Bank of Communications Credit Card Bonus Point Reward Program Terms and Conditions

1. Bank of Communications Bonus Points Reward Program ("the Program") is applicable to Credit Card(s) issued by Bank of Communications (Hong Kong) Limited ("the Bank") in Hong Kong and such other cardholders or customers as may be designated by the Bank from time to time.

2. Retail spending and Octopus AAVS transactions are counted for bonus points reward ("bonus points") of the Program. Cash advance, cash / purchase instalment amount, balance transfer amount, payment of SVC/MPF contribution, online bill payment transaction via our Internet Banking Bill Payment service (except for FWD Life Insurance Company (Bermuda) Limited ("FWD Life") insurance premium paid by FWD Credit Card and China Life Insurance (Overseas) Company Limited ("China Life Overseas Company"), FWD Life, China BOCOM Insurance Co., Ltd ("CBIC") and Bank of China Group Insurance Company Limited ("BOC Group Ins.") insurance premium paid by MI Credit Card), purchase of casino chips, purchase of traveler's cheque, payment of all Credit Card charges (e.g. annual fees, finance charges, etc.), spend with China UnionPay Dual Currency Credit Card on property, vehicle, aircraft ticket, fuel, wholesale, supermarket spending, hospital fee, academic fee in Mainland China and any Credit Card transactions designated by the Bank from time to time will not count for bonus points of the Program.

3. The expiry date of the bonus points will be based on the Program of the designated card types. The expired accumulated bonus points as well as the cancellation of a cardholder's Credit Card (s) will result in the forfeiture without prior notice.

4. The spending of supplementary cardholder will be aggregated to principal Credit Card account for bonus points calculation.

5. The accumulated bonus points cannot be transferred to the Credit Card account of other cardholder(s).

6. Cardholder’s Credit Card account(s) should remain valid and in good standing at the time when the bonus points are credited to the relevant Credit Card and the gifts are redeemed, otherwise the Bank reserves the right to cancel the gift redemption application of the Program to cardholders without prior notice.

7. The approval of redemption application is subject to the credit status of the Credit Card account, remaining bonus points and the availability of gift. The Bank reserves the right to reject the acceptance of the applica-tion of gift redemption. The application of gift redemption will be cancelled automatically if there are insufficient bonus points for gift redemption, Credit Card cash rebate or donation to "Yan Chai Emergency Assistance Relief Fund".

8. The redemption letter will be mailed to the address which is same as the one showed on monthly Statement of Principal Credit Card cardholder in 6 weeks if the application is succeed. Cardholder is required to follow the instructions stated in the redemption letter for gift redemption. Credit Card cash rebate will be credited to the principal Credit Card account

that debited with the bonus points the most as indicated under the section "Redemption Information". The required bonus points will be deducted from the Credit Card account immediately upon successful application and will be shown on the monthly statement of the following month.

9. For "HK$50 Donation to Yan Chai Emergency Assistance Relief Fund", the Bank will donate the amount on behalf of the cardholder to "Yan Chai Emergency Assistance Relief Fund" within 8 weeks (The donation amount will depend on the selection and bonus points balance of cardholders). Yan Chai Hospital will issue donation receipt to the cardholder. Cardholder authorize the Bank to disclose their information to Yan Chai Hospital for processing the donation instruction, issuance of donation receipt and for promotion and marketing by Yan Chai Hospital to cardholder. The annual accumulated donations of HK$100 or above are tax deductible. Cardholder, who does not wish to receive any promotional materials and direct marketing from the Yan Chai Hospital, has to contact Yan Chai Hospital Board Account Department at 2416 8409 or fax to 2412 0245 for arrangement.

10. Once the redemption application is approved by the Bank (regardless of the means of submitting the application), neither amendment nor cancellation can be made. The gift is available on a first-come-first served basis while stock lasts. If the choice of gift is out of stock, the Bank will mail a notification letter regarding cancellation of the respective redemption application. The gift is not redeemable for cash.

11. The Bank will not accept any liability for any damaged, lost or stolen gift in which delivered by mail (if applicable).

12. For unposted, cancelled, refunded and any other ineligible transaction (as determined by the Bank at its discretion) for the gift redemption or any fraud and abuse of the Program by the cardholder, the bank has the right to void the accumulated bonus points and cancel the cardholder’s Credit Card account with the bank, also the Bank reserves the right to take legal action in such instances to recover any outstanding amounts generated from redemption. The related fees will be deducted from principal Credit Card account.

13. All products of the Program are provided by the Merchant(s) (except Credit Card cash rebate and donation to "Yan Chai Emergency Assistance Relief Fund"), and thus the Bank shall assume no liability in respect of its service or the quality. The respective merchant(s) is/are solely responsible for all obligations and liabilities in relation to the products and services provided.

14. No person other than the cardholder and the Bank has the right under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong) to enforce or to enjoy the benefit of any provisions under these Terms and Conditions.

15. The Bank reserves the right to amend the terms and conditions as well as to vary or terminate the Program at any time without prior notice to the cardholders.

16. In case of any disputes, the decision of the Bank shall be final and conclusive.

17. If there is any inconsistency or conflict between the English and the Chinese versions, the Chinese version shall prevail.
