotgrantedbeforethedateoftermination(byreasonofdeath)ofthemember’scontractofemployment.

(2) Theamounttobepaidtoamemberintermsofsubregulation(1)iscalculatedinaccordancewiththefollowingformula-

(a) axb 250wherethememberworksfivedaysperweek;and

(b) axb 300wherethememberworkssixdaysperweek.

(3) Intheformulareferredinsubregulation(2)-

(4) Subjecttosubregulation(5),ifthecontractofemploymentofamemberwiththeCouncilisterminated,andthememberhasaccumulatedannualleavedaystohisorhercredit,theCouncil, in accordancewith the formula referred to in subregulation (2) and (3),must pay thatmemberhisorherfullremunerationinrespectofanyannualleavewhichaccruedtohimorherbutwasnotgrantedbeforethedateofterminationofhisorhercontractofemployment.

(5) TheCouncil only pays out the cash value of annual leave days contemplated insubregulations(1)and(4)tothemaximumof130daysinrespectoffiveworkingdaysperweekand156workingdaysinthecaseofsixworkingdaysperweek.

(6) Amemberwhoaccordingtohisorherappointmentcertificate,wasappointedintheemploymentoftheCouncilbeforethe31stofDecember2007isentitledto156workingdays.

(7) Amemberwhoaccordingtohisorherappointmentcertificate,wasappointedintheemploymentoftheServiceafterthe31stofDecember2007isentitledto-

42. (1) TheCouncilmay,onceonly,payamemberwhohasbeenrecruitedwithinNamibiabutoutsideitsareaof jurisdictionthefollowingmoneysafterassumptionofduty, if themember,inordertoreachandassumehisorheremployment-

(a) usesroadtransport, thetransportcostcalculatedonthebasisoftheperkilometertariffasdeterminedfromtimetotimebytheAutomobileAssociation;or

(b) usesrailtransport,thetransportcoststoamaximumamountequaltothepriceofafirstclasstrainticketforthememberandhisorherdependants,fromtherailwaystationorrailwaybushaltnearesttothemember’sformerplaceofresidencetotheWindhoekrailwaystation;and

(c) transportshisorherpersonaleffectstotheCouncil’sareaofjurisdiction,atanamountequaltothecheapestofthreequotationsquotedbyatleastthreedifferentfurnitureremovalcompaniesbutifthecheapestquotationexceedsN$10000quotationsfortheservicemustbecalledforundertheTenderBoardRegulationspublishedunderGeneralNoticeNo.73of12April2011.

(2) Ifthemembermakesuseofmeansotherthanroadorrailtransport,heorshemustberepaidasifheorsheandhisorherfamilyhadtravelledbyroadorbyrailwhicheveristhegreateramount. (3) TheCouncil, bywayof a special agreement,maypay amember recruited fromoutsideNamibiathefollowing-

(b) thetransportcostsinrespectof hisorherpersonaleffectsfromhisorherformerplaceof residenceaccordingtothebasisprovidedinsubregulation(l)(b).

(4) TheCouncilmayinwritingagreewithanymembertopaythetransportcostsandallowancesreferredtoinsubregulation(1)and(2)onassumptionofdutyorsometimethereafterandthataprorataportionof,orthewholeamountmaybereclaimedbytheCouncilifthememberterminateshisorhercontractofemploymentwiththeCouncilwithinaperiodoftwoyearsfromthedateofhisorherappointment.

(5) Everyapplicationfortransportcostsandallowancesundersubregulation(1) or(2)mustbesubmittedinwritingandmustbesupportedwithdocumentaryprooftothesatisfactionoftheCouncil.

subsistence and travel and special allowance

43. (1) TheCouncilmustpaytoamember,whomitrequiresordirectstotravelonofficialbusinessortoattendameetingorconferenceonbehalfoftheCouncilandwhoisabsentfromhisorhernormalplaceofworkforaperiodofonedayorlonger-

(a) asubsistenceandtravel;and

(b) whereapplicable,specialallowance,

at a daily rate and in accordance with the recommendations and directions of theManagementCommittee.

(2) If theperiodofabsence referred to in subregulation (1) is less thenoneday, theCouncilmustpaytothememberareasonableactualexpenditureincurredbythememberduringtheperiodofabsence.

Inadequate subsistence and travel allowance

44. (1) If thesubsistence, travelorspecialallowancereferredtoinregulation43isinadequatetocovertheexpenseswhichamemberincursoverandabovehisorhernormallivingexpenseswhenheorsheisabsentfromhisorhernormalplaceofwork,theCouncilmayrefundtothememberthedifferencebetweentheamountpayableassubsistence,travelorspecialallowanceinrespectoftheperiodofabsenceandthereasonableexpenditureactuallyincurredbythemember.

(2) Theamountreferredtoinsubregulation(1)mayonlybepaidtoamemberwhenheorshesupportstheclaimwiththenecessaryreceiptsorvouchers.

Reimbursement for expenses incurred

45. (1) TheCouncilmust pay or reimburse amemberwho is required to traveloutsideWindhoekonofficialduty,thecostsof-

(a) conveyinghimselforherselfandhisorherpersonalluggage;

(b) allreasonableexpenditureincurredinconnectionwithtaxihire,airfare,railcosts,insurance,portage,gratuities,landingorshippingfees,airporttaxes;and

(2) Noexpensethathadbeenincludedinapaymentmadeunderregulation43or44maybepaidintermsofthisregulation.

severance pay

46. (1) Subject to subregulation (2), the Council must pay severance pay to amemberwhohascompleted12monthsofcontinuousservice,ifthemember-

(a) isdismissedorserviceisterminatedforill-health;

(b) dieswhileemployed;or

(c) resignsorretiresonreachingtheageof55or60years;or

(d) isretrenched.

(2) Subregulation(1)doesnotapply-

(a) toafairdismissalongroundsofmisconductorpoorworkperformance;

(b) ifthememberunreasonablyrefusestobereinstated;or

(c) ifthememberunreasonablyrefusestoacceptemploymentontermsnolessfavourablethanthoseapplicableimmediatelybeforetheterminationofemployment.

(3) Severancepayintermsofsubrule(1)mustbeinanamountequaltoatleastoneweek’sremunerationforeachyearofcontinuousservicewiththeCouncil.

(4) When calculating the length of the service of a member for the purposes ofsubregulations(1)and(3)thefollowingapply-

(a) iftheServicehasbeentransferredtoaStateDepartmentoranotherorganizationinwhichtheStatehasamajorityshareholdingandthemembercontinuesintheserviceofthatemployerafterthetransferthememberretainsanyserviceacquiredbeforethetransferoftheServiceandnoseverancepaymentispayable;and

(b) “continuousservice”iscalculatedassetoutinregulation37(8)(a).

(5) Thepaymentofseverancepayintermsofthissectiondoesnotaffectamember’srighttoanyotheramountthattheCouncilisobligedtopaythemember.

(6) Ifthecontractofemploymentisterminatedasaresultofthedeathofthememberandintheabsenceofawill,theCouncilmustpaytheseverancepayto-

(a) thesurvivingspouseofthemember;or

(b) ifthereisnospouse,tothechildrenofthemember;

(c) iftherearenochildren,totheestateofthemember.

Acting allowances

47. (1) Ifamemberisappointedtoactinahigherpostforaperiodofnotlessthan30workingdays, theCouncilmustpay thatmemberanactingallowanceequal to thedifference

betweenhisorherbasicwageandtheminimumnotchofthebasicwagescalepertainingtothepostinwhichheorsheisacting.

(2) Amembermay only be paid an acting allowance for amaximum period of sixmonthswhichperiodmayonlybeextendedby theChiefExecutiveOfficer foramaximumofafurther6monthsinrespectofasinglevacancy.

(3) Subject to subregulations (1) and (2) and unless the Council has concluded anagreementtothecontrarywiththemember,amembermaynotclaimanyremunerationinrespectofadditionaldutiesperformedbyhimorherforanyreason.

Fringe benefits

48. (1) A member who holds the post of Head or Deputy Head or SeniorSuperintendentisentitledtoparticipateintheCouncil’sMotorLoanScheme.

(2) AmemberwhoparticipatesintheCouncil’sMotorLoanSchememaymakeuseofaCouncilvehicleforoperationalreasonswiththepriorconsentoftheChiefExecutiveOfficerinthecaseoftheHeadorwiththepriorconsentoftheHeadinthecaseofallothermembers.

(3) AmemberwhowishestopurchaseorbuildadwellingisentitledtotheCouncil’sguaranteeintheformofcollateralbond,suretybondorotherdeedofsecurityunder,andsubjectto,theHousingPolicyoftheCouncil. (4) The Council, in respect of each period of 12 continuous months and on a datedeterminedbyit,mustpaytoamemberwho,atthedatesodetermined,hascompletedatleast12consecutivemonthsofpermanentservicewiththeService,anannualbonus(13thcheque)equivalenttoabasicwageofonemonthofthemember.

(5) Despitesubregulation(4)-

(a) ifamemberonlyworksforaportionofthe12monthsperiodafterthedatedeterminedunderthatsubregulation,hisorherannualbonusmustbecalculatedonaproratabasisofthecontinuousperiodworkedbythemember;

(b) ifthecontractofemploymentofamemberisterminatedforareasonotherthanthatofmisconductbeforethedatedeterminedintermsofthisregulation,thememberisentitledtoaproratapaymentoftheannualbonus;

(c) ifamember,duringany12monthsperiod,hasbeen-

(i) onannualleavewithoutremunerationforaperiodexceeding20consecutiveworkingdays;or

(ii) onsuspensionforaperiodexceeding20consecutiveworkingdaysandwasfoundguiltyofmisconduct,

theCouncil,onaproratabasis,mayreducethatmember’sannualbonusinrespectofthat12monthsperiod.

(6) TheCouncilmustcontributeapercentage,asmaybedeterminedbyit,ofthemedicalaidpremiumpayablebyamemberinrespectofanymedicalaidfundcontributions.

(7) TheCouncilmustcontributeapercentage,asmaybedeterminedbyit,tothePensionFundforthebenefitofeachmemberinrespectofcontributionsofthatmembertothePensionFund.

(8) TheCouncil,inrespectofamemberwhobythenatureofhisorherdutiesisnotrequiredtowearuniform,mustpaytothatmemberaclothingallowanceasmaybedeterminedbyit.

strikes 49. (1) Amembermaynotstrike,induceanyothermembertostrike,orconspirewithanotherpersontostrike.

(2) If theHeadhasreasontobelievethatamemberisstrikingorconspiringwithanotherpersontostrike, theHeadmayinamannerwhichisreasonableunder thecircumstances, issueawrittenultimatumtothemembertoterminateordesistfromcarryingoutsuchconductwithintheperiodspecifiedintheultimatum.

(3) If the member refuses or fails to comply with the ultimatum referred to insubregulation(2),oriftheHeadcannotreasonablybeexpectedtoissuetheultimatumreferredtoinsubregulation(2)toamemberpersonally,theChiefExecutiveOfficermaysummarilydischargethememberfromtheService,withoutaninquiry,bynoticeinwriting,but-

(a) themembersodischargedmustassoonaspracticableafterthedateofdischargebenotifiedinwritingofthereasonsforthedischarge;and

(b) the member so discharged, not later than 30 calendar days from the date he orshereceivesthereasons,maymakewrittenororalrepresentationsto theCouncilregardingtherevocationofthedischarge.

(4) TheCouncil,afterhavingconsideredanyrepresentations,mayreinstatethemembersodischarged,orconfirmthedischargeorimposesuchothersentenceorpenaltyasitthinksfairandjust.

(5) AdischargefromtheServiceundersubregulation(3)isnotinvalidsolelybyreasonofsuchmembernothavingreceivednoticeoftheultimatumreferredtoinsubregulation(2).

(6) “strike” for purposes of this regulationmeans the partial or complete concertedrefusaltoworkortoreverttogoslowoperations,ortheretardation,preventionorobstructionofworkbymemberswhetherdoingsoinordertoresolveagrievanceordisputearisingfromtheirownemploymentorinsolidaritywithotherpersonsemployedbytheCouncilorotheremployers.

Trade unionism

50. Subjecttoregulation52amembermaynot-

(a) belongtoatradeunion;

(b) participateintheactivitiesofanytradeunion;or

(c) inanyotherwaypromotetheobjectsofanytradeunion.

Negotiation forum

51. (1) ThereisestablishedaNegotiationForumtonegotiatewiththeCouncilonwagesandbenefitsintermsoftheconditionsofservicereferredtoinPart5,butthenegotiationdoesnotincludethebenefitsoftheHead,DeputyHeadandSeniorSuperintendents.

(2) TheNegotiationForumconsistsoftwomembersfromeveryunitwithanalternateforeachmember,electedbysecretballotbymemberswithintheunit,excludingtheHead,DeputyHeadandSeniorSuperintendentscommandingtheunit.

(3) Thetermofofficeformembersistwoyears,reckonedfrom1Januaryoftheyearinwhichtheseregulationscomeintoforceto31Decemberofthefollowingyear,andsubsequenttermsofofficearecomputedinacorrespondingmanner,butifnoelectionsforaNegotiationForumhastakenplaceby31Decemberintheyearinwhichatermofofficeends,theoutgoingForumremainsinofficeuntilthedayimmediatelybeforethenextelectionofmembersoftheForumtakesplace.

(4) AmemberoftheNegotiationForumloseshisorherseatontheForumifheorsheissuspended,resigns,retires,isdismissedoristransferredtoanotherunit.

(5) IfamemberloseshisorherseatasmemberoftheNegotiationForumhisorheralternatebecomesamemberinhisorherplacefortheremainderofhisorhertermofoffice.

(6) AnalternatemembermustattendmeetingsoftheNegotiationForumwheneverthememberthatheorsherepresentsisunabletodosoandatanysuchmeetinghasallthepowersthatthememberhas.

(7) TheelectionformembersoftheNegotiationForumtakesplaceontheday,placesandduringthehoursthattheelectioncoordinator,afterconsultationwiththeForum,determinesandmakeknowntothemembersoftheService.

(8) Theelectioncoordinatormust-

(a) makeallthearrangementsnecessary;and

(b) monitorandcontrolthevoting,

inordertoensurefreeandfairelections.

(9) Everymemberofaunit,havingvoted,mustplacehisorhervoteinasealedballotboxsetapartforthatunitunderwhichcommandthememberresorts.

(10) StaffmembersoftheInternalAuditDivisionoftheCouncilmustcollectthesealedballotboxesandbringittothevenue,andatthetime,determinedbytheelectioncoordinatorandmadeknowntomembers.

(11) TheballotboxesmustbeopenedinthepresenceofthecandidatesforelectionthatarepresentandthevotescastcountedbythemembersofthesaidInternalAuditDivision.

(12) Having counted the votes cast themembers of the InternalAuditDivisionmustannounce-

(a) thetotalnumberofvotescasted;

(b) thenumberofspoiledballotpapers;

(c) thenumberofvotescastinfavourofeverycandidateforelection;and

(d) perunit,thenamesofthecandidateelectedandthenameofhisorheralternate.

(13) TheInternalAuditDivisionmustwithintwoworkingdaysthereafterconfirmtheannouncedresultsoftheelectionbyletteraddressedtotheChiefExecutiveOfficer,theHeadandtoeverycandidatestandingforelection.

(14) TheNegotiationForummust, fromamongitsmembers,electaChairpersonwhomustpresideatitsmeetingsand,whenevertheChairpersonisabsentorunabletoactataparticular

(15) ThemajorityofallthemembersoftheNegotiationForumconstituteaquorumforanymeetingoftheForum.

(16) IfatameetingoftheNegotiationForumnoquorumispresentthemeetingmustbeadjournedfornotlessthanaweek,toadatenotbeingapublicholidayoraSunday.

(17) The Negotiation Forum may make rules in connection with the convening andholdingof,andproceduresat,itsmeetings.

(18) TheCouncilandtheNegotiationForummayfreelyandwithoutduressenterintoanagreementarranginganyorallofthefollowingmatters-

(a) whichpersonsmustrepresenttheCouncilasemployerduringjointmeetingsandtowhatextent,ifany,suchpersonscanbindtheCouncil;

(b) thewayinwhichtoconveneandhold,andtheprocedurestobefollowedat,jointmeetings;

(c) whethermembersoftheNegotiationForumandtheirelectedalternatemembersbyaUnitmay,ormaynot,actasworkplacerepresentativeswithinthatUnit,andifsowhattheirbenefits,rights,powersanddutiesare;

(d) anyothermattercontainedintheRegulations,theseregulations,thePoliceAct,theLocalAuthoritiesActandtheRoadTrafficandTransportActandtheregulationsmadethereunderthataffectsanymemberoftheServicethattheCouncilmayagreeto,butsubjecttosuchlimitationstheCouncilmaydecideupon;

(e) disputeresolutionwhereagreementcannotbereached;

(f) theprocesstobefollowed,andthenoticetobegiven,byapartydesiringtoamendanyexistingagreement;and

(g) theprocesstobefollowed,andthenoticetobegiven,byapartyintendingtocancelanyexistingagreement.

(19) ThefunctionoftheHeadunderthisregulationistoactasadvisertotheCouncilandheorsheisnoteligibletobeelectedasamember,oralternate,oftheNegotiationForum.

(20) “Election Coordinator” in this regulation means a staff member that the ChiefExecutive Officer seconded under regulation 5(3) to arrange, manage and control the electionsreferredtointhisregulation.

Political activities of members

52. (1) Subjecttosubregulation(2),amembermaynot-

(a) publiclyorotherwiseactivelydisplayorexpresssupportfororassociatehimselforherselfwithapoliticalparty,organization,movementorbody;

(d) inanymannerfurtherorprejudicetheinterestsofanypoliticalparty.

(e) in anyway actively and publicly promote the candidature of a candidate for, orhimselforherselfbecomeoragreetobecomeacandidateinelectionsfortheNationalAssembly,anyregionalcouncilestablishedundersection2oftheRegionalCouncilsAct,1992(ActNo.22of1992),anylocalauthoritycouncilforanylocalauthorityestablishedundersection3oftheLocalAuthoritiesActoraschoolboard,beyondrecordinghisorhervoteorcarryingouthisorherfunctionsandofficialdutiesinconnectionwithsuchanelection.

(2) Subregulation(1)maynotbeconstruedasprohibitingamemberwhoisnotondutyandwhoisnotinuniformfrom-

(a) expressing views on any issue which is not directly related to the member’sresponsibilitiesasamemberaslongasthememberdoesnot-

(i) associatehisorherpositionasamemberwiththeviews;or

(ii) representtheviewsasthoseoftheService;

(b) attendingorparticipatinginapublicmeeting,excluding,acongress,conventionorothermeetingofapoliticalpartyorotherorganisationinvolvedinpoliticalactivityifsuchmeetingisnotopentothegeneralpublic;

(c) exercisinghisorherrighttovote;or

(d) engaginginanyotherpoliticalactivity,except-

(i) solicitingor receiving funds fororonbehalfof apoliticalpartyorotherorganisationinvolvedinpoliticalactivity;or

(ii) politicalactivitythatplacesorislikelytoplacethememberinapositionof

conflictofinterest.

(3) Despitesubregulations(1)and(2),amemberhastherighttojoinapoliticalparty,organisation,movement,orabodythatengagesinpoliticalactivities,ofhisorherchoice.

Obedience

53. (1) Subjecttosubregulation(2),amembermustobeyanyreasonableorderorinstructiongiventohimorherbyasupervisororapersonwhoiscompetenttodoso,butthemembermaynotobeyapatentlyunlawfulorderorinstruction.

(2) If it is reasonable in the circumstances, amembermaydemand that an order orinstruction referred to in subregulation (1) be recorded inwriting before themember obeys theinstructions.

(3) Amember,afterhavingobeyedanorderorinstructionsreferredtoinsubregulation(1),maydemandthatsuchanorderorinstructionisrecordedinwriting.

Prohibition to perform private work

54. (1) Subjecttosubregulation(2),amembermaynot-

(a) perform or engage himself or herself to perform any work outside his or heremploymentintheService;or

(b) claim as of right additional remuneration in respect of any official duty orworkwhichheorsheisrequiredbyanycompetentauthoritytoperformduringnormalworkinghoursinadditiontohisorherofficialdutiesorwork.

(2) Despitesubregulation(1),theChiefExecutiveOfficer,onwrittenapplicationbyamember,anduponrecommendationoftheHead,maygrantpermission,subjecttosuchconditionsandforsuchperiodconsideredtobedesirableintheinterestoftheCouncil,tothemembertoperformorengagehimselforherself toperformanyworkoutside theemploymentof themember in theService,buttheChiefExecutiveOfficermaynotgrantthepermission,unless-

(a) thememberdisclosesthefull natureofsuchwork;

(b) the performance of or engagement in suchwork does not give rise to a conflictof interests in the performance of his or her official duties, is not detrimental tothe interest of the Service, or does not contravene any other provision of theseregulations;and

(c) thepermissiontodoprivateworkisconditionaltheretothatitmayberevokedonreasonablegroundsatanytime.

(3) Ifamemberreceivesanyremuneration,allowance,gratificationorotherrewardinconnectionwiththeperformanceofhisorherworkintheService,otherthaninaccordancewiththeseregulationsorincontraventionofsubregulation(2)(b),suchmembermustpaytotheCouncil-

(a) an amount equal to the amount of such remuneration, allowance, gratification,reward;or

(b) if it does not consist of money, the value thereof, as determined by the ChiefExecutiveOfficer,

ifheorshefailstodoso,theChiefExecutiveOfficermayrecoveritbywayoflegalproceedingsorinsuchothermannerastheChiefExecutiveOfficermaythinkfit.

(4) If theChiefExecutiveOfficermadeadeterminationofanyvalueascontemplatedinsubregulation(3),thememberaffectedbythatdeterminationmayinwritingappealtotheCouncilagainstthedeterminationoftheChiefExecutiveOfficer.

(5) If in the opinion of the Chief Executive Officer a member has received anyremuneration,allowance,gratificationorotherrewardascontemplatedinsubregulation(1)(b),andsuchremuneration,allowance,gratificationorreward-

(a) isstillinthepossessionofthememberpossessionorunderthecontrolofsomeotherpersononbehalfofthemember;or

(b) hasbeendepositedinanybank,postofficesavingsbankoranybuildingsocietyorotherfinancialinstitutioninthenameofthememberorinthenameofsomeotherpersononbehalfofthemember,

the Chief Executive Officer may in writing require suchmember or such other person or suchbank,thepostofficeorsuchbuildingsocietyorfinancialinstitutionnottodisposethereofor,ifitismoney,toretainsuchsumofmoney,pendingtheoutcomeofanylegalstepsfortherecoveryofsuchremuneration,allowanceorrewardorthevaluethereof.

Misconduct

55. (1) Amemberwho-

(a) contravenesanyprovisionof theseregulations, theAct, theRegulations,criminallaworanyotherlawapplicabletoamember;

(b) sleepsonduty;

(c) isgrosslydiscourteoustoanypersonwhilstonduty;

(d) isnegligentorindolentin thedischargeofhisorherduties;

(e) absentshimselforherselffromdutywithoutleaveorvalidcause;

(f) failswithoutvalidcausetoreportfordutyatastipulatedtimeathisorherstation,placeofemploymentoranyotherplaceappointedbyhisorhersupervisor;

(g) knowingthatheorsheisunabletoreportfordutywhenrequiredtodosofailstoinformhisorhersupervisorthereofwithinareasonabletime;

(h) fails,withoutavalidcause,toappearataninquirywherebyheorshehasbeendulysubpoenaedorinstructedtoattendintermsoftheseregulations;

(i) contrary to anyordersor instructionsof a supervisor,goesoffdutybeforebeingrelievedorwithouthavingfirstobtainedpermissionfromhisorhersupervisortodoso;

(j) withoutproperauthority,releasesaprisonerorotherpersonincustodyorapersonunderquestioningduringan investigation,orwillfullyornegligentlyallowshimorhertoescapeortobereleased;

(k) usesunnecessaryforceorviolenceorthreatenstouseforceorviolenceagainstanyperson,orotherwiseill-treatshimorher;

(l) assaultsanothermemberorstaffmember,threatenshimorherwithviolence,usesthreateningorinsultinglanguagetowardshimorherresistshimorherbywordoractionoradoptstowardshimorherdisdainful,recalcitrantorinsolentattitude;

(m) falselyslanders,imputesimproperdemeanourormisconducttoanOfficerorNonOfficerofahigherranking;

(n) disobeys, disregards ormakeswillful default in carrying out any order given tohim or her by his or her supervisor, if in any prosecution under this regulationsorCouncil’s IndustrialRelation’s Policy, it is prima facie proved that amemberbywordofconductcommitamisconductintermsofsubregulations(l),(m)and(n) it ispresumedinabsenceofevidence to thecontrary, thatheorshecommitsinsubordination;

(o) victimizesor treats a juniormember,memberor staffmember in a tyrannical oroppressivemanner;

(s) conductshimselforherselfinadisgraceful,improperorunbecomingmanner;

(t) socializesorassociateswithorisinthecompanyofapersonwhoisunderinvestigationwithregardtothecommissionofacriminaloffence;

(u) takes an activepart in anyactivitywhich is likely to interferewith the impartialdischargeofhisorherdutiesorwhichislikelytogiverisetothatimpressionamongstmembersofthepublic;

(v) malingers,feignsorpretendstobeill,infirm,indisposed,injuredorsufferingfrompain;

(w) obtainsorattemptstoobtainexemptionfromdutybyadvancingafalseorexaggeratedexcuseonthegroundofillness,infirmity,indisposition,injuryorpain;

(x) willfullycausesillness,infirmity,indispositionorpainorwillfullymaimsorinjureshimselforherselforanyothermember,whetherattherequestofsuchmemberornot, orwillfully causes himself or herself to bemaimed or injured by any otherpersonwiththeintentionofrenderinghimselforherselforsuchothermemberunfitfordutyortheperformanceofhisorherfunctions;

(y) asapatientinanyhospitalornursinginstitution,willfullyfailstoobeyanyregulationoranylawfuldirectiongivenbyamemberofthemedicalornursingstaffattachedtosuchhospitalorinstitution;

(z) desertstheService,refusestoserveinorcarryoutthefunctionsoftheServiceorincitesorpersuadesanyothermembertodesert,refusetoserveinortocarryoutthefunctionsoftheService;

(aa) knowingly andwillfully receives, cares for, harboursor conceals amemberwhodesertedor,withoutvalidcause,absentedhimselforherselffromdutyor,knowingthewhereaboutsofsuchmember,failstonotifyhisorhersupervisorimmediatelyortodoeverythinginhisorherpowertohavehimorherarrested;

(ab) conspireswithanyotherpersontocommitmutinyortocauseamutiny,strike,riotorrevolt;

(ac) joinsinanymutiny,strike,riotorrevoltorincitesanypersontodoso;

(ad) whileamutiny,strike,riotorrevolttakesplaceinhisorherpresence,failstodoeverythinginhisorherpowertosuppressit;

(ae) whileknowingorsuspectinganyotherpersontobeinvolvedinanyconspiracytocauseamutiny,strike,riotorrevoltortohavejoinedinit,failstoreportallthefactswhichheorsheknowsimmediatelytohisorhersupervisor;

(af) addressesanyanonymouscommunicationtoamemberof theCouncil, theHead,anyotherdignitary,aseniorofficer,amemberorastaffmember;

(ah) withholdsorunreasonablydelaysanycomplaintagainstoranadversecommunicationconcerninganothermember;

(ai) willfullyrefusesor neglectsto dischargeanylawfuldebt;

(aj) withoutthepermissionoftheHead,discloses,otherwisethaninthedischargeofhisorherofficialduties,informationgainedbyorconveyedtohimorherasaresultofhisorheremploymentintheService,orusessuchinformationforanypurposeotherthanforthedischargeofhisorherofficialduties,whetherornotheorshedisclosessuchinformation;or

(ak) without thepermissionof theHead,discloses,otherwise than in thedischargeofhisorherofficialduties,removesorcopiesanyinformationfromanydocumentorrecordoftheServiceortheCouncil;or

(al) acceptsordemandsinreturnforthecarryingoutoforthefailuretocarryouthisorherdutiesanygratificationtowhichheorsheisnotentitledbyvirtueofhisorheroffice,orfailstoreportimmediatelytohisorhersupervisortheofferofanysuchgratification,commission,feeorreward;

(am) isundertheinfluenceofintoxicatingliquororstupefyingdrugswhileheorsheisonduty,and“onduty”includesanyperiodduringwhichthememberhasbeenplacedonstandbydutyunderregulation30;

(an) uses intoxicating liquoror stupefyingdrugsonduty, and“onduty” includesanyperiodduringwhichthememberhasbeenplacedonstandbydutyunderregulation30;

(ao) usesintoxicatingliquorexcessivelyorusesstupefyingdrugswithoutaprescriptionfromamedicalpractitioner;

(ap) whileondutyandinuniform,entersanyroomorplacebeingusedforthemanufacture,storage,saleorsupplyofintoxicatingliquor,exceptintheperformanceofhisorherduties;

(aq) placeshimselforherselfunderanobligationtoanydealerinintoxicatingliquororanybarmanorotherpersonintheemployofanysuchdealerorbarmanwheresuchobligationislikelytohamperhimorherintheproperdischargeofhisorherduties;

(ar) holdssharesorinterestinabusinessorclosecorporationoranunlistedcompany,themainobjectofwhichisthemanufactureorsupplyofortradinginintoxicatingliquor;

(as) demands,solicits,receivesoracceptsanydiscount,commission,gift,fee,rewardorotherconsiderationoradvantage,whetherpecuniaryorotherwise(excepthisorherofficialremuneration),inrespectoftheacquisition,purchase,saleordisposalofanysupplies,arms,ammunition,accessories,transport,animalsandotherequipmentoranyotherrequisitesofwhatevernature,requiredforusein,orbeingthepropertyoftheServiceoroftheCouncil,acanteen,messoranyotherinstitutionoftheServiceorintheCouncil’sbusiness;

(i) property issuedtohimorheror toanothermemberatpublicexpenseforpersonaluseintheexecutionofhisorherorsuchothermember’sfunctions;

(ii) propertyinpossessionorunderthecontroloftheCouncilorforwhichtheCouncilisresponsible;

(iii) anypropertybelonging to anothermember, a canteen,messor anyotherinstitutionoftheService,aprisonerorotherpersonincustody;or

(iv) any exhibit in a criminal case, or property abandoned, lost or unclaimedand found or taken into safekeeping by amember or being in his or herpossession;

(au) subjecttoregulation52(2)whileonduty,knowinglyanddeliberatelyinpublicwears,exhibitsorusesanybadge,emblem,standard,colours,salute,greeting,distinctivegestureordeviceofanykindwhichassociateshimorherwithanypoliticalpartyoranymovement,organization,bodyorassociationhavingpoliticalobjects;

(av) subjecttosubregulation(2)ofregulation52takesanactivepartinpartisanparty-politicalmattersorassociateshimselforherselfwiththepoliticalactivities,objectsormattersofapoliticalparty,movement,organization,bodyorassociationreferredtoinsubregulation(1)ofthatregulation;

(aw) inanywayactivelyandpubliclypromotes thecandidatureofacandidate for,orhimself or herself becomes or agrees to become a candidate in elections for theNationalAssembly,anyRegionalCouncilestablishedundersection2oftheRegionalCouncilsAct,1992(ActNo.22of1992),anylocalauthoritycouncilforanylocalauthorityestablishedundersection3oftheLocalAuthoritiesAct,oraschoolboard,beyondrecordinghisorhervoteorcarryingouthisorher functionsandofficialdutiesinconnectionwithanelection;

(ax) participates in the establishment of, or establishes, a trade union or becomes amemberofatradeunion;

(ay) takespartinorassociateswiththeactivities,objectsormattersofatradeunion;

(az) whilst on duty, knowingly and deliberately wears, exhibits or uses any badge,emblem,standard,colours,salute,greeting,distinctivegestureordeviceofanykindwhichassociateshimorherwithsuchtradeunion;

(ba) attemptstosecureinterventionfrompoliticaloroutsidesourcesinrelationtohisorherownorapositionforanothermemberorconditionsofemploymentorfunctionsintheServiceortheCouncil,butthisparagraphmaynotbeconstruedasprohibitingamemberfromapproachingtheofficeoftheOmbudsmanoraCourtoflaw;

(bb) with intent to deceive or prejudice any person, suppresses, conceals, withholds,defaces, alters,destroysordoesaway,whetherwhollyorpartly,withany report,return,register,book,record,form,claim,letteroranyotherdocumentinrelationtotheServiceortheCouncilwhetheritrelatestohisorherfunctionsanddutiesornot,orobliteratesanythingthereinormakes,causesorallowstobemadeorconnivesat

(bd) afterhavingbeendulyordered tobepresent at a specified timeandplaceas theaccused,defendantorwitnessatdisciplinaryproceedingsoraboardofinquiryoranyotherinquiryundertheseregulations,theActortheLocalAuthoritiesAct-

(i) failswithoutjustcausetoappearatthetimeandplacespecified;

(ii) if he or she is present, refuses to take anoath or tomake an affirmationadministeredtohimorherorrefusesorfailstoanswerallquestionswhichhavelawfullybeenputtohimorher;

(iii) refusesorfailstoproduceadocumentorthingwhichheorshehaslawfullybeenrequiredtoproduce;

(iv) havingbeendulysworninorhavingmadeasolemnaffirmationgivesafalseanswertoanyquestionputtohimorherknowingsuchanswertobefalseisliabletothepenaltythatmaybeimposedforperjury;

(v) makingafalsestatementknowingsuchstatementtobefalseisliabletothepenaltythatmaybeimposedforperjury;

(be) performs,causesorpermitstobeperformedorconnivesat,anyactprejudicialtotheadministration,disciplineorefficiencyoftheServiceortheoperationoftheCouncil;

(bf) whileonduty,on thegroundsofanotherperson’scolour,sexualorientationrace,nationalityorethnicornationalorigin,willfullydiscriminatesagainstsuchpersonortreatssuchpersonimproperly;

(bg) who in a court of law is convicted of a criminal offence forwhich he or she issentencedtoimprisonmentwithouttheoptionofafine;

(bh) damagesorlosesafire-armunderhisofhercontrolorallowsanunauthorisedpersontohandleorgainpossessionof suchfire-arm;

(bi) hasanattitudeofinsolence,orlowproductivity,poorworkperformanceorisunable,despitereasonabletrainingandwarnings,tomateriallyadaptto,orcomplywiththeoperationalguidelinesortheperformancestandardsoftheService;

(bj) contravening the provisions of section 5 of the Labour Act in that he or shediscriminates in employment or performs sexual harassment as defined in thatsection;

(bk) promotesorholdsanyinterest(whetherhisorherownoranyotherpersons)whichseriouslyconflictwiththatoftheCouncilor,thatoftheService;

(bl) representsanyotherpersonatanytribunalinproceedingstowhichtheCouncilisapartywhetheragainsttheCouncilorotherwise,including,conciliation,arbitrationandanycourtproceedings.

(bo) hasbeenappointedasanauthorizedofficerandwhocontravenesanyprovisionofregulation9(2)of theRoadTrafficandTransportRegulationspromulgatedunderGovernmentNoticeNo.53of30March2001;

(bp) owns,orhasadirectorindirectinterestin,ashebeen,taxiortow-inservice;

(bq) failstosigninwhencomingondutyorfailstosignoffwhengoingofduty;

(br) conceals from, or fails tomake known to, his or her supervisor of any possiblemisconductbyanothermemberorstaffmember;or

(bs) fails,neglectsorrefusestotimeouslychargeanothermemberwithmisconductasrequiredbyregulation20,

commitsanactofmisconductandisliabletoapenaltycontemplatedinregulation9or20.

(2) Despiteanyprovisiontothecontraryintheseregulations,notimelimitsimposedwithinwhichtochargeamemberwithmisconductmayoperateagainsttheCouncilwherethepersonresponsibletoinstitutesuchdisciplinaryinquiryfails,neglectsorrefusestodosotimeously.

Grievances

56. (1) Amemberwhohasagrievancemayreducehisorhergrievancetowritingin,asnearaspossible,theformatofForm2inAnnexure6andifthememberis-

(a) notanOfficer,heorshemusthandtheGrievanceFormtohisorherunitcommander,who-

(i) discussthegrievancewiththeaggrievedmemberassoonaspossible,butnotlaterthansevenworkingdaysafterthereceiptofthegrievance;

(ii) ifatthecloseofthediscussionfindsthatthereis-

(aa) nogrievance,mustinformthememberofhisorherconclusionandthereasonthereof;

(ab) avalidgrievance,musttryandresolvethegrievanceasfarasitiswithinhisorherpowerstodosoandinformthememberofthestepsthatheorsheintendstotaketosolvethegrievance;

(ac) a valid grievance, but it is outside his or her powers to solve thegrievance,mustinformthememberofhisorherconclusionandthereasons thereforeandforward thegrievancewithinsevenworkingdaystotheHeadforasolution.

(b) anOfficer,heorshemusthandtheGrievanceFormtotheHeadwho-

(i) mustdiscussthegrievancewiththeaggrievedmemberassoonaspossible,butnotlaterthansevenworkingdaysafterthereceiptofthegrievance;and

(ii) ifatthecloseofthediscussionfindsthatthereis-

(ac) avalidgrievance,but it isoutsidehisorherpowers tosolve thegrievance,must inform thememberofhisorher conclusionandthe reasons therefore and forward the grievance within sevenworkingdays to the section responsible for internal investigationfor recording and processing purposes and refer it to the ChiefExecutiveOfficertotryandsolvethegrievance;

(c) theHead,heorshemusthandittotheChiefExecutiveOfficerwho-

(i) mustdiscussthegrievancewiththeHeadassoonaspossible,butnotlaterthansevenworkingdaysafterthereceiptofthegrievance;and

(ii) ifatthecloseofthediscussionfindsthatthereis-

(aa) nogrievance,mustinformthememberofhisorherconclusionandthereasonthereof;

(bb) avalidgrievance,must try and resolve thegrievance as far as itiswithinhisorherpowerstodosoandinformthememberofthestepsthatheorsheintendstotaketosolvethegrievance;

(ac) avalidgrievance,but it isoutsidehisorherpowers tosolve thegrievance,mustinformthememberofhisorherconclusionandthereasonsthereforeandforwardthegrievancewithinsevenworkingdaystothesectionresponsibleforinternalinvestigationforrecordingandprocessingpurposesandsubmissiontotheCommitteereferredtoinsubregulation(2)hereoftofindasolution.

(2) If thegrievanceof themember insubregulation(1)(a), (b)or(c) isnotsolvedattheleveloftheHeadortheChiefExecutiveOfficer,respectively,theChiefExecutiveOfficermustestablishacommitteeconsistingofthreemembersoftheServiceAdvisoryCommitteereferredtoinregulation3toinvestigatethegrievanceandfindasolution.

(3) Uponthecompletionoftheinvestigation,theCommitteemustmakerecommendationstotheChiefExecutiveOfficerorHeadforconsiderationandimplementation.

(4) AnaggrievedmemberwhoisdissatisfiedwiththeoutcomeofthegrievancemaynotehisorherdissatisfactionagainsttheresultoftheconsiderationofhisorhergrievanceintheformofForm4inAnnexure6,andrequestthereconsiderationofhisorhergrievance.

Conduct sheet

57. (1) TheCouncilmustmaintain a conduct sheet in respect of everymemberinwhichallconvictionsformisconduct,unlesstheChiefExecutiveOfficeringeneraldeterminesotherwise,mustberecorded.

(2) If,foraperiodofthreeyearssincethedatethelastconvictionwasrecordedonamember’sconductsheetnofurtherconvictionisrecordedthereon,allentriesmustbedeleted,subjecttosubregulation(3).

(3) Anentryinconnectionwithaconvictioninrespectofwhichthesentenceorpartthereofhasbeensuspendedmustbedeletedassoonasalltheconditionsofsuchsuspensionhavebeencompliedwith.

(4) Despitesubregulation(2)aconvictionwhichhasalreadybeendeletedmaybetakeninto account if the present charge ofmisconduct and the deleted convictions relates to repeatedmisconductofthesame,orasimilar,natureovertime.

PART7

LEGALAID:CRIMINALANDCIVILCASES

Legal aid in criminal cases

58. (1) Ifamember, in thecourseofhisorherduty,commitsanactoromits todoanact and thecommissionoromissionamounts to a criminaloffence forwhich thememberis prosecuted, the Chief Executive Officer, subject to subregulation (2), must arrange a legalrepresentationforthememberatthecostoftheCouncil.

(2) Amemberreferredtoinsubregulation(1)-

(a) assoonaspossibleafterhisorherarrestorreceiptofsummons,throughtheHeadorDeputyHeadorSeniorSuperintendent,mustinformtheChiefExecutiveOfficerinwritingofthearrestandthechargeorsummonsandthedateofappearanceincourt;

(b) subjecttosubregulation(6),remainspersonallyliableforanypenaltythatthecourtmayimposeonhimorherasaresultofaconviction;

(c) ifheorsheelectstobelegallyrepresentedbyalegalpractitionerotherthanthelegalpractitioneroftheCouncil,hisorherlegalcostsmaynotbecoveredbytheCouncil;and

(d) exceptwiththewrittenpermissionoftheCouncil’slegalpractitioner,maynotmakeanyacknowledgementofguiltinrespectofanycommissionoromission.

(3) TheChiefExecutiveOfficer,aftertheconclusionofthetrialofamemberreferredtoinsubregulation(1),mustprepareareportwhichcoversthecauseoftheprosecutionandthefindingsofthetrialcourtandsubmitthatreporttothemanagementcommittee.

(4) Themember referred to in subregulation (1), has the right of access to a reportreferredtoinsubregulation(3)beforethereportissubmittedtotheManagementCommittee.

(5) Ifthereportreferredtoinsubregulation(3)revealsthatthememberknowinglyornegligentlyexceededhisorherauthorityorthescopeofhisorherduty,orwasundertheinfluenceof alcoholor drugs at the timeof the commissionoromissionof the actwhichgave rise to theprosecution, themember,must refund theCouncil the amount of such costs, if theCouncil hascoveredhisorherlegalcosts.

(6) Ifamemberisconvictedofacriminaloffenceasreferredtoinsubregulation(1),theCouncil,afterconsideringthereportreferredtoinsubregulation(3),mayinitsdiscretionpay,whollyorinpartornotatall,anyfineimposedonthememberasaresultoftheconviction.

(2) Amemberreferredtoin subregulation(1)-

(a) maynotadmitliability,offerorpromiseanypayment,offerorpromiseindemnityinrespectofthecommissionoromissionoftheact,exceptwiththewrittenpermissionofthelegalpractitioneroftheCouncil;

(b) mustinwritinginformtheHeadofthecommissionoromissionoftheactassoonaspossibleafterthedateofthecommissionoromissionoftheact,orthedateonwhichthesummonsisservedonhimorher;and

(c) must furnish the Chief Executive Officer with all information in respect of thecommissionoromissionoftheactasaccuratelyaspossible.

(3) IftheChiefExecutiveOfficerisreasonablysatisfiedorthereisevidencetoprovethat thememberreferredtoinsubregulation(1)knowinglyexceededhisorherscopeofduty,orwasatthetimeofthecommissionoromissionoftheactundertheinfluenceofalcoholordrugs,theChiefExecutiveOfficer,afterhavingheardrepresentationsfromthemember,mayrefusetorenderanylegalassistancetothatmemberandmaydenyanyresponsibility.

(4) If amember, in the courseof his or her duty, suffers any injuryor damage as aresultoftheactionoromissionofanotherperson,theChiefExecutiveOfficermayarrangeforthatmembertobelegallyrepresentedbythelegalpractitioneroftheCouncilatthecostoftheCouncil,ifthememberwishestoinstituteacivilclaimfordamagesorinjurysuffered,butifthememberissuccessfulinhisorherclaimandthememberhasbeenawardedcosts,heorshemustreimbursetheCounciltherecoveredcostoflegalrepresentation.

(5) IfamembertendershisorherletterofresignationorisinprocessofbeingdismissedfromtheServicebytheCouncilbeforethefinalisationofapendingcourtcase,theCouncilmaystoppaymentofanyfurtherlegalcost.

Non-application of regulations 58 and 59

60. Regulations58and59donotapply-

(a) ifthecommissionoromissionofanactbyamembergivingrisetoacriminalchargeamountstodrivingavehicleundertheinfluenceofalcoholorintoxicatingdrugsandsuchdrivingresultsinanaccidentorcausesotherdamage;or

(b) iftheStateorCouncilinstitutescriminalproceedingsoracivilclaimordisciplinaryactionagainstamemberasaresultofacommissionoromissionofanactreferredtoinregulation58(1)or59(1).

GENERALPROVISIONS

Limitation of liabilities and legal proceedings

61. (1) Amemberisnotpersonallyliableforanydamageorinjurycausedtoanypersonbysuchmemberasaresultofanyactdoneoromittedtobedoneingoodfaithundertheseregulations, unless suchdamageor injury is due to thenegligenceof suchmemberor failure tocomplywiththeAct,theRegulationsortheseregulations,orwillfulactoromission.

(2) LegalproceedingsinrespectofanyallegedactperformedunderorintermsoftheAct,RegulationsortheseregulationsoranyotherlaworanallegedfailuretodoanythingwhichshouldhavebeendoneintermsorundertheAct,theRegulations,theseregulationsoranyotherlawbyamembermustbeinstitutedagainsttheCouncil,subjecttotheLimitationofLegalProceedings(ProvincialandLocalAuthorities)Act,1970(ActNo.94of1970).

Estimates

62. (1) The Head, in respect of each financial year, must cause to be preparedandsubmitoperatingandcapitalestimatesof incomeandexpenditure to theCouncil thatshows,separately,theamountsthatisrequired-

(a) tomaintaintheServiceandprovideitwithequipmentandfacilities;and

(b) topaytheoperationsexpensesoftheService.

(2) TheformatoftheestimatesandthetimetableforthesubmissionoftheestimatesmustbeasdeterminedbytheCouncil.

(3) Whenreviewingtheestimatessubmittedundersubregulation(1),theCouncilmustestablishanoverallbudgetfortheServiceforthepurposesreferredtoinsubregulation(1).

Prohibition on certain dealings

63. Amembermaynot lend to another person anymeansof transport or equipmentwhichthememberisrequiredtokeepandpossesintheperformanceofhisorherduties,withoutthepermissionofthepersonunderwhosecommandthememberserves.

Missing members

64. (1) If amember ismissing and theChief ExecutiveOfficer is satisfied thathisorherabsencearoseduringorfromtheperformanceofhisorherdutiesandfunctionsintermsoftheseregulations,suchmemberis,forallpurposes,deemedtobestillintheemploymentoftheServicefromthedayon whichsuchabsencecommenceduntilthedayon which-

(a) heorsheagainreportsforduty;

(b) in the reasonable opinion of theChief ExecutiveOfficer, he or she should havereportedforduty;or

(c) acompetentcourtissuedanorderwherebythedeathofsuchmemberispresumed.

(2) Subjecttosubregulation(4),thewagesandallowancesandanyseverancepaymentbecomingpayableastheresultofanorderreferredtoinsubregulation(1)(c)accruingtoamemberduringhisorherabsencecontemplatedinsubregulation(1)mustbepaid-

(a) tohisorherspouse;

(b) ifheorshehasnospouse,tohisorherotherdependents;or

(c) toanypersonwho,intheopinionoftheChiefExecutiveOfficer,iscompetenttoreceiveandadministersuchwagesandallowancesonbehalfofthespouseorsuchotherdependents.

(3) Payment of any wages and allowances in terms of subregulation (2) is, for allpurposesdeemed tobepayment thereof to thememberconcerned,andanamountsopaid isnotrecoverablebytheCouncilfromanyperson.

(4) Despitesubregulation(2),theChiefExecutiveOfficermaydirectthatonlyaportionof thewagesandallowancesofamembermaybepaid in termsof thatsubregulation,or thatnoportionthereofmaybesopaid.

Access to Namibian Police facilities

65. (1) TheServiceoramembermayuseafacilityoftheNamibianPolicefor-

(a) thedetentionofsuspectedcriminals;

(b) the keeping of exhibits, found properties and other items confiscated pendinginvestigationsoracourtcase;

(c) anymatterwhichmaybeagreedtobytheCouncilandtheNamibianPolice.

(2) AmembermayhaveaccesstotheregistersandrecordsoftheNamibianPoliceforrecordingpurposestoanextentagreedbetweentheCouncilandtheNamibianPolice.

Reward for extraordinary diligence or devotion

66. TheChiefExecutiveOfficer,withtheapprovaloftheCouncil,mayhonourorawardtoanypersonwhoisorwasamember,forextraordinarydiligenceordevotionintheperformanceofhisorherdutiesassuchmember,suchhonour,monetaryorotherrewardasheorsheconsidersappropriateunderthecircumstances.

Establishment of decorations and medals for members

67. TheCouncil,ontherecommendationoftheHeadunderthedirectivesoftheChiefExecutiveOfficer,mayestablishandintroduceawards(includingaposthumousaward),decorationsandmedals,aswellasbars,claspsandribbonsinrespectofsuchawards,decorationsandmedals,whichmaybeawardedbytheCouncil,subjecttosuchconditionsastheCouncilmaydetermine,to-

(a) anypersonwhoisorwasamemberinrespectofhisorherservicesassuchmember;or

(b) anypersonwhohasrenderedexceptionalservicestotheService.
