Re: George Harrison (b )(6)

\ \ .~ ~ Dear Mr. Marks: ~-~~(-·~:-~------~

I want to thank you for your help in assisting George I Harrison to be admitted despite the fact that he had ~----------~ left England without his visa. I would also like you to express our sincere gratitude to the government, and particularly to your office, for their prompt and efficient action and cooperation in this case.

Please be assured that George was himself, completely with-out fault in the matter. Because certain extremely important business meetings and negotiations were scheduled to begin promptly on March 12, 1973, and a number of other people had already arrived, and because the meetings required Harrison's personal presence, I insisted that no effort be spared in expediting his arrival here. In their apparent haste to satisfy my request, the English office made the travel arrangements without picking up the necessary visa. This was an obvious and unintentional oversight on their part.

George is quite meticulous about complying with the law in every respect, and I would not like this inadvertent occurrence to be held against him in any way. Likewise, I would like the government to know that their special courtesies extended in this case are sincerely appreciated by us all and that this type of occurrence is not likely to ever be zepeated.

On March 6, 1973, Miss Dorothy Gilchrist of the Visa Office was informed that the Service had received the Visa Office's letters recommending section 212(d)(3) orders on the subjects, but that the letters failed to indicate the basis for State's recommendation. She stated that it was recommended that the subjects' entry be authorized to promote international business.

Hr. Carl Shepherd of the Visa Office (101-22920) advised that the subject was to be awarded the Father of the Year award by the United Nations International Children' e Educational Fund (ill~ICEF) on June 1, 1972. He stated that State is getting a lot of pressure from Congressman :Bingham. He asked whether, in view of the above award. the Service might authoriie the subject's admission without waiting for the additional infonnation requested from the Embassy of London.

After consultation with Mr. Greene~ Mr. Shepherd wae ad,?ised that the subject's entry would be authorized for a two week period. However~ if he requests an extension. he will be required to fully justify his need for it.

SUBJECT MATTER: George Harrison) member of former "ieatles"

Examination ofl ~elating to the subject reveals that it contains~ copy of a microfilm of ~1bjeet 1 s original Form I-94 showing his admission as a B~l on 3/8/73 until 5/7/7'J. The revene of the Fom I-94 contains a typed notation reading "Extension of stay denied. Required departure on or before June 1, 1973. WS - 1073• Beneath that notation ia a note too legible one which appears to read ''IDS to June 30 WS 1-24 pez D. T. Williams" (the second numerial of the identifying number of the immigration officez at LOS is smudged and osnnot be read). The Form 1·94 is also endorsed to show departure from NYC on June 29 via TWA to England.

Because the notation regarding the authorization to remain in the U.S. until 6/30 is not too legible, I called Acting District Director Williams, LOS, to ascertain whether he had any personal recollection of authorizing subject's stay until 6/30. Mr. Williams did not personally recall the case but, after checking: he stated he was satisfied that subject had appeared at LDS and had received the authorization to remain until 6/30 as an extension of the previously given V/D date.

I called Deputy Director;Arias, Visa Office> referring to State Department's telegram #190417 of ~/25/73 to the Amlm, London, concerning the subject and his wife. That telegram advised the Embassy that section 212(d){3)(A) waivers were not considered 'tv-arranted, citing as one of the reasons, their failure to depart on 6/1. I informed Mr. Arias that if he agre~ I would call Attorney Fried and advise him that our records confirmed that subject had been given the right to remain here until 6/30 and

The latter atated that the Service had recently refuaed • 212(d)(3) waiver on behalf of subject on the ground that he had overstayed hia authorized stay in this country. However, the corporate attorney alleges that, although subject's stay originally expired on June 1, 1973, the subject bad pertonally appeared at an unspecified INS office in California and that the officer handling extension of stay ttt that office had endorsed Harrison's Form I-94 to indicate t.h.itu his departure en or before June 30 would be aatisfactory. Subject allegedly departed on June 28 ..

ltr. Pried requeated that, in fairnesa to the subject, the Service abould recheck, its records and that, if the record shoved tb.at he had effected a timely departure and the alleged overstiy was the only hasia for refusal of the 212(d)(3) autbori~ sation, that the Service give further consideration thereto.
