SCHEDULE TO CLAUSE 72.01 RESPONSIBLE AUTHORITY FOR THIS PLANNING SCHEME

1.0 Responsible authority for administering and enforcing this planning scheme:

The Monash City Council is the responsible authority for administering and enforcing the planning scheme, except for matters specified in Clause 72.01-1 and matters listed in this schedule.

2.0 Responsible authority for administering and enforcing a provision of this planning scheme:

The Minister for Planning is the responsible authority for administering and enforcing the planning scheme for:

Land at Waverley Park, Mulgrave and more particularly described in Certificates of Title Vol 10172 Fol 938; Vol 7523 Fol 049; Vol 8062 Fol 152; Vol 2885 Fol 885; Vol 10040 Fol 536; Vol 8100 Fol 113; Vol 8955 Fol 878 and Vol 10040 Fol 537.

Land on the north–east corner of Wellington Road and Blackburn Road, Clayton and known as Lot 2 on Plan of Subdivision 318311L and more particularly described in Certificate of Title Volume 10112 Folio 036.

Land at 2107-2125 Princes Highway, Clayton and known as Land in Plan of Consolidation 108305 and more particularly Certificate of Title Volume 09326 Folio 036.

Clause 51.01 of the scheme in respect of the “Melbourne Metro Rail Project: Upgrades to the Rail Network Incorporated Document, May 2018”.

Any other provision of the scheme as it applies to the use or development of land for the Melbourne Metro Rail Project: Upgrades to the Rail Network.

3.0 Person or responsible authority for issuing planning certificates:

Minister for Planning.

4.0 Responsible authority for VicSmart applications:

The Chief Executive Officer of the Monash City Council is the responsible authority for considering and determining VicSmart applications to which Clause 71.06 applies, in accordance with Divisions 1, 1A, 2 and 3 of Part 4 of the Act.
