1. Any article described In the provision» of thl» subchapter. If It Is either civil aircraft or an articles certified for use in civil aircraft, as defined below. Is subject to the rate of duty set forth herein In lieu of the rate provided for in chapters 1 to 97, inclusive.

2. The term "civil aircraft", as used In this subchapter, refers to all aircraft other than aircraft purchased for use by the Department of Defense or the United States Coast Cuard.

3. The term "certified for use in civil aircraft", as used in this subchapter, refers to articles for which the importer ha» filed a written statement, accompanied by such supporting documentation as the Secretary of the Treasury may require, with the appropriate customs officer stating that the imported article has been Imported for use in civil aircraft, that It will be so used, and that the article has been approved for use by the Administrator of the Federal Aviation Administration (F.A.A.) or by the airworthiness authority in the country of exportation. If juch approval is recognized by the F.A.A. as aa acceptable substitut» for F.A.A. certification, or that an application for approval for such use has been submitted to. and accepted by. the Administrator of the F.A.A.
