No. 26512013 in the Kerala Gazette Extraordinary No. 9411dated lst April, 2013, Govemment exempted the said type of societies from theoperation of the third proviso to the sub-section (1) of section 28 of the KeialaCo-operative Societies Act, 1969, for a period of one year from the date ofcommencement of the Kerala Co-operative Societies (Amendment) Act,20l3(Act 8 of 2013), or till the date of conducting election to the committees afterduly registering their bye-laws in accordance with the provisions of the saidAmendment Act, whichever was eartrier;

No. 285/2014 in the Kerala Gazette Extraordinary No. 1247dated lsth May,2014, Goyernment exempted the said type of societies from theoperation of the third proviso to sub-section (1) of section 28 of KeralaCo-opeiative Societies Act, 1969. for a further period from 14th February,201-1 to 31st December,20l4 or trll the date of conducting election to thecommittees after duly registering bye-iaws in accordance with the provisions ofthe said Ame-iiAnGnT Act, whichever-was earlier;

Now, TuenenoRE, in exercise of the powers conferred by section 101 of theKerala co-operative Societies Act, 1969 (21 of 1969). the Govemment of Keralahereby exempt the Primary Agricultural Credit Societies, ServiceCo-operative Banks, Farmers Service Co.operative Banks, Rural Banks, Regional

As per the new proviso ecded to sub-section (l) of section 28 of KeralaCo-operative Societies Act. .969 (21 of 1969) by the Kerala Co-operativeSocieties (Amendment)Act,20i3 (Act 8 of 2013), election to the committees of

Primary Agricultural Credit Societies, Service Co-operative Banks, FarmersService Co-operative Banks, Rural Banks, Regional Banks, Urban Co-operative

Banks, Urban Co-operative Societies, Primary Agricultural and Rural Development

Banks, Primary Housing Co-operative Societies, shall be conducted on ward

basis. Howeverr no exemption *as given to the existing affected societies whereelection procedure was started on the basis of the provisions prior to thecommencement of the said Amendment Act and also no time limit was prescribed

in the said Amendment Act to the affected societies to implement the saidamendment. Therefore. the Registrar of Co-operative Societies requested theGovernment to exempt the afiected societies from the operation of the thirdproviso to sub-section (1) of section 28 of the said Act, Vide G.O. (P)No. 52l20l3lCo-op. dated lst April. 2013 published as S.R.O. No. 26512013 in the

Kerala Gazette Extraordinary No. 942 dated lst Apnl, 2013, Government exempted

the societies which were affected by the said amendment from the operation of

the third proviso to sub-section (l) of section 28 of Kerala Co-operativeSocieties Act, 1969, for a period of one year from the date of commencement ofthe Kerala Co-operative Societies (Amendment) Act, 2013 (Act 8 of 2013), or tillthe date of conducting election !o the committees after duly registering bye-lawsin accordance with the provisions of the sdid Amendment Act, whichever wasearlier. The exemption granted was extended vife G.O. (P) No. 66/2A14/Co-op.dated 14th May,2014, published as S. R. O. No. 28512014 in the Kerala GazetteExtraordinary No. 1247 dated l5th May; 2014. The Registrar of Co-operativeSocieties has now reported that thougtr the rules in accordance with the4nsndment Act came into force on 26th Novanber, 2014, the societies requestedfurther time for amending their b-ve-laws in accordance with the said AmendmentAct and hence requested the Gor,ernment to extend the exemption for furtherperiod of one year from lst January,2015 to 3lst December, 2015.The Government have considered the matter in detail and are satisfied that it isnec€ssar)' i:r public interest to extent the exemption for a further period of one

The order is intended to achieve the above objects.
