COMPLIANCE CHALLENGES

THE CASE FOR COMPLIANCE Compliance with global EHS laws is a business necessity. Regulators are becoming increasingly stringent, NGO’s more active, while consumers search for environmentally responsible companies.Compliance is not just about ensuring the health and safety of workers or protecting the environment. Compliance and the costs associated with it are affecting the day-to-day productivity and profitability of global organizations. The global challenge is to achieve a high level of compliance while watching the bottom line. The integration of EHS as a business strategy is critical to success in an ever changing global marketplace.

THREAT OF ENFORCEMENT

GLOBAL REGULATORYCOMPLEXITY

In the last four years, EHS and Product regulations around the world increased by more than 27%. In 2015 alone, 2,960 pieces of legislation were adopted worldwide. As regulatory growth continues to expand, companies must adopt a proactive and global perspective to address both the risk and impact this represents for their business.

In the ever evolving EHS regulatory landscape companies face not only the challenge of identifying and understanding the breadth of applicable regulations, but also must address the various local complexities of operating at a global level. Successfully navigating diverse regulatory frameworks, varying interpretations of regulations and government enforcement practices are critical to mitigating operational risks.

Companies pursuing global operations must individually address the unique cultural and language barriers specific to the various countries and jurisdictions where they operate. For each location assessing the local regulatory environment, understanding the implications of non-compliance, recognizing local practices and evaluating whether they are acceptable to a multinational organization is essential to strategy planning and overall successful operations.

The volume of EHS regulations is increasing every year, yet those regulations serve no purpose if they are not enforced. Governments are becoming increasingly aware of this and targeting corporate management with stronger enforcement actions. Prosecution for non-compliance can impact businesses in a variety of ways, from large fines to enforcement orders, product-recalls, cessation orders and even prison sentences for directors.

Stakeholders and consumers are putting pressure on companies to go above and beyond what is written in the legislation. In today’s world every corporate action has a social media reaction or overreaction. With such implications, companies must do what they can to preserve image as well as increase profit and prevent avoidable expenditures.

As countries around the world increase their enforcement programs in both severity and frequency, violators are on the receiving end of heavy fines for non-compliance. Additionally, business losses that result from compliance infractions are often six to ten times more than the direct cost related to enforcement fines (ex. loss of information, stoppage in production, or diminished employee productivity). Managing EHS risks proactively can actually decrease your bottom line.

OUR AREAS OF EXPERTISE

WHY ENHESA?

Enhesa’s regulatory content is structured according to standard thematic modules, which create consistent coverage across all countries and regions. The consistent thematic approach facilitates better reporting and collaboration. The individual EHS topics that fall within each of the standard thematic modules provide users with the ability to search  key issues that are most relevant and do cross-country comparisons. This facilitates cost effective training and communication around such issues for staff who are not usually EHS professionals but are still responsible for compliance.
