REQUEST FOR THE RELEASE OF FUNDS
On or about March 1st, 2015, the Chippewa Cree Tribe- Tribal Water Resource Department will submit a request to the U.S. Department of Housing and Urban Devel-opment, as applicable on behalf of Chippewa CreeTribe for the release of Indian Community Devel-opment Block Grant under Section 104 (g) of Title I of the Housing and Com-munity Development Act of 1974, as, to undertake a project known as Small-sville Water SystemImprovement Project, for the purpose the proposed activities are to i improve the water and wastewaterinfrastructure in the Parker School to Smallville area. The project is to benefit the residents in this area with adequate and safe drinking water, improve Wastewater operations and improve both ground water and surfacewater quality. The proj-ect will include Phase 1- Water Infrastructure Improvements and Phase II- Wastewater Infrastruc-ture Improvements. The project consists of con-struction of a 50,000 gal-lon storage tank, booster station and approximately 2.0 miles of 6-inch Watermain; also would be a community wastewater system for the 7 homes. Chippewa Cree Tribe of the Rocky Boy’s Indian Reservation requests the assistance from the U.S.Department of Housing and Urban Development,

Office of Native American Programs for FY 2012 Indian Community Devel-opment Block Grant funds in the amount of $900,000 in addition to ensuring that all funds identified will be available to complete the project, will provide lever-aged funds in the amount of $461,572.00 from the Chippewa Cree Tribe’s On-Reservation Water Development Fund.
FINDING OF NO SIGNIFICANT IMPACT
The Chippewa Cree Tribe- Tribal Water Resource Department has determined that the project will have nosignificant impact on the human environment. An Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA), therefore, is not required. Additional project informa-tion is contained in the Environmental Review Record (ERR) on file at Chippewa Cree Tribe- Tribal Water Resource Department and may be examined or copied weekdays 8:00 A.M. to 4:00 P.M.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wish-ing to comment on the project may submit written comments to the Chip-pewa Cree Tribe- Tribal Water Resource Depart-ment. All comments received by February 28, 2015 will be consid-ered by the Chippewa Cree Tribe- Tribal Water ResourceDepartment prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The Chippewa Cree Tribe- Tribal Water Resource Department certifies to the U.S. De-partment of Housing and Urban Development that Jonathan Eagleman in his capacity as TWRD Direc-tor consents to accept the jurisdictionof the Federal Courts if an action is brought to enforce responsibilities in relation to the environ-mental reviewprocess and that these responsibilities have been satisfied. The U.S. Depart-ment of Housing and Urban Development’s ap-
proval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Chippewa Cree Tribe to use Program funds.
OBJECTIONS TO THE RELEASE OF FUNDS
The U.S. Department of Housing and Urban Development will accept objections to its release of funds and the Chippewa Cree Tribe- Tribal Water Resource Department certification for a period of fifteen days following theanticipated submission date or its actual receipt of the request (whichever is late) only if they are made on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Chippewa Cree Tribe- Tribal Water Resource Department; (b) the Chip-pewa Cree Tribe- Tribal Water Resource Depart-ment has omitted a step or failed to make a deci-sion or finding required by U.S. Department of Housing and Urban Development regulations at 24 CFR Part 58; (c) the grant recipient has com-mitted funds or incurred costs not authorized by 24 CFR Part 58 before the approval of a release of funds by the U.S. Depart-ment of Housing and Ur-ban Development; or (d) another Federal agency, acting pursuant to 40 CFR part 1504, has submitted a writtenfinding that the project is unsatisfactory from the standpoint of environ-mental quality. Objections must beprepared and submitted in
accordance with the required procedures of 24 CFR Part 58 and shall be addressed to the U.S. Department of Housing and Urban Development, Region VIII Office, 8ADE, 1670 Broadway Street,Colorado 80202-4801. Potential objectors should contact the U.S. Depart-ment of Housing and Urban Development to verify the actual last day of the objection period.
