DETAILED TENDER NOTICE
GODAVARI MARATHWADA IRRIGATION
DEVELOPMENT CORPORATION AURANGABAD
INVITATION:
Online tenders are invited from registered firms/ contractors or
individuals having experience in the field of operation, maintenance,
development and management of Gardens, amusement parks, water
parks, land scaping hotel and tourism etc., for the work of operation,
maintenance development and management of Sant Dnyaneshwar
Udyan Complex, Paithan, details of which are as per Annexure 'A'.
GENERAL INFORMATION
The function and powers of the Corporation have been listed in
the Maharashtra Act XXIII of 1998. In general it has been entrusted with
the work of investigation planning, designing of Irrigation Projects,
maintenance of completed Irrigation Projects, and construction of
Irrigation Projects and Irrigation Management of the Major. Medium and
Minor Projects in the Godavari River Basin.
DEFINATION AND INTERPRETATIONS:
In this tender document the following terms shall have the
meaning here by assigned to them except where the context otherwise
required.

a)
"Corporation" shall mean the GODAVARI MARATHWADA
IRRIGATION DEVELOPMENT CORPORATION, AURANGABAD
acting through its Executive Director, as defined in Maharashtra
Act XXIII of 1998.
GODAVARI MARATHWADA IRRIGATION DEVELOPMENT
CORPORATION, AURANGABAD is
a body corporate constituted under the Maharashtra
Act XXIII of 1998 and has been established by the
notification published in the Gazette of Irrigation Department
dated 17.08.1998. The head quarter of the
GODAVARI MARATHWADA IRRIGATION DEVELOPMENT
CORPORATION, AURANGABAD (GMIDC Aurangabad or
GMIDC in short, and here after referred to only as Corporation)
is at Aurangabad. The official postal address for correspondence
is:

Administrator CAD, Irrigation Department,
Aurangabad.

"Superintending Engineer" shall mean Superintending
Engineer, Jayakwadi Project Circle, Aurangabad, to
whom Superintendence of the work is assigned by
GODAVARI MARATHWADA IRRIGATION
DEVELOPMENT CORPORATION, AURANGABAD.
e)
"Engineer / Engineer-ln-Charge" shall mean, the Executive
Engineer, Lower Dudhana, Project Division, Sailu. In
charge of works duly authorised by GMIDC,
Aurangabad.
f)
"Engineer's Representative" shall mean the sub-Divisional
Engineer / Assistant Executive Engineer / Sub- Divisional
Officer / Assistant Engineer (Grade-I), who has been
assigned specific duties.
g) Contractor shall mean the person, firm or company who
enters into contract, with the Corporation and • shall
include their executors, Administrator's successors and
authorized assignees.
h) "Contract" shall mean and include agreement as below.

Eligibility: Online tender will be issued only to those firms / Contractors
who would pre-qualify for tendering the above said work. Details of
Work: Details of work to be executed, EMD, class of contractor,
agreement period and other information is given in Annexure 'A'.
Information regarding the work for which the tenders are invited as well
as online tender forms can be obtained from the site of
ISSUE OF BLANK TENDER FORMS:
http://gmidc.maharashtra.etenders.in. Online tender forms shall be
issued to those contractors who are eligible as explained in para 2
above. online tender forms can be downloaded by web site of
http://gmidc.maharashtra.etenders.in.
PRE-TENDER CONFERENCE:
1) Pre-tender conference open to pre-qualified tenderers will be held
in the office as stated in Annexure 'A of this section wherein the
prospective tenderers will have an opportunity to obtain
clarifications regarding the work and the tender conditions.
2) The prospective tenderers are free to ask any additional
clarifications either in writing or orally and the reply to the same
will be given by the Superintending Engineer in writing and these
clarification referred to as common set of conditions shall form
part of tender documents and which will also be common and
applicable to all tenderers.

3) The tender submitted by the tenderer shall be based on the
clarification, additional facility provided (if any) by the Corporation
and this tender shall be unconditional. Conditional tenders will be
summarily rejected as non-responsive.
4) All tenderers are cautioned that the tenders containing any
deviation from the contractual terms and conditions, specification
or other requirements and conditional tenders will be rejected as
non- responsive.
REVISION OR AMENDMENTS OF TENDER DOCUMENTS
Right is reserved to revise or amend the tender documents prior
to last date notified for the issue of tenders and such revisions of
amendments’ or extensions shall be communicated to all concerned by
post and by notice in the press as may be considered suitable.
Tenderer shall be presumed to have carefully examined ail
documents, forms, statements, conditions, schedules, drawing and
specifications of contract and to have fully acquainted himself with ail
details of the site, river and weather characteristics and Labour
conditions in general and with all the necessary information and data
etc. pertaining to and needed for the work prior to tendering of the work.

1.0 MANNER OF SUBMISSION OF TENDER AND its ACCOMPANIMENTS:
Tender is to be submitted on line in two separate sealed
envelopes. The tenderer shall submit the tender and documents in two
sealed envelopes as below.
a) ON LINE ENVELOPE NO.1 (T1) :-
I) Attach scan copy of Earnest Money Deposit (EMD) in the
form of Demand Draft of a nationalized / scheduled bank
situated in he state of Maharashtra payables to the
Executive Engineer as stated in Annexure 'A' of this section
shall be enclosed. Certificate of exemption for payment of
earnest money, shall not be accepted.
II) An income Tax Clearance Certificate from Income Tax
Officer of the Circle. (Original or true copy thereof duly
attested by Gazetted officer) valid oh the date fixed for the
receipt of tender
III) Sales Tax Registration Certificate in Form II Rule 4(l).
as provided by Maharashtra State Govt. Sales Tax Act.
(Maharashtra Act No. XXXVI of 1989). The MST on transfer
of property in goods involved in the execution of works
contract. (Reenacted) Act 1989) from Sales Tax
Department.
IV) Deed of partnership or Article of Association and
Memorandum of Association for Limited Company duly
registered.

V) Tender has to submit a note covering details of his future
developments such as amusement / water / boating parks
or other developments for beautification of garden
including execution program of such developments.
VI) Details of technical personnel with the tenderer.
VII) Details of similar type of works and magnitude carried out
by the tenderer.
VIII) Details of other works tendered for and in hand with
tenderer and value of work in hand.
IX) Professional tax clearance certificate.
X) Attach scan copy of Main tender Fee D.D.
All documents required to be submitted in Envelope No.1 shall be
attested by gazetted officer and if required original copies shall be kept
ready at the time of opening of tender.
ON LINE ENVELOPE NO.2 (C1): -
The second envelope should be submitted online with .main
tender including the common set of' conditions / stipulations, if any,
issued by the Corporation after the pre-tender conference.
The tenderer should quote his offer yearly for 10 years
in this tender. He should not quote His offer any

Where directly or indirectly in Envelope No.1 failing which the Envelope
No.2 shall not be opened and his tender shall stand rejected. The
contractor shall quote for the work as per details given in the main
tender and also based on the common set of conditions
issued/additional stipulations made by the Corporation as informed to
him by a letter from the Superintending Engineer as given in Annexure
'A' of this section after pre-tender conference. This tender shall be
unconditional.
C) SUBMISSION OF ONLINE TENDER:-
Contracors must prepare complete offer during Bid preparation
stage .once the Bid preparation time is over , online system will
not allow to do any change in offer.
All contractors must submit their offer as per online schedule.
Contractors who will complete the download and online Bid Preparation
stage only those contractors will be able to submit their offer.
8 OPENING OF TENDERS:-
On the date specified in the tender notice, following procedure will
be adopted for opening tender.
Envelope No.1:-
First of all, Envelope No.1 of the tenderer will be opened to verify
its contents as per requirements as stated at Sr.No. 7 (a) above
of this section. If the various documents contained in this
envelope do not meet the requirement, a note will be recorded
accordingly by the tender opening authority and the said
tenderer's Envelope No.2 will not be considered for further action
by the same will be recorded. Decision of the tender opening
authority shall be final in this regard.

Envelope No.2:-
This envelope shall be opened immediately after opening of
Envelope No.1 only if the contents of Envelope No.1 are found to
be acceptable to the Corporation. The tender offer shall then be
read out.
9) INSTRUCTION FOR SUBMISSION OF ENVELOP NO.1:-
Documents to be submitted in Envelop No.1 shall confirm to the
instructions given below.
9.1.0 EARNEST MONEY DEPOSIT: - . .
9.1.1 Earnest money of Rs.3.00 Lakhs along with the tender shall be in
the shape of D.D. for a period of one year issued by nationalized /
Scheduled Bank branches situated in State of Maharashtra in
favour of Executive Engineer, Lower Dudhana Project Division,
Sailu.
9.1.3
9.1.2 Exemption certificate will not be accepted
Tenders of those who do not deposit earnest money in one of the
above acceptable forms shall be summarily rejected.
9.1.4 The earnest money deposit amount shall not carry any interest
whatsoever. The earnest money will be refunded in the case of
tenderer whose tenders are not accepted, only after completion
of all formalities in respect of the accepted tender or in case of
expiry of validity of offer, when specially withdrawn by the

tenderer. In case of the successful tenderer, it will be refunded
on his paying the security deposit and completing the Contract
documents or will be transferred towards a part of security deposit
to be paid after awarding of the work. If the successful tenderer
does not pay the security deposit in the prescribed time limit and
complete the agreement bond, his earnest money will be forfeited
to Corporation.
9.2.0 SECURITY DEPOSIT:-
9.2.1
The Contractor whose offer has been accepted shall, within
15days of the receipt of letter of acceptance of offer, have to
deposit with the GMIDC, a Security Deposit amount as specified
in para 5 of Annexure-A of this section, in the form of D.D. in
favour of Executive Engineer, Lower Dudhana Project Division,
Sailu for 10 years period plus six months.
9.2.2 The earnest money deposited by the contractor with his tender
will be retained by the Corporation as the part of
security deposit,
if tenderer requests in writing to that effect. The balance to make
up this security deposit may, unless otherwise specified, in the
condition, be deposited by the contractor in the form of D.D. The
GMIDC shall not pay any interest on the amount of security
deposit paid by the tenderer.
10) INSTRUCTIONS FOR SUBMISSION OF ENVELOPE NO.2 :

Documents to be submitted in envelope No.2 shall confirm to the
instructions given below.
10.1
The tenderer shall be deemed to have fully acquainted himself
with the nature of work and site conditions.
CONTRACTOR TO INFORM HIMSELF FULLY :-
10.2
Conditional tender will be summarily rejected.
CONDITIONAL TENDER :-
10.3
Tenderer should quote his offer to be paid to Corporation as
yearly contract amount after taking into consideration all the
information given in para No.3 of Annexure-A of this tender. He
should quote his offer in the agreement form, in section
TENDERED OFFER :-
-V only at
appropriate place, both in figures as well as in words in English.
Envelope No.2 shall contain only those documents as mentioned
in para 7 (b) above.
11) CORRECTIONS:-
No Corrections should ordinarily be made in the tender
documents. However, any corrections in the entries
made by the tenderer should be by crossing the incorrect portion and
writing the corrected portion above and each correction shall bear the
attestation of the tenderer.
12) SIGNING OF TENDER DOCUMENTS:-

The tender shall contain the name, residence and place of
business of person or persons making the tender and each page
of tender document including drawings, shall be assigned by the
tenderer with his full, dated signature.
The tender by partnership firm shall furnish the full names of all
the partners in the forwarding letter. The letter shall be signed by
the partner or by an authorised representative followed by the
name and designation of the person signing.
An attested copy of the partnership deed shall be furnished.
Tender by company, shall be signed with the legal name of the
company and signed by the person authorised to sign in the
matter.
Whenever in the submission of the tender in other matters, the
signature are made by one person on behalf of the company the
tenderer shall supply an attested copy of the power of attorney.
Witness shall be persons of status and probity and their names,
occupations and addresses shall be stated, below their
signatures. All signatures shall be dated.

The tender is also liable to be rejected outright if while submitting,

The tenderer proposed any alteration in the work specified in the
tender or in the time allowed for carrying out the work / in any
other conditions.
Any of the pages of tender are removed and / or replaced.

III)
Any erasures are made by the tenderer in the tender.
IV)
All corrections and additions or pasted slips are not signed
by the tenderer and Tender in case of firm, each partner, or
the person holding the power of attorney, authorizing him to
do so thereof, does not sign or the signature is not attested
by the witness in agreement form in Section-ll at the space
provided for the purpose.
13) ACCEPTANCE OF TENDER:-
Acceptance of tender will rest with the authority, as indicated in
Annexure A' of this section, who reserves the right to reject any or
all tenders without assigning any reasons. The acceptance of
tender will be intimated to the contractor by letter. Such intimation
shall be deemed to be an intimation of acceptance of tender: The
tenderer whose tender is accepted will have to complete the
contract form within 15 days of being notified to" do so and shall
be abide by all the rules and regulations and conditions
enumerated therein or attached here with. In the event of failure

of the tenderer to sign the agreement within the stipulated time,
the earnest money paid by him shall be liable to be forfeited to
Corporation and the acceptance of the tender shall be liable to be
considered as withdrawn. In that event the work will be awarded
to next or any other contractor, to whom the Corporation deems
to be suitable.
14) VALIDITY PERIOD:-
The offer shall remain valid for a period of 90 (Ninety) days from
the date of opening of tender and therefore until it is withdrawn by
notice in writing by the tenderer, duly addressed to the authority
as stated in Annexure 'A' of this section and sent by R.P.A.D. If
the acceptance of tender is not communicated within 90 days or
before and if the offer is withdrawn by the contractor as
mentioned above earnest money paid in such case shall be
refunded in full.
15) COMPLETION OF TENDER DOCUMENTS:-
While completing tender documents, the contractor must
invariable complete all the formalities included in the tender
documents giving correct information. However,-this information
shall have to be submitted by 'the contractor in the prescribed
formats separately in Envelop No.1 as per provision' of paragraph
7 of the detailed tender notice.

16) LANGUAGE:-
The language of all correspondence regarding this work shall be
English only.
17) LICENCE UNDER CONTRACT LABOUR REGULATION
AND ABOLITION) ACT 1970.
The successful tenderer should produce to the satisfaction of the
competent authority accepting the tender a valid and current
license issued in his favour under the provisions of contract
labour (Regulation and Abolition) Act. 1970. Maharashtra
Contract Labour (R & A) Rule 1971, before signing the contract.
On failure to do so the acceptance of the tenderer will be
withdrawn and also the earnest money will be forfeited to
Corporation. The contractor shall submit the certified copy of
registration certificate under E.S.I.S. and P.F. act.

Sant Dnyaneshwar Udyan has been developed on the down

a) Formal Garden: Formal garden spread over in 28.00 ha of
area;
comprises of different types of flower beds
developed in six terraces with beautiful layout with
various types of lawn, hedges, edges, water pools,
channels, and internal paths. In addition to various
shaped fountains, .waterfalls, cascades. This park also
includes musical fountain, 40 feet high fountain and
Garden area around the statue of Late Shankar Chavan,
which is main attraction to tourists.

b) Informal Garden: Informal garden is developed in 18.00 ha of
area which comprises of varieties of forest trees and Children
Park.

Sacred Garden: Sacred garden is developed in 8.00 ha of area
comprising sacred trees of various types.

Tourists can enter in to Sant Dnyaneshwar Udyan by two
main entrances, provided with beautiful entrance gates.
Both entrances are provided with entry fee collection
booths.

Parking facilities inside the Udyan.
V)
Array type stalls and canteens are provided at various
important locations.
Considering the visitors strength at present three toilets are
provided, out of which one well furnished toilet is provided at gate No.1
and other two toilets are located near terrace No.4 and 6.
e) Dnyaneshwar Dnyanpeeth and Research Institute:
Dnyaneshwar Dnyanpeeth and Research Institute Building is
constructed in sacred garden area, where marble statue of Sant
Dnyaneshwar is installed. This building is also equipped with
architectural features to attract the tourist.

f) Boating Facilities: i) Udyan Complex also includes river portion
between causeways to Nath Mandir Ghat for development of
boating facilities. This river side portion can be utiliased after
studying the fluctuations during generation, pumping activities of
power house, depth of water available for boating facilities.
Revenue from boating facilities is a part and parcel of revenue
from Udyan Complex, ii) Rest houses at Nathnagar (North) also
named as Nath Vishram Griha Situated at seven K.M. from Sant
Dnyaneshwar Udyan.
This Nath Vishram Griha comprises of furnished five VIP suites
with kitchen room, dining hall and waiting room.
I) Contractor has to maintain the existing facilities
provided in Udyan Complex and if necessary he has
to improve the existing facilities at his own cost.
2) SCOPE OF WORK TO BE DONE:-
II) It is essential to develop existing Udyan Complex, as
per development proposal submitted with the tender
with due approval of competent authority with or
without modification if any at his own cost
Competent authority has a right to change / modify
the development proposal submitted with the tender
for such developments he has to give detail program,
with flow of investment and accordingly after
approval to the same by competent authority he has
to start and finish developments as per program at
his own cost. Delay in such investment / committed
developments shall be treated as bad performance

The maintenance works as mentioned in Section - IV
shall be done regularly and in time and as per the
necessity.
IV)
As a part of Udyan Complex, rest house is to be well maintained and if
necessary he can provide additional facilities inside or out side the rest
house at his own cost with approval of competent authority.
3) INFORMATION FOR OFFERING THE CONTRACT:
It is proposed to maintain this garden with existing facilities as
well as proposed to develop amusement park, Water Park and other
attraction to tourists at the cost of Contractor.
At present entrance fees to Udyan, boating facilities and rest
house is the source of income to GMIDC. Contractor can add to this
income from development of amusement park in Children Park or he
can utilize the river source for development of Water Park and renovate
the existing boating facilities at his own cost.
Contractor has to take review of yearly expenditure for
maintenance of existing garden with all existing facilities and also he
has to estimate the expenditure for future scope for development of
Essel world type amusement park, Water Park and new generation
fountains and whatever development he planned for by applying his
creative mind.

He has to consider for total expenditure on i) Regular
maintenance, operation and management of existing Udyan, ii)
Proposed development plan and iii) Maintenance of rest house which is
also included in Udyan Complex.
He has also to estimate future income from entry fees levied to
tourists for various places of interest.
After estimating net revenue from all sources in Udyan Complex,
pre- qualified tenderer is expected to give his offer of yearly contract
amount to be paid to GMIDC in lieu of providing Sant Dnyaneshwar
Udyan Complex with all existing facilities yearly for a 10 years period as
per terms and conditions of contract. This contract offer is to be given
as per Section - V in OFFER FORM.

No.JAY/67/202/T-3 Sachivalaya Mumbai Dt. 27/08/1975 to perpetrate
the memory of Sant Dnyaneshwar on the occasion of his 7th Centenary
celebration decided to build a glorious Sant Dnyaneshwar Udyan,
Paithan at the foot of the Jayakwadi dam. For the purpose of finalizing
arrangements for quick planning and execution of this Scheme the
Government appointed a State level Committee, under the
Chairmanship of Irrigation Minister.
In order to take regular review of the works under the Sant
Dnyaneshwar Udyan, Paithan and to sort out the day to day difficulties
arising during construction and development works and to suggest
appropriate measures to solve these difficulties, a Standing Committee
was formed under the Chairmanship of Divisional Commissioner,
Aurangabad. As per directives of the Standing Committee and as per
the guidance of State Level Committee, development of Sant
Dnyaneshwar Udyan. Paithan has been practically completed. Layout of
Sant Dnyaneshwar Udyan, Paithan is prepared on the basis of famous
Gardens in India. Viz Shalimar, Vrindivan & Pinjor.

from animals and from unauthorized persons. Fabricated steel grills are
embedded in compound wall.
Water supply arrangement is made in Sant Dnyaneshwar Udyan
Complex, Paithan for Formal Garden, Orchard Garden, Water
Channels, fountains, drinking water purpose and for toilet, canteen,
ARREY type stalls and for other purposes. One direct outlet is provided
in the body of the dam for the entire water supply form the outlet. For
future distribution 29 cm. dia. 300 meter long A.C. Pipe line is provided
in different parts of Sant Dnyaneshwar Udyan along with controls.
1.1.11 TREATMENT OF EXISTING NALA:
For drinking water facility to tourists, 2 water fountains are constructed.
As per the requirement and necessity the No. of water fountains shall
have to be increased.
Specific plants are to be planted on the bank- and the slope of the Nala
flowing in the Sant Dnyaneshwar Udyan Complex, Paithan to increase
the beauty of the Sant Dnyaneshwar Udyan, Paithan.

1.1.19 CONSTRUCTION OF DNYANESHWAR DNYANPITH
RESEARCH INSTITUTE :
Approach road is also constructed, with an R.C.C. Bridge on the Nala,
flowing the west side of Sant Dnyaneshwar Udyan, Paithan for
approaching the Sant Dnyaneshwar Dyanpith Research Institute
building.
Sant Dnyaneshwar Dnyanpith Research Institute building is constructed
in the Sant Dnyaneshwar Udyan, Paithan area where in a marble stone
statue of Sant Dnyaneshwar is installed. Behind this marble statue
stained glass mural is fixed. Life sketches of Sant Dnyaneshwar in fiber
glass are displayed on both sides along the passage
of main structure.

Lawns provided in 4 corners of this building shall always be kept
in good condition. Timely cutting by lawn mower machine and
necessary watering of said lawn should be done.
v)
The entire structure and especially the flooring, also the premises
should be kept clean.
vi)
Flooring and Marble cladding of the main building shall be
cleaned two times a day using suitable detergent and water.
vii)
Care should be taken that there should not be any accumulation
of dust on the cement jalli provided in the main building. These
cement jallis should be cleaned daily.
viii)
Pictures in fiber glass fixed in side the verandah of the main
building should be kept in good condition. The glass frames in
front of pictures are to be cleaned at least two times a day.
Breakages, if any, shall be made good.
ix)
All doors, windows, steel grills of Ihe windows and other wooden
materials should be cleaned two times in a day.
Ail inside roofs should be cleaned daily.
x) Leakages .of the building should be strictly prevented

xvii) MAINTENANCE AND REPAIRS OF THE R.C.C. BRIDGE AND APPROACH ROADS: I) Regular maintenance and repairs of the R.C.C. Bridge should be carriedout.

iii) Care should be taken that no unauthorized person enters into the Sant Dnyaneshwar Udyan Complex, Paithan.
TICKET BOOKING ARRANGEMENT:
i) For ticket booking arrangement adequate staff should be engaged
by the Contractor.
ii) Care should be taken that tourists should purchase ticket in a
disciplined and descent manner without causing any disturbance.
iii) Separate account should be maintained for adult, children and
school trips tourists.

necessary staff should be appointed by the contractor at his own

v) Separate tickets should be issued for the vehicles.

Contractor at his own expenses.
21)
GENERAL PROTECTION ARRANGEMENT:
i) Arrangement for parking the vehicles should be made at both the
Entrance gates of the Sant Dnyaneshwar Udyan Complex.
Paithan, in such a way that there shall not be any disturbance to
the tourists visiting the Sant Dnyaneshwar Udyan Complex,
Paithan.
ii) Entry should be permitted to the small vehicles, medium, type
Vehicles arid tourists through gate No.2 only. All heavy vehicles
should be permitted to enter through No.1 of the Sant
Dnyaneshwar Udyan Complex, Paithan.

the water falls and also to pluck the flowers.

Udyan Complex, Paithan at suitable places for disposal of the
waste materials by the tourists. These dust bins be emptied as
frequently as required.
The tourists shall be prevented from damaging any plants,
electrical provisions and any construction in the Sant

22) GENERAL MAINTENANCE OF SANT DNYANESHWAR
UDYAN COMPLEX, PAITHAN.
Tourists shall not be permitted to linger on in the Sant
Dnyaneshwar Udyan. Paithan. beyond the visiting hours.
i) Sant Dnyaneshwar Udyan Complex, Paithan: Sant Dnyaneshwar
Udyan, Paithan shall be kept in good condition: No trees and
structures and constructions inside -the Sant Dnyaneshwar
Udyan, Paithan shall be damaged in any way. and shall be
maintained properly besides above mentioned works, necessary
works, if requried shall have to be taken up immediately as •
directed. Annual maintenance Programme will have to be
prepared by the Contractor and got approved from the competent
authority.

ii) Maintenance of the Rest Houses during service:

(Furniture, fittings, plantation of species, manure injecting.

The Contractor in consultation with the Engineer shall evolve a
maintenance manual and supply 10 copies to the G.M.I.D.C.to
ensure systematic maintenance of the facility. Periodicity of both
routine special inspections shall be decided and carried out jointly
by the Resident Engineer and the Executive Engineer.
The maintenance and repairs shall also include maintenance and
repairs of electrical and other installations and payment of
Energy bills and water bills.
Vi) Water: It will be the sole responsibility of the Contractor to lay
pipe lines to storage/distribution system at his own cost and pay
all charges as per prevailing rates in force at that time, vii)
Power: Power supply for the Complex during Maintenance and
operation period will be made arranged from M.S.E.B. from
nearest substation by the Contractor himself at his own cost.

2 )
COMMENCEMENT OF CONTRACT, DURATION AND
COMPLETION:
2.0 Handing over of Sant Dnyaneshwar Udyan Complex, Paithan on
Contract will start within 30 days of signing the contract. All the handing
over details will be enlisted at the time of handing over. The contract
shall start from the day on which the handing over process is
completed. Maximum period of handing over will be 10 days including
holidays. No land/buildings other than the specified in the drawing
attached with the agreement will be handed over to the/ contractor.
However period will be decreased or increased w.r.t. provision in the
respective clauses in this tender.
2.1 Request to extend the period for starting the handing over process of
Sant Dnyaneshwar Udyan Complex, Paithan shall exceptionally be
considered on the merit for which the Contractor shall have to make
the requisition in writing with due justification
2.2 The process of handing over of the Sant Dnyaneshwar Udyan
Complex, Paithan back to GMIDC shall be started by the
Contractor 15 days prior to the day on which the contract period ends
and this process shall be completed within 15 days so that Complex
will be handed over on the last date of completion of contract period.
On failure to do so the Sant Dnyaneshwar Udyan Complex. Paithan will
be taken in possession
unilaterally by the

Corporation and shortages, damages if any shall be made good from
the security deposit and Additional security deposit if
necessary, and
the Contractor shall not be entitled for any claim or any compensation
thereof.
2.3. Neither advance nor Loans shall be made available to the Contractor
for the (development works in the Complex by
GMIDC.
2.4. Agreement deed enclosed as Annexure -B in this booklet shall be
signed on bond paper of appropriate value at the cost of tenderer.
3) SECURITY DEPOSIT:
3.1 The Contractor shall maintain properly all features in the Sant
Dnyneshwar Udyan Complex which includes trees, flower beds,
lawns, plants, Buildings, roads, fountain, water channels and other
equipment etc. So as to boost up general beauty of Sant
Dnyneshwar Udyan Complex.
3.2. Security deposit amounting to Rs.15 Lakhs (Rupees Fifteen Lakhs) for
the period of agreement plus six months, will have-to be
deposited by
the Contractor with the GMIDC within 15 days of letter of acceptance of
offer. The Sant Dnyaneshwar Udyan Complex. Paithan will not be
handed over to the Contractor unless this amount is deposited. If any
damage occurs to any of the components as mentioned in para 3.1
above or to the beauty of the Sant Dnyaneshwar Udyan complex
during the contract period, the

Contractor will have to repair the damages by executing the necessary
work to the original form at his own cost. If the contractor fails to do so,
the competent authority will intimate in writing all corrective actions
repairs etc. In the eventuality of non-compliance of such Instructions of
the repair work within 3 days of such notice, the same will be carried
out by the GMIDC. In such case, the amount that will be recovered
from the contractor will be actual expenses incurred by GMIDC+ 40%
extra towards establishment and supervision charges. Amount of
actual expenses certified by the Engineer-in-charge will be final and
binding on the contractor. Also such act of the contractor will be treated
as bad performance and action will be taken according to the provision
made under Right to terminate the contract on.
3.3 Additional Security Deposit
The property of GMIDC, named as Sant Dnyaneshwar Udyan Complex
is to be handed over to successful Contractor after signing the
agreement deed. Till the expiry of this contract period he is
expected to
maintain this property without any loss or damage to the property.
Considering cost of this property, to safe guard against the cost of
damage/loss, Contractor has to submit, before signing the agreement,
in additional security deposit in form of solvency of a
Nationalised/Scheduled bank-branches situated in State of
Maharashtra of Rs.35/- Lakhs as per proforma enclosed.

The security deposit and Additional security deposit will remain with
the GMIDC
for the period of agreement plus Six months & will be
returned only after completion of above said period and will not carry
any interest.
The security deposit and additional security deposit will be retained by
the Corporation for the due and faithful fulfillment of the contract by
contractor.
4) NOTICE AND INSTUCTIONS:
4.1.
Site Office of the Contractor should be located in the Sant
"Dnyaneshwar Udyan Complex. Paithan.
4.2
4.3 All communications from Contractor shall be addressed to the
competent authority of the GMIDC
Any notice / Instruction to be given to the Contractor under terms of the
contract, shall be deemed to have been served if it has been- delivered
to his Authorised Agent or his Representatives at Site of work or
sent by registered letter to the site officer or to head Office address
provided by the Contractor
5) SCOPE OF WORK
TO BE DONE
i) Contractor has to maintain the existing facilities provided in Udyan
Complex and if necessary he has to improve the existing facilities at his
own cost.

ii) It is essential to develop existing Udyan Complex, as per development
proposal submitted with the tender with due approval of competent
authority with or without modification if any at his own cost.
Competent authority has a right to change/ modify the development
proposed' submitted with the tender.
For development works the contractor has to give details
program, with flow of investment and accordingly after approval to the
same b y competent authority he has to start and finish developments
as per program at his own cost.
Delay in such investments/committed developments shall be
treated as bad performance and will be dealt with as per provision
made under the "Right to terminate the contract"
i
ii) The maintenance works as mentioned in Section -III and any other
maintenance and repairs if required shall be done regularly and in time
and as per the necessity.
iv) As a part of Udyan Complex, rest house is to be well maintained and if
necessary the contractor can provide additional facilities
inside or out side the rest house at his own cost with prior approval of
competent authority.

6) SUPPLY OF MATERIAL BY THE GMIDC:
6.1 Neither material nor personnel will be provided by GMIDC for this work.
6.2 Presently water is supplied to the Sant Dnyaneshwar Udyan Complex,
Paithan from Nathsagar reservoir. Necessary application will have to be
furnished by the Contractor to the respective authority of GMIDC to
continue the water supply for the contract period. Water charges as per
rule of the GMIDC as revised from time to time shall be paid by the
Contractor. In the event of paucity of water the GMIDC may be
compelled to stop or reduce the quantum of the water supply to the
Sant Dnyaneshwar Udyan Complex, Paithan. In such cases' the
Contract shall not be entitled for any compensation or concession in
yearly contract amount on account of reduced supply or non supply of
water to the Udyan.
6.3 Electricity is presently supplied by M.S.E.D.C.Ltd for the Sant
Dnyaneshwar Udyan Complex, Paithan. This connection will be
Continued by the Contractor during the contract period. Electricity
charges as per rule of the M.S.E.D.C.Ltd and as per the tariff which
may be made applicable form time to time shall be paid by the
Contractor, regularly.
6.4
The Contractor will be responsible for the loss occurred to
Sant Dnyaneshwar Udyan Complex. Paithan due to disconnection of
electric or water supply due to nonpayment of electric or water charges
in time.
6.5
The Contractor may get increased electric supply if necessary at his
own cost from M.S.E.D.C.Ltd by following the relevant rules.

7) ESTABLISHEMENT:
The Contractor shall engage the various types of personnel for
execution and management of various works i.e. experts in gardening, maintaining fountains and water channel. Civil works, Electrical,
Agriculture, Horticulture, Gardening, Hotels, Security arrangements etc.
The Contractor will be responsible for any misbehavior of his
staff with visitors, public representatives. Govt./GMIDC officers on
inspection etc. and also for damage to the Sant Dnyaneshwar Udyan
Complex, Paithan by his staff.
A) The Contractor will have the right to get income from entry-
fees and from Canteen, boating in River Godavari. Entertainments,
Rest houses and other attraction centers in Sant Dnyaneshwar Udyan
Complex. Paithan.

B) Entry fees at entrance Gates No.1 & 2
shall be got approved
from competent Authority Prior approval shall be taken for any
increase in the rate of main entree fees. However the
rates will be increased subject to completion of proposed development
works as per agreement.
C) The Contractor shall be bound to inform & shall take the permission of
the competent
Authority of any type of film/video shooting & other
functional activities, events (Excluding the activities mentioned in
clause No-19.1) to be done in Sant Dnyaneshwar Udyan Complex,
Paithan and care must be taken that it will not harm any plantation,
structure, electrical installation etc. in the Sant Dnyaneshwar Udyan
Complex, Paithan. The Contractor will be liable to make good the
damages, if any resulting from such shootings.
12) CHANGES TO BE MADE IN THE SANT DNYANESHWAR UDYAN
COMPLEX, PAITHAN:
A)
Contractor will have no right to change the existing layout and plan of
the Sant Dnyaneshwar Udyan Complex and rest houses at Paithan.
B)
CHILDREN PARK AND MODERN AMUSEMENT PARK :
General types of playing articles are provided in the children
park No.1 besides the terrace No-1, The Contractor shall efficiently
maintain and augment these playing articles and he shall replace the
defective at his own cost.

The contractor has to provide modern amusement rides in
proposed children park No.2. He shall arrange, fix such modern rides
(as described in Para 16
of Section-Ill) and maintain the same at his
cost at the time of expiry of contract, all new works of amusement
park/water park or whatever developments carried out during the
period of contract by the contractor for beautification of garden shall be
the property of GMIDC and the same shall be handed over to GMIDC
without any cost. If additional development carried out by contactor
during the period of contract having huge investment & if recovery
period is not sufficient to cover investment then contract period will be
extended subject to prior approval of concerns or if contact period is
not extended contactor will remove the articles & other removable
accessories & equipments.
13) INSPECTION OF SANT DNYANESHWAR UDYAN
COMPLEX,
PAITHAN:
A) The competent authority will appoint an Officer of appropriate Rank to
supervise the M & R
activities of Sant Dnyaneshwar Udyan Complex,
Paithan as per agreement. The Office of this Officer will be located in
the Sant Dnyaneshwar Udyan Complex, Paithan and this Officer and or
his staff will have right to enter in any part of Sant Dnyaneshwar Udyan
Complex. Paithan for inspection.
C)
The members of Government Committee relating to Sant Dnyaneshwar
Udyan Complex, Paithan and officers' and staff of GMIDC shall have
entry at any time in the Sant Dnyaneshwar Udyan at Paithan with their
vehicle without any entry fees.

C) Contractor will have to grant free entry to the employees and Officers
of-Irrigation Department on production of specified entry passes.
D) The Contractor shall be bound to implement instructions given by
competent Authority or higher officer after his inspection.
E) Rest house will be inspected by competent authority periodically.
14) AUDITING:-
The detailed record of Receipts and expenditure of all items in
the Sant Dnyaneshwar Udyan Complex. Paithan must be kept and it
shall be audited by recognized Chartered Accountant. This audit report
must be submitted to the Competent Authority within 45 days of
completion of financial year, failing which penalty of Rs. 50/- per day
will be payable by the Contractor to GMIDC. The Contractor shall have
to furnish the details of expenditure / receipts any time in the year, if
the Competent Authority demands it in writing.
15) OWNERSHIP OF SANT DNYANESHWAR UDYAN COMPLEX
15.1 The Contract shall not affect GMIDC's right of Ownership of Sant
Dnyaneshwar Udyan Complex, Paithan.

15.2 The contractor will have no right title or interest over the property of
Sant Dnyaneshwar Udyan Complex after the expiry of
the period of
contract. The period of contract shall be deemed to be over on expiry of
period of 10 years from commencement of the contract; or after
termination of the contract as per provision in Para-19 'Right to
terminate the contract', of this section, whichever is earlier.
All the rules and Acts made by Govt, of India/ the Government of
Maharashtra and/ or GMIDC from time to time and Government
recognized institution related to such works as included in this Contract
shall be binding on the Contractor.
16) RULES AND REGULATION:
All the present and future taxes of Government of Maharashtra/
Government of India shall be paid by the Contractor, timely for the
contract period. Since the Income from Sant Dnyaneshwar Udyan
Complex, Paithan is to be directly collected by the Contractor, he shall
be responsible to pay the income tax and any other taxes on it as per
rules prevailing from time to time.
17) LIABILITY OF TAX:
The income tax clearance Certificate shall be submitted to the
competent Authority after completion of each financial year.

18) VISIT TO SANT DNYANESHWAR UDYAN COMPLEX,
During the visit of V

.P's etc. and Guests of Central and State
Government the Contractor shall co-operate for security arrangement
of such visitors. For V.I.P's/ Guest of Govt./member of Governing
council of GMIDC visiting Sant Dnyaneshwar Udyan Complex. Paithan
minimum two suits must be kept reserved on demand, with minimum 1
day prior information at prevailing Govt, rates for Guest houses.
19.1 In case of bad performance during the period of agreement GMIDC
shall have right to terminate the Contract and take back the Sant
Dnyaneshwar Udyan Complex, Paithan at any time by Written Notice
of ninety days period, by Competent Authority and Contractor shall not
have any claim for compensation for such termination of the contract
and security deposit will be forfeited in such case.
19) RIGHT OF TERMINATE THE CONTRACT:
Misuse of any part/ premises of Sant Dnyaneshwar Udyan Complex
(in brief Dnyaneshwar Udyan) for criminal antisocial/ dangerous
activities by the contractor or his agents, servants and any activities on
their part causing public menace, harm and injury to the property and
reputation of the corporation shall also be grounds to
terminate/rescind-the contract.
19.2 Successful tenderer has to develop Udyan Complex, as per the
proposal of development submitted with the tender document,

Developments as per such proposals and creation of amusement park/
Water Park within the specified period and as per the approved
schedule of development shall be the responsibility of the successful
tenderer.
Period of such development, as per approved schedule of
developments, will be watched by the competent authority. If
successful tenderer fails to develop his specific developments projects
as approved by GMIDC. competent authority, within the schedule
period, it will be treated as bad performance.
20) FACILITIES TO VISITORS:
Contractor shall provide all the required facilities to the visitors
visiting Sant Dnyaneshwar Udyan Complex, Paithan at his own cost.
These facilities include pure drinking water facilities, Toilets, Canteen,
quality snacks and soft drinks, Niwara Sheds etc. The Contractor shall
pay more attention to engage employees of polite conduct and of good
moral conduct. In case any negligence or deficiency is noticed by
Competent Authority or pointed out by any visitor. Written Notice of
such complaints will be given ta the Contractor and Contractor shall be
bound to take corrective measures.

21) CANTEENS:
Considering the holiness and importance of Sant Dnyaneshwar
Udyan Complex. Paithan. good quality snacks, soft drinks etc. shall be
provided at the conteens. Sale of non vegeterian foods and Alcoholic
drinks shall not be allowed in the canteen or in any part of the Sant
Dnyaneshwar Udyan Complex, Paithan nor shall such items be
permitted to be brought from outside.
22)
The rates of snacks and food stuffs, soft drinks etc. to be served
in the canteen shall be displayed at suitable places in the canteen on
boards kept at clearly visible places.
INSURANCE:
The Contractor shall insure the equipment and other properties
in the Sant Dnyaneshwar Udyan Complex, Paithan for risk of damages
due to natural calamities, visitors etc. with the Govt. Insurance i.e.
Directorate of Insurance, Maharashtra State. He shall keep the
insurance policy alive by payments of premium in due time and
produce the proof of payment to the competent authority. If the
Contractor fails to pay the premium, it will be treated as bad
performance and action will be taken accordingly.
23) CONTRACT AMOUNTS.
The Contract periods will come in to effect from the date of
actual possession of Udyan Complex. Full amount of the offer which is
offered by the contractor for that
particular year should be paid

before 30 days of starting of the next year in advance, if the contractor
fails to do so then he shall be penalized Rs.2000/- per day up to 30
days from the starting of the next year & even then the contractor fails
to pay the contract amount, after expiry of 30 days period, action will be
taken as per the clause No- 19 and contractor shall have no right to
claim for the same.
24) SETLEMENT OF
DISPUTES:
In the case of any disputes arising between the contractor and the
competent authority, with respect to the terms & conditions of this
contract the same shall be referred to the Chief Engineer & Chief
Administrator, Command Area Development, ID Aurangabad and his
decision shall be final and binding on both the parties.
25) ENVIRONMENT:
The Contractor shall take proper precaution while working in the
Sant Dnyaneshwar Udyan Complex, Paithan so as not to damage the
Environment of Sant Dnyaneshwar Udyan Complex, Paithan and the
Nathsagar failing which the GMIDC shall have right to take
precautionary measures at the cost of Contractor.

25 A) Contactor shall take care of the following points to
a) Existing tree growth except for exotics like eucalypt, if any, will not be
disturbed.
Compliance the conditions imposed by National Board for Wild life
as per the Hon. Supreme court decision on dated 15-07-2011 for
fulfillment of criteria to delete the Sant Dnyaneshwar Udyan complex
from Jayakwadi bird sanctuary.
b) No pesticide or other harmful chemicals will be used within the garden.
c) Use of plastic will be banned within and on the peripheries of the
garden by displaying such instructions on the notice boards and
instructing to the guards & the watchmen.
d) Area of 10 Ha between Entrance Gate No.1 to Entrance Gate No.2 is
to be handed over to Dy.Conservator of Forest Wild Life, Aurangabad
for development of State of Art Interpretation Center.
This portion is not a part of Sant Dnyaneshwar Udyan, Complex.
26) Agreement enclosed as annexure B in section V is to be signed on
Bond paper of appropriate value by the contractor at his cost and will
be treated as a part of contract documents and shall be registered with
the appropriate registering authority. All the expenses for purchasing
bond paper, registration fees etc. necessary for registration of the
agreement shall be borne by the contractor.

Act XXIII of 1998 for and behalf its Executive Director, who has delegated his
power to frame and execute an agreement to The Executive Engineer. Lower
Dudhana Project Division. Sailu (Hereinafter referred to as PARTY OF THE
FIRST PART which expression shall unless repugnant to the context or
contrary to the meaning thereof shall mean and include its executors,
Engineers, successors, assignees etc.)

provide these specialised services to 89 Hector part of Sant Dnyaneshwar
Udyan and to two Rest Houses. Hence party of the First Part had published
tender Notice in Daily Lokmat Times and Nawa Maratha vide tender notice
No.___ and invited tenders, according to same the Party of the Second Part,
after pre qualifying to purchase the tender, has submitted his highest offer
vide tender Notice No or Operation, Development, Maintenance &
Management of Udyan Complex .
Under this agreement party of the Second Part has agreed to make payment
to the party of the First Part as below:

Bank Solvency) both refundable at the expiry of the contract period plus six

5)Sam Dyaneshwar Udyan Complex including developments done by the
party of the Second Part during contract period will be the sole property of the
Party of the First Part.
6) The party-of the First Part shall not be liable for any labour problem or
litigation under labour laws in respect of the employees appointed by the party
of the Second Part.
7) The party of the Second Part has to appoint its own staff for operation,
maintenance, management and development work of the Complex
possessing required qualifications.
8)The party of the Second Part has to take care to operate, maintain and
manage the existing facilities & the developments done by him during contract
period with full safety measures & to the satisfaction of customers & to the
party of the First Part. In case of accident of any type arising during operation,
maintenance ' & management or during development work, contractor has to
take care types of liabilities, court matter, matters regarding compensation
due to accident & all expenses should be borne by the party of the Second
Part up to molestation of the cases.
9)The party: of the Second Part has to take insurance of Udyan Complex for
fire, accidents or of natural calamities for the contract period at its own cost
with Government insurance, i.e. Directorate of insurance, Maharashtra State
10) The party of the- Second Part has to acquire all the necessary
provisions-regarding house keeping of the Udyan Complex for good.

11) All electrical work should be carried out by the party of the
Second Part as per the provision of Indian Electricity Rules.

12) The party of the Second Part shall take care & caution regarding not to
advertise products like tobacco, cigarette, gutka, wine or any vulgar
presentation etc. If any legal matter arises in that case, the sole responsibility
will be of the party of the Second Part up to finalization of the same.
13) All the present and future liabilities and the taxes, levies, etc. for the
contract period including entertainment tax of the contract declared by any
Govt, authorities should be borne by the party of the Second Part.
14) The party of the Second Part is bound to take all necessary permission,
licenses from respective authorities of Govt. Dept. like fire, health, electrical
inspector, police & environment at its own cost and to adopt all the provisions
of public safety suggested by the respective authorities and respective Xerox
copies duly attested should be submitted to the party of the First Part.
15) The party of the Second Part has to carryout good quality painting for all
the rides, machinery, equipments and structures as and when required at its
own cost.
16) Electricity & water charges are to be borne by the party of the Second
Part.
17) Security of the Udyan Complex is the responsibility of the party of the
Second Part.
18)The required all types of amenities like tools, safety measures, sign
boards, first aid box has to be provided by the party of the Second Part.

19) The Party of the Second Part shall allow inspection by the officers
appointed by the party of the First Part.
20)Damage due to accident, improper maintenance of workmanship, riots
should be borne by the party of the Second Part.
21)Party of the Second Part can suggest any activity/development proposal,
other than the proposal submitted with the tender and approved by the party
of the First Part to increase the revenue and for applications party of the
Second Part should obtain permission from GMIDC.
22) The party of the Second Part shall take all possible care while facing
natural calamities and see that there is no financial, physical loss to the
property of the Complex of the party of First Part.
23) The party of the Second Part has to submit certificate of good condition of
water park, amusement park & of the facilities provided by The party of the
First Part as well as of the facilities provided by the party of Second part for
every year.
24) The Party of the Second Part shall take care to pay all Govt. Taxes (i.e.
Entertainment tax. Electricity bill etc.) and to take police permission in time
and submit the arrested Xerox copies
of the same to the Party of the First
Part.
25)
The party of the First Part shall not give any guarantee for loans on the
Complex property & the party of the Second Part agrees not to raise any
loans on the Complex property.
26)If the party of the Second Part would like to cancel or withdraw the contract
before the expiry of the contract period. it has to submit in writing, before six
months, his desire, to the party of the First Part with due payment of the
contract amount to be paid for that contracted year.

27) The possession of the Complex to be given to the party of the Second
Part is on as is where is basis, the party of the Second Part has agreed to
repair, recondition and if required renovate existing facilities, at its own cost
and after expiry of the agreement the Complex shall be handed over to the
party of the First Part on as is where is basis.
28) Contractor should sale the Entry Ticket through computer slip. The
required software will be provided by GMIDC. Daily sold total computerized
slip should be communicated through E-mail.
29) Extension beyond contract period will be granted by the party of the First
Part on the basis of previous performance during contract period. Right to
extend the period beyond contract period will be absolutely at the sole
discretion of the party of the First part.
30) Drinking liquor will be prohibited in the whole Complex.
31) In case of any dispute of difference arising between the Engineer-in-
charge and party of the Second Part, in respect of this agreement, the same
shall be referred to Chief Engineer & Chief Administrator, Command Area
Development. ID Aurangabad, and his decision shall be final and binding on
the Engineer-in charge & party of the Second Part.
32) Complaint & Suggestion Register shall be maintained by the party of the
Second Part & shall be made available to visitors/ Tourists on demand.
33) Any part/premises of Sant Dnyaneshwar Udyan Complex shall be
deemed to be public place. Misuse of any part / premises of this.

34) Party of Second part should follow the conditions imposed by National
Board for Wild life as per the Hon. Supreme court decision on dated 15-07-
2011 (Section No-4, Terms & Conditions of contract) for fulfillment of criteria
to delete the Sant Dnyaneshwar Udyan complex from Jayakwadi bird
sanctuary.
35) Liabilities ,dues & outstanding payments (i.e. Tax, Insurance, Energy Bill,
Water Charges, & other related payments of Sant Dnyeshwar Udyan
,Complex) of old contractor

Udyan Complex for any antisocial/criminal activities by the contractor or his
agents, servants shall be a ground to cancel this agreement.
